I recently had the pleasure of working with the Law Offices of Carol Bertsch, and I can't recommend them highly enough. Our attorney, Autumn, was outstanding. Her exemplary knowledge of the law was matched only by her kindness and compassion throughout the process. She truly went above and beyond to ensure we felt supported and informed every step of the way. The entire team was professional and attentive, making a potentially stressful situation much easier to navigate. If you're in need of an elder care attorney, I highly recommend the Law Offices of Carol Bertsch—you won't be disappointed.

Following the unexpected death of a friend, I consulted Carol to assist me with managing the estate and Probate. The complicated process was made easier and the staff walked me through the process to the final filing. During the grief process, it was comforting to have the professional guidance to manage the legal issues which resulted. We were so appreciative, that my wife and I have used Carol to put together our final Will and end of life documents. Now my family will have the benefit of a much smoother process when we die. Thanks, Carol.

Edited. I've still never been there. I still get asked by Google for a review almost daily. Hopefully, this edited post will stop Googles inquiries. Please know that despite Mr McKinney's present overwhelming situation, he took the time to respond to me on Google and with an email. He even sent me references for my case since he was not taking on any more new clients. NOW that's a lawyer with integrity!! And if you have his office retained, then be blessed for him representing you.

Dawn took my case after court proceedings had begun (Rare I am told) and yielded the results I had previously offered my former spouse which was iaw Texas law and countless unimaginable amounts of money saved a based upon allegations. She is composed, articulate, knowledgeable and represented me in the fight of my life in a commanding manner at my side. Recommended to all military members staring this misfortune but the potential blindsided consequence of not having a military specialist in your corner could easily leave you homeless and still needing to work in that same transient situation. She was gracious and affordable while helping me keep some of my retired SVC dignity. I Cannot recommend her any more strongly but the representation is A MUST. It is the rest of your life. The sweat of your work will go to someone else (ex) for being supported by you for your career even if they chose to not invest in one of their own, as they are achievable through the multiple transfers. How much is what you are fighting to protect, along with equal award of debt, assets, and the potentially unproven, misclaimed allegations misleading to the court if not for money, to affect the children, if any. Don't start or go any part of it without representation.

Dawn was my divorce attorney from 2015 - 2016. My divorce was nasty and drawn out because of my ex-husband, and Dawn handled everything professionally, and in a timely manner. In 2018 I needed geographical restrictions lifted, so I hired Dawn for that process as well. Once again, Dawn went above and beyond for me! Her staff was amazing as well. I highly recommend Dawn; she and her staff do a stellar job!

The first two reviews you see here are from two vindictive mothers, trying to keep children away from the fathers. If you want fairness justice, abd somebody who will actually fight for you. Hire her she will not let you lie you cannot make up lies. You cannot be vindictive. She will help you down to the bottom. Another lawyer practically stole my money and I ended up with L Gavito. At first I thought she was rude with how short she kept phone calls and I was getting and thinking my case is just another pile for her. Nope she called me out nowhere to me to go get my kids for the spring break. She will work on your case even when you think she is not. LET HER COOK as they say. I’m 3 Months into my custody against a spiteful person. I wish I hired Gavito from the start. She CARES

In my opinion, there's no one better. I've hired several attorneys due to custody issues for my son. Her office was the most efficient, informative, pleasant, empathetic staff I've ever worked with. Going to court is never a positive experience, but Ana Hessbrook's practice made me comfortable, prepared, and confident. She was communicative and very good at returning calls and emails. She helped me win rights for my child that I had fought for over 7 years. I found her courtroom demeanor to be cool, confident, assertive, and very well versed in the Texas Family Code Laws and the Judicial practice. She doesn't get pushed around like some other attorneys. I wouldn't go to court in Texas with anyone else for a family law case. I am very satisfied and highly recommend her competent services because she wins cases.

I met this attorney and what she told me was that she does not take a case that she cannot win. The beginning was fine, there was active communication, then radio silence. I sent numerous emails and made several phone calls. The administrative assistant said she couldn't track her down, was unavailable, was out of the office etc (that's how many times I'd called). I asked to speak with another member of the team, and did not receive a phone call or e-mail back from them either. She even set up appointments that she missed. I have paid this attorney a few thousand dollars and NOTHING! If you would like an attorney that will call you back, please do not have her represent you. I definitely suggest do your research before hiring any attorney. Especially this one!

He seemed to be oblivious to my case issues. Said he didn't like computers and failed to read my emails. (I was out-of-state due to a dying parent). He relied on me doing all research. His sole contribution was asking if my ex-husband was related to an unknown someone who shared an extremely common last name with us. He did not follow up on info that I gave him. Charged me for attempts to call my home phone in Texas when I'd clearly informed him that I was in another state. He was unprepared, inept and more interested in discussing football than my settlement. He cited financial data that wasn't even applicable to either of us... was acting very confused. He tried to be more than a little chummy with my ex during this process. In addition, the attorney for my ex-husband declared he'd been extremely lax at responding to her communications. The divorce was not especially contentious and there were no custody issues, yet it took almost two years to be final. Paperwork was incomplete, omitting important points we'd agreed on in mediation such as my request to resume using my maiden name and the refinancing of the mortgage. He had the gall to say he'd file for that separately. Expensive exasperating muddling.

Slow, dim-witted and ponderous - he missed a significant point of law that had changed in the previous year which was crucial during the middle of an all day mediation session. While his staff is good, and he is responsive, I would not consider using him again. While he won't engage in useless letters and bulldog tactics to run up billable hours, don't expect him to represent your interests very well either. You will need to hound him to bring up points on your behalf.

Mr. Valdez has no business holding a Texas bar license to practice any kind of law whatsoever. I have submitted a formal complaint/grievance to the state bar. He was a court appointed lawyer for a case i had in county court 186 in S.A. He missed completely more than one court appointment. A judge during his absence asked the court clerks in a scheduled appointment "is this the same Jerry Valdez that always shows up late if at all ? ". The clerk simply nodded and said "yes your honor". That's to say he has a well established reputation for being tardy and even absent from scheduled court proceedings. Do not for any reason hire this man. He is a crook, a lier, and has no business practicing law in Texas or any other state for that matter. I will work tirelessly to have him disbarred as he is a detriment to legal community as a whole.

This guy was horrible. He failed to get protective order in timely fashion or meet with me and tried to convince me of splitting my son 50/50 after the father abandoned, stalked, harassed, and was mentally unstable. He then said he needed an extra $7k retainer on top of $2.5k he already received. I fired him the next day and he refused to give any of the 7k back nor did he provide a single invoice. He didn't seem to really work on the details of my case until the very day of mediation. Prior to that, he forgot about our meetings that didnt involve his payment and wasn't prepared for them which left us discussing the exact same things we had already discussed; yet, he had no problem charging me for that meeting and thensome. During one meeting (in which I paid him more $) he yelled and threw papers at me when he got upset that I wouldn't just agree with his point of view of how I should just forget about getting things that the mediated contract noted should have occurred. Yes, I know that complaining about paper being thrown at me sounds silly because it was merely paper, but it should not have happened in the first place. I never felt like he was "on my side" and his advice during mediation was just to give into what the other side demanded since it'll cost more $ in the long run...but that didn't stop him from charging me more than $3,000 after that! Very unprofessional! It'll be a waste of YOUR time and money.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
