Carl made what would normally be a stressful process fast and easy! He was very patient with and was able to answer all of the questions I had for him. With me having to work during his office hours he was very flexible and made it possible to meet with me later in the evenings. Very good price and a very knowledgeable bankruptcy lawyer. I would 10/10 recommend him

I had an 'old' issue' with a bank that I thought was over and done with a few years back. I recieved a phone call from them regarding monies I supposedly owed them. They offered me a settlement that I wasn't comfortable with and I was not comfortable contacting and negotiating with them myself. I knew I needed the advice of an attorney and started looking. I read reviews, ratings, and inquired about attorneys in my area. This led me to calling Mr. Rolsma. I explained my situation, and he said up front that this was not necessarily his area of law, but agreed to talk with me and, if he couldn't help he may be able to recommend someone who could. That was important to me! I met with him, showed him my papers, explained my side of this situation, and sat and talked. When I asked what he thought I should do he said to my surprise, 'Lets call them'. He did, and after about 20 minutes on the phone with the bank, the bank dropped the debt, and I left thinking 'what just happened'? I believe I would not have gotten this result without Mr. Rolsma's guidance and expertise, as we sat there on the phone with the bank representative. This was a big turning point in my financial life, and I will be forever grateful for his patience, and guidance through this.

Attorney Hiller completed our estate planning, including our wills, POA’s for finance and healthcare as well as declarations to physicians and HIPAA documents. She is very personable, she answered our questions and explained changes in laws in terms we understood. She identified a problem with our homestead deed and made the changes necessary to prevent future probate problems.

Several years ago, my parents asked me to manage their finances in the event they could not manage themselves. It seemed like an easy enough request. I felt confident that I could pay their bills on time and keep the check book balanced. Besides, my mother was indestructible and would never, ever need my help with this. But in 2001, my dad’s health failed and my mom was diagnosed with dementia. It was then that I realized that I had agreed to something that I was never prepared to handle. I met Mike Vogel at the very beginning of this very difficult time in my life. Mom and dad had done their powers of attorney for health care documents incompletely so both needed legal guardianship. Dad’s would later be reversed but mom’s continued until her death in 2007. During the span of 7 years, Mike helped me navigate the very confusing legal system. My education as an RN did little to help me understand the complexities of legal guardianship of the estate for mom which included very detailed accounting of her finances every year. He assisted me with the sale of their home, which I had never done before. He advised me in the management of separate financial accounts for each of them and helped me with their taxes. When dad died in 2005, he helped me as executor of dads estate, which again I had to knowledge of how to do and then helped me with settling mom’s estate after her death in 2007. It is impossible in a short paragraph to tell you just how ill equipped I was to manage mom and dad’s affairs. It was far more involved than simply paying the bills on time. I turned the trust that they had in me over to Mike who helped me every step of the way through a very long and emotionally difficult 6 years. He did so with knowledge, expertise and compassion and I could never have done it without him. Linda T.

We hired Scott through a mutual friend. I wasn’t sure what to expect, but he went above and beyond my expectations. He is extremely professional, friendly and very knowledgeable. I received a lot more than I could have ever expected from my law suit. Honestly, I never expected this to go as smoothly as it did and receive the compensation that I did. I would recommend him to anyone that I know, or anyone that I don’t know. Absolutely an amazing person and he was available anytime I needed him. I never had to wait for a call back or a response from him. He truly cares about his clients and his job. I give him 5+ stars

After moving to Janesville one year ago, our Realtor recommended the McDonald's firm to us. For updating our will, the cost we incurred from Patrick McDonald was much better than the average price charged by other law firms in the area. The initial interview was by phone due to the pandemic. Patrick was engaging, making the entire process painless and actually enjoyable. He also assisted our friend's will update a few weeks ago. I cannot speak for the other person who gave this firm only one star. Noting that it is the only review, my feeling is that this was perhaps an anomaly. We are all very happy with the work the firm processed for us and the fee for that work was very reasonable. Thanks McDonald Law, Laura, Bill and Chloe

I hired his firm a number of years ago after talking to Patricks brother. I was told that he would contact the insurance co and say we wanted $200,000 and then we can settle for $100,000 and they will think they are getting off very good. Just sign the paper. Well I signed and the letter he sent the insurance co. was for $20,000 not $200000 and I ended up with $5300 after his cut.He charged $1.00 per copy for every paper he sent out plus other charges that I could not prove he did. He sent about 6 or 7 copies of everything. That totaled hundreds of dollars. After being dragged out a long time I only ended up with a few hundred dollars more then if I would have taken the insurance co offer.I told him I was going to make a complaint against him and he said go ahead because he was on the board that would hear the complaint and he would dismiss it. Well that was one of the truthful things he said. He was on the board and it got dismissed. I would not recommend this firm to anyone. I remember part way thru this his brother gave the case to Patrick and said he was very familiar with this case. NOT! He did not even know what happened in the accident so I had to explain everything about the accident to him. And he was pleading my case for me.

Mark was brought on by another attorney my family was using to help with a part of an insurance settlement my family was receiving. We wanted to use him as our estate lawyer and I drove all the way out of state to meet him and was told to reach out to him after I spoke with my other family members. I emailed, called and no response. He even went so fat as to disappear on my other attorney and held up our ability to receive our settlement. SO unprofessional. If we were not ideal clients, then the least he could have said as a business owner and professional that he could not work with us. I do not reccomend.

Not upfront about fees. Takes weeks to get back to you. Cost over $3000 to file chapter 13 ,twice. And now instead of instead of being honest about my ability to convert 13 -7 for a much lesser amount. I have been advised to withdraw my chapter 13 and refile 7, therefor paying her an additional $1500. I work in the Title Loan industry , what she does isn't any different.

I was told by Attorney Holly Jensen, in our fist consultation that she would be on my side and would be a strong voice to help me. In that fist consultation also, attorney Jensen stated she was going to help me get my time with my daughter because that’s what I was entitled to. But at a sad, frightening, and frustrating moment just before we were to finish my case in a court of law after 9mo. (my personal emotions in overdrive) Attorney Jensen backed out on me, and stated “she was done wanting to help on the case anymore” and said “I was changing my mind too much”. I felt that I had a right to somehow sometimes change my mind, contrary to what she kept telling me. She was not understanding of my positions, ideas or questions even when I explained myself in great detail in emails or phone calls. When I did write an email on a Saturday asking questions and wanting to know anything it would take days into the next week to get an answer from Attorney Jensen would respond with a few short words. (Felt I was bothering her more than her reaching out to really help me) She takes a lot of time off at a moments notice without any word on your case status. She is easily intimidated by the opposite side especially if it is a male. Attorney Jensen will not reach out to you on her own most times to give you updates. By Friday afternoon (12pm she’s has left for the weekend) and you’re left with the thought of “how is my case progressing”? If your case is in depth and requires her to be on top of the situation she does not posses these skill sets. If you have a case the requires her to interact with other people in anyway, (the opposing attorneys) or in a court of law setting, I wouldn’t recommend Attorney Holly Jensen she again is intimidated and keeps quiet.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
