Cares about clients and wants to get you a positive outcome without bankrupting you. I have learned that you can pretty much divide divorce attorneys into 2 categories: one group that simply wants to churn information back and forth between attorneys as well as between attorney and client in way that simply bills hours and accomplishes little until the 11th hour when it could have been settled in the first or second hour. And then there is a group, like Karen, that truly wants to problem solve, propose solutions, avoid litigation and get an outcome for her client that is both fair and reasonable in cost. Karen is honest, dedicated and she told me what I needed to hear rather than what I wanted to hear. I cannot recommend her highly enough. I was fortunate to have someone recommend her to me and, every time I mentioned her to someone in the legal community in Maryland (4x), the response from each attorney was overwhelmingly positive. If you are looking for someone who will be in your corner, fight for you, shoot straight with you(the good and the bad), look no further than Karen Amos.

He listened to me in full and talked me through the situation and some options that I had, even referring me to someone with different expertise who could also be of help to me. At no point, did he cut me off or try to sell me on his services, which I appreciated. Rather, he told me his opinion honestly and with good intent. I must say that The Taylor Firm is… to say the best and efficient in the judicial process of Baltimore City is an absolute understatement!!!! I was arrested held without bail. I’d hired the firm and within less than a month’s time, I was released without any bail review or court proceedings. As GOD as my witness… out of nowhere I was told to pack up!!!! Not to mention throughout the duration of this incarceration, the team was amazingly informative and empathetic. This firm is a firm that will go far and beyond to get the job done! They WILL work together to work for you. If you’d ask me to describe the Firm… I’d say I’d bet my bottom dollar on The Taylor Firm vs The Cochran Firm any day.

She provided me with the asset spreadsheet and specific instructions and guided me through the entire process. In addition, Iryna gave me a gift of 1year Docubank membership that will provide hospitals with quick and easy access to my healthcare directives and my vital contact information in the case of emergency. I would highly recommend Joseph Mathis to anyone considering an attorney for a matter. Period. I have been a paralegal for the past 25 years in Washington state, but lacked a referral from any sources to handle the probate of my stepmother in Maryland. I found Mr. Mathis just as you are doing now by reading his reviews on AVVO. I was compelled by the online review to contact him and I was not disappointed in any area of representation. My case involved the probate of my stepmother’s estate. My father pre-deceased my stepmother, but my father’s estate was not probated based on the assumption that my stepmother would “do the right thing” by my father. This was my father’s third wife, but he also had been married to her for over 30 years. She had no children of her own, her parents had pre-deceased her and she was estranged from her sister for over a decade, if not longer. My step-mother did sign a will within months of my father’s passing that accomplished doing the “right thing”, however, due to either her severe alcoholism or undue pressure/influence from “friends”, she changed her will to exclude all three of my father’s children and leave her estate to three of her “friends”. Two of these friends hadn’t been part of her life for over five years and one of them was my father’s friend who she had been “dating” after my father’s passing. After she passed away, we discovered that my stepmother’s alcoholism was more severe than anyone thought it to be. It was on this fact that I pursued investigating a will contest, aka caveat proceeding, with Mr. Mathis. Based upon my stepmother’s severe change in behavior, her self-isolation, and new discovered high level of alcoholism, I truly believed that my stepmother was not in her right state of mind when she signed the second will. . In addition to my stepmother signing the new will two years after my father’s passing and 4 years before she passed, we were told by her attorney that she had sent a letter to him that stated that none of her deceased husband’s family were to inherit from her estate. In the end the land my grandfather gifted to my father in the early 70s (pre-marriage to my step-mother) where he and my father built the only home my father’s children knew, and the only piece of land my father grew up on from age 12, was sold and the proceeds split between “friends”. I was forced to purchase a few of my father’s guns from my stepmother’s estate. I found out about the auction of my father’s items the morning of the auction. Obviously, I couldn’t get to Gettysburg from the West Coast in time. I emailed and called Mr. Mathis’ office at 6:00 am (PST) and Mr. Mathis called the personal representative’s attorney to see about stopping the auction or what options might be available to us. There was nothing I could do but bid on my father’s property. I called Mr. Mathis in tears this day to tell him how things went. I had to leave him a message with my crying voice. He was so kind, he called me after hours to see how I was doing. All of this hurt my heart wickedly, but I cannot say enough positive things about Mr. Mathis’ handling of this case. When we discovered the letter plus the new will of my step-mother, Mr. Mathis was very honest with me about worrying about the amount of money it might take to fight the will with this new information plus the probability of not being able to “win”. Mr. Mathis could have simply told me a retainer amount and taken my money, however, he admitted he was concerned about the costs versus the probability of winning. This is the mark of a truly great attorney. Based on my experience, a great attorney is more concerned about the negative affect on his/her client’s versus being paid a fee in a probable no win situation. I recommend Mr. Mathis for any legal matter you seek counsel on without any reservation!!!

