Not only is Michael Kushner an excellent Lawyer, but he is also a wonderful person in general. Love the guy! I can't say enough good things about him! In my last court appearance with him, he totally annihilated and destroyed my adversaries lawyer and adversary, with expertise, knowledge, skill, common sense, integrity, professionalism and a desire and conviction to do the right thing and to persevere at it. I would highly recommend him to anybody and I will use him again in the future if I need an attorney.

I'm no easy grader when it comes to reviewing ANYTHING, and I'm done with lawyers, hopefully, hahaha, so I have no reason to kiss Mike's butt! I ranked him excellent for everything, and I didn't just do it without thinking! I thought about each one for a while and decided that BY FAR he was the most trustworthy, responsive, knowlegeable and most informative lawyer that I've ever had, and I'm sorry to say that I've had alot of lawyers. Since I'm doing this anonymously I'll tell you what MIKE had to deal with! I have numerous mental problems. I've got OCD, ADD, and major anxiety to start with! I know I'm a pain in the neck. I ask too many questions. I'll ask the same question or say the same thing over and over. I'll not do what I'm supposed to do, be late or miss appointments, and not give the right paperwork when I'm supposed to. I know when I'm wrong, but I am what I am, like popeye, hahaha. Lawyers I've had before knew all about my problems but they had no patience, I heard them talking bad about me behind my back, they wouldn't call me back, they wouldn't tell me what was going on and half of the time they would screw stuff up and then say it was my fault! And I was paying them. They weren't legal aid or something! But with Mike I told him right up front about my problems and he actually understood! He wasn't arrogant, he was patient, he returned my calls fast, he would call me and remind me of things I had to do, he treated me like a human being, AND he never screwed anything up! I even had a question about something that had nothing to do with the case a few weeks later and he helped me and wouldn't let me pay him for it! It was just a 5 minute call but once in the past I had something like that happen and the guy sent me a bill even though he was no help! I hope I never need a lawyer EVER AGAIN but if I do I'm calling Mike! Mike, I assume you read this too and I just want to thank you again and I meant every word of it and you know how slow I type and this took me like an hour, hahaha! Thanks again for everything! I don't plan on needing you again but if I do you'll DEFINITELY be the only lawyer I call!

Mr. Stewart as well as his mother (Lynn Stewart)represented me in NYC many years ago. One of the most caring, straight forward attorneys I have ever been represented by. My condolences to Mr. Stewart and family. I wasnt aware that Ms. Stewart had passed until today. God bless her soul. More than an attorney to me, much more. Lynn was )The peoples champion), to say the least. You cant go wrong being represented by Mr. Stewart.

My son had a ticket in Lynbrook from 2+ years ago and his license was suspended...we moved to Florida because of Hurricane Sandy so we had no way to go to court. We called Ray, he was so helpful and took care of my son like he was a relative. He got a court date 2 days after our initial call, even paid out of his own pocket to get the new date and was able to get my son a small fine, no point jaywalking disposition. All I can say is AMAZING!!! Raymond Baltch you will always be family to us, THANK YOU for all you did for my son...

Raymond went to court on my behalf today and reduced my 3 moving violations to 0 points! Zero - from potentially 8 pts on the license, he did his magic and now I am so relieved. He was very professional and knowledgable about the subject, explained all the details to me, answered all questions when we first chatted. I would definetly recommend this attorney, a true professional. Before I called him, I spoke to another lawyer in Long Island and she did not even know the point system - could not tell me how many points I could get for any of the 3 violations. Then she was thrilled when she realized that my court date was during her time off work... anywway please do not even bother with anyone else - just call Raymond and he will get you out of any mess.

Mr. Feeney has worked for me on several occasions starting when he was first licensed in the state of NY. Each case I brought to him was handled in a fast and efficient manner, with agreeable outcomes. He explained the reality of each case, most of which were resolved with a single letter from his office. When his presence was needed in court, he showed up looking sharp and professional, on time and in charge. His southern charm and way with words can captivate an audience for as long as he desires, and he has a very convincing way of making others see things from a different perspective.

