After attending a seminar on Elder Law, my husband & I decided that we needed to acquire further information for our family. We made an appointment with Keith Stevens to assist us with this task. He is an extremely professional attorney, that is personable, and has great attention to details. He provided excellent explanations and questions were always welcomed. He is an attorney that you can depend on to give you that added extra security that is important to you and your family, especially when dealing with the sensitive topic of Elder Law.

Keith was a professional but very understanding. It did not matter how many questions we asked he would take the time to explain them and even put it up on the dry erase board to help us understand. Responded very well. He was polite, very knowledgeable and made sure we were following what he was explaining. I would definitely and have already recommend Keith to our family and friends. Thanks Keith

There are no words to express our appreciation for Lindsay. She helped at a time when we had issues going on with both our parents. Our Dad had dementia. It made it very difficult getting him to understand about the Medical POA, Living Will, etc...Lindsay was very patient going over everything until she knew he understood about all the documents. She also fit us in to take care of this without an appt. (what lawyer have you ever heard of would do that). Someone who has dementia you never know what the day will bring. If Lindsay hadn't been so understanding what happened next would have been unbearable. Our father broke his hip, had surgery, went into a home and died two days before Christmas. Just 2 weeks after everything had been completed. We were able to make the right medical decisions for him, pay his bills, etc... without any additional stress. In regards to our Mother. I had taken upon myself to get my mom on Medicaid in 2010. Not realizing that we would lose an additional 50,000. All because I wasn't informed about what documents I would need to protect my parents and future generations. I even used a regular lawyer to write my dad's will. All of which was a bad idea. Someone I knew mentioned using an Elder Lawyer and recommended Lindsay. Which I am forever grateful for. Lindsay takes care of making sure my mom stays on Medicaid every year. She made sure we had the right Will for my dad so that when he passed. My mom wouldn't be kicked off of Medicaid. She is also helping us take care of Probate, etc...for my dad. Taking a huge burden off my family. We tell everyone we know that is taking care of their parents. Don't make the mistakes we did. Go To Lindsay Graves and she will protect you and their parents.

I worked with Lindsay beginning three and a half years ago, when my mother was diagnosed first with cancer, through present when she suffered a debilitating stroke. None of my mother's legal affairs were in order, and I had no idea where to start on figuring things out. With Lindsay's help, we were able to retire my mother from her job, secure her insurance and property, and ultimately find a wonderful nursing home where she's receiving top-notch care. I can't say enough about how willing Lindsay was to take the time to answer all my questions, big and small...with a big dose of compassion too.

John Grundy was highly recommended to us by an Ohio attorney to prepare a Certificate of Trust and various documents for my mother aged 91. We live in San Diego with my mother living in Ohio. John agreed to meet with us when my wife and I were visiting which happened to be on a holiday. He was exceptionally well prepared and we methodically reviewed each document in its entirety with John and his assistant. All our questions or concerns were addressed to our complete satisfaction. John certainly demonstrated a mastery of professional skills and knowledge. It was obvious when we met, that his years of experience would be beneficial in accurately completing all documents to our complete satisfaction. Ron was hired by our family in 2005 after the untimely death of our father. With assets in Florida and Ohio, and virtually no estate planning beyond a simple will, we needed a firm that we could trust to help my mother immediately and my brothers and sisters longer term to determine how to proceed with an estate plan. Ron and his team were very helpful to help us with practical advice and options. They educated each of us every step of the way on the ins and outs of estate and probate law and how to organize a trust for the estate. And with offices in both Florida and Ohio, they were able to help us meet each state's probate requirements. With Ron's expertise and experience, we were able to develop a plan we were well prepared for my mother's passing in 2008 and we as a family came together. In fact, ten years later, we are still all together due to how well Ron helped prepare us for an effective estate plan. Thanks Ron and your team!!

Top notch business, estate lawyer and CPA. He introduced me to attorney David Moening of his office. He changed the name on a power of attorney, and changed the name on a health care power of attorney . This was changed since my children were minors when I made my will. He prepared a declaration for funeral arrangement, and gave me three clean copies of everything. He spent several hours with me at the initial meeting and the execution meeting knowledgeable staff . Corryn has been so kind and understanding with all that's been happening with my parents and their health issues. She is so accommodating with our crazy work schedules and very patient when explaining the legal parts of how a family trust works. She is very compassionate when dealing with both my parents and helping them understand how a trust works for them and the care that they require. It's also very comforting to know that she is a RN and can give advice or explain some of the health care involved with my parents care. At the time, all I was going through seemed like a fog which would never lift, but Gwen made it all clear for me, and fought hard to get me what I not only desperately needed, but believe my husband really wanted the end result and probably more. What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