I strongly disagree with reviews that dismiss Felinton Elder Law as a sales scam. For the past five years, Mindy has worked with three generations of my family on many elder-related issues such as wills, POA's, health-related documents, and, especially, various types of estate planning trusts. Elder care legal considerations are, by their very nature, complex, time-consuming, and expensive. Through all of our interactions, Mindy has balanced the professional and the personal, more than once going our of her way to make last-minute personal accommodations and document changes necessary for our peace of mind. She has gotten to know our entire family: from my late father, to my wife and myself, and now our sons. (And yes, we all enjoy the warm reception her office staff and her canine companions Scruffy and Princess provide at each appointment.) So, if you are looking for quick, cheap elder-related legal packages that promise the world, look to the Internet for shake-and-bake, cut-rate legal advice of dubious value. That's where you will find your scams! Otherwise, if you are ready to be realistic about the hard, emotionally charged work of end-of-life considerations, Felinton Elder Law, with its years of experience, is the real thing.

Roger will take the time to walk you through the process of an appeal to see if it's worth your time and resources. He and his network of former staff attorneys from the Court of Appeals and Supreme Court taught me that strict compliance with the rule of law is necessary or you will waste your time and resources. This means that the record must be cited accurately, facts must be taken from the record and you must comply with all the rules. Judges do not want to be overturned. Randle & Randle are exceptional! I hired Randle & Randle to represent me in an EEO case because of their vast expertise and years of experience supporting government employees and their reputation for fighting to get the best outcome for their clients. I was very glad I did. I was treated with first class service by Mr. and Mrs. Randle and their staff. Mrs. Randle, as my lead attorney, provided me with sound legal counsel that included full and clear explanations on the application of EEO law and my case options. She was very sympathetic and understood my personal struggle fighting harassment. Being on the point for my case, she was a fierce and professional negotiator with the agency lawyers and she demonstrated a greater level of skill compared to her counterparts. I found the value of their services I received compared to the fees I paid to be a tremendous value especially when she achieved a timely and better outcome of my case than it looked like to me when I hired them. I sure hope I will never experience harassment again, but if I do I will certainly turn to Randle & Randle again! Thank you always

Mr. Davis has worked with me three separate times. He prepared my Will and all those papers you have to have now days - the Power of Attorney and Living Will, financial papers and on and on. My head was swimming. He spent a lot of time with me and made it as painless as possible. It's not fun making a Will. The second time I worked with him, he handled the probate of my father's estate. The third time was the probate of my mother's estate. He was kindness, itself, both times. It's never easy when a parent dies yet he was able to be comforting as well as helpful. He spent more time with me than he probably should have and made sure I understood everything that was happening with the estates. I highly recommend him to anyone with elder law concerns. He leaves no stone unturned and makes sure you, the client, understand and are aware of the ins and outs of the legal stuff older people have to deal with. (His assistant, Michelle, is great, too.)

Shannon Hammond did an excellent job for my parents. Her expertise was/is so impressive. Originally, we went to a lawyer in Rockville who didn't do anything and yet charged my parents $3,500. I witnessed the initial experience with both lawyers. On our first meeting Shannon Hammond spent over 2 hours asking questions and with the information created an excel spreadsheet - the information was unique to my parents' situation. One month prior to meeting Shannon Hammond we met with a Rockville lawyer who spent 1/2 hour with us; we knew nothing when we left her office. The Rockville lawyer directed me to provide all information to her; her paralegal filled in an already issued template from the information I provided which took me over a week to gather. The Rockville lawyer did not create anything original (it was a template) whereas Shannon Hammond created the unique excel spreadsheet that pertained directly to my parents' situation. The Rockville lawyer rushed through whatever information she was trying to provide us whereas Shannon Hammond took so much time that even my mother understood what she was presenting to us. My parents will continue to use Shannon Hammond as will the rest of my family. I have already recommended Shannon to friends who will be using her in the future. She's the best and I cannot say enough great things about her especially since I had experienced a horrible lawyer prior to meeting Shannon. Shannon Hammond respects all who speak to her unlike the Rockville lawyer who was always too busy to take calls, etc. I highly recommend using Shannon Hammond for any elder care services but especially if applying for Medicaid.

