Working with this attorney has been an absolute nightmare. I spoke with her a few weeks after my divorce was finalized. My best friend had recently gone through a divorce & told me to make sure a qualified and competent attorney handled the QDROs portion of my divorce, as hers took an unreasonable amount of time. Emily was recommended by my divorce attorney. I spoke with her a few weeks after my divorce & stated to her my friend’s experience. She assured me my friend’s experience would not be the way she treated me & the process would be smooth & she had good relationships with the plan administrators where my money was invested. Fast forward to November. I emailed Emily, as I had heard nothing from her in almost 4 months. 25 days later she responded to me. She said she would get back to me the following week. Guess what? Not a word. 1/2/20 I asked her for an update. I received no response. Getting fed up Emily was ignoring me, as well as my financial planner stating this was nonsense, I put her in charge of contacting Emily. She called multiple times and received a lot of dodging by Emily’s secretary. I then let my attorney know what was going on. 1/17/20 — the paralegal finally seems to get things moving. 2/3/20 we were told this would be wrapped up in a few weeks. Today is 3/14. That day has come and gone. Nothing has happened. Also 3/13 I received a bill from my own attorney for $810. All the billing had to do with my attorney chasing down Emily Carrara and figuring out what was going on. I’m on a fixed income and do not have $810 just laying around for someone to chase this woman down. My own attorney stated he was disappointed in her actions. The portion of the QDRO I was to receive as cash that was owed to me by my ex husband has probably gone down 20-30% due to the stock market tumble. I am a social worker and that money was to go toward a bachelors of nursing degree I am pursuing, to help purchase a new home so I can get my son into the high school he wishes to attend with his friends & to pay for my kids’ college. I do not know now if the money will be there to make these goals happen. Had this been finalized months ago, I would not be in this predicament & would not have lost a large portion of my life savings. I am not a person who likes to leave negative reviews. I also always give people the benefit of the doubt. Given these circumstances I would NEVER use this attorney for any reason. She is incompetent & she will not respond to you. Please stay away from Emily Carrara.

Emily Carrara is an exceptional attorney. She exceeded by far any expectations I imagined during my divorce proceedings. Emily's knowledge and expertise is unbelievably top notch in her field and her compassion, empathy and understanding are what enabled me to 'survive' during this devastating time in my life. Emily took the time to speak with me and made me feel like a real person whom she genuinely 'cared' about and fought for in order to obtain the best settlement possible for me. I never once felt like a case number or dollar signs in the form of 'billable hours'. Emily is exactly 'the attorney' you want in your corner fighting for you during such a horrendous process and I highly recommend Emily to anyone who is entering into a divorce proceeding. She helped me more than I can explain in words and a settlement that allowed me to move forward and live again.

Emily Carrara is to be counted on to deliver results. She is highly competent, trustworthy, collaborative, and yet not afraid to be strong on points that have proper merit. She has an excellent understanding of IL QDRO, significant ability to quickly grasp complex situations and distill them into actionable items for your best interest. My situation was a decade old, required opposing lawyer work, court appearances, multiple 401K company ownership, and of course - emotion. She properly educated herself on all counts, provided accurate assessments and expectations .... delivering results in the end. I would highly recommend Emily Carrara!

Working in a very customer-centric environment, my expectations of customer service tend to be sky high. I value promptness, professionalism and an attention to detail. For my recent (and very first) home purchase I worked Mike Anselmo and could not have had a more pleasant experience. From the initial phone call to my closing, everything was absolutely seamless. Mike answered all of my questions in detail, but also in a way that was easy for me to understand. The ease and comfort I had in dealing with all of the individuals from this firm is reason alone for me to highly recommend them.

No matter your situation you can't go wrong with Adam. Adam has been practicing law for the better part of 40 years and knows how things will shake out. He has earned the respect from his colleagues in and out of the courtroom. All of the Judges seem to know him and respect him. I would strongly suggest hiring Adam stillo for any legal matter your facing. If it's not something he thinks he can handle, he will let you know. We used Diaz Anselmo & Associates (specifically Tom and Jessica from the Naperville office) for the purchase of a new home. Tom is an amazing lawyer. He is extremely thorough, quick to reply, and kind. Jessica was also there every step of the way. She is organized and patient while answering all of our questions. We loved them so much, we used them to represent us in the sale of our townhome, and also recommended them to a family member for the sale of their house! While buying or selling a home is stressful, both Tom and Jessica made it easy. They are trustworthy, accommodating, and reliable people. They will be representing us any time we buy or sell in the future.

