I was introduced to Michael over three years ago when he took over a large portion of my whistleblower retaliation case against a large municipality. He has held a dual role in dealing with OSHA matters, as well as the Federal case. He has an amazing propensity to filter through an extraordinary amount of material and pick out all that is relevant. At times, I have told others, I speak to him more than I do my wife. He has kept me abreast of all the developments in both cases and, along with his team, has made amazing recommendations which have resulted in very positive outcomes. Michael also takes a personal interest in his clients and realizes the emotional strain this has on a person. There are times he has called just to see how I’m holding up. His concern has been greatly appreciated. Over the years, I’ve come to regard him as a great friend as well as a brilliant attorney. I cannot say enough about the amount of time and energy he has spent to deliver justice to my case. I don’t believe you will find an attorney anywhere with the level of dedication of Michael and his team.

Michael Halberstam carefully listened to me as he put together strong arguments for my unjust termination case. He was amazing at conceptualizing my case. His approach was very professional and very supportive. He showed kindness, empathy and respect during the process. Mr. Halberstam was relentless in pursuing the facts. He is a powerful legal writer. He was an extremely strong advocate every step of the way. It was empowering the way he told my story with the full force of the law behind it, ultimately winning a settlement.

Michael was extremely helpful to me in navigating my severance package when I was terminated from my employment. I was overwhelmed with many feelings over the termination. Michael was instrumental assisting me both professionally and personally. Professionally he clearly explained that I had the right to negotiate with my former employer the severance package they gave me. He also shared with me his personal experience with a similar issue that happened to him. He negotiated all the negative verbiage out of the severance document that would have hindered me in future employment in my profession. he also was successful in extending my severance package for an additional 4 weeks. Being able to talk to someone who had a similar experience was by far the most helpful. Michael helped me get my head on straight and got me going in the right direction in seeking future employment. Thanks Again to a great Lawyer and a great person.

She listened, gave honest advice, her communication was timely and always let me know what to expect as far as next steps. After being represented by an attorney who did not care about me or the outcome of my case I was referred to Marilyn. Although the outcome of my case remains unresolved and uncertain at this time, I know that Marilyn will do everything possible to see it through and to get me the justice that was squandered by my last representative. Marilyn shows genuine interest in my case and I completely trust her as we move forward to what I know will be a positive outcome. I HIGHLY recommend Marilyn and her firm to anyone that seeks justice. She's awesome!!

I retained Joel to help me defend my daughter and I from a civil suit involving a college apartment rental. Cost was as issue and so he emphasized a common sense approach that allowed the matter to get resolved without spending more necessary. I would hire him again for any civil matter.

He has outstanding expertise in insurance law, business law of all types, the other areas he discusses in his bio and now he has entered a role as a high level person of expertise in Cybersecurity, privacy and related areas of breach law. I highly recommend Joel without reservation. I would hire him for any of these matters again.

I write from the perspective of someone who has not only hired half a dozen lawyers in prior years, but as someone who is now in law school. In short, I have been around many lawyers. There are many fine lawyers and so a lawyer who does a good job for a client doesn't necessarily stand out. Thus, while I would give a good review to many lawyers, Mr. Holt is the only lawyer to whom I would give an unqualified five-star review; not only is he an exceptional lawyer, but he is someone who genuinely cares for his clients. I have sat here for a while debating the best way to explain my opinion of Mr. Holt without digressing into either a list of commonly-used adjectives that could be written about anyone (and by anyone), or into the multiple ways that he has consistently exceeded expectations as my lawyer for the past five years. I think the following most accurately conveys my sentiments: Despite being a profession that is the recipient of more than its fair share of jokes and pessimism, a lawyer -- at his or her best -- has a higher calling. The lawyer is a champion of the rule of law and a zealous advocate for his or her client. In these roles, a lawyer necessarily inhabits a special position of trust and should be deeply mindful of the fact that his or her efforts may profoundly affect the lives of other people. The best of lawyers recognize these facts and thus they do not approach the practice of law as merely a job. And so, when I think about these facts within the context of soon embarking on my own legal career, I cannot think of a better embodiment of the virtues that all lawyers should strive toward than Mr. Holt. He therefore has my unqualified highest recommendation.

