In 2012 my husband and I contacted Tracy to help us prepare a living will and overall estate plan. I will say that she was very professional and courteous, and her prices were quite fair. My husband has been in oil and gas his whole life and we were specifically concerned about putting money away so that I would be okay and our disabled oldest daughter would be okay. In general she did a good job and was easy to work with. My husband passed in early 2021 and my son worked with Tracy to probate the estate. When we involved our tax specialist there was a 7 figure tax bill that was completely unexpected! It felt like she didn't do her homework or involve the right tax specialist. We've been blessed to have more than we need but I am upset that she didn't do this properly when my husband was around to help.

I found Tracy through Avvo. She was so kind and thorough helping my father and I through the living will, MOA, and POA process. I had no previous experience with lawyers; she has set the bar high for other lawyers, that's for sure!

I have worked with many attorneys, across a range of different legal disciplines. My experience has definitely varied. Tracy has proven the very best attorney with whom to work. I enlisted Tracy's help on estate planning. My situation included will, trust, inheritance trusts, and a special needs trust. Tracy's legal advice was rock-solid, she was patient with my many questions, able to communicate, responsive, organized, and reasonably-priced. These are precisely the attributes I seek in an attorney. I plan on continuing to enlist her services. I recommend her highly.

Mr Allison helped me out when no other attorney would. He took my case and was by my side through a long workman's comp process which helped ease the stress of it all. He fought for me against the insurance company and won my case and got me the benefits and everything else I was denied. I highly recommend him! He's more than just an attorney. He actually cares and fights for the working man.

Hello everyone! Aaron Allison has accepted my case to where no one else would, at first I was on the verge of giving up , I had called at least 12 other attorneys that said ," this is something beyond my experience" or ," there is not much of a fight to be had". With Aaron Allison and his legal team, they are truly a force to behold. The determination to win your case and the pure aggressive manner they go after your opposition is unmatched by anyone in the field. If you need help and have no one else to turn to, call Aaron Allison today, yoi are one phone call away from a breath of fresh air.

I contacted the firm in December regarding an employment law issue. I wasn't informed of the firm's unavailability until months later. The above words are the ones I use to describe Mr. Farrell. We used his services in the past for my mother-in-law through various stages of aging to provide for her care. Our current need was to write my husband's and my wills and other important documents. As always, he listened carefully to all our needs and created documents that reflected our wishes, including a trust for our dogs!

I chose this law firm from my legal protection plan. I consulted with attorney Mario Flores on the phone for 8 minutes and sent him documents to review. His legal assistant put me on his calendar. Toward the end of that day, I called during business hours, but no one answered. I reached Mario on his cell phone, and he said his assistant "messed up" when scheduling. He said he had not reviewed my case and would not look at it until the following Monday. I reached out twice since then, but he did not return my calls or emails. It is apparent he is not interested in helping me further, but I would have preferred he told me that rather than ignoring me. My legal plan paid him a full consultation fee for an initial 8 minute converation, followed up by a one-minute call where he treated me rudely.

It was horrible to speak with her. It was supposed to be a $20 consultation that they decided to add over a $100 to and then decided to add even more in costs. I thought finally I would be able to at least pay someone to look at the evidence. I paid at least $300 for May Yang to talk over me, tell me how I was uncooperative, refused to look at the evidence I had to pay extra to submit, put me under pressure to answer her why questions correctly and interrupt the questions she allows me to voice. It was maddening. It was rude. She would say she doesn't know much about immigration law and then tell me how I was wrong about immigration law despite 30 years experience in the field. She never bothered to get to know me nor what my concerns were. She took the money for the consultation, it was beyond a reasonable amount, and failed to deliver. She charges $300 an hour And Is Not Worth It. Not to me is it worth it. I am out of money for a person who wanted to complain about me during the consultation. She is extremely inconsiderate. She apparently likes to cuss a lot focusing on the F word and the S word. I didn't mind that part. But she does like to do that if you want to spend your money to listen to it.

Not only is May Yang proficient in all aspects of guardianship law, she is amazingly well-informed about all aspects of disabled adult custody law, social security benefits, and involuntary commitment rules. I was extremely grateful for May's insight into my daughter's character, her honesty about what our options were, and her patience, understanding, and professionalism. She was always concise and articulate in her descriptions of the challenges we could face, and she consistently found solutions to even the most complex of problems. You could not ask more from a lawyer. Consider yourself lucky if you find May Yang!

