I found that I needed to revise my Will after some life changing events. I had two previous Wills drawn up but neither were as thorough or as detailed as the one that Attorney Bulkovitch did. She took the time to go over every legal aspect in detail with me and answered all of my questions and concerns. I also never felt rushed or pressured to make a hasty decision about issues that are very important to me . I highly recommend Attorney Bulkovitch for her outstanding , detailed and professional work!

My family and I are beyond grateful to have found this amazing attorney to put together our trust and will. Great location and very well appointed office. Communication was clear and consistent. Mr. Drapp always answered any questions or concerns we had guiding us through the process. Most importantly he never made us feel uncomfortable or judged when discussing sensitive family issues or how we want our memorial to be. Katie was also very welcoming and warm. Bonus stars ⭐️⭐️ for the beautifully detailed binder with tons of info should things change. 100% recommend.

I needed an elder care legal expert in the New Haven area. Because of my situation, I needed a timely response. I left messages with four different law firms after-hours. Mr. Stillman's office was the first response in the morning and within five minutes I was on the phone with Mr. Stillman who immediately provided his council and time to deal with the matter at hand. He created the necessary documents in the morning, met my mother at the Yale hospital that afternoon to obtain signature and returned the signed documents later the same day.

It's my pleasure to submit a positive review for attorney Dan Murphy. Dan brings integrity to his profession, something I suspect he demonstrates in his personal life as well. During my 13 month divorce, he continually coached me on the value of restraint, always concerned with how any action might be perceived should we head to trial. His patience, coupled with his relentless attention to detail, resulted in a positive outcome when my divorce turned from amicable to litigious. Dan successfully reduced my now ex-wife's settlement demand by 85%. Her lawyer tried an aggressive approach that Dan's experience and coolheadedness was able to navigate and resolve using the facts of our case. While I am grateful to settling only weeks before our trial, part of me wishes I could have seen Dan litigate -- his tenacity and willingness to fight on my behalf was a preview I got to glimpse during deposition. Thank you, Dan.

In order to buy or sell property in Connecticut, you must be represented by an attorney. My brother recently passed away, and because we live in Florida we didn't know where to turn for assistance. Our realtor provided us a list of three names, and Jim's was at the top of the list. I called Mr. Dougherty after having read reviews and visiting his website. It was immediately apparent in speaking with Jim, that he was exactly the kind of attorney that would make me feel well represented. Soft-spoken, extremely knowledgeable, and methodical in his approach, resulted in a very quick and stressless conclusion to the sale. James Dougherty is exactly the kind of attorney that will put you at ease, and remove any anxiety when in the position of requiring legal representation.

I was very fortunate to have Allison’s expertise in guiding me through the living will estate planning process, including updating my will and POA, after recently going through a life-altering situation. As a single mom, I was quite concerned about the impact to my children if something were to happen to me so it was important to have my affairs in order, and my mind at ease. Allison took the time to listen, offered great insight, and explained every step of the process in a clear and concise manner which allowed me to carefully think about the choices I needed to make now that could affect my children in the future. Allison was very patient, organized and knowledgeable. The office staff was professional, yet very kind, at all times. Everyone at Floman DePaola who assisted me during this process truly helped make a stressful undertaking seem less daunting.

We needed an attorney to review our elderly mother's estate planning documents, as they haven't been reviewed in almost 15 years. Allison, from the initial contact through the signing of new documents, was incredibly prompt in her responses, professional and extremely knowledgeable. She reviewed our paperwork at no cost, and then made some recommendations for us. We hired Allison to draft a Power of Attorney and a new Health Care Directive, as the laws have changed quite a bit over the past 10 years or so. The cost was very reasonable but more importantly, Allison's "bedside manner" with my mother was nothing short of fantastic. Sensitive to how this type of planning can affect some elderly people, Allison made it VERY easy for our mother to understand what she was signing and why. She showed compassion, understanding and above all, patience. Without question, I would recommend this attorney (and her staff) to anyone who needs estate planning or really any planning for that matter where a lawyer that actually knows law, is needed. We are thrilled to have found Allison, and we will use her from now on for any and all attorney/client needs.

I have known Attorney Knott since childhood so naturally I contacted him when I was having issues with family members using fraudulent POA documents to loot my Mother in-law. We had a great conversation, he sent me an email with certain information he needed from me and said he would file paperwork the following week. I have not heard from him since our initial conversation. I have left several e and voicemails with no reply. Meanwhile I have had to obtain new counsel and leave my loved one in financial jeopardy for 2 extra weeks because of false promises on the behalf of attorney Knott. The law firms website is like ordering from a fast food menu. Everything is monitized and it is impossible to get in touch with the attorney.