After losing all of my appeals I contacted Tiffany Smith in regard of a clemency project. Tiffany took time and patience to Investigate my case. She went on to write a Clemency that rightfully describe every aspect of my situation. As a part of a clemency project it involved numerous attorneys and other women that were incarcerated for killing their abusers. Myself and five others were granted hearings by the parole board. I received a unanimous vote from the parole board leading to The only clemency granting immediate release by Governor Kasich in 2019. This is all due to the hard work and determination of Tiffany Smith whom I love and respect going much further than my attorney but my friend And Family. I am so grateful for Tiffany Smith and all of her efforts in pursuing justice for me. I love you Tiffany!!!

An unfortunate incident between my neighbors dog and my dogs resulted in 3 injured dogs, huge vet bills, my eviction by a family member, and me with criminal charges on top of all that. "Failing to Maintain a Dangerous dog" which didn't seem too serious at first so, I tried to handle it myself in the early parts of the case. I briefly retained a Public Defender but eventually decided to hire a paid attorney after reading the neighbors statements. Since I hadn't worked with any criminal lawyers for 15 years I sought a referral from a reputable Attorney I know and he referred me to Paul Laufman. During our initial phone conversation Paul and I went over some details of the case and set an appointment. Between our initial phone call and our first meeting Paul did some preliminary research on my charges and when we met he had a good understanding of what was going on and he had some ideas for a defense strategy. He collected some evidence from me and we were set for pre-trial. At pretrial we couldn't come to a favorable resolution so it was set for trial. Paul and I set another meeting for a few weeks later. At our final meeting before trial Paul made sure to explain everything in detail to me and in a way that I could understand. He gave me several possible scenarios and I decided to follow through with a bench trial. Paul made no promises to me but said he was going to look into every possible defense to resolve the case. Well the good news is I was "acquitted" and I am so very glad I stuck to my principals and decided to hire a very capable criminal defense attorney named Paul Laufman. At trial Paul's performance and the outcome were excellent and both ran parallel with his expectations for the case. I have worked with approximately 20 lawyers in various specialties over my lifetime. The services and performance I received from Paul Laufman are in the top 10% of the 20 lawyers I've worked with collectively and the BEST by far among the criminal defense attorneys I have worked with.

He was extremely knowledgable and professional. I was looking at serious prison time, he was able to get me off with just a misdemeanor. He's absolutely amazing and I would recommend him to anyone in trouble.

Marilyn was genuinely interested in a case that was both ridiculous and below her pay grade. As a painter/plasterer, I was given a job to fix a ceiling. I was accused of destroying it-despite the fact that it was constructed in '87----1887. Despite the fact that a mouse could have farted on that "ceiling" and caused it to fall. If they can sue for this-they can sue for anything. Then home repair is done. And maybe I should quit. But not because of Marilyn. She did her job. A desperate society did not do its

Brian has been absolutely amazing. I and three other women had a frivolous defamation lawsuit filed against us in federal court. Brian fought hard against a large law firm to get us safely out the lawsuit without ANY fees paid to the plaintiff and worked an agreement that would protect us from this person in the future that was filed publicly with the court. He’s also really funny and beyond professional.

I have used the services of this attorney several times, and each time Mr. Worhatch stepped up to the plate and knocked it out of the park every time. Though he is very knowledgeable in the field, he requires you to take an active role in your case and you work together to obtain the best possible outcome. The vast expansion of his talents is so great, one would be pleasantly put at ease regardless of what type of case they acquired him for. Mr. Worhatch has excellent communication skills, as an attorney, and never hesitated to make sure I not only understood each step of the process, but that I was comfortable in the decisions that were being made as well. In the courtroom he is a force to be reckoned with: confident, stern, direct, and a take no prisoners type of defender. In the office, he will guide you through the process as a friend. Because of all of this, one would can feel confident HE WILL get the job done!

