I wouldn't let them draw up a simple power of attorney for me. I called them because they are a big firm I wanted to file suit against a local hospital for miss diagnosing me costing me months of treatment and my cancer to spread and become more aggressive. They said I didn't have a case. I wrote 50 letters and mailed them to 50 different attorneys explaining what this particular hospital did. One attorney responded. A young Lady in Georgia that was also licenced in Florida. She said you have a great case with everything backed up in writing. I would like to handle the case for you. She filed suit for me I never had to go to court or be disposed and she called me in less than a year and said we have a settlement offer from the Hospital and the doctor. My part would have been 275 thousand after she got her part. I said I'm not going to settle for that she said I knew you wouldn't because we talked about what you wanted when we first met. She said I declined it as soon as their attorney called me and I told them you wanted to go to court and pled your case to a jury to decide the amount of suffering they caused you. I thanked her the following week she called me and said they made another offer to keep it out of court. I asked her what the offer was and what my part would be. I settled for a cool 525 thousand dollars as my part she got a total of almost a million dollars on a case these attorneys said wasn't worth it. I still have cancer however I'm getting treatment and I was able to pay off all my debts including my home and set up a trust so my son would have money when I die. I would never call these people again.

Ira is a very conscientious, detail-oriented attorney. He will thoroughly review the report of your case for inconsistencies and possible leniencies. Although I was very upset to be in a situation where I needed a lawyer, I was fortunate that I chose him as my lawyer. The situation was resolved relatively quickly. Unfortunately, like many quality services, it was expensive. He also seems to have many connections in the courthouse – that always helps. The ‘justice system’ is definitely not just or even a vaguely fair system. I’m glad I chose him.

Upon responding to my question i believe he made assumptions that i am making certain choices for selfish reasons. I believe he failed to ask sufficient questions to unknown circumstances and instead jumped to conclusions, something i personally never want to experience during a session with any attorney. I believe he Had no concern as to why, what, when, where, who or how. He was knowledgeable and i was able to take away legal advise but i would not recommend.

We hired Mr. Porcella after receiving an advertisement in mail. He represented my hubby on 2 occasions in the past year and he won both cases. Case 1 was a speeding ticket. The case was dismissed, no points with 120 days to pay the court fine. Case 2 was a DWLS ticket that turned into a bench warrant after my hubby failed to appear at the hearing. Mr. Porcella accepted a payment plan, told us what to do and we followed his instructions. At the first hearing the bench warrant was removed and my hubby's license was reinstated. Several weeks later the case was dismissed. We are very happy with this lawyer and we will continue to use him for traffic court issues. Thank you

Karmen has been working on my case for 2 weeks now. She has spent a good amount of time with me on the phone ( I'm presently out of state ) researched my case and has given me excellent leagal advice. Every time I talk to her she has answers. O by the way, she did this without a retainer payment, I just sent a small retainer fee today. So much for money driven !!! Thus far she has proven to do her job, been empathetic and seems to actually care.( Try finding those qualities in a lawyer. ) Although my case is in the begining stages I have full confidence she will do all she can for me. I will post another review when all is said and done.

I needed a Divorce Lawyer. Upon meeting Mr. Marshall, he represented himself to me as specializing in Divorce, so I hired him... I would later learn, he did not. After a 30 year marriage, I trusted Mr. Marshall to know what he was doing as a representative for my best interest, but in the end, I signed off on a Divorce Agreement that failed me. I lost the home I'd bought for myself, all the money I counted on coming in for years, and it absolutely destroyed the plans I had for the future. He made a terrible error, being simply wrong on the information he assured me was correct. I asked him repeatedly to check and double check his facts, but he did not, or I wouldn't be writing this now. He failed me completely, and I would never recommend this lawyer!

Dan Marshall was able to provide excellent and courteous professional services. I met with Dan only once, but was reassured that my case was in good hands. The strategy decided upon by myself, Dan, and his partner Scott Berry was made clear and understood - and it was successful. The added stress of the case was alleviated by the confidence the lawyers of Marshall & Berry projected - and the communication I had with them was made convenient and with ease. I would happily refer the services of Marshall & Berry to any friend or family member. Thanks Dan!

