This attorney's wise advice and skillful negotiation avoided a lawsuit that likely would have turned out badly for me. She would have made a lot more money if I had sued the person who was causing me problems, but she did what was in my best interest and persuaded the problem person to quit. I wholeheartedly recommend this attorney without reservation.

Furthermore, he has an outstanding court general court demeanor. If I were going to hire a trial attorney for my own case I'd certainly hire him.

I hired John in August 2016 for my divorce after having retained another attorney from this site in March 2016 for my divorce case. John was referred to me by an attorney at work. On our initial consultation I was looking to switch attorneys because of having a simple divorce case with a irregular retirement division which my first attorney made very complicated. John was presented with the same information I provided to the first attorney and he understood what I was wanting to achieve right away. He gave me three possible solutions with the pros and cons and advised as to my request not the norm. John said I was being very generous, but knew my intent was to do the right thing. We only met the one time and as of 11-4-16 I am divorced and was the result we wanted from the beginning with decree and a retirement QDRO. I would highly recommend John and will be referring him when people ask. I think a personal reference is the best review source to find an attorney to meet you need.

For the last four years, Lauren Brown has provided excellent legal counsel during a protracted and complicated legal battle involving a very large estate. Throughout the process, I was amazed by Lauren’s command of the smallest details in the multitude of complex documents. Lauren’s depth of legal knowledge and command of the facts made her invaluable to my team. She frequently spotted issues and unintended consequences of proposed actions that impacted our decisions. Her work is superior, and her work ethic is phenomenal. Every task is completed ahead of schedule and all emails and phone calls are promptly returned. Lauren has also assisted in the preparation of my own estate plan, seeking common sense solutions to complicated issues. Lauren received the ultimate compliment from one of the older attorneys involved in the litigation when he said, “She’s a great young lawyer and I’d love to hire her away from her firm.” If I was still practicing law, I’d want her in my firm as well. But, I’ll settle for keeping her as my attorney.

My wife and I hired Lauren Brown and Bob Kroney to defend our rights in a complex case regarding the resolution of my mother's estate in Dallas. My wife and I are not Texas residents, so we used Avvo.com to find the best lawyers. The opposing counsil was one of the toughest, highest paid lawyers in Dallas at one of the largest law firms. It was a difficult case, and I have only superlatives to describe for the work that Lauren and Bob did. My emails and phone calls were answered promptly, even on weekends. They were highly professonal and effective in resolving the case to my satisfaction in the shortest amount of time. If you are looking for results in a case regarding estates or trusts, you need to contact -- individually or collectively -- Lauren Brown and Bob Kroney.

He showed a great amount of professionalism, courtesy, client commitment, and thorough preparation and attention to the specifics of my estate plan. John VanBuskirk was referred to me by a friend who knew of him as his customer and after his previous recommendation NEVER contacted me after numerous calls to him. I HIT THE JACKPOT with John! He is extremely thorough (covers everything with a fine tooth comb), meticulous (dots every "i"and crosses every "t"), answers every single question with clear understanding, is very prompt with his communication and has a personality that adds him to your list of treasured friendships. I have referred him to numerous people I know (one has used him already) and will continue to do so. He handled my elderly mother with care and thoughtfulness. Dear Daniel Herrin and Jennifer Cruse, I want to say a BIG THANK YOU for putting your hard work, extensive knowledge and expertise forth to assist me in my 7-year struggle to hold on to my beloved home. Due to poor advice from previous Chapter 13 attorneys, my house fell back into foreclosure twice since 2012. When Herrin Law filed my Chapter 13 case in 2017, Daniel and Jennifer literally snatched my home out of the jaws of foreclosure. The prior Law Firm representing me dropped the ball and left me and many others hanging with our Chapter 13 cases. Even after Herrin Law got my Chapter 13 protection up and running, my finances remained volatile and unstable, causing me to miss both mortgage and Chapter 13 payments. Any other Law Firm would have been frustrated with me and doubted that I could continue to hold on to my home, but not Herrin Law. Daniel, you, Jennifer, Lisa and the rest of your amazing team continued to treat me with dignity and respect. You never criticized or judged me - you only offered encouraging words and continued to fight for me. Daniel Herrin and Jennifer Cruse were willing to go back to the judge and ask him to continue to give me a chance. Late 2018 was the most recent predicament I was in and it was doubtful that the judge would approve the extreme plan that Daniel and Jennifer devised to help me, but because of their caring nature and passion for the people they represent, the judge approved the plan. I think that is simply amazing! Daniel, I thank you and Jennifer for telling me to apply for a loan modification. The attorneys that handled my previous Chapter 13 cases never told me that was an option. Today (March 6, 2019), you called me Daniel to tell me my loan modification has been approved and I will be able to get out of my Chapter 13 bankruptcy! You negotiated a payment that is very manageable and well within my budget. I had been a two time loser with Chapter 13 bankruptcy, my case was very complicated and no one was interested in taking it on. I will be eternally grateful to the attorney that referred me to Herrin Law. He told me that if anyone could help me it would be Herrin Law. He said, “Daniel Herrin is a smart, honest, caring man, give him a call.” I'm so glad I followed his advice. May God continue to bless this very talented, compassionate law firm. I feel like running down the street and saying if your back is against the wall please give Herrin Law a call!

I hired Mr Davis to represent me in a probate case. I came to him with a mess of information regarding mishandling of an estate which I stood to inherit from. He worked very diligently with me to ensure we had all the information and supporting documentation to go forward with the deposition to prove our claim. This was a very sensitive family matter and Mr Davis handled everything with an exuberant amount clarity, compassion, poise, and dignity on my behalf. He was very intentional and through during the questioning in deposition which provided absolute clarity as to amount of mismanagement that had taken place. Mr Davis was excellent about communicating with me every step of the way about what to expect without giving false promises as to a possible outcome. Again I cannot praise his efforts enough for the way he handled this! He was an absolute shark when needed while being compassionate to the situation. It is hard to express how thankful we are that we were referred to Brian for our case. We were in a rough situation with a will that was not probated in time, a house to sell as my Mother moved into assisted living, and decedent's children making claim to 50% of the proceeds of the house that was purchased by my parents over 40 years prior. Brian was excellent, he reviewed our situation, explained all our options, helped us find the best approach, educated us continuously throughout the process, kept us updated on all progress, kept the case moving, and went over and above to take as much of the burden of the case off my Mother and myself. Brian works in real time, we never had to wait hours or days to hear from him if we had a question, he spent several hours throughout the case on the phone with me, explaining the process and providing expert advice, he connected us to additional expert attorneys as needed and coordinated all the information and documents for us. This was a very emotional situation for us and Brian was supportive and compassionate but was able to keep us on a fact focused professional level. We would recommend anyone who is dealing with Estate planning, a will to probate or other family issue in his field to talk to Brian.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
