I just became a US citizen and I do not think it would be possible without Jason. He helped me first with the resident card and removing all the conditions and then told me when I was ready to become a US citizen we could do that as well. He made the process very easy and I felt so prepared when I went to the interview to take the test. Don’t forget to study your 100 questions! Thank you Jason !

I can’t believe how fast Jason got me my green card. Really, in just a few months I became a permanent resident. He was referred to me by other lawyers who had mentioned the success he has had with other clients and now I see why. A high quality immigration lawyer. Incredible lawyer and person! Would 100% recommend!

I've worked with Brian for 5+ years as our company has grown from 5 people to 45. Brian is more than "just" an attorney and is a trusted advisor to our firm. In additional to quickly and competently handling any issue we have related to internet law, Brian has kept us in the loop on upcoming changes and gives sound advice that has helped us protect our brand. I wish every attorney was as competent as Brian.

I found Brian Hall online when our company in Chicago was a victim of cybersquatting by a party outside of the United States. We could not have made a better choice. We were concerned that because this was in international issue, we would have no recourse. In addition to being an expert in this area of law, Brian was fast, efficient and laser-focused. Within days, the problem was resolved to our benefit and complete satisfaction. Brian did not stop there. He asked if our logos and trademarks were up-to-date. They were not. Some of our trademarks had lapsed; others were never registered. He was instrumental in ensuring that all our logos and trademarks were properly registered in the U.S. and in Mexico. This was absolutely critical to securing our brand names. Finally, Brian suggested that we have a signed agreement with our network of distributors, and he provided us with an excellent distributor agreement that clearly defines the responsibilities of both parties. I highly recommend working with Brian Hall. He not only took care of our immediate domain name problem, he focused our attention on other aspects of securing our rights to our brand and positioned our company for the future.

Lauren provided excellent work and guidance in reviewing a contract I had been presented with from a new client. She was prompt with her work and clearly explained the legal aspects to me when I had questions. Lauren wrote portions of the contract to protect the interests of my small company, but she was also very fair to the client and worked for a win-win outcome. I recommend Lauren to anyone needing legal services that she covers.

I hired Lauren in a rushed situation and she handled it with perfection and ease. I need a detailed contract to be prepared for a consulting agreement I was entering into with a company, as well as a sales commission agreement and a non-disclosure/non-compete for a partner I had just engaged with. I called her in need to all of these items to be done asap, within a day. That same day she drafted the items, sent them to me for review and completed all my edits in a timely manner. She answered a barrage of questions and counseled me though them all. She is professional, responsive, and knowledgeable. I will be using her for all my business needs going forward.

I hired Mr. Walters to handle a case dealing with an apartment complex that failed to provide services regarding an issue with hot water. The case went to trial. I have dealt with and hired many lawyers over my years. Personally, I have never experienced a lawyer who is so diligent in their works. Mr. Walters did much case law research and was extremely prepared for trial. During trial he brought forth excellent argument and handled himself in a professional manner. Mr. Walters, I applaud you for your efforts in my case. You did a fantastic job and thank you.

While going through a trying experience I was lucky to have found David Walters. He is positive, supportive and knowledgeable and did whatever he had to do to win my case. His positive interaction with other attorneys and judges was nice to see because it seemed like he was well regarded by his peers. To feel in control of an uncontrollable situation is a rare thing, and he made me feel that way. I don't usually write reviews but a I had to comment about an attorney that is honest and has a lot of integrity.

In seeking help, Max's staff was very professional in providing me responsive help from Max himself. When I spoke with Max on the phone for the first time, Max was already familiar and knowledgable about how to help me. Max even went out of his way to meet me in person to provide me that free consultation and Max was spot on about my situation. During that consultation, he gave the pros and cons of the situation and advised me of all possible options available to me. I was willing to hire him on the spot but he recommended that I evaluate my other options before I hire him. Max Harger is definitely one of those attorneys who is passionate about what he does as demonstrated by his knowledge. And he's definitely not of those stereotypical "ambulance chasers" as he's not concerned about the bottomline. Lawyer jokes can NOT be made about Max Harger because I definitely respect what he does for a living. I whole heartedly, without a doubt, recommend Max Harger for legal assistance.

Even though Mr. Harger has a lot of clients, time and time again he has responded to my inquiries via email almost immediately and answered every one of my phone calls the first time I've tried him. His ability to draft complicated terms of service and compensation schemes is exceptional. He projects a knowledgeable, friendly exuberant attitude and is fair in his billing time. I could not be happier with Mr. Harger's services and will certainly continue to seek his legal council on all fronts regarding my entertainment business!

Phyllis Blees is a brilliant lawyer! Phyllis created a 501-c-3 tax exempt school, the non-profit arm of my math consulting business. She guided me through the complicated legal process of establishing the non-profit entity, clearly explaining every step of the process. I was grateful to have someone taking care of the nuts and bolts of getting everything filed in a timely manner and communicating the legal requirements in a way that a non-lawyer can easily understand . I'd highly recommend Phyllis. She's highly knowledgeable, responsive and a true professional.

