Despite providing substantial documentation to support our claims, our concerns have been consistently disregarded by State Farm Fire and Casualty, leading us to contemplate submitting complaints against the attorney representing State Farm Fire and Casualty to The Ohio Board of Professional Conduct and The Office of Disciplinary Counsel. State Farm's actions have demonstrated a pattern of bad faith practices, including a failure to conduct a thorough investigation into our corporation and the unauthorized disclosure of confidential policy information to a third party without proper authorization. These actions have not only hindered the progress of our insurance claim but also infringed upon our rights as a small African American-owned business. Specifically, we would like to highlight the following grievances: 1. **Failure to Conduct a Proper Investigation**: We contend that State Farm neglected to conduct a comprehensive investigation into our insurance claim, focusing erroneously on individual personnel rather than engaging with all relevant stakeholders as required by Ohio regulations. 2. **Lack of Personal Contact**: Despite my pivotal role within the corporation and clear documentation listing my responsibilities, State Farm failed to make any direct contact with me during their investigation, breaching standard investigative protocols. 3. **Allegations of Discrimination**: Our status as an African American-owned business raises concerns of potential discrimination in State Farm's handling of our claim, with actions suggesting bias in their decision-making processes. Additionally State Farm Fire and Casualty company disclosed policy information to an unauthorized party without any consent from any officer, partner or shareholder of our corporation. (Attached evidence) Please view the attached sworn under oath statements attached specifically answer number 7 "7. Please admit or deny that you, Deborah McSurley, were given notice that on or about August 16, 2022, Claim Number 35-29N7-27R had been denied. ANSWER: Admit. I contacted State Farm’s corporate office and they advised me I was not a named insured and that the claim had been denied." 4. **Engagement with Black Lives Matter**: In response to perceived injustices, we have reached out to the Black Lives Matter organization to seek support and potentially raise awareness of our case within the community and beyond. 5. **Attempts to Resolve the Issue**: Multiple efforts to engage with State Farm's attorney, Lori Thomson, have been met with silence, prompting us to explore alternative avenues of addressing these issues. 6. **Potential Legal Actions**: Considering the gravity of the situation, we are prepared to pursue further legal actions against State Farm for their alleged misconduct, including filing formal complaints with relevant regulatory bodies. Sincerely, Mr. Marquis L. Kimble Director of Operations/Co-Founder The HCV Distribution Corporation Inc.

To the distinguished members of The Ohio Disciplinary Counsel, I wish to express my gratitude for the valuable services provided by your esteemed organization, which enables consumers to address professional misconduct. I am writing to share my experience regarding State Farm Fire and Casualty's attorney, Ms. Lori Thomson. I have personally experienced violations of my rights, including racial discrimination and defamation of character, at the hands of State Farm Fire and Casualty. Additionally, the rights of our protected class organization, The HCV Distribution Corporation, have been consistently disregarded by Ms. Thomson. The attached document provides evidence of State Farm Fire and casualty's breach of our company's private policy information by sharing it with an unauthorized third party. Despite clear violations of my rights and those of our company, Ms. Thomson has failed to respond adequately to our requests for resolution. She has also instructed us not to contact State Farm Fire and Casualty regarding these violations, yet she continues to disregard our attempts to seek a resolution. In February 2024, we sent a certified letter to State Farm Fire and Casualty seeking a settlement for these violations. Although it was received and signed for, it was ultimately disregarded. The response from Ms. Thomson included personal threats of criminal charges for our attempts to address these violations. I am reporting Ms. Thomson to the professional board of conduct due to suspected racial discriminatory actions, which parallel the treatment we have received from State Farm Fire and Casualty. Despite providing sworn evidence of the violations and rights infringements, Ms. Thomson has ignored our requests and resorted to threatening me personally with criminal charges, despite her client's violation of my personal rights and those of our corporation, The HCV Distribution Corporation Inc. We are urgently seeking your involvement to address these violations. I would like to emphasize that I am a registered minister in the state of Ohio and a sworn public servant notary in Lucas County with a clear background and record. It is both unprofessional and a violation of my rights for Ms. Thomson to threaten filing a police report against me for seeking answers and a resolution. We have filed complaints with various authorities, including The Ohio Department of Insurance, The Ohio Civil Rights Commission, The Ohio Attorney General's Office, The Ohio Supreme Court, The Ohio Office of Disciplinary Counsel, the Better Business Bureau, The Office of the Honorable Governor Mike DeWine, The Consumer Protection Bureau, The Federal Trade Commission, and the Office of Ohio Senator Sherrod Brown. I kindly ask for your immediate involvement and appropriate actions to address these actions committed against me personally and against our corporation, The HCV Distribution Corporation. I have attached relevant documents for your review and appreciate your assistance in addressing this serious and ongoing matter. Sincerely, Minister Marquis L. Kimble Public Servant, Co-Founder, Director of Operations The HCV Distribution Corporation INC.

