Mike Kircher has done a fantastic job of representing my kids and I over the last few years. He's extremely intelligent, and really knows the law inside and out. I can't recommend him highly enough! I've also worked with Steve Sunde in the past. I have so many good things to say about him as well. I would never trust issues of family or business law to any other law firm.

Stuart helped my children and I with the estate planning for my ex-husband who was in the hospital. The three of us met with him and hired him on the spot. His knowledge and experience were undeniable but he was also empathetic, friendly and caring. Our first meeting was probably 1.5 hours yet we never felt rushed, actually the opposite. He made sure all our questions were answered and the conversation grew past just estate planning. When it came time to sign the documents, Stuart insisted on having my ex-husband sign the documents himself even though our daughter had power of attorney. Stuart said he just wouldn't feel right representing someone he hadn't met. We all met at the VA hospital and there was no additional charge for the visit. He notarized the documents on the spot and everything was completed in two visits. My children and I were determined to interview three attorneys before hiring, but during our meeting we knew Stuart was the perfect fit and we hired him on the spot. I subsequently went through a divorce and hired Stuart for my estate planning. I never considered anyone else. I had ideas of what I wanted to do but Stuart showed me better options and explained not only the benefits of his recommendations but the potentially negative financial consequences of my original plans. Stuart has been a blessing to our family because of his expertise and his caring nature. I feel completely taken care of and secure in my estate planning and my children would say the same. Clearly I'm a huge fan of Stuart's and I recommend him wholeheartedly!

Stuart did my mothers' end-of-life documents, and mine, several years ago and his work was invaluable. Knowing that this paperwork is in his vault is a comfort to me. But even more important to me was that he answered all of the questions I had all through my mother's probate gratis. I kept waiting for him to tell me that he was going to have to charge me for the time I was taking up but he never did. He really does stay with you as long as you need him. (I do expect to be charged if I rewrite anything, of course.)

Regarding my wife's early dementia situation, he advised both of us to turn over $400,000 to our children whom he knew nothing about. The children's obligation to use those funds in our behalf would be based upon a "mutual verbal agreement". He urged us to act quickly. As an attorney, I was hoping he would have researched our children's financial situation (this could be an explosive mistake). Usually attorneys are legal like, but a "mutual verbal agreement" involving $400,000 sounds a little bit risky to us. Other options that we proposed in writing were never considered. And finally, all this for a flat fee of over $7000, only. The more my wife thought and talked about this, the more unnerving we felt about working with him. Unthoughtful, expensive, ineffective are words that come to mind. He offered expensive complex solutions, but never considered simple effective and economical solutions that didn't involve the possibility of creating destructive relationships.

I would recommend this lawyer if you have plenty of money. He did an excellent job with the custody motion, however I was only able to use him until a hearing was scheduled, and had to proceed pro se. This lawyer requested a larger than normal retainer (due to my particular situation) and stated that when the retainer ran out, he would let me know before he started billing me. This did not happen and he billed me $8,000 beyond my retainer.

Mr Ludescher is a very skilled negotiator and litigator. His rates are an excellent value. Worth every dollar. He has strong ethics and has suffered because he would not do wrong by his client to avoid punishment. All the same, when it comes to family matters and estates, even collections, David presents options as well as how those options affect the time frame for resolution as well as the cost potential for each option. His communication is also excellent. Response times are asap. We used lawpay to make our payments online, so there was no worry of delayed check cashing or handling of cash. Kristina is also spot on with documentation, appointments, communication and customer service. We will be back for estate planning... 😁

She was efficient , thorough and empathic to clearly highly emotional situation, she knows the laws and she and her team were prepared and organized especially the days of trial. I was so relieved to be working with someone I could trust to make sure my kids and I could be safe and have someone on our side of the table working with us for the best outcome of my family. I am so grateful for this law firm and their entire team! She knew the system and the folks in the judicial system to make sure we had all we needed to present ourselves in court fairly and concisely. Thank you to this entire team.

Do not recommend this mediator. He was recommended from the Lawyer of my Wife that he was a reputable, professional, and affordable mediator. I felt the exact opposite. I never once raised my voice to the man. Where he screamed at me and swore at me twice to the point where my mom had to walk in from another room because she was worried about how the conversation was going and how I was being talked to by this man. When the man realized that he had been witnessed talking to me in such an unprofessional matter he completely changed his tune and started singing my praises and telling me that I was such a smart negotiator and a bunch of other stuff. Would not recommend this mediator it felt like he was in cohoots with my wife's attorney the entire time because he kept pushing me to settle for whatever my wife and her attorney were trying to get from me. It felt very unprofessional and the swearing and the screaming at me when I never raised my voice once to him was completely uncalled for.

I wish I could give zero stars. Mary Fenske completely robbed me and then tried saying I owed more money in the end. I went to treatment and their lawfirm used that as an opportunity to screw me over. She did not help me with a single thing and was rude and aggressive the entire time I worked with her. Their receptionist is also one of the most disrespectful people I've ever met. This lawfirm only cares about money, not the people coming to them for help.

Would rate a zero if possible I do not recommend hiring Dennis Simpson to represent you. We hired him for an estate process, and he told us, during the process, that we were lucky to get anything, since we were STEP CHILDREN. Dennis did not represent us thru the process, he was just a YES man to the other lawyer. We prepaid for his service when it was supposedly close to being finished, and then it really got bad. We no longer get answers to emails sent, asking questions about the case. (Now 3 years later and not finished.) Best advice I can give, is find another lawyer, and don't waste your money or time. A lot of money spent for nothing. I have really lost faith in the system and how this firm allows someone to stay on, that does not do what he is paid for. Only after the money! Hoping this helps so no one else gets ripped off and unrepresented!

Giving 1 star because there's no option for 0. Stacy Wright is highly disrespectful and unprofessional. She was my father's attorney for 18 years, unfortunately he passed, and I had some questions. She started screaming at me, at the top of her lungs, out of no where. She wouldn't let me get a word in and was calling me disrespectful names. For someone who should be considered a professional, she definitely wasn't one. If you're looking for someone caring and to show empathy DON'T go to her.

Karen England represented my ex-wife in court for child support and failed to get any money from a father that had no legal representation. So, she took a roundabout way and went to Wabasha county social services and had child support forced on me. It is really sad that a father that watched & cared for his kids, witch documented everything for 13 years can win a court battle but lose a few months later, because she manipulated the local government. I have been divorced for 13 years and I have been building myself back up taking care of three children and she has destroyed it in the last 13 months.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
