They tell you they can take your case. Contractor comes to your house get your information and sign paperwork. Then an attorney calls to tell you they can’t take the case and when asked why, the conversation goes in circles instead of the attorney just telling the truth. Waste of time. Get a second opinion before considering them because they will tell you to get a second opinion.

The past year I’ve spent 14,000$ in fees alone in Gustafsons office. The only thing he has helped us do is create more trouble for us to spend more money in his office. He will take advantage of your vulnerable situation. Do not rely on this man to hold your best interest dealing with criminal court. If I wanted a public defender they are nearly free. He has 0 respect for the people he works for. I’m not here saying this because I’m mad with him or because he lost a case this is the truth. I just fired him from my case that he was representing us on even thought Ive already paid him 6,000$ 2.5 months ago to represent me during this case. I have lost that money and hired another lawyer because we can’t trust him to do the job I hired him for. He played us like a fiddle from the beginning. Please take this advice and don’t let yourself get in the position we’ve allowed him to put us in. There were cases he won but not because he’s good, only because we had evidence contradicting these so-called victims police report. That’s not the point the point is he will TAKE ADVANTAGE OF YOU.

I hired Ms. Fudge at the suggestion of another attorney. I paid a flat fee. The case dragged on with no resolution. Finally, after paying a fee to Ms. Fudge, she suggested I let her be relieved of the duties which I had already paid for and I ended up having to pay thousands to another attorney to finish the case. I should have been repaid for the expenses paid out of my pocket to Ms. Fudge, but the judge only allowed slightly less than 1/3 of what I paid to be reimbursed to me stating that the court didn't feel she had earned what she was paid; therefore, I was screwed out of several thousands I paid to her. Not happy with service or results.

She showed up to my divorce hearing wearing a skin tight dress that just passed her hips a item someone would wear to the club and trashy stiletto hills. She showed up unprepared and when the judge asked her questions she kept looking at me for answers. I would have been better off representing myself. Her mind was on her son going to jail. She admitted that to me after the hearing, and instead of apologizing for making us loose the hearing ( I supplied her with PLENTY of evidence weeks prior to the court date) her response was "you married him".

I hired them for a simple Commercial eviction and was given a quote and a timeline on getting the tenant out. The price was 3 to 6 times what was quoted and it took 3 times longer than they said. I finally started making phone calls to the court and I got got the tenant out myself !!! They don't communicate, and when you pressure them for an update via email (1 or two sentence email) they charge you big time, every time. They are lazy and don't follow up with the courts. They cost me an additional tens of thousands of dollars. Do yourself a favor and find a law firm that actually does there job!!! Your better off representing yourself !!! I hired Mr Hyland because he told me I had a slam dunk case. 1 year later, I was battling just to break even and not lose any parental rights that I had. It all came down to finances. He never expected my exwife to lie and fight I guess. Lol. He never filed inquiries I requested to prove my case and just wanted it over at the end. He was pushing me into a settlement that I didn't want but felt compelled to accept because it was obvious that he could care less. So overall, don't believe in him and dont hire him unless your pockets are deep. He appears to lose that loving feeling as the well dried up.

Long story short, the closing was handled in the manner my family desired. And as a result, my has used his firm for more closings and other matters. Hired Xavier to represent me to negotiate with the insurance company after a boat accident in which I sustained significant facial injuries. I feel Xavier didn't put the time in to understand the whole picture. He seemed to do a cursory review, if that, of everything. He was telephoning me at least five or six times a week for five months during his representation of me, and I felt I continuously had to reiterate the same things over and over to him. I finally became frustrated and had a conversation with him about it, relayed to him everything he kept getting incorrect, and expressed I was not happy. Three, four days later, he sends me his first draft of the demand letter, and the things I had JUST expressed to him in that conversation were incorrect were still incorrect! In his initial draft of the demand letter to the insurance adjuster, he didn't even have the mechanics of the accident correct. He indicated I was thrown from the boat necessitating a water rescue. I had relayed to him AT LEAST 50 times the boat hit the pylon, my face flew into the center console and was knocked unconscious, another occupant got a life jacket on me, and THEN the boat sank. Although I told him repeatedly I remembered floating in the river and then being pulled up on the overturned boat and that I had floated in the river for at least 30-40 minutes before the rescuers got to us, he indicated in the letter I had no memory of anything. In fact, he was also told I was not sleeping well because I was having nightmares about it. So with all the information I provided him, plus our nearly-every-day telephone conversations about everything, he definitely should have had that down by five months! He also didn't have my medical providers or all of the treatment I received correct, and it didn't include some of the significant injuries I sustained outlined (tooth shoved up in my jaw, breaking the jaw and requiring surgery, and shifting of facial bones from impact were the big ones, but there was swelling and bruising that lasted for months as well). I kept copious notes of my recovery and treatment and conversations with my medical providers and photographed my injuries and the healing process. Xavier was in possession of all of it. In fact, I mainly maintained those records for him so that everything would be all laid out for him. It was disheartening to learn at the end the information I was providing him he wasn't taking the time to read and digest. That is what a client hires an attorney for! Along with a couple of facial surgeries, I had a few bumps in the road during my recovery. My life consisted of and I was focused on doctor's appointments, surgeries, and recovering. That's why I hired a lawyer in the first place. So I put my trust in Xavier, and I feel it was his job to know my case intimately, to learn all the facts, understand the treatment and surgeries and who the medical providers are, and have a concrete grasp of all the injuries suffered, all so that when it comes time to put the demand letter together and begin negotiations, he is able to speak intelligently about my case and advocate for me with vigor. Unfortunately, that didn't happen. Therefore, Xavier gets two thumbs down.

Had a great experience at first. However, she likes to play the long game and blame others so she doesn't seem money hungry. For example, she provided me a document and told me to fill it out and have it notarized. When I did, she stated it was incorrect and I should have known how to fill it out simple documents. With better communication and patience she could be great. For now, all she sees is dollar signs.

There were a lot of things he could've done to help win my case but he didn't. I even offered a lot evidence that he never brought up to help win my case. All he cared about was that I paid the legal fees and didn't try very hard to help win my case. I had tons of evidence against the other side that he ignored. I think his agenda was to drag the case out for as long as possible so to rack up the legal fees for me to pay him more over time as opposed to using the evidence to shut down the other side.

I responded to an ad to buy waterfront property out of a development on a nearby lake. The one day sale was set up to do mass showings then if you wanted to buy you signed a contract on the spot for the lot of your choice. The land was beautiful and prices were very good so I entered into a contract. The Seller made no provisions for any due diligence and set an aggressive closing date. After several months I got suspicious and hired Mr. Jordan to review the entire transaction. He found numerous issues with the covenants and restrictions rendering the property unmarketable. These issues were not apparent to me and I am an attorney with the experience of many deals under my belt. Mr. Jordan was able to terminate the contract against the Sellers vigorous efforts to force the closing, saving me from a terrible and expensive mistake. His knowledge of real estate law was immense and instrumental in causing the Seller to return my earnest money. His fee was very reasonable and I would have no hesitation in recommending him to anyone needing real estate advice.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
