I would give 100 stars if I could. After spending one year in a very complicated divorce, I realized I needed someone new and I was recommended to Lyndsey and Paradise Family Law. It completely changed everything. I could not have asked for a better advocate: she is highly skilled, excellent listener, meticulous with everything she does and she is very responsive. Sometimes I wonder how she sleeps, but she gets the job done! Ginger is fantastic too, and I could not be more grateful to have found them.

I had a great experience with Attorneys Lindsey and Ginger at Paradise Valley Family Law. Ginger was especially helpful in preparing all the necessary documents for my court filing. She has excellent communication skills and was always attentive to my questions. Whenever I called regarding my case, she was willing to assist me in any way possible. I would recommend Paradise Valley Family Law to anyone going through a divorce, but it would be helpful if they had a payment plan system.

Very favorable yet when I asked them a question about technical issues regarding the trust they would not answer the question. "We weren't retained by you, retained by your parents. Here is a list of attorneys who can help". Thing is, mother was alive. Still their client. Why couldn't they help me? I was set up as "special agent" for mom with rights entitled to act as "attorney in fact" for my Mom and I could not get my questions answered.

Place seems perfectly professional - until parents pass away and rightful heir is left without funds after paying these attorney for decades of Trust establishment and help. I am such a heir, and have been left absolutely nothing from my parents after a half brother, not my father's son, also an attorney, took control of the hundreds of thousands of dollars and property that was strictly my fathers'. Timothy Struse Senior left the management of my parents' estate to his son (it was originally established by very long term partner Paul D Slosser). Do not possibly trust these attorney with your funds if you want your only son and heir to have them!

I am an out-of-state resident but my parents live in Arizona. With my mom's passing in the fall, my father has been living alone for 6 months and recently fell gravely ill. He has been hospitalized for over 2 weeks and is incapable of managing his finances. Unfortunately the only POA on file was over 20 years old and listed mom as his financial AIF. Thus a conservatorship was needed. Mr. Wood answered the phone himself when I called, and secured me as my father's temporary conservator in less than 4 business days! I never imagined it would happen that fast and relatively easily. Personally, this is nothing I ever wanted to do. I wanted my father to continue to self-manage his financial affairs, but the situation necessitated it. Mr. Wood was very sensitive to our situation and communicated with clarity, respect and compassion throughout. I plan to continue working with him as the permanent conservatorship process unfolds and in helping me to remain in good standing with the court for as long as I must act in this capacity. I highly recommend him to anyone needing such services too.

My brother passed suddenly in 2014. In his Will I was named executor or as I later found out from Mr. Wood, a Personal Representative. Not knowing a thing about probate and the duties of a PR, Mr. Wood was there to help guide me through the process of a Probate. He was forthcoming with fees and kept me informed of each step we were taking. Since I live in CA, I couldn't imagine doing all this by myself, without his help.

Rick was my parents’ (my mom and stepdad) lawyer and created their estate plans in the mid90s. They made sure to introduce me to Rick back then, as they planned to have me be one of their trustees when needed. When the time came and each had died, I became very active in settling their estates. Rick and the estate plans he developed, were pivotal in working out their wishes. I know for certain that had their wishes not been written down, it would have been a mess to sort through. I’ll forever be grateful to Rick and his efforts.

I highly recommend Benjamin Deguire, Family Law Attorney in Flagstaff, AZ. Ben was the top reference I was given through my friends and family who practice Law in Arizona. With that, I was not shocked to learn that Ben was completely booked when I reached out to him last year, but he agreed to meet with me over the phone to assess the complexity of my Divorce case and feel me out as a prospective client. Fortunately, he agreed to take me on. Ben is an expert on Family Law and also very familiar with the Judges’ tendencies, and well connected with the other family law attorneys in town. This positions him to give sound advice on probable outcomes of settling outside of court vs. in trial. Communication is key when you’re navigating something as stressful, complex and high stakes as Divorce. Ben welcomes questions and input. He was able to pull my input into a strategy with my best interest and outcomes in mind. He tackled each category of the divorce decree one at a time, approaching the cleanest, simplest issues first. This set a nice tone for negotiating the more difficult issues later. Ultimately, we were able to settle outside of court through a combination of a Settlement Lite conference and a Judicial Settlement Conference. I can’t say enough good things about Ben and his wife, Liz. They were wonderful to work with and very relatable on the emotional aspects of divorce and divorce with children.