Dan is an excellent attorney. Dan helped immensely in the administrative hearing portion of my son's DUI case. To keep one's license between being charged with a DUI and when the actual case is heard is difficult. Dan managed to use his expertise to successfully negotiate the process to a successful outcome. Dan is thorough, responsive, and extremely literate on the research end of legal issues. He provides excellent customer service. The team of Dan Marshall and Scott Berry in the law firm of Marshall and Berry is solid.

Simple technical VOP I left the state and went to California without permission. Had to get a paid lawyer because the prosecutor wasn't coming off 36 months and the PD said she not going to negotiate for me she has trial. $1,000 retainer no contract paperwork signed I was already locked up no bond. Got me sent to a drug dorm and another 3 month drug program upon my release, so all in all I did a year locked up. I avoided the felony conviction and had to pay victims restitution. He was a nice funny guy knowledgeable but trying to hit me up for more money when really I plead out to the judge open plea because the prosecutor was unreasonable coming down to greedy

I had to put one star because you could not go any lower. "He" represented me in a DUI several years ago. I needed an approval from the state/Division of Licensing to be able to have driving privileges to go to and from work while my license was suspended. "He" showed up late, and because of this I was denied. He made no apology to them or to me. The representative said because of the lateness they were denying ME my request. "He" said nothing to accept blame since "He" was late and NOT me and I should not suffer the consequences because of him. "He" never apologized to me for his gross negligence. He did nothing for me, nothing. Regarding the outcome of my dui at court again he did nothing to negotiate just accepted what was told to him. "He" really could care less, "He" just takes your money.....It's inexcusable for an attorney to be so unprofessional. If you just want to hand over your money and get nothing.................this happened in 2000-2001

If I could give this lawyer Adam Farkas no stars I would. Adam was very unprofessional. We paid this lawyer for a first appearance that he didn't even show up too! First appearance was reschedule and Adam had every excuse for not being present at the time of the call instead of taking ownership of missing the zoom. On top of that Adam requested more money for "filing". He did so many things wrong in so little time. It was a complete mess! We had to switch to another lawyer. Adam wouldn't even refund us which we paid him for a first appearance that he missed! Worst experience ever I would not recommend this lawyer at all for any case!

Adam represented me in a traffic citation, which is 'light’ work for him because most of his work is in serious criminal charges. I am an attorney myself, but not a criminal defense attorney, and I was very pleased to see Adam pursue the weak points of the charge against me by succinctly and clearly, but not obnoxiously objecting to irregularities and questioning the witness against me. His courtroom demeanor was highly effective in bringing out the judge’s sense of fairness against the bogus charge against me. In fact, Adam brought out many points showing that the opposing witness is the guilty party, which is the actual situation, so I won ‘hands-down’. The policeman who was in the hearing room to keep people from brawling kept looking at me like he hated me, over a traffic accident over which he had no prior knowledge, all he knew was that I was a defendant, so it goes to show you the prejudice of law enforcement against defendants, (you know the idea, that if a policeman said it, it’s the gospel truth), which Adam Farkas was able to completely overcome by raising very important points about the state’s case and the testimony of the opposing witness. In fact, Adam Farkas raised important verifiable and unquestionable factual points that show that the alleged infraction by me was completely physically impossible, which are facts that the policemen should have known, but didn’t know, and that won the case for me. He didn’t even need me to testify, I just sat there listening to Adam bring up important questions about the facts of the accusation and to question the opposing witness about facts that showed the illusion that I had committed a crime. Adam also told me about a hearing he had earlier in the day in a felony case in which he scorched the evidence against his client, and won that one too. He is the best criminal defense attorney that I know of. Would I hire him again? Absolutely yes. I even paid him more than he asked, out of gratitude for his good work. While the bulk of my legal work as an attorney is in transactional work, I was co-counsel at a U.S. Supreme Court case (on prisoner rights) so I am familiar with courtroom advocacy at the highest levels, and Adam was as good as the attorneys I have seen at the U.S Supreme Court. The world needs attorneys like Adam Farkas to stop false charges against people. He definitely has a gift for this kind of work.