A few months ago, I found myself calling Attorney John Brennock for his services again but this time for a serious life-threatening incident that happened in my apartment building where my cousin and I reside. Our neighbors moved from their apartment above us and management began repairs and renovations as they usually do. It was around 3:45 p.m. on Friday, April 12, 2024 when we began to smell a strange but harsh odor that penetrated throughout our whole unit. The smell literally cut our breath so much that I opened all the windows, even opened the front door. The following Monday morning my cousin called the property manager and discovered that they were working on the bathrooms however they didn’t disclose exactly what they were doing. After speaking to the property manager, we both concluded that we were exposed to some type of paint striper that contained methylene chloride. I wondered how anyone could survive that smell and not keel over without wearing protective gear when working directly with these chemicals. Then I decided to look at my security cameras to see if it captured any type of equipment they were using for renovation of this apartment. I saw two men suited up in what looked like gas masks and carried a different type of fan that was small in size with them before they went upstairs. They were finished in less than thirty minutes and obviously closed all the windows and locked the apartment door to keep vagrants out. The odor became more intense and permeated throughout our unit for hours. Mr. Brennock offered to write a letter to the property manager in regards to this incident. He isn’t a personal injury lawyer but did advise me that is what I would need if I wanted to pursue this matter. Then he informed me that I can still go to the hospital if I was still feeling bad, which we did. I thought if I didn’t go right away that there was no need. I opted out of the letter and chose to use the money that I have been saving to buy a home instead of attorney fees. He even gave me references to a couple of really good real estate agents to assist. Yeah, I know what you're saying, “Well that’s not too much.” When a lawyer returns your every call or emails, responds to all not some of your questions, explains what's in their perimeters and what is not, followed by what they can do for you, and gives advice and then follows up on that advice, puts this attorney way above the others. Would I turn to this attorney if I need to again? Yes, absolutely.

I give Denise Cahill no marks because she deserves not one. In order to fill this out you still must Rate! We needed a lawyer to handle our Autistic child. We had discussed our situation over the phone with a Free Consultation she was saying we had a good case and was totally on board with our goals. Once we got to the consultation she changed her story on which way to go once she had our retainer and consult. Fee she pulled the bait on switch on us and said she doesn't think she can meet our goals w/o even looking at the docs. She then asked for more $ if we wanted her to proceed that our case was too complicated! This was in an email all being after only one week and two pages of documents. She wrote one letter to the schools atty. Stating she was retained by us and stated if we don't give her more $ she'll drop our case! How does someone get away with this kind of behavior? She shld. Be disbarred for telling me all this and stating "my kid is complicated" after laying down thousands of dollars!!!! Ms. Cahill is only a glorified advocate but really at best a con-man/woman!!!!!

Im having issues with my son at his current school. I needed someone aggressive, organized and experienced with special needs education issues. I specifically wanted her to fight for another placement for my son so he could go to a therapeutic day school as he needs intensive behavior modification Instead, at the IEP meeting, she focused on minute, insignificant details in regards to his goals that were not important to me. I had to refocus on the placement issue, but she did not fight for it. Later, she casually told me that I would not get what I wanted anyway. I feel awful as I spent the only savings that I had.

We used Gail for divorce mediation. She was late for every appointment. She clearly hadn't ever review anything prior to our meetings and then never sent us our final documents. She was supposed to connect us with a lawyer at the end who 'she works with' to finalize and file our case, she did not do that, she completely disappeared once our last payment was sent. I called and emailed many times and no one responded. She was slow during meetings and wasn't much help with any questions we had. If it hadn't been during a pandemic we would have changed mediator. Ours was a simple divorce, I would hate someone in the middle of a stressful divorce to have to deal with this unprofessionalism on top of that.

We had requested a thirty minute consultation to determine the feasibility of our case in person. It went over to an hour long, which we were fine with paying for that extra time. What we were NOT fine with is that we were not consulted on any pre-meeting billable hours nor had we approved any pre-meeting billable hours. What turned from a small consultation fee turned into a nightmare of him sending us a bill for hours of "service" on the topic that probably took no more than 15 minutes for him to write up, totaling up to over $1,000! I have visited with several attorneys in the past on consultations and no one has EVER tried to bill me in this proposterous manner. I would never never hire or recommend this individual. Luckily, we fought that bill and sent him a check for the consultation fee amount which is what was the AGREED upon fee, after all, we did not HIRE him to do any research. IT WAS A CONSULTATION.

The worst experience I have ever had by far. Hired him to mediate maintenance issue. After paying for the initial consultation separately and then paying a retainer he never produced. Would not return phone calls. After his lack of professionalism I requested a refund of retainer, it took him three weeks to provide that and a billing statement where he had double charged me for the initial consultation and marked it half price and charged for bogus hours looking over paperwork related to the case. Took two weeks to get a response from him where he reconciled the double charge and reduced his hours billed. It cost me two months because I was referred here by a friend. What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