My brother lived in AZ and I live in CO. When he passed I became his personal representative. We weren't really sure we needed an attorney, but Jennifer was recommended and we engaged her. That was the smartest decision we made. She was able to explain and guide me through the process, which was significantly more complex than I had ever imagined. When the situation took a turn for the worse and became contentious she provided valuable guidance and advice and worked tirelessly to resolve the issues. She and her staff listened and understood my concerns and helped me work through them. They also helped me stay centered and focused on the important issues. She and her staff were always available to answer questions and provide assistance. This was especially helpful since I did not live in AZ. Their communications with me were always clear and concise whether they were explaining something or forwarding me documents. I received the information I needed and, when necessary, very detailed instructions on what was required. She was always mindful of managing her and her staff's time to try and keep the costs down. She made sure I was aware of the status of the important issues, but did not keep me updated on the status of every little item which helped keep the costs down. If, however, I had any questions she and her staff were always available and would answer all my questions. They were always supportive and understanding and worked very hard and diligently to help me through this process which has been going on for over 15 months. Jennifer and her staff exceeded my expectations in all areas and I cannot thank them enough for all that they have done.

Jennifer was hired to represent me in our nightmare of a case against cps. We were wrongly accused with no evidence and Jennifer did everything in her power to prove that. She knew what she was doing and how to respond to cps and their lies. She never gave up, always working hard to prove their lies wrong. She was professional, caring, informative, hard working and completely committed to my case. She was constantly thinking a step ahead of cps. Although my case has gone on for 2 years, she never gave up or stopped caring. Even though the case is not closed yet, my kids are back at home where they belong. When the kids came home she genuinely celebrated with our family!! She was excited to meet and hug our kids. If you want a lawyer who will fight for you, knows what they are doing, genuinely cares and knows how the system works.. Look no further, this IS who you should hire!!

I hired Jennifer to help me get my share of an asset from my fathers estate. She proposed to get a written agreement between myself and the other beneficiaries, but failed to inform me that the trust attorney added language to the agreement she knew was unacceptable to me. She then lied and said she told me of the added language. She later suggested to correct the language we amend the agreement and wanted to charge me for the time and effort. The sale of the asset eventually happened without help from her. It was a very unpleasant experience. She seemed distracted and communication was poor. In fairness it may have been a staffing problem but ultimately she should be in control of what is happening in her name.

As a working mom I didn't have the time nor the energy to navigate the process with insurance claims, bills, etc. She handled everything and went out of her way to check in, give me updates and inquire how I was physically doing. Mr. Collins has handled my parents trust for many years. It has had to be amended a couple times for the following reasons: first my father died, then my mother wanted to give me a more of the remaining assets after she died because she has given my brother $400,000. Ironically, that last amendment disappeared. Mr. Collins is and was aware of the fact that my brother continues to take advantage of my mom who is now in advanced dementia, including taking over half her monthly income and getting her to take out a reverse mortgage after I had got her all approved on a regular home equity loan that would protect her only remaining asset (home equity). I can not believe Mr Collins did not counsel my mother against this knowing full well, my brother would deplete the remaining equity. The last time I talked to him a year ago, he berated me on the phone despite all my efforts to protect my mother. I tried calling him twice over the past year to discuss these concerns and left a message both times. No return call. I do not recommend using this attorney.

My family hired and paid Bartlett after my mother's death to handle her estate. He suggested we set up a "special needs pooled trust fund" for my schizophrenic brother with some of the money left (10K). He said my brother's SSI payments would be protected because the trust would only be for extra items other than food and rent which SSI covers. This was in 2012. In 2015-2016, SSI started demanding "over-payments" from my brother to the tune of 30K stating that his trust was not allowable. Bartlett would not even talk to me without a credit card number. All I wanted to do was talk first. I fumed, then came back after a few months and said I'd pay. His answer? He "declined to represent" us anymore. I don't understand how he could have gotten us into this mess with SSI and then not have the decency to help us out - even when I finally offered to pay. I strongly do not recommend him.

I did not hire the attorney only had a phone conversation. I do not reside in AZ but was told that I needed to hire an attorney in order to obtain an Affidavit of Succession in order to sell the property I inherited. I called her office and asked how much the service would cost me and was told eighteen fifty plus required filing fees.(approx $235) I said eighteen fifty??....do you mean to say One thousand eight hundred fifty dollars?? She said yes. Please be advised that it is probably less than one hour worth of work for her. $1,850??? Seriously!!? Please beware!!!!! Another attorney called me back today and confirmed that this is about 1 hr worth of work and he charges $300 for that service. Although, I know that one needs to hire an attorney for some things, I was able to obtain my above stated Affidavit w/o an attorney. The ladies at the Pima County Supreme Court/probate/trial department are super nice and super helpful. It only cost me my $235 filing fees plus my FedEx $24. I gave her 2 stars because she was nice on the phone. Please beware!! Will take you for your money!!!