Jay Lopez knew exactly who my ex husband was and yet let him run the shots, and cost me custody of my children to our abuser when I went to him for help. Now I am not saying he’s directly responsible but until he can show otherwise..my review stands. To top it off, I get an email this morning about a bill when I know I have filed for bankruptcy and they were included in the proceeding but didn’t show up for the review of creditors hearing. After going to Jay's office to speak with him and getting a clearer understanding I would first like to apologize for my earlier review. i was misinformed by people working for our government. I would like to thank Jay for fighting diligently and for helping me to get a better understanding of the system. I would like to apologize to the Lopez family for my earlier review. The system is broken but it is people like the Lopez family that will help make a change. I truly hope they can forgive me and In my opinion the Lopez family is the best in the firm. Thank you again from the bottom of my heart for all your help and understanding!

I can’t say enough about Kyle Phillips and the way he handled my case. He showed so much compassion during the death of my parents and the finalization of their estate. He went above and beyond in several instances during this time for me. I have referred Kyle to others and will continue to do so. I feel confident in his ability to always handle the situation with professionalism.

I would give his paralegal Lauran 00000. I called to set up meeting with attorney Parker his paralegal answered the phone unprofessionally, rudely assaulted me over the phone. She was horrible not sensitive in my matter, confused me with days that were available. I could not get from her the day that attorney PARKER is available. Whatever the day I asked she would answer NO HE IS NOT Available. After half hour on a phone she said; " You know what go see other attorney" she asked to see my ex partner attorney. She did not even check for conflict of interest. BUT SHE DID NT FORGONT asked for large retainer right away and his rate she said $400 an hour first Can you imaging if paralegal acts this way what does it says about firm. STAY AWAY FROM THEM IF YOU WANT TO HAVE A SUCCESS WITH YOUR CASE.

My aunt used this attorney's office for her estate documents. They compiled the documents, mailed them to her, she did not sign them. She ended up passing away without having signed the papers and her next of kin (my father) was assigned as the executor. This office claims to not have kept these documents on file. My father (the assigned executor) kept asking what we (as a family) thought she would have wanted etc and it wasn't until the estate was almost settled that I found these documents in her house. When I walked into this office with these papers, they had an accusatory tone with me but I just found them on her computer desk in her home, the same home in which I was in the process of buying and cleaning out. It feels like to me it is unethical and morally wrong for this office to not keep working documents on file. It's WILD honestly. What if my aunt would have wanted something modified? Would they are been scummy and charged her twice to redo the documents? I literally do not buy this at all. I talked with Candy and she is super kind and understanding, but the attorney she works for is rude and had a tone with me when he thought that I was holding up the sale of my aunt's house when it was a cascade of events and how the home did not pass loan requirements since it was neglected and there were some safety issues. Overall, I got screwed over on the house and this office did nothing to protect this asset, which was the only asset of my aunt's which would fund their payment and my father and uncle from getting their money. It seems like the attorney just wanted to point the finger at the easiest person because he wasn't getting his money quick enough. Go anywhere else but this place. It is their duty to protect and execute the wishes of the client. This place failed to do that, signed estate documents or not. Also, I was named the estate executor in the unsigned estate documents, and the estate was supposed to be divided equally between myself and my siblings. It's unreal how different the document is than reality, yet this office doesn't seemingly want to even acknowledge any of this happened since they don't even maintain their own documents they created.

Steer far away if you’re considering her for any custody matters. Almost one year into my case and still did not have a child support order. Met with her once in person and once over the phone. Rarely and almost never responded to my questions and concerns, nor advised or met with me prior to hearings. The only mistake I made was putting my full trust in her. I’m an attorney myself and I was extremely disappointed and saddened by her representation after a friend recommended her to me. She set me back when she knew I was dealing with a high conflict ex spouse who was physically, emotionally, verbally, and financially abusive. Not to mention, I was pregnant and unemployed. With all due respect, she played a major role in making our (my children and I) situation worse.

