My parents have had Ms. McLamb as their attorney since the mid nineties and she probated their estates. My parents said many times that they could not have done it without her assistance and expertise. Now Ms. McLamb is helping me with trust administration. I am so thankful to be in good hands!

My experience with Kendall Page was nothing short of excellent. I worked with Kendall on Estate and Will planning. She listened carefully to my wishes and then crafted documents that precisely mirrored my needs. She was very knowledgeable and offered well-reasoned and substantive suggestions. She was flexible about appointment times and her staff was always helpful and professional. I would engage her again without hesitation.

Kendall and her staff have managed our real estate transactions for years. We have bought and sold several properties through her firm as well as refinanced many times. She and her office are always very professional, thorough and takes the time to explain every part of the process. Kendall Page is an incredibly knowledgeable attorney. I have used Kendall for my personal real estate transactions, and have recommended her to my family members as well as numerous clients over the last decade. I have always found Kendall to be incredibly responsive, patient, thoughtful, conscientious, and an all around solid, trusted source for all my real estate inquiries and needs. She is generous with her time, whether it's taking a call from me and answering a question I may have, or that from a first time home buyer who is nervous and new to the process, or clients who haven't bought or sold a home in 30 years. Kendall makes a point of never rushing through a closing. She is very good at stopping along the way to make sure her clients are comfortable and well informed. I have worked with a number of real estate closing attorneys in our area over the course of my 11 year real estate career and Kendall stands out from the rest. I give Kendall Page my highest recommendation.

Rob was amazing! After wasting 8 months (and a lot of money!) with another attorney, I sat down with Rob and in an hour he laid out a plan to resolve my personal divorce. Even better, he was then able to communicate the plan to my ex-husband in such a way that he and his attorney started working with us cooperatively. Rob did more in two hours than the other attorneys did in 8 months. I wish I had found him sooner!

"Dear Mr. Maitland, Thank you for seeing us today about our family-owned beach house and the increasing burdens that joint ownership involving my three children and me has caused us. I can't tell you how helpful it is to have talked this through with you, and have our options presented clearly devoid of all the emotional weight that can't help but cloud each of our own family associations with the cottage. Thank you especially for the empathy and care you gave to our overall well-being and the longer-term considerations attendant on this decision for me as I approach my seventies -- I hadn't really acknowledged my own inadequate financial situation, but I do now and appreciate your concern, wisdom, and decency." I couldn't be happier with the experience of putting my trust together with Duffy Palmer’s firm. I found the firm to be knowledgeable, responsive, professional, and thorough. His firm answered all of my questions promptly and anticipated most of them. Although trusts can be complicated the firm process and knowledge crisply led me through the steps while addressing my specific needs. I never felt rushed as I determined our best options. Duffy Palmer was the attorney but the support staff all contributed to the effort. The trust process doesn't end with writing documents. The funding phase where your legal entities are transferred to the trust was also clearly defined. I was provided a package with detailed instructions, forms, and a discussion to answer any questions. I thought the price was fair for the amount of work performed and would strongly recommend Duffy Palmer for any of his service offerings.

I engaged Duffy Palmer to prepare my estate plan after attending his estate planning seminar held at Manning’s Restaurant in April 2019. I was very impressed by his professionalism, breadth of knowledge, ability to answer the attendees’ questions, and pleasant and friendly demeanor. During our initial conference, he explained all aspects of the plan which was tailored to my specific financial needs, and made plenty of time available for addressing my questions and concerns. Everything we discussed was in clear, easy to understand language. He drafted the documents promptly, and after incorporating some minor changes, we met again for review and sign-off. In our final meeting, he turned over the completed official plan in a binder, and went over the additional steps I would need to take to complete the process, all of which were clearly documented in a checklist included in the package. I also reached out to Duffy recently for advice on purchasing a long-term care policy. He researched and provided me with very thorough responses to my questions about how tax-qualified and partnership long- term care benefits are addressed in North Carolina estate and Medicaid law, and his advice was instrumental in my decision on which type of policy to obtain. Duffy has impressive expertise in estate law and is extremely pleasant to work with. I highly recommend his services.