DO NOT HIRE! Barry represented me on a case a couple months ago. Besides being unprofessional and nearly impossible to get a hold of, he ended up doing nothing for me besides “managing” my case. He sent me right away to a county office that no longer existed, then had me drive an hour and a half and wait at a DMV when I learned afterwards other people’s lawyers handled it for them and emailed the dmv all necessary documents. When it was finally time for my court date, he texted me saying it had got rescheduled till “probably next week”. A few days later I got a text from him telling me the judge’s assistant must not have acknowledged the paperwork and thus a warrant had been issued for my arrest because they had me as a no show to the court date he told me got rescheduled. His advise was to “lay low and avoid the cops” while he would try to take care of it. When I tried to get a hold of him for an explanation I couldn’t reach him for days. On top of that he never actually confirmed when the next court date was, I had to look it up myself on the county website. I finally got a hold of him the day before the court date and he acted like everything was fine and said it was “bullshit dude” that he never told me the date...I guess saying probably then never actually confirming or giving me the time was good enough for him. In the end I was charged a lot of money by this “lawyer” to get the same result I would have gotten by myself and somehow an arrest warrant to boot. I could have done a better job then him managing my case and I urge you to find a more professional and capable lawyer than this guy for your case.

The worst experience I ever receive! I do not recommend this attorney. My family struggled to pay this man $12,500.00 and we barely heard from him. When ever we called to get case updates he responded rudely and was hostile. He kept my family in the dark about my brother's case while he was in prison. He made a plea deal that did not work in our favor and forced my brothers hand as if he had no other choice. In addition he yelled at my family in court right before the trial sentencing because he was upset that I sent an email complaining about the poor service we received from his law firm. My family and I knew nothing about the law and entrusted Mr Franklin with our brothers case only to find out that he barely Did anything to help. If I knew better I would have asked the judge to give us more time to find another lawyer. Beware and do not make the same mistakes we did.

What a Criminal Defense Lawyer Can Do for You

A criminal defense lawyer provides legal representation to individuals or organizations accused of criminal conduct. If you're facing criminal charges, a defense lawyer will work to protect your rights, build a defense strategy, and ensure you receive a fair trial. Their primary goal is to reduce or dismiss charges, secure an acquittal, or negotiate a favorable plea deal.

Criminal defense lawyers have extensive knowledge of criminal law and court procedures. They investigate your case, identify weaknesses in the prosecution's evidence, and represent you in court, ensuring that you have the best possible defense.

When Should I Hire a Criminal Defense Lawyer?

It’s crucial to hire a criminal defense lawyer as soon as possible if you are facing any criminal charges. Some situations in which you should seek legal representation include:

  • Arrest or police questioning: If you've been arrested or are under investigation, hiring a lawyer early on can prevent self-incrimination and protect your rights during police questioning.
  • Felony charges: Crimes such as murder, assault, drug trafficking, or robbery carry severe penalties, including long prison sentences. A defense lawyer is essential in these cases.
  • Misdemeanor charges: Even for less serious offenses like DUI, theft, or simple assault, a lawyer can help reduce penalties, negotiate alternatives to jail, or get charges dismissed.
  • Plea negotiations: If you’re considering a plea bargain, a lawyer can evaluate the deal, advise you on its consequences, and negotiate for more favorable terms.
  • Probation or parole violations: If you’ve been accused of violating probation or parole, a lawyer can defend you against additional penalties or revocation.
  • Juvenile offenses: For minors charged with criminal acts, a criminal defense lawyer can protect their future by minimizing legal repercussions or keeping the case in juvenile court.

What Does a Criminal Defense Lawyer Do?

Criminal defense lawyers provide comprehensive legal services to protect their clients’ rights throughout the criminal justice process. Their duties include:

  • Case evaluation and investigation: Reviewing the evidence, interviewing witnesses, and investigating the facts to develop a strong defense strategy.
  • Legal advice: Advising you on your rights, the charges you’re facing, and potential defense strategies, including whether to take a plea deal or go to trial.
  • Negotiating plea bargains: Working with prosecutors to negotiate a plea deal that could reduce charges or minimize penalties.
  • Court representation: Representing you in all court hearings, including bail hearings, pretrial motions, trials, and sentencing hearings.
  • Filing motions: Filing motions to dismiss charges, suppress evidence, or reduce bail, depending on the specifics of your case.
  • Trial preparation and defense: Preparing a defense strategy and presenting arguments, evidence, and witnesses during trial to contest the prosecution's case.
  • Appeals: If you are convicted, a defense lawyer can appeal the conviction or sentence, arguing errors in the trial process or legal rulings.

