In a very unexpected situation, I chose Banner to guide us through and represent my child. We were disappointed to find out that the $5000 retainer we paid was completely gone before charges were ever filed. And for what ? A few emails and phone calls and 30+ hours of checking OSCN? We never asked him to check OSCN daily and the contract doesn't say he was going to check OSCN daily. And we told him that we were already checking OSCN daily. And that is clerical work. $300/hr to check OSCN? There hasn't even been an arraignment. The attorney didn't go to court even once. The contract stated that there would be an accounting and refund upon request. We never expected the attorney would fill the accounting with 8 pages of checking OSCN. We trusted this attorney to take care of our child in a time of need and feel like our naivety was taken advantage of. Interesting. As a response to your response, if I am not a party to a contract then I would like a full refund of the $5000 that I paid. My name was on that check. And the word retainer is misleading. Just take it out of your contract and call it a fee only. I read the contract and I was ok with it this whole time, because I was under the impression that the $5000 was a retainer and that unused/unearned funds would be refunded. Yes I understood an additional retainer would be due if charges were filed, but I never understood that meant the first retainer was completely used up at that point. My child and my husband were both at the initial consultation and we all believed the same. We never thought it was just a $5000 charge before ever even filing an entry of appearance as the attorney. We thought the $5000 was just to retain legal services and that fees would be deducted from the retainer as legal services were performed. We never, ever thought we were going to be billed $300/hr attorney fees for $20/hr clerical work or that it would cost $5000 for a few emails and phone calls. I guess we learned to always get an attorney to review our contract with an attorney before signing.

I filed Chapter 7 bankruptcy with Mr. West. I felt uneducated on how the process was going to be like because this was my first time filing for bankruptcy. I thought I was prepared enough for my court hearing but I wasn’t. The trustee in the hearing asked me several questions on my documents which I didn’t have in front me at the time. I wasn’t able to give him an accurate answer. Mr West and his assistant wasn't able to step in at the time because the trustee wouldn’t allow them during the hearing.

I fought for 8 months to get a GAL per the request of one of my children, as well as their counselor. After finally getting my ex to agree, we were assigned Mrs Smith as the GAL for our case. Almost immediately, I regretted ever agreeing to using her, but decided to trust the process. There are FAR too many things to put into a google review…but I am more than happy to provide any and all details if anyone should choose to reach out to me. By FAR, the worst decision I made in the entire almost 3 year process of my divorce. She actually didn’t care that my ex was refusing to sign to give her access to one of our former marriage counselor’s records…which CLEARLY confirmed the abuse I had been telling her about…saying only after weeks of letting this go that “it was clearly important to ME that she have access to these records” in an email to my legal team…NOT that she thought it was important for HER to have access to those records…because she truly didn’t care what was in them, nor would they have had any weight on her decision…which has ultimately destroyed my relationship with one of my children…in his words, “she didn’t listen to me, mom, and I don’t think she did her job” She made the decision that my ex husband’s girlfriend “doesn’t have a drinking problem” after it was brought to my attention that she drove my children AFTER a judge ruled that she couldn’t drive her OWN children under the influence, and having told my ex and her that she shouldn’t be driving them months prior…and when that was violated, she took the word of my CHILD who said he felt fine being in the car with her (because what CHILD should be put in that situation to tell his father in her presence that he doesn’t because he’s read everything and is aware of everything in her still pending case) When I brought it up…she simply told me, she didn’t think she had a drinking problem, and that it wasn’t a court ruled decision…when in fact it was, and I sent her the public document clearly stating that it’s (still currently) a court ordered decision…I caution you HIGHLY to look into the complaints against her and her ethics before agreeing to let her make decisions regarding your children that could potentially have lifelong consequences.

I hired Dustin, based on reviews I found online and his website, as part of a dream team, after watching the OJ trial, and that outcome. I am not new to the system and am well aware that lawyers can, and will sell you out, so I thought I could protect myself by hiring attorney’s from all across the state, that were not friends with each other, or the prosecutor. When your life is on the line, do whatever you can to protect it. It worked and my case was dismissed at preliminary hearing. The prosecutor did appeal to a higher court where it was also dismissed. At the preliminary hearing, 2 of the attorney’s would object in unison, while Dustin would just sit and remain quiet. I am so glad I had the other attorney’s there, because if I had to count on Dustin to fight for my life, I would most likely be sitting in a cell today, because he never did object to a single thing. Later, he told me, and the other attorney’s, it was an honor getting to watch them work, since they were significantly more experienced than he was. I essentially paid a schooling session, for Dustin. Paid him 2x what the other lawyers charged me, and I had a hard time even getting him to write a motion, for the return of some money, and a car they illegally took. I figured he could at least do that, since he did nothing to save my life, and the judge had already ordered my things to be returned. All he would have needed to do, was write a motion to get the judges signature. He acted as if he was above that, and most likely wouldn’t have done it, if one of the other attorney’s hadn’t asked him to draw up the motion. Almost lost another $25k for his lack of action. TO BE TOTALLY CLEAR, I WOULD NOT RECOMMEND DUSTIN TO REPRESENT YOU IN ANY TYPE OF CRIMINAL MATTER. I would like to say a lot more about how he handled things, but I must stay within review guidelines. He asks to be paid up front, in full, and in my experience, if he has nothing to work for, he isn’t going to work hard, but that goes for all attorney’s. I have had many criminal cases, both state and federal, and have dealt with a number of attorneys for those reasons, as well as being a criminal defense paralegal. I give my background to show I have dealt with my fair share of defense attorneys, and in all those dealings, I can only think of 1-2 worse. I have finally left OK for good and happy about it. John Hunsucker is THE MAN!!! My APC arrest in 2012 was a very embarrassing & humbling experience and when I was referred to John I was told I would be in good hands. They were right! On a scale of 1-10, 10 being the worst, my DUI situation started out at an 8. By the day before my final hearing it was a 4. John didn't stop there. He fought for me right through the final hearing and I came away with a 2 on the pain scale. It always pays to hire an expert for a job that requires an expert. I consider his fee quite reasonable when compared to what an alternate outcome would have cost in money, drivers license loss, and a negative criminal record. John's knowledge of DUI law, attention to detail, confidence, punctuality and pleasant personality could give lawyers a good name. For DUI trouble, who ya gonna call?...........John Hunsucker.

Do not use this law firm!!! I lost complete use of my left arm and got $500 settlement and this law firm got over $5,000. Because they dragged my case out a year my loans totaling $3000 with interest of 70 percent ended up a lot more. I lost my employment because of losing ability to type. Left arm is paralyzed!
