Josh is a passionate attorney who zealously represents his clients. He assisted us in reaching a favorable resolution when a larger company would have otherwise ignored and tried to bully us into bearing thousands of dollars of losses for that company’s mistake. Highly recommend and would hire him again in a heartbeat.

For better or worse, I have been involved in several situations were I was in need of an attorney. However, this time I needed a criminal attorney as the person that I gave a ride was carrying illegal narcotics. Even though I was pulled over for out of date tags, the police charged both me and the passenger with possession of controlled substances. Mr. Hilburn stood by me throughout the entire ordeal (both legally and mentally). He kept to his original price quote in spite of have to reschedule numerous times. This was a weird situation but if I ever needed a criminal attorney again, I would not hesitate to call Mr. Hilburn, again.

David Hilburn's handling of our case was simply horrendous. He was unprofessional every step of the way once we contracted his services and paid him in full up front. Phone calls were not returned for days, or sometimes weeks. He did not show up for two different court dates, even though we were specifically told to be there. Additionally we were told to be in court two other times that we did not have to be. Each unnecessary court appearance cost us travel time (we live out of the county) and lost wages. As we expressed our increasing displeasure with his handling of the case, his behavior became more and more unprofessional, to the point that he hung up on us during one of our final phone conversations. Despite telling him early on that we wished to plead guilty, take the consequences, and move forward, it took him three years and three rescheduled appearance dates (two of the re-schedulings were for his convenience) to finally get before a judge. Those three years were filled with unnecessary stress and hundreds of dollars of unnecessary expenses (breathalyzer, probation, and monthly fees) that we incurred while waiting months and months longer than necessary for our case disposition. We felt the results were far less satisfactory than could have been with a more professional, focused, caring attorney who could have worked harder with the DA to get our case concluded. His work method seemed to be that he puts every client into the same automatic processing template. And if your case is not cookie-cutter (ours was not) it seemed that his office still treated it as such, sending routine correspondence and appearance instructions that did not apply in our case. He didn't like being questioned, explaining options, or spending time trying to help our confused and scared client family members who have never been involved in any prior legal action understand what was happening. In summary, we believe that by using David Hilburn to represent us, we had a worse outcome and much greater expenses than we would have had with any other attorney. We would not recommend him under any circumstances.

Here's my story and how Jay came into my life. I came to College Station to celebrate my son's birthday. Not even 24 hours later I found myself sitting in a jail almost 300 miles from home. My charge was assault of a family member. The family member was my fiance. We had gotten into an argument in the car while driving to the bowling alley to Bowl with my son and his family for his birthday. My fiance was shouting at me in the car over a GPS. I had asked him to stop when he didn't I pushed his face away from me and ended up cutting his chin with my ring. Another motorist saw this commotion and called 911 because they thought I was in distress. I was pulled over not even 2 minutes later and was questioned as to what had happened. I told the policeman the plane truth and I was arrested for that. I have never been in trouble in my life never been to jail never nothing more than a speeding ticket but yet here I was 56 years old going to jail for my first time. I could not believe what was happening. It was the worst experience of my life. I spent two days in jail and upon returning back home and returning to my job they somehow found out about the arrest and I was terminated from my employment because of a violation of policy for not reporting my arrest. I had forgotten about that policy that I signed 18 years prior because that's how long I was employed at this place for the state. I knew that I needed a lawyer and I knew that I would have to get this expunged from my record. That's where Jay came in. He was very nice very understanding very sweet and kind. He never made me feel like he was just some lawyer he made me feel like a friend. I appreciated that probably more than he knows. He also set me up on a payment plan that I could pay him out. That helped so much. Teresa his assistant is just a sweet and kind. I loved working with these two. They answered all my questions and gave me the help I needed. Since then and in a very quick manner I should say my case was dismissed it was not even seen by the court and I am in the process now of getting it expunged off my record. All of this is due to Jay and his expertise and connections. I would recommend him to anyone, he is a great attorney and someone you want to have on your side. Jay, I thank you and Teresa for the help you've given me and everything you've done for me. God bless you and your crew. ❤️

Absolute worst help possible! After being told they would take my case and told me there rates. I expressed my concerns about my financial situation and I would call them back once I have verified I can afford them. After that I left message after message requesting a call back to sign the necessary paper work with no response. All I would get is a receptionist promising call back. Then one week before my first court date after multiple attempts a day including one being in person at there office, there receptionist informs me they won't take my case with no reason. If you want good representation, don't choose Dunham and jones!