I have nothing but GREAT things to say about Mr. Massena. From the very beginning Mr. Massena put his clients first, he listened and was very attentive. He was very honest and upfront whether it was good news or bad news. He was very knowledgeable and most importantly he didn't make any false promises. But the one promise he did make was that he would give it his all and he will fight until the very end. This is what you want in an attorney. You don't want a lawyer to fabricate to you with false hopes. You don't want representation where in the very beginning the lawyer expresses to you that they really can't do much for you but get you to plead guilty and in return I will try to get you the lowest possible sentencing. How can you tell a client that without even trying to fight for your client. And this is exactly what I encountered before using Mr. Massena. Prior to hiring Massena to represent my son I attained two other lawyers to handle the exact same case and they did absolutely nothing. The case was mishandled from the beginning. they did not express any care or concern. They were very dishonest and just did not make us feel comfortable or safe. It showed they just wanted to get paid and really did not have any intention on fighting. If I would have stayed with any of those lawyers, the outcome would have been devasting. They just wanted monetary gain and did not have my son in their best interest. Mr. Massena went above and beyond and fought for us not 100 but 120%. I was very satisfied with the results. It definitely was a victory and to be honest even if it did not turn out the way I hoped I still would have been satisfied because I know he fought the best fight and he did not give up. This is the type of attorney you want for representation. I HIGHLY RECOMMEND MR> MASSENA!

Mr. Levine met my expectations again. I was arrested this past winter( a violation of my current probation status) I was processed and booked at Bronx Central booking. My first call was to my partner at home. The next Call was to my faithful attorney. He calmed my nerves. He was clear and presise and did not sugar coat anything and informed me of what I was looking at. He met me the next morning, spoke with me in detail and then represented me when I went in front of the judge later that day. After months of scheduled appearances at the Bronx County courthouse( Mr. Levine by my side on each instance, objecting and revealing many holes in the police investigation and in the D.A.’s case. It was dropped! Persistancy and Smarts+ Experience and Guts= The finest Legal Council Thank you Howard, God bless you sir. Neil Harrison

I was an innocent man incarcerated in the New York State Department of Corrections, and had a Federal Petition for Habeas Corpus pending in the Southern District of New York. After much wrangling with the Attorney Generals Office, I was appointed Mr. Theodore Green to assist me with my filing. I can unequivocally say that he was the only attorney that I had in this long ordeal that was attentive to all my concerns, questions, and calls. I never waited for a reply from him. Ultimately, he was able to secure my release on actual innocence, not an easy feat in the federal court system. I can say, without any hesitation, that Mr. Green is a true professional, and future clients should feel assured that they have hired a man at the top of his field. I cant thank this man enough for all of his assistance, and has restored to me what is most desired of any person. FREEDOM. Thank you Mr.Green.

A good lawyer in getting my case resolved quickly through settlement. I brought in this firm in after another firm, outside of the venue in which I had civil action, took full advantage of making as much as they could in discovery. Thankfully this firm came in with little to do other than show up in court a few times and work out a settlement. I was encouraged from the onset to settle, which I found to be fair and ethical, particularly given how it had been previously handled.. Jim did a stellar job in working it out. I was given a last-minute bill via a crude email without any details, to the sum of five figures in the final hours of our settlement. After numerous requests for an itemized invoice with hours spent, phone calls, emails, etc., I finally received an one, but it was not itemized. While I will never truly know what I paid for (I like knowing exactly where my money goes), altogether the outcome was good and I have no other complaints.

Great Experience, Great Outcome - Fought for my case and did not settle until I received the positive outcome John promised, John was there to council me and advise me on my case. He gave me a full layout of the possible positive and negative outcomes I could face (without scarring me to death.) He then offered his opinion based on his extensive understanding of the court system of what he expects to happen. As for trustworthyness, I think the fact that he made aware of the retainer cost, what it covers and after extensive hearings, he stayed tru to the original retainer amount and got the result he initially envisioned. So in other word, There was no discrepency, additional charges or misunderstandings - I got exactly what I paid for and more. I referred John to someone who was facing a more serious crime. I reached out to him at 10:00pm on a Tuesday. He was at the courthouse by mid-night to council the person in need, was there the next day an next day until he got released. His charges were originally very serious, but John was able to reduce the charges to a very ideal and minor charge. Bottom line is John is a man of his word, with a proven track record. HIghy recommended.