Trevor White tried to say that items were not left to me and even sent me an email saying that he thought I only wanted those items for my parents, which wasn't true. As an executor, I didn't think it was any of his business what I did with items left to me. I could have chopped them up and burned them and it still wouldn't be any of his business. Laura was basically a very expensive paper pusher. She was late to meetings and court. I traveled 1300 miles to go to court and for the Judge to say he only had 1 1/2 a half to attempt the mediation. I told Laura that I was feeling rushed and uncomfortable. She agreed but basically shrugged her shoulders and did nothing. She barely spent 2 hours with me on that trip. During my time with the judge Laura was unprepared. Communication was sporadic. She never fought for me. She would talk a big strategy to me in conversation but she didn't execute. I wanted someone to protect and fight for me. That didn't happen. I ended up letting her go and using my husbands attorney. Unfortunately this was after spending close to 10k. I would not recommend her practice.

Man was so rude he couldn't wait to get off the phone and didn't listen to what I was saying before I finished saying it, two sentences. I asked him a basic procedural question that he said he couldn't answer unless he reviewed my entire case. Whether you can file an appeal in bankruptcy is universal and procedural, it doesn't change "depending on your case". don't waste money on these idiots, they can only lose for you.

The previous reviews were correct about Christine Powell. Please if she is assigned to your case get her off, unless you can get on her emotions with no evidence. Christine Powell was unfortunately appointed to my case as a best interest attorney. My case involved a narcissistic parent who has been out of my children’s lives for the past several years to the point where he has been in jail for non-payment of child support. As our court date was approaching, I called her for our initial meeting and she wanted to meet last minute. After the meeting, Powell promised me that she would do everything in her power to prevent the other parent to receive 50/50 custody. I thought that was a little odd because at that time she did not even speak with the other parent or my children. Powell then met with the other parent the day before the hearing. Powell called me right after her meeting with the other parent and said that the other parent made allegations about me and that she believed those allegations. Powell then proceeded to use profanity against me and spoke to me in an emotional tone. I could not believe all of the allegations Powell was saying about me especially since I have never done anything close to what she had said. For example, Powell said that I have an alcohol problem and I can’t even remember the last time I drank alcohol. Despite all of that, Powell told me that at Court the next morning she would recommend to the Judge that I get every day except some weekends. To my surprise, at Court the next morning, Powell recommended to the judge that I get 50/50 custody, made baseless allegations against me, and recommended that I be tested for alcohol. To make matters worse Powell told the Court that she did not even need to interview my kids because her mind was already made up and the interviews would not change anything. It is devastating because I am the only parent that my children know and all one needs to do with Powell to get her to side with you is to make false allegations about the other parent.

I am the petitioner in my case. Over a year ago my now 3year-old son was abused while in his mother's care. When we broke up she kept my son from me for 2 month's before I was able to get her to court. We finished court and not even a month later his mother lied to the courts to get emergency custody of our son. I went to the courts with proof that she lied and a witness whom she told that now that she had custody of our son she would never let me see him again. The courts assigned Christine Powell to the case. From my very first phone conversation with Christine she used offensive language told me I was guilty of what my ex said dispite my proof that my ex had committed perjury to get emergency custody of my son. She then told me to email her the information I have. A week later she says she doesn't have the time to read the emails and to mail her the papers. She also not only accused me of stalking my ex she said she believed that I was. I informed her it's impossible for me to stalk anyone without a vehicle. She also told me I wouldn't be getting my son on Halloween even after I told her that our current custody agreement says our Son spends all Holidays with both parents. She replied back with )"That's not how it works"). I replied back with haven't you even read the custody agreement? Her next email was her apology for not checking the agreement. I still didn't even get to to my son trick or treating for a hour. She has been coaching my son's mother. Which is a conflict of interest. She also refuses to give me the babysitter information that his Mom has even though it's not protected information in any way. She lied to the courts about me even though I can prove she is lieing. This woman thinks she canmakr up laws at will. She eeven threated my boss to have me held in contempt of court if he didn't let me have the day off for a mediation that I had already requested to the courts that it be changed because I didn't have anyone to cover my shift. The judge of the case granted my request to reschedule the mediation. This woman has also orderd me to give my son to his Mom before my time is up or else.

She is the best interest lawyer for a minor child in a case I have going on. She is very basis. And she says one thing one minute and then she changes her mind a few days later. She has a good back ground history but she doesn't do her home work and shows up for court right on time and has done any research on what she is doing. Then when she was told that the case will have to come back in a month she replied she wasn't going to come. That she will call in her review of the case.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