It took me awhile in contemplation on whether or not I should write this review but seeing others' writing, I see that I owe it to myself and others to speak on Mr. Brian Bernard. I was first introduced to him by a good friend of mine who was actually upset with him that he had spent $500 on his daughter's behalf and received no service. He said he was upset with Mr. Bernard for not doing anything and he, his daughter, and his daughter's mother had reached out to him several times and Mr. Bernard became upset. They parted ways but I decided to give him a chance because I felt that any grievance over $500 is DEPLORABLE because I am a pre-law student and I understand that attorneys charge anywhere from $250 to $1000 an hour for their time. I talked this attorney for the first time last October and he was the cheapest attorney of them all. When I talked to him again this year, the price went up because I needed him to travel I was still good with it because it was 5k and it was cheap for what I needed him to do. He hastened me to get the money and said if you don't hurry, your parental rights will be terminated. Within two months, I had half of his money and a brand new apartment. I gave him the money, knowing he would not do any work without all of it. I made a good faith payment was what I called it. The first time I had ever heard him "bubbly", he called me and appointed me his paralegal. He said he would begin "making a file". For the next month, he had me collecting my own documents. The paralegal did nothing but sort them in an app. I accepted that because he didn't have to start at all ... I tried to get a loan for the rest of his money and got denied. The loan company stated I had "filed bankruptcy". A couple Fridays ago, I told Bernard how badly I wanted to get him his money but that it appeared that someone had filed bankruptcy in my name and that would prohibit me. I asked him to perform a nationwide search and told him I would pay him for his time. He obliged mentioning nothing of payment. He said he would do it the following Monday Monday morning rolled around and I woke up to a text, an email, and an app notification from his paralegal, demanding the rest of his money. I texted Bernard about it and he didn't respond. The week went by and I called his assistant to see what was up. I texted her on our group chat and also called his paralegal to no avail. Suddenly his assistant called me and apologized, stating that it was all a misunderstanding and the alerts take place every 2 weeks. She said Bernard could do my search for $750 as it would allow him 3 hours. He has 25 years of legal experience and I knew the search only takes minutes even for a beginner. It was a PRICE GAUGE. She assured me no more alerts would be made and we hung up. Funny thing is, I had never gotten the alerts in the MONTH I had worked with him. Not ONE...so if they were every two weeks, they would have alerted me at least once right? Plus, who charges someone almost A GRAND to perform a search when they are having issues getting the INITIAL money they owe to GET THEIR KID BACK. I asked for a refund last Saturday and havent gotten a single text, call, or email. I paid him $2000 to be his paralegal for a month and to be presented false hope that he was on my side. What do I think? Well, I think he is money hungry and unconcerned with your personal problems. I think he located the OC in this case and used the documents I collected for him to sell me out, making me think that ALL THE SUDDEN, he was willing to work for half the money, up front. I also think he tried to sucker the money he didn't get from my friend out of me....but who am I ... Just a paralegal in training, on the Dean's List in school, and a double major in Business.

Greetings to all 💝 I would like to share my experience with Attorney Brian Bernard. I had Mr. Bernard saved in my contacts from a relative in jail that asked me to reach out to him (Brian) in June 2024. About 1 month later my son went to jail and the attorney that I initially reached out to wanted to help for the "low-low" price of $7,500 for a Class "A" misdemeanor with an initial payment of $2,500😂. I sent Brian a text message wanting to know how much should a misdemeanor charge of that nature cost. I was bracing myself for impact of his response (because I am extra broke😂) but his response pleased me. The conversation of the photo is attached💝 Brian had my son out within hours. I was relieved because as parents we want our children to do the right thing and be ok. The day was nearing for me to fly out of town for work, so I was pleased and burden lifted. Moving forward to August 2024, my Aunt called me upset and stated her son went to jail and it would cost a lot of money for the bail bonds to get him released. I instantly said "Aunty call Brian, I am sure he can help and have him released the same day for a fair price💕 " She said text me his info and I will call him (In her still hurt tone). After my aunty called Brian, she called back telling me how excited she was and I could hear it in her soul💕 Then she told me some fun facts about Brian's career from their in person meet (I paid through CashApp😊 so we did not meet in person). My aunty kept thanking me. I said Aunty we Thank God for Mr. Brian Bernard. Names to me are very important because what we are called is what we are as well as what we respond to. For example My name is Jacqueline which means "May God Protect Her" and He definitely has throughout my whole entire life💝 Brian means: High, Noble, Honor and dignity Bernard means: Brave, Hardy and strong Now look at this fair man walk in his purpose according to who and what he is called.💗💖💝💓

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