I was referred to Mr. Torchia because my case was a very high risk case. David let me know that from the initial consultation, was straight up with my odds, and blew no smoke my way. I envied his even, mild, professional demeanor from day one. Don't let it fool you. After nearly 3 decades, I really think David enjoys the challenge when he sees a glimpse of light. When he was tied up during the process, the staff did an excellent job keeping me informed & relaying questions. An Ohio product, backing Ohio workers, and yes Virginia, there are still ethical attorneys out there. (Haven't forgot about that basket of veggies Dave, God bless & take care)

What a Civil Rights Lawyer Can Do for You

A civil rights lawyer focuses on protecting individuals whose constitutional rights have been violated by government authorities, employers, or private organizations. These lawyers specialize in cases involving discrimination, police misconduct, freedom of speech, and other fundamental rights guaranteed under the U.S. Constitution and civil rights laws, such as the Civil Rights Act, Americans with Disabilities Act (ADA), and the Fair Housing Act.

Whether you've been discriminated against due to race, gender, religion, disability, or other protected characteristics, or you believe your civil rights have been violated by a government entity, a civil rights lawyer can help you seek justice, hold wrongdoers accountable, and secure compensation for any harm you've suffered.

When Should I Hire a Civil Rights Lawyer?

You should hire a civil rights lawyer when your constitutional rights or other protected rights have been violated, and you need legal assistance to seek justice. Some key situations in which you may need a civil rights lawyer include:

  • Employment discrimination: If you have faced discrimination at work based on race, gender, age, religion, national origin, or disability, a civil rights lawyer can help you file claims under laws such as Title VII of the Civil Rights Act or the Americans with Disabilities Act (ADA).
  • Police misconduct or brutality: If you were the victim of police brutality, unlawful arrest, racial profiling, or other forms of misconduct, a lawyer can help you file a lawsuit for violations of your Fourth and Fourteenth Amendment rights.
  • Freedom of speech or assembly violations: If your First Amendment rights to free speech or peaceful assembly have been restricted by the government, a civil rights lawyer can represent you in challenging the violation.
  • Housing discrimination: If you’ve been denied housing or faced unfair treatment due to your race, ethnicity, gender, or disability, a lawyer can help you file a complaint under the Fair Housing Act.
  • Voter rights violations: If you believe your right to vote has been unfairly suppressed or you’ve faced discrimination in the voting process, a civil rights lawyer can help you fight for your rights.
  • Disability rights violations: If you’ve faced discrimination in accessing public spaces, employment, or services due to a disability, a lawyer can help enforce your rights under the ADA.
  • LGBTQ+ rights violations: If you've experienced discrimination based on sexual orientation or gender identity in employment, housing, or public services, a civil rights lawyer can help you pursue legal remedies.

Hiring a lawyer early on can help you understand your legal options and build a strong case to protect your rights.

What Does a Civil Rights Lawyer Do?

A civil rights lawyer provides legal representation and advocacy to individuals whose rights have been violated. Their work can include:

  • Filing lawsuits: A civil rights lawyer can represent you in court by filing lawsuits against individuals, businesses, or government entities that violated your rights.
  • Advocating for policy changes: Civil rights lawyers often engage in advocacy work, pushing for reforms to laws and policies that infringe upon people's rights.
  • Representing clients in discrimination claims: These lawyers help clients file claims with federal or state agencies, such as the Equal Employment Opportunity Commission (EEOC) or the U.S. Department of Housing and Urban Development (HUD).
  • Negotiating settlements: In many cases, civil rights lawyers work to negotiate settlements for their clients before a case goes to trial, securing compensation for damages such as lost wages, emotional distress, or legal fees.
  • Defending freedom of expression: Lawyers may represent clients whose rights to free speech, assembly, or protest were violated by government restrictions or other actions.
  • Handling appeals: If your civil rights case has been decided but you wish to appeal the ruling, a civil rights lawyer can help you through the appeals process.