This man was my attorney on a criminal case and he would not listen to a word I had to say. My first time ever getting in trouble and was told the whole time I would not get incarcerated then day of sentencing I was given 2 years and after the bailiff arrested me and we went in the back he said your a bigger guy you will be ok!! My family always tried to contact him and couldn’t get ahold of him!! I my own judicial release from prison and he had no idea because he wouldn’t return phone calls!! So I wrote my own judicial release and got it filed on my own and day of my judicial release hearing he randomly showed up and had no clue because I did everything on my own then after it was granted from the work I did I sat in Cuyahoga County jail another 7 days because he didn’t make sure judge signed off on all paperwork so I finally got released 7 days later on Christmas Eve when my family went to the judge and explained I was still in county!! So stay away do not waste ur money even if you’re life depended on it stay away from this crook!! If he is your court appointed lawyer ask for a new one or you will get incarcerated and told you are a big fella you will be ok it will all be a lie he doesn’t help you just looks to get money!!! David Abromowitz was the lawyer I hired to help set up my IV Hydration and Vitamin Infusion business. He charged me quadruple what was discussed (quoted me 3.5-5K - charged me over 20K and I paid a final amount of OVER 12k - astronomical amount) and took 3 times as long to complete the job. Three other nurses in my coaching group (NursePreneurs) had similar experiences with him and another nurse, coincidentally, came forward today from a different IV Hydration/Vitamin Infusion business reporting the same story. RNs - be warned! He is dishonest and will overcharge you! I notified the BBB but his response was "I'm sorry she didn't understand". You and I both know the truth, Mr. Abromowitz. I was in wreck caused by a police offer. Due to terrible laws not lining with logic, I could only go after others who hit me. I contacted this guy. At the time his reviews were a little better(cough). I see they went down. Anyway, he had to go after my own insurance company since the girl who hit me didn't have insurance. Laws, got it great. Unfortunately my other half didn't put a good amount on our insurance policy for idi0ts without insurance. Long story short, we finally come to a close. He has me sign at his home (pretty ballsy in my opinion) to sign the papers that the case is closed and I was excepting $8k ( give/take a few bucks. I'm Rounding) for pain and suffering. 2 months later I receive an email from the this guy stating I owe the chiropractor office little over 1k for the settlement. This isn't my first rodeo, unfortunately with being rear-ended. Everything should have been finalized when signing. I talked to the chiropractor and here this lawyer didn't pay attention to his math. Then I received my ambulance bill of $700 and little over 1k for my christal clinic bill. This guy missed mathed almost 3k, I needed to settled after the fact things were "closed". Luckily my health insurance covered it, except the chiropractor. I had to take care of it myself. Last I checked i had my career. If i mess up, people die at my job. I simpky don't mess up. I shouldn't have to fix others career mistakes. Unfortunately, this guy has a clause in that final paper work that covers his mistakes. Sad when you mess up enough, you need to cover your own mistakes. I call it deliberately done. He gets 1/4 of the OVERALL settlement. He gets the settlement as high as possible. Gets that 1/4 then you get the remaining he " miss calculated". Good snakey deal huh? His excuse was I was lucky to get his rate at 1/4 and not 1/3rd and I had a pre-existing condition. A deal doesn't mean you get to do a terrible job. My condition was a c5 to c6 herniation of 1 mm. This wreck was a c5 to c6 to c7 herniation. C5 to c6 became 3mm. I have never suffered so bad with constant pain. I do NOT recommend someone who gaslights and underminds people. Wouldn't be suprised if he didn't try to sue me for posting FACTS. At least post a bs comment trying to justify his actions. Ps my dude, I can get all kinds of law info from the chiropractor, my other halfs dad who is a sheriff and my sister who is in law. Unfortunately doesn't do these kinds of cases. Otherwise I would have picked her. Just do better. Answered the bs on the pre-existing condition. So did the chiropractor. Clearly you don't understand a what a herniated disk is. That a 3mm is bigger than a 1mm. A new disk being herniated is not pre- existing. There goes that gaslighting again. Blah blah blah. Comment. It is okay i finished doing your work for you. I did the foot work for you and submitted the rest of what you didn't. I submit them several times. As I should not have had to.

Cassone Law Offices was contacted in September of 2021 to take on my case involving a house purchase on a land contract. I invested over $30,000 into remodeling the property but, unfortunately, misplaced some receipts and could only find documentation for $21,000. Michael Perry, who was selling me the house, requested pictures of the remodeling. Shockingly, he then used those pictures to sell the house out from under me and my three children. When I initially spoke with an attorney from Cassone Law Offices, they assured me it was an open and shut case. Fast forward three years, and I still haven't received any compensation. The man who scammed me out of my savings has since inherited a considerable amount of money, yet it's a struggle to get any response from Cassone Law Offices or see any progress in my case. It seems that everything went downhill for me when they lost their paralegal, Lisa D. Despite the lack of results, I keep receiving bills from the office claiming I owe money. I only want to recover the money I invested in the house, which was in a blighted condition until I fixed it up. My family and I ended up living in a hotel for a year after the house was sold out from under us. I don't know what to do anymore, and I'm deeply frustrated and upset by the lack of action and communication from Cassone Law Offices.

I was absolutely astonished by the rudeness and lack of empathy from someone who is supposed to be a professional and beyond my side if they represent me. That lawyer At first said flat out, I’m not gonna take your case. Then he changed his mind and said wanted to charge me $2000 extra dollars for the retainer plus extra money hourly there just because I was going through a domestic violence relationship and just because he felt like it was going to be a complicated case. Not only that but he said “what kind of mother are you?” (To have been stuck in an abusive relationship), “have you gotten a mental evaluation lately?” “The more I learn about you the more I understand why other lawyers won’t take your case” he also asked Intimate details of my trauma which was totally irrelevant to the context. You do not ask somebody what happened to cause PTSD!!! I felt like I was totally in the twilight zone. Do not fall for his shock and awe attempts at manipulation to get you to pay more money to him for him to mistreat you and not even be on your side if he’s gonna be your lawyer!

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