Andrew and his firm work their absolute hardest to deliver the best results for their clients. Attorney Andrew Knott is diligent, ethical, extremely competent in the work he does, and he does it with charisma. Robert Santoro, Esq. assisted on my case as well, and I extend the same compliments to him, as well as all other staff members who worked on our case. My mother and I had a rough time while our case was litigated for roughly two years. But there was always clear communication, transparency, honesty, and a sense of trustworthiness we were able to hold onto while the courts went through their motions. Lawsuits can turn a person into a basket case, and he handled all of our concerns with the utmost respect and patience. He was always very responsive and kept me informed of developments notwithstanding the added challenges of Covid and my being out of state. I met Nicole at a Continuing Ed seminar, where she presented on the topic of Estate Planning 101. Following a consultation, I hired her to set up a Trust for our estate. Every aspect of the planning and execution of the estate documents was methodically handled. Nicole, as well as the legal staff are professional, pleasant and accommodating. I'm confident our heirs are in good hands with Nicole and the law firm she represents. I've already recommended her to my friends.

We were purchasing a home, and Mary was referred to us. Throughout the process Mary was actively involved, paid attention to critical details and overall made the legal/contractual side of the home buying process very easy. An issue with our lender arose and Mary was quick to act as a calming influence to reassure us a solution was around the corner and indeed she had suggestions ready for our reference. Above all, Mary represented and protected our interests to a degree that we were wholelly satisfied and as a result for any legal issues in the future we will be giving Mary a call.

I had to have an updated will since it had been years and my situation had changed. Not only did Atty Miller do this to my specifications, she made sure I was covered for end of life health concerns and emergency life situations. On top of all that, I needed the update in a very short time. She delivered.

After a acute change in health status, we were referred to Lillian for estate planning. During a very difficult time, she and her office provided outstanding services in the area of estate planning, advanced directives, and wills. We can not thank her enough. As well, folks we have referred had a similar superb experience, and we will continue to recommend her and her staff to others.

Lillian Miller was recommended by a friend to do estate planning for me. She did a great job. She met with me and my two children, where we discussed our situation and our needs. She listened very well, and took the time to understand us. She asked many questions, so she could get a clearer picture of what I would like to accomplish and avoid in the event of my death or incapacitation. She spent a great deal of time explaining to us what our options were, and what advantages or disadvantages there would be depending on the choices that were made. She was prompt in returning phone calls or emails. Her fees were reasonable. I would highly recommend her as an estate planning attorney.

Gus Large has been our attorney for many years now. He was there at a most difficult time for our family. When dad passed on, Gus literally took care of everything, carefully explaining the probate process, and then seeing that all the required steps were done in a timely and efficient manner. Throughout this time, Gus advised and counseled our family as to what needed needed to be done - and then took care of it. This included all communications, legal documents, and meetings with principals involved. Gus carefully explained anything we needed to do, decide, or sign. Gus is a stand up guy, thoughtful, considerate and personable, and he never let us down. I highly recommend Gus Large as your best choice for a Wills, Estates, and Trusts Attorney, and for Estate Planning and Elder Law.

Due to the untimely death of one relative, I was thrust into a dual position of Estate Administrator and Conservator of an elderly second relative. Since this situation was all new to me I had to rely extensively on legal guidance. Attorney Alyson Marcuccio was exemplary in this regard. The situation with my relatives was somewhat complicated due to property title issues, asset identification, and interaction with the State over prior services provided by them to my deceased relative. Atty Marcuccio's knowledge of these issues was extensive and made what appeared to be a daunting task more than manageable. Furthermore, she was always available to be contacted either by phone or email and promptly and courteously returned messages. All required paperwork was promptly prepared and filed. Therefore, I wholeheartedly recommend the legal services of Attorney Alyson Marcuccio for any issue regarding Estate Planning or Probate.

Alyson is the best thing that could have happen to us in dealing with my minor son's estate. She has gone above and beyond my expectations. She has stood up for not just for my son's rights but also for mine as the natural guardian (mother). She has dealt with all aspects of this mess with the highest respect and regard. She is not in this for the money for she truly cares for the standings of a minor child. She has been on our case for almost three years and will continue to be to the end. My 13 year old son has been involved with what has been going on and one day after I got off the phone with Alyson my son said to me that he could not believe that someone like Alyson would really care about him. That really is something coming from the mouth of a babe as the saying goes. My son and I have been truly blessed with having Alyson as our lawyer.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