I agree with the other reviewers. He put forth as little effort as possible and 1 week before my trial, tried introducing another attorney. Not interested in going to trial or doing much of anything. I tried taking information/pictures up to the office and was told just to bring them the next day to court. Don't have a lot of faith unless you're a paying customer.

This guy Bruno Shimek was all like "I don't have a file on her. You know, went through and looked at all those, and she's not a person that-- you know, Robin Stewart I represented, Aaron Stewart, Eric Stewart. I've checked all those, but not Erma." But his name was on Erma Faye Stewart's plea agreement, okay, so I guess he's incompetent AND a liar. THEN, this so-called confidential informant that they had over in Robertson County that got 27 people indicted basically was not reliable because he was whack-a-doo and had a long history of psychiatric disorders and the DA threw out all of the cases, exceppt for the people who had already plead to reduced charges. Those people got screwed because basically it came out that this guy was a fraud, but they still had to do their probation and pay fines and have permanent records because he rushed them into a plea. Mr. Shimek had he even done like a tiny scintilla of inquiry he would have realized that the sole witness was fruit loops and then could have gone to the DA like "Yo, your witness is F'd up and I'm gonna wreck him on the stand. My client isn't pleading to caca. We're going to trial you cacahuate!" But instead he just rolled over. And he didn't even tell Erma to get a better hat. That's how bad his advice was both legal and fashion. But seriously, if my dog got a ticket from animal control I would not let the dog judge appoint mr. shimek as his lawyer for dog court. I would definitely pay money to retain a real lawyer dog.

What a Criminal Defense Lawyer Can Do for You

A criminal defense lawyer provides legal representation to individuals or organizations accused of criminal conduct. If you're facing criminal charges, a defense lawyer will work to protect your rights, build a defense strategy, and ensure you receive a fair trial. Their primary goal is to reduce or dismiss charges, secure an acquittal, or negotiate a favorable plea deal.

Criminal defense lawyers have extensive knowledge of criminal law and court procedures. They investigate your case, identify weaknesses in the prosecution's evidence, and represent you in court, ensuring that you have the best possible defense.

When Should I Hire a Criminal Defense Lawyer?

It’s crucial to hire a criminal defense lawyer as soon as possible if you are facing any criminal charges. Some situations in which you should seek legal representation include:

  • Arrest or police questioning: If you've been arrested or are under investigation, hiring a lawyer early on can prevent self-incrimination and protect your rights during police questioning.
  • Felony charges: Crimes such as murder, assault, drug trafficking, or robbery carry severe penalties, including long prison sentences. A defense lawyer is essential in these cases.
  • Misdemeanor charges: Even for less serious offenses like DUI, theft, or simple assault, a lawyer can help reduce penalties, negotiate alternatives to jail, or get charges dismissed.
  • Plea negotiations: If you’re considering a plea bargain, a lawyer can evaluate the deal, advise you on its consequences, and negotiate for more favorable terms.
  • Probation or parole violations: If you’ve been accused of violating probation or parole, a lawyer can defend you against additional penalties or revocation.
  • Juvenile offenses: For minors charged with criminal acts, a criminal defense lawyer can protect their future by minimizing legal repercussions or keeping the case in juvenile court.

What Does a Criminal Defense Lawyer Do?

Criminal defense lawyers provide comprehensive legal services to protect their clients’ rights throughout the criminal justice process. Their duties include:

  • Case evaluation and investigation: Reviewing the evidence, interviewing witnesses, and investigating the facts to develop a strong defense strategy.
  • Legal advice: Advising you on your rights, the charges you’re facing, and potential defense strategies, including whether to take a plea deal or go to trial.
  • Negotiating plea bargains: Working with prosecutors to negotiate a plea deal that could reduce charges or minimize penalties.
  • Court representation: Representing you in all court hearings, including bail hearings, pretrial motions, trials, and sentencing hearings.
  • Filing motions: Filing motions to dismiss charges, suppress evidence, or reduce bail, depending on the specifics of your case.
  • Trial preparation and defense: Preparing a defense strategy and presenting arguments, evidence, and witnesses during trial to contest the prosecution's case.
  • Appeals: If you are convicted, a defense lawyer can appeal the conviction or sentence, arguing errors in the trial process or legal rulings.