I can’t say enough good about Brian. Brian helped us with a petition to sell in lieu of partition case. Usually trust and lawyer aren’t used in the same sentence but in this case it is. We trust this lawyer. He’s honest, reliable and on top of his game. He an expert in estate law, knows the players and his advice is sound. He’s aims to solve issue quickly rather than drag them out unnecessarily like other lawyers do. Every time we’ve needed him, he is ALWAYS been there. He responds quickly to phone calls or email. His experience and wisdom have saved us a ton of money. On top of that he’s just a really nice guy and easy to talk to.

Bill is very professional, and responsive. Made appointment to meet us very quickly, told us to bring all related documents, discussed the situation with us throughly and patiently. Showed high professionalism during the trial, quoted from a number of law sections, making strong arguments based on the facts and helped defending us and won the trial. We couldn’t be more happier! The fact that he did his research before the trial and came fully prepared, is what mattered to us most! We thank him for his time and highly recommend working with him!

Several years ago, my mother hired Mr. Gatesman to do a Medicaid plan for my father who was entering a nursing home. When my father’s condition suddenly got worse, Mr. Gatesman quickly changed gears, and through his fast action, all of my parents’ assets ended up in a trust under my father’s will. When she needed to move into a retirement community, he came up with a way to secure a mortgage using trust assets to secure a loan on her residence, then converting it into a rental unit that provided my mother both income and secure support through trust assets. The trust allowed my mother to continue living as she always had been living, but when she too needed nursing home care, none of the assets in the trust had to be used to pay for her care. Mr. Gatesman then guided me through the baffling process of obtaining Medicaid benefits to pay my mother’s nursing home costs. This was a daunting journey, but his attention and direction to the actions that needed to be taken made the journey successful. With Mr. Gatesman’s guidance, my parents were able to preserve all of their assets, including their home. I am very pleased with Mr. Gatesman’s representation and I highly recommend his services to others.

I needed my Advanced Health Care Directive, Durable Power of Attorney, Will and the Deed of Trust for my house redone. At the initial consultation in Pasadena, Veronica listened to my needs and questions. Then explained what needed to be done in terms I could understand and informed me of the cost. No mystery on pricing! When I went home I felt confident Frame & Frame team was the right choice and in a few weeks it was all accomplished.

We knew we needed a will or trust because we aren’t getting younger! Having no experience with attorneys, we chose Frame and Frame online because they had a local office. Veronica Zoberbier became our attorney. We were full of questions and Veronica was personable, patient, and thorough, explaining things so that we could make good decisions. She made us feel confident. We had virtual meetings, whenever needed. We met Tara at the signing, and she was wonderful, too! The office staff was courteous and efficient. All things considered, I wouldn’t hesitate to recommend Frame and Frame to friends and family.

I highly recommend legal services for Estates and Will that the law office of Cheri P. Wendt-Taczak provide. Ms. Wendt-Taczak and her team were professional, knowledgeable and rendered exceptional services. Her attention to detail and willingness to accommodate my parent, whom are native Spanish-speakers was amazing. Ms. Melissa Smith, her paralegal, went above and beyond by continuously following-up and verifying that we received all documentation for review and approval. Ms. Wendt-Taczak and Ms. Smith were very friendly, understanding and truly care about their work.

As a result of the excellent legal advice, guidance, empathy and compassion I received from Kimberly Battaglia and her paralegal, Ricky, I was able to obtain the 24/7 nursing care my mother was in desperate need of within a few short months. This may sound "routine" but it certainly is not. Our family of numerous siblings had tried and failed for four years to provide needed care for Mom at home while trying to cut through the legal, financial & government red tape of Medicare & Medicaid on our own. Without adequate knowledge, this proved to be one of the most time consuming and frustrating experiences of our lives. The ongoing & overwhelming stress was destroying our family from within. From the outset, Kim & Ricky assured me they would help us obtain the quality care we were seeking for Mom and just as importantly, relieve our family of the huge financial burden, and yes fear, of what we faced without obtaining Medicaid approval. Kim successfully accomplished all she had promised. Without Kim's concern and expert legal guidance, my lifetime retirement savings would have been lost in order to pay for private nursing care for Mom. Do yourself and your family a favor by retaining Kim to lead you out of the legal elder care wilderness and into the sunshine of peace of mind, relief and happiness that comes with knowing your loved one is being properly cared for while also protecting you from certain financial disaster.

With Ms. Battaglia's assistance I was able to successfully apply for Long Term Care Medical Assistance for my father back in February 2011. I was also able to allocate my father's income to my mother, which was truly the best part of the plan Ms. Battaglia laid out for me. Now my father is being taken care of at the care facility and my mother can still maintain her lifestyle at home. We also worked with a paralegal who helped coordinate the information Ms. Battaglia needed to process the application for benefits. They worked together as a team, which helped to keep the costs down. The entire process went very smoothly and the cost for all of the legal services were less than one month of paying the facility privately!

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
