I contacted Ms. Shartle to represent my wants, needs and concerns in a custody case in which I cannot have legal custody. The mother of my daughter passed away and my daughter was placed in the temporary custody of a family member who did not know my daughter. My sister stepped in and filed for custody to keep my daughter in my family. While Ms. Shartle did not represent my sister, she went out of her way to make sure she understood all of the nuances of the case law and what was able to be done to support my sister getting custody. She took the time to get to know my family and what we would like to see as the outcome. Even when I felt hope was lost and there was no way that anything could change, Ms. Shartle's compassion and care seemed to never waiver. She continued to find what she could file to express my desires in the fate of my daughter. After so many months of filings, status hearings and a DNA test proving I was the father, all of Ms. Shartle's hard work payed off. I received a call from the temporary custodian that she wanted to transfer my daughter into my sister's custody. It seemed as if she could no longer deal with the pressure and persistence from my attorney's determination to see this through. I cannot begin to explain how grateful I am for attorneys like Ms. Shartle who, to be honest, are a dying breed. She is not the in your face type of attorney. Ms. Shartle is the one who looks for the actual problems and does her best to understand and solve them.

I'm from Houston, TX. I was driving through Missouri late one evening on my way to Michigan. I was pulled over and received a speeding ticket. I hired a different law firm in Missouri to handle the ticket. I paid them and the fines and the informed me that it was all taken care of. A few years later I attempted to renew TX DL and was informed that my TX DL had been revoked for a traffic violation by the state of Missouri. Houston was hit by Hurricane Harvey, and my house was flooded. I lost all my records in the flood. The TX Department of motor vehicles was useless, they could not tell me what municipality in Missouri the ticket was from. All they would say was to contact Missouri. When I attempted to contact Missouri, all I could get was the automated phone options that would always leave me on hold for hours and hours. I gave up and hired an attorney in Houston to figure it out for me. The attorney Houston took my $500 and several months later informed me that he was unable to find out anything helpful, but he could do more research for another $500. Finally, I did a search for traffic attorney in Jefferson City, MO and came across Dodson & Waters. Nancy Hanks answered the phone, and I gave her brief description of my problem. Within 5 minutes Nancy had searched the public records and found the original ticket and the records where the original attorney had paid the the fines and court costs. She then was able to get the reinstatement issued from Missouri to Texas. Solving a legal problem in minutes that two other attorneys had failed at for years. Thank you, Nancy Hanks! You're the best! John from Houston, TX

Mr. Kaspar was extremely knowledgable, respectful and represented me well. He did an excellent job of reviewing every document with me, making sure I understood each step and helped me through the process. Since divorce is stressful enough as it is, and emotional, I appreciated Mr. Kaspar taking his time to make sure I was comfortable and understood each portion.

I recently used the services of Ms McKay to bring resolution to my divorce after terminating the services of a different lawyer. Ms McKay is bright, intelligent, and responsive. Her knowledge of divorce law and the finances associated with it are outstanding. Her fee was extremely reasonable and her hours were not "padded", in fact maybe just the opposite. I highly endorse her services and those of the firm she associates herself with.

My wife and I had an adoption that was finalized and then vacated two months later. When the adoption was vacated my previous attorney refused to return our calls and left us in the dark while we were in the process of moving out of state. I simply did not know what had just happened. I sent out over 50 emails to Cleveland Attorneys during the Christmas Season hoping that one of them would be able to explain what had just happened. Most did not respond and the ones that did told me they did not practice in my county or did not work in adoption law. Early January, Attorney Barrett called me and we spoke. She reviewed my case and explained what happened. My wife and I hired her and she quickly began to clean up a messy situation. Our case will be ongoing for a while and I am confident that I have found the best adoption attorney in Ohio. Whatever result we achieve will be the best that can be achieved. Attorney Barrett always responds quickly, is upfront with you on what to expect and never gives false expectations, extremely prepared, and has a tenacity that many attorneys do not have when it comes to adoption. I wish I had known Attorney Barrett prior to this adoption. If I had, then my finalized adoption would never have been vacated. I made the mistake of hiring a general practitioner to handle my adoption case because I did not know any better. That mistake cost me. When it comes to your family and your adoption, hire the best. Do your research and know-how experienced your possible attorney is with adoption law. You will be surprised at how many don't really know much about it. I highly recommend Attorney Barrett. It is hard to find an attorney that specializes in adoption and surrogacy.

We never doubted he was working in our best interest while considering the next step to pursue in a complicated, protracted proceeding. We will always refer our friends and family to him, without reservation, knowing he is ethical and honest, which sadly, is not always a given in the legal arena nowadays.

I’ve had the distinct pleasure of engaging with Alex, an exceptional business attorney who provided much more than legal advice - he offered peace of mind in a complex business landscape. Alex didn't just "do their job." Instead, he took the time to dive deeply into my unique situation, and patiently guided me through every aspect of my business formation, each legal consideration, and potential financial impact. He translated the labyrinth of legal and financial jargon into clear, understandable language, enabling me to make informed decisions with confidence. What impressed me most was Alex’s candor. He astutely pointed out situations where it would be more cost-effective for other services to handle certain matters rather than employing his services. This level of honesty and integrity spoke volumes about their character and commitment to their clients. Alex demonstrated what I’d call a profound understanding of the risks involved in formation, while mitigating member angst with clear background on his experience in pertinent subject matter. Even more remarkable was the level of commitment Alex showed when our consultation ran over time. He generously spent an additional 30 minutes answering my questions and ensuring I was fully aware of all considerations - he didn’t charge a dime and provided a solid overview of his cost structures to avoid any misalignment. As someone with a fairly difficult personality and standards some might consider unreasonably high, I can attest that Alex not only met, but exceeded them in every aspect. His competency, patience, dedication, and “to the point” nature was a testament to his professionalism and passion for their work. The home run? Trust. Myself and my partners expect privacy with Trust as a core component of our lives and our business. Alex was attentive in providing details in information processing. He displayed integrity, empathy, reliability, and full accountability . I wholeheartedly recommend Alex to anyone seeking a business attorney who truly goes above and beyond for their clients. I'm profoundly grateful for the superb service and personal attention that I received and look forward to working with Alex in the future.

I have known Garrett for over 17 years and have utilized his legal skills many times. He drew up my wife and my wills, upon the birth of our first child. He has helped me with the formation of two LLC businesses. He has provided counsel, not only on the legal technicalities, but also on a personal level. He asks the tough questions and has helped me think through aspects from an unbiased perspective. However, the most appreciated service Garrett has provided was the settlement of my mother's estate. My family accepted my recommendation that we work with Garrett through the estate settlement process. The first portion of our first meeting with Garrett at his office was spent with him focusing on my Dad and really getting to know him and find out how he was coping with the loss of Mom. The compassion he showed to a man he had never met made quite an impression on the entire family. Since then, both my sisters have utilized his services for various legal matters, related to their personal estates. I would and have highly recommended Garrett to many people.

Monica worked as a social worker and brings that earlier career to the practice of law. So she has better insight into the people she is dealing with than many attorneys. She can listen in a more thorough way than most and takes the time to research the law ahead of time. Her fees are so affordable. Well worth hiring in Painesville Municipal Court, Lake County Court of Common Pleas and Cuyahoga County Court of Common Pleas.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