How Are Criminal Defense Lawyers Paid?

Criminal defense lawyers generally charge clients in one of three ways, depending on the complexity of the case and the lawyer’s experience. Payment structures include:

  • Flat fee: For straightforward cases (e.g., minor misdemeanors), some lawyers charge a one-time flat fee that covers all aspects of the defense.
  • Hourly rate: For more complex or ongoing cases, lawyers may charge by the hour, with rates varying based on the lawyer’s experience and geographic location.
  • Retainer fee: In cases where extensive work is expected, the client may pay a retainer fee upfront. The lawyer then bills against that retainer for their work on the case.

The cost of criminal defense services can vary greatly, so it’s important to discuss fees during your initial consultation.

How Much Does a Criminal Defense Lawyer Cost?

The cost of hiring a criminal defense lawyer depends on several factors, including the severity of the charges, the complexity of the case, and the lawyer’s experience. General cost guidelines are:

  • Misdemeanor cases: For relatively minor offenses, such as a DUI or petty theft, a flat fee may range from $1,500 to $5,000.
  • Felony cases: More serious charges, such as assault or drug trafficking, can range from $10,000 to $100,000 or more, depending on the complexity and duration of the case.
  • Hourly rates: For cases billed by the hour, lawyers may charge anywhere from $150 to $500 or more per hour, depending on their expertise and the case's location.
  • Additional expenses: You may also be responsible for other costs, such as filing fees, expert witness fees, or the cost of private investigators.

Be sure to clarify the lawyer’s fee structure and any potential additional costs during your consultation.

Top Questions to Ask a Criminal Defense Lawyer

Before hiring a criminal defense lawyer, you’ll want to ensure that they’re a good fit for your case. Here are key questions to ask:

  1. What is your experience with cases like mine?
Make sure the lawyer has a strong track record with the specific type of criminal charges you’re facing, whether it’s DUI, drug offenses, or violent crimes.
  2. What is your fee structure?
Ask how the lawyer charges for their services and whether you’ll be responsible for any additional costs.
  3. What are the potential outcomes of my case?
A good lawyer should provide an honest assessment of your case and the likelihood of dismissal, a plea bargain, or conviction.
  4. How many cases have you taken to trial?
While many criminal cases settle with a plea deal, it’s important to hire a lawyer with courtroom experience in case your case goes to trial.
  5. Who will handle my case?
Ask if the lawyer will be personally involved or if other attorneys in the firm will handle most of the work.
  6. How do you communicate with your clients?
Be clear on how often and through what channels you can expect updates on your case.

How to Check the Credibility of a Criminal Defense Lawyer

To verify the credibility of a criminal defense lawyer, take the following steps:

  • Check their standing with the state bar: Confirm that the lawyer is licensed and in good standing with your state’s bar association. Look for any past disciplinary actions or complaints.
  • Read online reviews and testimonials: Platforms like Avvo, Martindale-Hubbell, or Google can provide insights from previous clients about the lawyer’s communication, professionalism, and case outcomes.
  • Ask for references: A reputable lawyer should have past clients or other professionals who can speak to their competence and work ethic.
  • Review their case history: Look at the lawyer’s website or professional profile to see their experience with criminal cases, including high-profile or complex cases.
  • Look for trial experience: If your case might go to trial, make sure the lawyer has a strong history of courtroom advocacy and success.

What Should I Prepare for My First Consultation?

To make the most of your first consultation with a criminal defense lawyer, bring the following:

  • Details of your case: Be prepared to provide a detailed account of the charges against you, including any documents related to your arrest, police reports, and court dates.
  • Criminal history: If you have any prior criminal convictions, inform your lawyer so they can understand how that may affect your current case.
  • List of witnesses or evidence: If there are any potential witnesses or evidence that may support your defense, share this information during the consultation.
  • Questions for the lawyer: Prepare questions about their experience, legal strategy, and fees to ensure you understand how they will handle your case.
  • Bail or release documents: If you’ve been released on bail, bring any paperwork related to your release conditions or restrictions.

By being well-prepared, you can help your lawyer quickly assess your situation and begin building an effective defense strategy.