Amy Cagle helped my husband and I navigate what I was anticipating would be a long, confusing, time consuming and complicated process with efficiency and ease. This was relieving for me especially because we chose to take care of our estate at a time when I was pregnant with #3, already tired 100% of the time and with a brain that was functioning at 10% capacity. She is professional, knowledgeable, kind, funny, logical and makes the entire estate planning process approachable. My parents also had an incredibly positive experience with Amy and we have recommended her many times to others looking for estate planning services. Thank you, Amy! 😊

A good friend recommended Amy Cagle for creating a trust, will, and Durable Power of Attorney. I worked with Amy and I couldn’t have been more pleased. She’s knowledgeable, bright, professional, funny, and thoughtful. Plus she pointed out a way I could save money by informing me that I didn’t need a new Medical Power of Attorney, that my previous one was fine. She said something similar to friends I referred to her. To me they said that she was honest and refreshing; they had the feeling that she was interested in helping them, not out for every last nickel. My cost was half the price of another attorney I had previously interviewed for this work. A close friend who is an attorney accompanied me to the meetings with Amy. He, too, was impressed. I’m picky about choosing professionals to help me, but once I find a good one, and she is that, I stay. And I recommend.

Mr Suczynski assisted me in a student conduct case in which medical services were called to assist another student. Despite medical amnesty being in place, myself and another student received conduct cases despite doing nothing wrong. Mr Suczynski used his connections and relationships with the school to get the cases of myself and the other student entirely dismissed to which I didn’t even have to attend the conduct meeting. Matthew Charles Law is great for cases beyond being defense lawyers and excel even in situations such as student conduct. Couldn’t thank them enough!

We reached out to attorney, Robert Maitland, for the very first time, regarding a very stressful, time-sensitive, provider related conflict on a major home renovation. A huge 40-piece cabinet order was to be delivered the following day but the day before the already weeks late delivery was to happen, we received unacceptable demands for payment by the supplier who threatened refusal to deliver the following day unless their unreasonable demands were met.The cabinets had already been delayed for weeks and needless to say we were frustrated and anxious about the job slow down. Even though the firm’s appointment booking system only provided one single 30-minute consultation, Mr. Maitland not only took his time, prior to our consult, to review our contract and the supporting information that I had forwarded earlier that morning. He never made us feel rushed during the consult in which he recommended a solid solution. More, he agreed to reach out to the provider, drafted a letter of agreement, and calmed the situation down that very afternoon so the delivery could proceed the next day. He accomplished all of the above on a two hour window! More importantly, he negotiated a solution that avoided what might otherwise have been a nightmarish and costly legal battle and anxiety-ridden additional project delay. Frankly, I’ve never received such competent, thoughtful and effective legal service in such a stressful, time-condensed situation, including during my 20+ years as CEO and owner of a major real estate sales and marketing company. If I could have given Mr.Maitland a higher rating then 5-stars I would have done so. If you are looking for a client-best-interest solution, quality legal advice and service from a brilliant and calming communicator you will not find a better contract lawyer than Mr. Maitland!

I fired Ms McKee yesterday after 6 months of waiting and requesting a meeting with her. I was patient as she was very busy but became upset with her when she had still not answered my questions asked in December of last year and several times after. She had nothing but excuses every time I spoke with her. The last time we talked she was going to finally review my file and then call me. When I arrived for our meeting she had still not looked at my file and that was the last straw. Then she tired to blame it on me! I was combative. Right. More abuse from my attorney to add to my ex and my family. Nice work McKee.

My family and I had the pleasure of working with both Attorney White and Attorney Dickerson over a period of years to resolve a few legal matters. They were by our side and very supportive every step of the way. They always went above and beyond in being responsive and addressing all of our questions and concerns. I really cannot say enough positive things about our experience. If it had not been for them, I do not think we would have had the confidence to keep moving forward and gotten the positive resolution that we did. What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