I am writing to recommend Tim Lee for legal work. Tim has been my company’s go-to person for legal matters for over seven years. We have used him to draft, review and negotiate contracts on multiple occasions and have always been pleased with the results. He has handled our trademark and copyright filings and advised us on how to protect the intellectual property we have. Tim has also been very helpful with employment matters. He drafted our human resources policies and procedures manual and we regularly consult with him on employment agreements and other matters as they arise. We have had several matters come up over the years that could have easily ended up in a courtroom, but Tim helped us avoid it. Some lawyers seem eager to file a lawsuit when a contract dispute arises, but Tim works with us, our clients and vendors in an effort to resolve our problems in a manner that minimizes cost and is most effective for us. In addition, unlike other lawyers, Tim has taken the extra step of learning how our business operates and what our priorities are. We are very pleased with the legal service Tim provides us and hope to keep him as our attorney for many years to come. Sincerely, Scott President/Founder Screamer Co.

I met Jenny informally at a meeting and immediately liked her as a person. Our introduction was a lucky coincidence as I had just started a business and happened to be seeking legal advice. I was confident that I could easily find a well qualified and talented lawyer, but I wanted more than that. My business is my passion and my life and I wanted somebody that would treat it as such. Jenny stood out in a crowd of professionals as she was friendly, down to earth, and had a warm, welcoming demeanor. I honestly could not believe she was a lawyer. She is sharp, witty, and extremely intelligent, as many lawyers are, while also being a compassionate, kind human being with a wealth of knowledge and experience, which many lawyers are not. She is an exceptional lawyer and an exceptional person. Lawyers become lawyers for many reasons, it seems like Jenny is a lawyer because she thoroughly enjoys it. It is her career, her service to the world, and her passion; it shows in her level of dedication to, and consideration for, her clients. She is an excellent educator and I applaud her for being so incredibly adaptable, yet solid in her values and limitations. She knows exactly what she is and is not willing to do in her practice, and is very straight forward with her intentions and statements. Bottom line, she is an honest, trustworthy person and she is great at her job. She is exceedingly fast at writing documents, and is very efficient with her time. If you write her an email, you are guaranteed to hear back from her as soon as is humanly possible. In addition to providing superior legal protection for myself and my business, she also has a great personality, and manages to be incredibly fun while maintaing a high degree of professionalism. She has earned my business and my loyalty, and I plan to use her services for years to come.

I met Jenny when she was giving a presentation on ip, contracts and business formation at a tech entrepreneurs meetup. The presentation was quite good, and since I'm looking to start my own business, I took note, because I'd been on the lookout for a lawyer I could trust to understand these issues in the context of software development. As it happens, I ended up landing some contract work, but felt really uncomfortable with the language in it, particularly regarding the ip. As a programmer, this is a really important area for me. Since it was my first time using a lawyer for this kind of thing and it was also a very small contract, I decided to try out oDesk but was pretty dissatisfied with the results. After wasting a lot time and money, I decided to contact Jenny and to be honest, I'm really glad I did. At this point, the employer was getting frustrated at how long it was taking to get the contract back to them and I was a bit desperate. I reached out to her, and she got back to me right away. We talked about my situation and concerns about the contract, and she got started immediately, even meeting me on the weekend to handle some paperwork. After a quick turnaround, she walked me through all her changes on the phone, explaining her rationale and patiently explaining points that I didn't understand. Personally I appreciated this, since I always look to increase my understanding on top of getting what I need done. Since it's in my nature, even though I was having a lawyer look at the document, I did a lot of research on my own regarding software contracts, and what should be in them. Having never done this before, I wanted to be more informed, and I'm glad I did, since it allowed me to gauge that the work done for me off of oDesk was not high quality. That being said, I was feeling pretty skeptical when I hired Jenny, but I couldn't have been more happy with the end result. She was able to tell me what wasn't standard, what was missing, alter language to make the contract more fair for me and even pointed out certain language that I thought I understood, but I guess in a court of law, does not mean what I think. At the end of it I was quite happy. As unfair as the contract started out, I felt very confident in the end result. Throughout the whole thing, I felt she understood where I was coming from as a programmer, which was the most important thing to me. I tried to go the cheap route with oDesk and got what I paid for. After going with Jenny, I feel like I got more than I paid for. I'll definitely be going back to her when I need a lawyer in the future.

Steven greatly helped me settle a dispute with Universal Music Group about their copyright claims. As a wedding videographer, I never dreamed that a huge company like UMG would go after me for copyright infringement, but they did and Stephen helped me understand how important it was to take the whole thing very seriously. He helped me figure out what UMG was demanding and fought to push back on many of their demands. This helped lower the final bill tremendously. He negotiated for the lowest possible amount of fine ($750) for each of the songs. I'm so happy I hired Steven to represent me in this extremely stressful lawsuit. He always quickly returned emails and even kept me on schedule when I procrastinated. When UMG took months and month to answer, Steven kept me up to date with quick emails that he didn't charge me for. I really appreciated how professional he was through the whole process. I felt that his fees were very fair and I would hire him again if needed.

Jacob has extraordinary skills as an intellectual property attorney. His ability to understand nuanced comments and reconstruct them into meaningful approaches for his clients is an important asset. Jacob is a people person, which is very important to founders of start up and early stage companies who are seeking patent protection for their intellectual property. Jacob's skills at interpteting IP law and the process of securing a patent greatly benefit his clients. My short experience with Jacob has been nothing short of excellent and in a relatively quick time frame, he has played an integral role in securing patent protection for our IP. I would not hesitate in engaging Jacob in the future and in fact, already have done so!

Mr. Whitehouse guided my web firm through a rather intricate start up process with total aplomb. He has excellent communication skills, and was able to keep me in the loop despite my relative ignorance to all things business. He was overly attentive, regardless of the relatively small-scale of our operation, He was far and away the most adroit business attorney that I have ever dealt with, and we will continue to use him for all our contract matters.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
