The lady answering phones is incredibly distracted and irritating she needs to pay more attention and not be so distracted with whatever else she's doing in the background when she takes an initial consultation call this happened at 10:30 in the morning on January 22nd 2025 I'm sorry but she was so irritating distracted and didn't have a clue what gets me is how many five-star ratings you have for customer service

If it wasn’t for ADAM and his team, Chris and his children wouldn’t have gotten any justice when everyone else laughed at me. ADAM said no screw that let to make this right and he did and they helped get justice for my love Whether it’s something big or small 1000 out of 1000 I recommend calling ADAM even if he can’t help you he’s gonna give you the resources to go get the help in one way or another My son and I will forever be thankful to ADAM and his team for getting justice for Chris #justiceforchrissanchez

There aren't enough words to express the gratitude I have for Dusti Harvey, Jennifer Foote and their staff. The Harvey & Foote Law Firm pursued a case involving the wrongful death of my sister. Although there was no amount of money that could undo the suffering my sister endured prior to her death, the settlement we received was more than I could have hoped. With their help, I feel like I did right by my sister's memory.

The Harvey and Foote law firm settled a wrongful death case for our family involving a nursing home. The process was for me was hard to deal with due to the loss of our loved one. Dusty and her staff eased this by good communication, updates, several scheduled milestones were we had a chance to ask questions and were given the process and what the next phase would bring. As a team we would approach each step going forward. This case ended in a settlement but I had the confidence that if we were going to trial we would be fine, this helped in negotiation and peace of mind. I would recommend the Harvey and Foote law firm to anyone who needs help in this type of case and will say the entire staff was always curtious and professional everytime I reached out to them.

I highly recommend Shane Maier from Gauthier & Maier Law Firm, P.C. After being injured on a vacation property, I turned to them for help. Shane's expertise in personal injury law and his background as a former insurance defense attorney were invaluable. He explained everything clearly, fought tirelessly for my rights, and secured a settlement that exceeded my expectations. What sets Shane apart is his personalized approach and dedication. If you need a skilled, compassionate attorney who gets results, Shane Maier is your best choice.

I highly recommend Patrick Kelley Family Law to anyone going through family legal matters. I called and spoke to his paralegal who was very friendly on the phone and pointed me in the right direction. I made an appointment with Patrick and he was very professional and caring. I never felt like I was just one of his clients but a real person going through a real event in my life that mattered to him as well. I was in a child custody case and he was very organized in getting all documents together and creating a great case for me. I personally had an out of state case and everything was done over the phone and email. Anytime I had a question or concern he was always available to speak to me or called me back within the same day. When going to court he knew all the right questions to ask and was prepared for the trial with no surprises. I feel like he was not only my lawyer but a part of my family. He always had a personal touch to our conversations to ask how everyone in the family was doing and was honest and true. If you need an attorney who cares for your matter and not just your money, I would highly highly recommend Patrick Kelley!!

Regardless, the staff I spoke with, were incredibly kind and understanding and Mr. Kelley was forthright, seemed knowledgeable (I don't have experience to gauge for certain) and generous.

I had an unusual situation with my child support agreement and had been told there was no clear-cut solution. Then I went to Maria, who had the experience and knowledge of family law in New Mexico to provide the answers I needed to make financial decisions for the betterment of my family. She even showed me the case law in a law book and explained things in a manner that was helpful and understandable. Maria relates to her clients and is a skilled practitioner.

I wish I had read the review from Kent P before I even called this firm. When I first called and spoke to someone regarding my case I was encouraged when i was told that I would be able to do a video chat with an attorney. I did the chat with Margaret Graham on the pre arranged video call. I discussed my situation with Ms Graham. She advised me to write a letter to my brother before I went further, primarily because I expressed to her that I was not sure how to proceed because my father is a 92 year old purple heart veteran and I did not want to stress him more than my brother had. This was a case of exploitation. My older brother had taken steps to take control of my parents estate which included falsly claiming I was stealing from my Dad so he could gain control. In his process he not only removed me as POA but he got my father to sign documnets making him a joint tenant on the properties. He has also kept me from seeing my Dad. I told Ms Graham I was not interested in the property but wanted to be able to see my Dad. Ms. Graham advised me if I was unable to resolve this with the letter I could call her back and she would file. Since I was unable to resolve the issues with the letter. I called her office letting them know that I was unable to resove the issue and upon her request I was calling back to hire her to file and help me move forward. I was given an appointent for Oct. 10 @ 1:15. Today Sept 25 I received a phone call from intake to let me know that they wanted me to know that I did not have an appointment and that the firm was no longer accepting any new clients. When I told the young lady about the video call with Ms, Graham and the pre set appointment she proceeded to tell me There was no record of my having the video call nor did I have an appointment on Oct 10. What confused me, is why call me to tell me they wanted to make sure I knew I didn't have an appointment. And where did she suddenly come up with my name and number. If this never happened why call me? I am so upset because I have not seen my Dad in a year now because I have not been able to find an attorney! I Was so excited that Ms. Graham had given me advise (free consultation) and agreed to help me if the letter did not work. I don't know how much longer my Dad has and I am missing out on his last years. I am so sad that I am being told I never had the teleconferance nor did I ever have an appointent. I was told that it could not have happened, yet I fully recall what Ms. Graham looks like. I know it was not any other firm because I double checked the web page and found the photo of Ms Graham. I know I did not make the call up. I now have to start all over again to find and attorney with the clock ticking on my time with my Dad. I am so very upset especially at being accused of not ever having had that conference call. I was also interested in having this firm handle my estate plan. I am prepared to pay a retainer and hourly fees if it gets my father back before he passes. I just don’t understand how this could happened when I did as Ms. Graham instructed. I even had to wait because I couldn’t get an earlier appointment. I now have learned I have to start all over again. Why was I not notified sooner they couldn’t take me as a client. And why did they give me an appointment in the first place?