How Are Civil Rights Lawyers Paid?

Civil rights lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Contingency fee: Many civil rights lawyers work on a contingency basis, meaning they only get paid if they win your case. Their fee is typically a percentage (usually 25% to 40%) of the settlement or damages awarded.
  • Hourly rate: For cases that require extensive legal research or litigation, some lawyers charge by the hour, with rates ranging from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Pro bono or sliding scale: Some civil rights lawyers or organizations may work on a pro bono (free) basis or use a sliding fee scale for clients who cannot afford typical legal fees.
  • Flat fee: In specific cases, a lawyer may charge a flat fee for services like drafting legal documents or filing a complaint.

It’s important to clarify the fee structure during your initial consultation to avoid unexpected costs.

How Much Does a Civil Rights Lawyer Cost?

The cost of hiring a civil rights lawyer varies depending on the complexity of the case, the lawyer’s experience, and the type of legal issue. General cost estimates include:

  • Contingency fee cases: For cases taken on a contingency basis, the lawyer’s fee will typically range from 25% to 40% of the settlement or judgment awarded.
  • Hourly rates: Many civil rights lawyers charge hourly rates ranging from $150 to $500 or more, depending on their experience and the complexity of the case.
  • Flat fees: For straightforward legal tasks, such as filing a complaint with a government agency or drafting legal documents, flat fees may range from $1,000 to $5,000.
  • Pro bono work: Some civil rights lawyers or nonprofit organizations provide free legal representation in certain cases involving important constitutional or civil rights issues.

Be sure to ask for a detailed estimate of costs during your consultation to understand the financial commitment involved.

Top Questions to Ask a Civil Rights Lawyer

Before hiring a civil rights lawyer, it’s important to ask the right questions to ensure they are the best fit for your case. Key questions to ask include:

  1. What experience do you have with civil rights cases?
Ensure the lawyer has experience handling cases similar to yours, whether it’s employment discrimination, police misconduct, or First Amendment violations.
  2. How do you charge for your services?
Clarify whether the lawyer works on a contingency fee basis, hourly rate, or flat fee, and ask for an estimate of the total cost of your case.
  3. What is the likelihood of success for my case?
Ask the lawyer to provide an honest assessment of your case, including the strengths, weaknesses, and potential outcomes.
  4. Have you handled cases like mine before?
Inquire about the lawyer’s experience in cases with similar facts and legal issues.
  5. What is the timeline for resolving my case?
While exact timelines can vary, ask for an estimate of how long your case may take, from filing to resolution.
  6. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may work on parts of your case, so it’s important to know who will handle your legal matter directly.

How to Check the Credibility of a Civil Rights Lawyer

To ensure you are hiring a reputable civil rights lawyer, take the following steps to verify their credentials and track record:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed to practice and has no disciplinary actions against them.
  • Look for specific civil rights experience: Review the lawyer’s website or professional profile to ensure they specialize in civil rights law and have a history of handling cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can speak to their experience with civil rights cases.
  • Check for advocacy or nonprofit work: Lawyers involved with civil rights organizations, such as the ACLU or NAACP Legal Defense Fund, may have a strong reputation in the civil rights legal community.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a civil rights lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A detailed account of the violation: Provide a written summary of the events, including dates, times, and any people involved in the violation of your rights.
  • Documentation and evidence: Bring any supporting documentation, such as emails, letters, photos, or video footage that may help prove the violation of your rights.
  • Records of complaints or reports: If you’ve filed complaints with a government agency or reported the violation, bring copies of those documents.
  • List of questions: Write down any questions you have about the legal process, costs, and potential outcomes of your case.
  • Information on damages or harm: Be prepared to discuss the harm you’ve suffered due to the violation, such as emotional distress, financial loss, or physical injury.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and get the best possible legal advice on how to proceed.
