Ryan is knowledgeable and a good communicator. I was Executor for a family member whose estate was being probated in another state. Ryan's guidance was very helpful regarding a time sensitive and frustrating situation with that process. If it had been a Minnesota case where Ryan handles probate cases, I would have definitely hired him. Being an Executor is very stressful. I would have appreciated working with him. He is easy to talk with and I trusted his experience in probate matters. His firm also coordinates the legal and tax filings for an estate which would have been wonderful. He helped make a tough situation easier.

Jane handled all of our estate documents including will, living will, healthcare directives, etc. This was in preparation for the guardianship of our son. We have also used her for some business advice. Everything was done professionally and she made sure to take time with us to ensure that we understood the information she was providing. If Jane doesn't have the exact information you need, she works very hard to get that information and explain it in terms that everyone can understand.

Where to even start, I just want to scream THANK YOU to Katie for everything you’ve done for my life and my family. Because of you I am able to finally rebuild a relationship with my son again. For that I am forever grateful. Katie is by far THE best family attorney in Duluth, she actually cares about the people she works with. She treats me like a human and not just a “client” She has went way above and beyond for me as her client and that is a trait you don’t find often in attorneys. Honestly, I suggest you book her now before the prices go up because I promise you one day Schwandt Law will be the biggest firm in Duluth Minnesota. 💯

I can't say enough good things about Alexander M. Landreville. He helped me through one of the most challenging times in my life – my child custody case. Thanks to his hard work and expertise, my ex-wife and I were able to come to an agreement through mediation, and now, I have the incredible opportunity to see my son regularly. Alexander M. Landreville was always professional, compassionate, and available to answer any questions. His knowledge of family law is top-notch, and he fought for my rights every step of the way. I am forever grateful to him for giving me the chance to rebuild my relationship with my son. I highly recommend him to anyone facing a family law battle!

As an attendee of a course on conciliation (25 April '24) led by Katie Schwandt, I came away extremely happy with not only the amount of ground she covered in a short period of time, but also the way she made time to make certain the material was helpful as well as understood. She was obviously enthusiastic about her subject and made potentially difficult to understand legal material very approachable. Highly recommend reaching out to her. Thanks so much Katie.

Recently had a custody and child support battle with the mother of my nine year old daughter. As biased as Minnesota Courts are against fathers, I went into this battle very discouraged already. Derk Schweiger was amazing in court, and I felt that because of his professional demeanor, articulateness, and sheer brilliance in court, the judge was able to see where I was coming from, and my life situation, my desire to better myself as a man, and my desire to be a father. The judgment was more than fair, and I was very happy that I chose Derk to be my lawyer. I have referred him to several people, and if need be, I will definitely call upon him again. He was professional, organized, clever, and not as expensive as other lawyers in the metro area. Thanks again! -Ryan Wagner

Beau has served as my attorney. I have nothing but great things to say about his skills as a lawyer, his professionalism and his empathy. Although my matter was a relatively small one, he made me feel like I was his only client. I knew he was incredibly busy with other cases, but I was always a priority. His knowledge of the law and his willingness to go to bat for me really resonated. I am still grateful for his services and would recommend him to anyone with a legal issue large or small.

Needed some planning done and documents written up so went off a friend's recommendation and met with Kelly Corbin. She was so kind and made the whole process very easy. She was compassionate, honest and very thorough and I felt she was genuinely interested in getting every detail necessary. I was so impressed that I recommended her to my Mom for some Estate matters and she was equally impressed with Kelly. Mom has met with several estate planning lawyers over the years and she said Kelly was by far the most knowledgeable and personable one she's met. I will definitely seek out her help when my husband and I do our estate planning in the near future. If you're on the fence, just call and ask to make an appointment with Kelly Corbin. You'll be in good hands with her!

Dear Ryan, I wanted to take a moment to express my deepest gratitude for all that Ryan has done to help me not only to win a case but also helped me understand the justice system. His unwavering dedication and commitment to my defense have made a profound difference/impact in my life. Throughout the entire process, Ryan was always available to answer my questions and address any concerns I had, no matter how small. His patience and clarity in explaining the intricacies of the justice system in a way that made the most sense to me helped ease my anxiety and kept me informed every step of the way. In addition to keeping me in the loop he was also very very honest about everything in and of the process. What truly stood out to me was how far he went to find the evidence we needed. He is very determined and his diligence proved to be the key to our success. He was also very professional, and compassionate about his work and finding a solution best suited for our case. I will forever be thankful for the way that he stood by me during such a challenging time. My family and I are beyond grateful for the help and kind gesture he showed us. Thank you again Ryan, for your remarkable efforts. I feel incredibly fortunate to have had you by my side.

I recently had my Will completed by Ron Walters of Willwright Estate Planning. I found Ron to be professional & knowledgeable & was so impressed that he also was willing to give me advice & help me resolve another legal issue that arose right after my will was complete. He has streamlined his process to minimize how much he bills his clients & provides a choice of several locations to meet with him which is convenient. Ron is easy to communicate with, takes extra care to ensure that you understand the process, & is ethical. His focus is to provide quality service at an affordable price. Despite their website stating they handle cases that include Economical Damages that include, -Lost wages from missed time at work -Loss of earning capacity -Property damage, such as damage to your vehicle in the crash And Non-Economic Damages that include, -Emotional issues (stress, anxiety, depression, post-traumatic stress, etc.) -Humiliation I guess, according to the representative I spoke to, that information is false. I wasnt even given a chance to speak to a lawyer despite mentioning them being listed on their website. She was just rude and repeated her statement. If you're looking for a lawyer regarding those damages, don't bother calling these guys. You'll only get frustrated.

We contacted Ben to set up a trust / guardianship for our daughter and do a will and trust for my husband and I. After meeting with him three times, he completely ghosted us. No return calls or emails. Nice guy, not sure I’d recommend him.

Keaton Ostir, Attorney worked on a challenging car accident case for me. He went above and beyond what I initially expected. He was fantastic, staying in close communication with me throughout the entire process. Keaton fought for a good result. I can confidently say that I would use his services again and recommend him to anyone dealing with personal injury. I am truly grateful to Keaton for all his hard work.

Mr Matthew’s was absolutely great to work with. His knowledge of estate planning is impeccable. He explained the planning in lay man’s term and even was witty and humorous in doing so. I would not hesitate to reach out and use his knowledge and experience for future planning. The overall experience was like sitting down with family.

I attended one of Ed's free informational seminars and was very impressed with his knowledge and professionalism. He explained the details of a trust and the benefits of having a trust clearly. My wife and I immediately made a decision to start the process with him by scheduling a private meeting. Just as I expected everything went smoothly and we moved forwarded with the process. Now we feel secure and confident with the estate plan he helped us develop. Thank you Ed!

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
