My uncle was being abused in a nursing home. Josh was honestly a gift. I can't imagine an attorney more skilled, effective or reasonable. He was always available. When I couldn't pay, he kept helping. He helped us in court. He helped fight him being dumped out by an assisted living. He won our medical assistance appeal. Josh was amazing to work with! If you need help, he is the only lawyer I'd call.

I retained April Carlson when I couldn't find another lawyer to represent me. She seemed like she'd put in effort, but that quickly vanished. During mediations, she had nothing to say, or helpful advice. Even though I was adamantly against an evaluation, I felt I had no other options. That evaluation cost me another year and a half without my child. When talking with her about the evaluation on the phone, she gave me the wrong information that wasn't in it. She wrote up the mediation agreement wrong which cost me custody and made my case miserably more difficult. April carlson will waste years of your life in court by her own mess ups.

We were very lucky to have found Bonnie! She explains things in language which is easy to understand... No lawyer-speak. She answers her own phone, answer emails quuckly and if she needs to, calls to explain further. She was very accommodating when we had to cancel a meeting due to a work issue. But most important, she seemed to care about us as people. Thanks! Bonnie

Bonnie was very rigid and not easy to work with. I found her to be cold and uncooperative. She prepared something for me, and I found it very confusing, and unusable. I had many questions, and decided I wanted something a little different, but she was only interested in getting paid. She threatened to sue me if I didn't pay her. I did pay her... but never used any of the documents she prepared.... A waste of over $2,000.00!

Mr. (Daryl) Bail is a joke. Hiring him means you're overpaying for legal services and there are plenty of other better lawyers in the area that cost THOUSANDS less. No sense of ethics whatsoever. He's openly disclosed to other people the amounts of money he has drained from his clients. Client confidentiality means nothing to this guy. I totally get why he's not a named partner at PHB. He'd ruin the firm's reputation. When looking for a law firm to represent you I suggest looking anywhere else.

I was very pleased how everything turned out to be. I’m not going to lie, I was very nervous and scared for the worst and thought that I didn’t have a chance. But with the help with my lawyer and the whole team from Patton Hoversten And Berg this wouldn’t be possible. So I want to give a huge Thank You to Joe Heinrichs and Andrea Lembke for helping me get through this all the way, none of this would be possible if it wasn’t for you guys. Thank you Patton Hoversten And Berg!

I was referred to this group for a special needs trust. They basically charged me over $450.00, didn't listen, made assumptions, and finally said they were "too expensive" but have to bill me for the first hour. Needless to say, I ended the engagement. I would not recommend this law firm to anyone unless you're interested in wasting money on expensive, inexperienced lawyers that don't take their time to review your request but still charge their high rate.

A person that doesn't pay her house cleaners to threat, don't respect agreements and change them to her convenience. I strongly recommend consider doing buissnes with this law firm. You can judge people how they behave with others and most important if its in your own home and family.