I was referred to Peter Sell because of his experience when he was at the New York District Attorney's office. My partner, a law student studying for the Bar, who also has ADD, was exhausted and I thought needed hospitalization, not realizing that by calling 911 he could possibly be admitted to a Psychiatric ER Ward and then involuntarily admitted to a psych hospital. It was a total screw up but once the doctors at the ER write a "2 PC" admittance, the state takes control of your life and you lose your liberty. My partner, as a lawyer, refused to provide information to the EMTs and then to the doctors, which is his right, but this actually made matters worse. He invoked his right to request a release within 72 hours but I promised him I would do anything I could to get him out. We began working with the Mental Hygiene Legal Services, but all they tell you to do is to "comply" which would have been taking anti-psychotic and potentially harmful drugs. Once I spoke to Peter he rearranged his workload, took the case immediately, and began to work with us for a hearing that would be in 3 days (by the way, when an individual has lost their liberty in NYS, at least in Westchester, the court only meets on Friday mornings so you have exactly one chance a week to get out - how's that for respecting liberty and the civil rights of our citizens). Anyway, because of this weekly hearing schedule, we had to work fast. As I said, Peter moved his schedule around and met with my partner and I for 4 hours. He started locating expert doctors for another opinion. He found another lawyer to handle our immigration questions (my partner has a green card but is not a citizen). With Peter's help we learned that my partner could, as a last resort, assert his foreign citizenship rights and hand in his green card and leave the US forever to avoid being forced to take the hospital drugs. Peter quickly began to prepare for the Friday morning trial. As luck would have it, the hospital reversed their original diagnosis and released my partner prior to the trial. After being locked up for a week, losing precious time to study for the bar, and having the most terrifying moments of his life, my partner was free, I believe, in part, because of the hospital's knowledge of our legal actions. I still can't believe this all happened, but it could have been worse without Peter's help and involvement. He's very bright, very accomplished, and very efficient. You sense his moral compass immediately, and know that he is a man that you can put your trust in. Much much thanks, always, to Peter Sell.

What a Criminal Defense Lawyer Can Do for You

A criminal defense lawyer provides legal representation to individuals or organizations accused of criminal conduct. If you're facing criminal charges, a defense lawyer will work to protect your rights, build a defense strategy, and ensure you receive a fair trial. Their primary goal is to reduce or dismiss charges, secure an acquittal, or negotiate a favorable plea deal.

Criminal defense lawyers have extensive knowledge of criminal law and court procedures. They investigate your case, identify weaknesses in the prosecution's evidence, and represent you in court, ensuring that you have the best possible defense.

When Should I Hire a Criminal Defense Lawyer?

It’s crucial to hire a criminal defense lawyer as soon as possible if you are facing any criminal charges. Some situations in which you should seek legal representation include:

  • Arrest or police questioning: If you've been arrested or are under investigation, hiring a lawyer early on can prevent self-incrimination and protect your rights during police questioning.
  • Felony charges: Crimes such as murder, assault, drug trafficking, or robbery carry severe penalties, including long prison sentences. A defense lawyer is essential in these cases.
  • Misdemeanor charges: Even for less serious offenses like DUI, theft, or simple assault, a lawyer can help reduce penalties, negotiate alternatives to jail, or get charges dismissed.
  • Plea negotiations: If you’re considering a plea bargain, a lawyer can evaluate the deal, advise you on its consequences, and negotiate for more favorable terms.
  • Probation or parole violations: If you’ve been accused of violating probation or parole, a lawyer can defend you against additional penalties or revocation.
  • Juvenile offenses: For minors charged with criminal acts, a criminal defense lawyer can protect their future by minimizing legal repercussions or keeping the case in juvenile court.

What Does a Criminal Defense Lawyer Do?

Criminal defense lawyers provide comprehensive legal services to protect their clients’ rights throughout the criminal justice process. Their duties include:

  • Case evaluation and investigation: Reviewing the evidence, interviewing witnesses, and investigating the facts to develop a strong defense strategy.
  • Legal advice: Advising you on your rights, the charges you’re facing, and potential defense strategies, including whether to take a plea deal or go to trial.
  • Negotiating plea bargains: Working with prosecutors to negotiate a plea deal that could reduce charges or minimize penalties.
  • Court representation: Representing you in all court hearings, including bail hearings, pretrial motions, trials, and sentencing hearings.
  • Filing motions: Filing motions to dismiss charges, suppress evidence, or reduce bail, depending on the specifics of your case.
  • Trial preparation and defense: Preparing a defense strategy and presenting arguments, evidence, and witnesses during trial to contest the prosecution's case.
  • Appeals: If you are convicted, a defense lawyer can appeal the conviction or sentence, arguing errors in the trial process or legal rulings.