How Are Criminal Defense Lawyers Paid?

Criminal defense lawyers generally charge clients in one of three ways, depending on the complexity of the case and the lawyer’s experience. Payment structures include:

  • Flat fee: For straightforward cases (e.g., minor misdemeanors), some lawyers charge a one-time flat fee that covers all aspects of the defense.
  • Hourly rate: For more complex or ongoing cases, lawyers may charge by the hour, with rates varying based on the lawyer’s experience and geographic location.
  • Retainer fee: In cases where extensive work is expected, the client may pay a retainer fee upfront. The lawyer then bills against that retainer for their work on the case.

The cost of criminal defense services can vary greatly, so it’s important to discuss fees during your initial consultation.

How Much Does a Criminal Defense Lawyer Cost?

The cost of hiring a criminal defense lawyer depends on several factors, including the severity of the charges, the complexity of the case, and the lawyer’s experience. General cost guidelines are:

  • Misdemeanor cases: For relatively minor offenses, such as a DUI or petty theft, a flat fee may range from $1,500 to $5,000.
  • Felony cases: More serious charges, such as assault or drug trafficking, can range from $10,000 to $100,000 or more, depending on the complexity and duration of the case.
  • Hourly rates: For cases billed by the hour, lawyers may charge anywhere from $150 to $500 or more per hour, depending on their expertise and the case's location.
  • Additional expenses: You may also be responsible for other costs, such as filing fees, expert witness fees, or the cost of private investigators.

Be sure to clarify the lawyer’s fee structure and any potential additional costs during your consultation.

Top Questions to Ask a Criminal Defense Lawyer

Before hiring a criminal defense lawyer, you’ll want to ensure that they’re a good fit for your case. Here are key questions to ask:

  1. What is your experience with cases like mine?
Make sure the lawyer has a strong track record with the specific type of criminal charges you’re facing, whether it’s DUI, drug offenses, or violent crimes.
  2. What is your fee structure?
Ask how the lawyer charges for their services and whether you’ll be responsible for any additional costs.
  3. What are the potential outcomes of my case?
A good lawyer should provide an honest assessment of your case and the likelihood of dismissal, a plea bargain, or conviction.
  4. How many cases have you taken to trial?
While many criminal cases settle with a plea deal, it’s important to hire a lawyer with courtroom experience in case your case goes to trial.
  5. Who will handle my case?
Ask if the lawyer will be personally involved or if other attorneys in the firm will handle most of the work.
  6. How do you communicate with your clients?
Be clear on how often and through what channels you can expect updates on your case.

How to Check the Credibility of a Criminal Defense Lawyer

To verify the credibility of a criminal defense lawyer, take the following steps:

  • Check their standing with the state bar: Confirm that the lawyer is licensed and in good standing with your state’s bar association. Look for any past disciplinary actions or complaints.
  • Read online reviews and testimonials: Platforms like Avvo, Martindale-Hubbell, or Google can provide insights from previous clients about the lawyer’s communication, professionalism, and case outcomes.
  • Ask for references: A reputable lawyer should have past clients or other professionals who can speak to their competence and work ethic.
  • Review their case history: Look at the lawyer’s website or professional profile to see their experience with criminal cases, including high-profile or complex cases.
  • Look for trial experience: If your case might go to trial, make sure the lawyer has a strong history of courtroom advocacy and success.

What Should I Prepare for My First Consultation?

To make the most of your first consultation with a criminal defense lawyer, bring the following:

  • Details of your case: Be prepared to provide a detailed account of the charges against you, including any documents related to your arrest, police reports, and court dates.
  • Criminal history: If you have any prior criminal convictions, inform your lawyer so they can understand how that may affect your current case.
  • List of witnesses or evidence: If there are any potential witnesses or evidence that may support your defense, share this information during the consultation.
  • Questions for the lawyer: Prepare questions about their experience, legal strategy, and fees to ensure you understand how they will handle your case.
  • Bail or release documents: If you’ve been released on bail, bring any paperwork related to your release conditions or restrictions.

By being well-prepared, you can help your lawyer quickly assess your situation and begin building an effective defense strategy.