I was gravely disappointed in his overall performance concerning his representation during my divorce. There were circumstances, in this particular case, of an unusual nature that could have made a for a less painful end if he would have had the fortitude to actually pursue on my behalf. From the very beginning, he displayed an obvious condescending and arrogant demeanor toward me. One of several examples, on 11/22/19 , I had asked him for a ball park figure regarding the possibility, if this case went trial. His reply, “a ton of money”, or “a truck full of money” and on further occasions when I made this same inquiry…..as if I were incapable of understanding. That same afternoon, I asked about scheduling a consultation before the first scheduled FENE meeting….never got a response. Later, I dropped off some requested documents, inquired about the importance of some that I couldn’t get and asked about others that I didn’t include…..he just shrugged his shoulders giving me the impression that they weren’t actually that necessary. I also reminded him about the pre-FENE consultation previously requested…..again no response. Again, dropped off more documents that suddenly became important from the last time he requested info….hummm… and we finally had our pre-FENE consultation due to my constant urging. I asked him about my wife's income and bank account info…if he had requested this disclosure info. His exact response, “I hadn’t had time to ask for it”.....the day before the meeting? Am I not paying him to collect all info, that I have been asked to provide? Luckily, FENE got rescheduled. This should have given him more than enough time to collect the same kind of info that was required of me…..which he didn’t pursue. He still hadn’t requested it, until the day before the 2nd FENE, in an e-mail to opposing attorney. I again asked him about it that morning at the meeting, his response, "Her attorney says she has nothing and that is good enough for me”…..seriously? My wife had been on her own for three years. Numerous times he told me that my income wasn’t a factor; because my wife had been self sufficient for the past three years without my financial help. He also told me my home, which was purchased in 1994, could be considered non-marital. I asked about the validity of this, and his exact response, “I’m not worried about it” and just disregarded my inquiry. Seriously?.. he obviously didn’t do his homework as it was a completely different set of circumstances when I showed up at the 02/11/20 FENE meeting. During this entire process, he was unforthcoming and almost to the point of being blatantly misleading …all the way up to the morning of the 2nd scheduled FENE meeting. His efforts in representing me were lame and lackadaisical with his obvious attitude being, that any judgments or agreements against me were unimportant, as he had my retainer in hand, why try to actually represent his client for a more favorable and fair outcome? During the FENE meeting, he was shiftless and unhelpful. I felt he had made some kind of a “deal” with the opposing attorney before I even arrived....for it sure seemed that way, as he starting back peddling on everything he had previously told me about her access to my income, home equity values, personal property be it marital or non-marital, etc. He should have scheduled a consultation sometime before, to prepare me for these so called “changes” from his original dialogue/findings? Also, flashing around a Family Law text book made me sadly realize his level of incompetence, especially when he couldn’t even correctly formalize the equity in my home that she might be entitled…..he relied on her attorney's numbers without even fact checking. I certainly wouldn’t recommend Benjamin Kaasa representing on any legal matter.

Dear Bernick Lifson P.A., We understand that you found our service difficult to understand, our company has been practically dedicated to this type of international transactions for over 3 decades and as you can confirm we have been in business since 1984 maintaining an excellent reputation. The main reason why we are talking about our reputation is because your company is making very delicate allegations in which you are trying to defame us and when we ask for evidence or solid proof that we are engaged in such practices you simply refuse to provide it or even answer the calls of our legal consultants which we consider quite unethical and unprofessional, but we will take the necessary legal actions as your false allegations may affect our business. We adhere to the highest standards and focus on providing exceptional services. We expect a public apology since our mutual client is being affected financially due to these allegations and instead of protecting his interests he is about to lose a considerable amount of money thanks to you. Ms Trogdon is quite nice in person. That's the end of the good news. She wrote a recommendation to the judge in our case. Her recommendation was not even possible under the statute. On two separate points. In addition to lack of basic ability to interpret the law, her opinion was fully biased and illustrated everything "old" and wrong leftover in the court system against equal parenting. The judge thankfully threw her opinion out as it was not possible under the statute. Stay away. She should not be hired or working in any meaningful manner to do with families in the 21st century.

I looked out the 2nd floor window of the Mpls court house. I saw an old woman pulling her black bag down the sidewalk and thought, how can she sleep. Had 3 different attorneys in one yrs work on my case. All 3 quit. 3 mediations, At one, we sat downtown St Paul for 2 hours, nothing was done. I have now found out a 500K life Ins policy, 400k spent on a gf, and more was never discovered. Can't afford anyone to get my unpaid settlement. Took over a year to file my case....he said it was because the bankruptcy laws kept changing. I knew other people that were done with their entire bankruptcy within 3 months. Due to the lack of filing in a timely manner I had to change from Ch. 7 to a Ch 13 filing. Was also not informed about all the fees. Was told the day before court that I needed to come up with an extra $400 for filing fees. Why was this not included in the $1500 I paid up front? Clearly I was going into bankruptcy for a reason, I didn't have extra money laying around to use. I've had to call his office a few times to ask some questions and he is not helpful at all. Gives vague answers and is not willing to help get things resolved to get out of bankruptcy before the allotted time ordered.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