We regret choosing this firm to prepare our trust. It has been 7 months and it is still not finalized. They do not respond to emails in a timely manner, if at all. I question their competence, professionalism and ethics. I strongly recommend finding another firm.

I engaged Betsy Salcedo and Gregory Gahan to help with two cases. Betsy Salcedo was the presiding attorney. We had meetings, emails and discussions for how my case would be handled. Gregory Gahan was my court representative. He was completely unprepared for my hearing despite all of my own preparations which cost me a lot of time and money. I did a ton of leg work for him. Gregory Gahan waited until the last minute to prepare for my hearing and then completely blew everything despite Betsy Salcedo's assurance that they were in fact prepared. Betsy Salcedo and Gregory Gahan will drain your retainer and finances and then when it is time to represent you in court, completely fail. Behind my back and without my permission Gregory Gahan asked the opposing party for a Motion for Continuance on the day of the hearing....after knowing with Covid and the death of the Presiding Judge I had eagerly awaited this hearing for 6 long months. I ended up being pigeon holed into an agreement that I was sorely disappointed in. If Betsy Salcedo and or Gregory Gahan blew your case, please report them to the NM State Bar and the BBB. Post your story, be heard. Betsy Salcedo and Gregory Gahan are scam artists. They should not be practicing law. If that is not enough, Betsy Salcedo is completely disrespectful. Betsy Salcedo has a bad habit of talking over people. Betsy Salcedo is arrogant and will insult you and demean you. I truly wish I never met Betsy Salcedo or Gregory Gahan. They have drained my bank account and my time. They completely botched my court case, they failed to defend me as promised. Why on earth would a lawyer who is hired in good faith wait until the day before the hearing to get the hearing audio. Why would a lawyer go behind a client's back and ask for a Motion that a client had not approved. Furthermore, Gregory Gahan did not copy me on the email he sent the opposing party. When I asked Betsy Salcedo and Gregory Gahan to please send me a copy of the email requesting a Motion for Continuance which I did not approve they refused. I made this request 3 times. I finally had to terminate both of these lawyers. I guarantee they will overcharge me even though they failed to do their job.

LICENSE IS INACTIVE. Worst attorney ever! The things you did on my case Greg was unethical! And you know exactly what unethical things I'm talking about I should have turned you in. Research this attorney. He has had big problems of his own. I wouldn't waste my money. Failure. How does an attorney with 20 plus years experience only have 3 reviews? Please. Its because he is a horrible attorney. Find another attorney. Many more better attorneys out there. Go get yourself one. Greg forgets his lack of abilities have life long affects on people. Find an attorney who cares about you. They are out there.

I used M. Torres several years ago in a child custody case. He was the most incompetent and lazy attorney I have ever met, and since him I have worked with some excellent ones.He did nothing but spend my money on completely useless maneuvers that he never followed through in court. His one time arguments to the Judge was pathetic and usless and he came off as foolish and the Judge told him so. He lost my case due to his negligence in producing any viable material to the court dispite his constant promises and billings. His behavior bordered on inappropriately flirtatious with me, as he thinks he charming with female clients.

We've been involved with Mr. Hall for nearly fours years trying to resolve a real property issue. He has indicated to us that he agrees with a solution on several occasions yet when we try to get finalized signatures and settlement he wants to change what was agreed on. Our experience with him has convinced us that his word is worthless and he can't be trusted.

For bring an attorney he was not only unprofessional, he acted rude, arrogant, pompus, and should be reprimanded for his shortsighted line of questioning and gross incompetence. I am a SENIOR CITIZEN, GIVE ME A BRAKE. I Have sustained multiple head injuries, more than a dozen automobile accidents, (always a passenger), a survivor living through several vicious attacks; to be called a "LIAR" by a snotty-nosed, wet behind the ears individual, who hids out in a "Government" Office, pretending to be assisting Seniors. Although We may be disadvantaged financially, we deserve equal respect and service as any other citizen. This Michael Mcguire, asks me several questions, I answer truthfully, he repeats what I say. I say yes, I continue to inform in further detail. He says, "YOUR LYING! YOU HAVE TO TELL THE TRUTH OR NOBODY WILL HELP YOU!" The nerve! He says, hold on a second, let me run that by one of my collegues, because I don't think I want to take this case! Wow! Unbelieveable! It's like some young persons go to college, earn a degree and think they have a free pass to dis the elderly, disabled, and disadvantaged. We get nailed by unscrupulous, money hungry, wolves just to be verbally smacked upside the head by one of those so called attorneys still earning his wings. Shame on you MM. Shame on you. Develop a back bone to genuinely help out those "more complex cases." Don't say "no other attorney is going to help you." Dream snatcher! As long as we live in America this will be a government for the people and by the people. I know things in general do not appear to be for the regular folks, but we still have a voice. I'm going to use mine to promote Equal Justice under the Laws of this Nation.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