How Are Criminal Defense Lawyers Paid?

Criminal defense lawyers generally charge clients in one of three ways, depending on the complexity of the case and the lawyer’s experience. Payment structures include:

  • Flat fee: For straightforward cases (e.g., minor misdemeanors), some lawyers charge a one-time flat fee that covers all aspects of the defense.
  • Hourly rate: For more complex or ongoing cases, lawyers may charge by the hour, with rates varying based on the lawyer’s experience and geographic location.
  • Retainer fee: In cases where extensive work is expected, the client may pay a retainer fee upfront. The lawyer then bills against that retainer for their work on the case.

The cost of criminal defense services can vary greatly, so it’s important to discuss fees during your initial consultation.

How Much Does a Criminal Defense Lawyer Cost?

The cost of hiring a criminal defense lawyer depends on several factors, including the severity of the charges, the complexity of the case, and the lawyer’s experience. General cost guidelines are:

  • Misdemeanor cases: For relatively minor offenses, such as a DUI or petty theft, a flat fee may range from $1,500 to $5,000.
  • Felony cases: More serious charges, such as assault or drug trafficking, can range from $10,000 to $100,000 or more, depending on the complexity and duration of the case.
  • Hourly rates: For cases billed by the hour, lawyers may charge anywhere from $150 to $500 or more per hour, depending on their expertise and the case's location.
  • Additional expenses: You may also be responsible for other costs, such as filing fees, expert witness fees, or the cost of private investigators.

Be sure to clarify the lawyer’s fee structure and any potential additional costs during your consultation.

Top Questions to Ask a Criminal Defense Lawyer

Before hiring a criminal defense lawyer, you’ll want to ensure that they’re a good fit for your case. Here are key questions to ask:

  1. What is your experience with cases like mine?
Make sure the lawyer has a strong track record with the specific type of criminal charges you’re facing, whether it’s DUI, drug offenses, or violent crimes.
  2. What is your fee structure?
Ask how the lawyer charges for their services and whether you’ll be responsible for any additional costs.
  3. What are the potential outcomes of my case?
A good lawyer should provide an honest assessment of your case and the likelihood of dismissal, a plea bargain, or conviction.
  4. How many cases have you taken to trial?
While many criminal cases settle with a plea deal, it’s important to hire a lawyer with courtroom experience in case your case goes to trial.
  5. Who will handle my case?
Ask if the lawyer will be personally involved or if other attorneys in the firm will handle most of the work.
  6. How do you communicate with your clients?
Be clear on how often and through what channels you can expect updates on your case.

How to Check the Credibility of a Criminal Defense Lawyer

To verify the credibility of a criminal defense lawyer, take the following steps:

  • Check their standing with the state bar: Confirm that the lawyer is licensed and in good standing with your state’s bar association. Look for any past disciplinary actions or complaints.
  • Read online reviews and testimonials: Platforms like Avvo, Martindale-Hubbell, or Google can provide insights from previous clients about the lawyer’s communication, professionalism, and case outcomes.
  • Ask for references: A reputable lawyer should have past clients or other professionals who can speak to their competence and work ethic.
  • Review their case history: Look at the lawyer’s website or professional profile to see their experience with criminal cases, including high-profile or complex cases.
  • Look for trial experience: If your case might go to trial, make sure the lawyer has a strong history of courtroom advocacy and success.

What Should I Prepare for My First Consultation?

To make the most of your first consultation with a criminal defense lawyer, bring the following:

  • Details of your case: Be prepared to provide a detailed account of the charges against you, including any documents related to your arrest, police reports, and court dates.
  • Criminal history: If you have any prior criminal convictions, inform your lawyer so they can understand how that may affect your current case.
  • List of witnesses or evidence: If there are any potential witnesses or evidence that may support your defense, share this information during the consultation.
  • Questions for the lawyer: Prepare questions about their experience, legal strategy, and fees to ensure you understand how they will handle your case.
  • Bail or release documents: If you’ve been released on bail, bring any paperwork related to your release conditions or restrictions.

By being well-prepared, you can help your lawyer quickly assess your situation and begin building an effective defense strategy.
