Todd Bonder represents me in a case that is both financially significant and emotionally fraught. Reviewing his communications with opposing counsel and with out-of-state attorneys whom he has engaged on my behalf, it's clear that Todd is like a chess player thinking many moves ahead of everyone else in the game. Todd has been equally good on the personal side, answering questions and keeping me apprised of all developments in real time. Also, Todd's distaste for the evasive and ethically questionable behavior of opposing litigants and counsel has highlighted his own high ethical standards and increased my comfort level with him. As a professional and as a person I've come to hold him in the highest regard.

Todd Bonder is simply a first-class attorney. He is technically expert, aggressive without being obnoxious and, perhaps most importantly, compassionate and a wonderful listener. My legal matter was emotional and sensitive and involved revisiting painful issues and I always felt that Todd had my best interests at heart as a human being as well as a client. Todd's experience and professionalism gave me a great deal of confidence and I found Todd to be extremely responsive and efficient. I simply cannot recommend this man strongly enough.

Todd Bonder has served as my outside counsel for more than 10 years. We have worked on an extensive number of diverse matters together, and I (and the companies I have worked for) have always been thoroughly satisfied. Todd not only knows the law, he never fails to look at the "big picture" when advising clients about their options. Based on my experience, there are a number of large law firm litigators who are quick to run up hours and file cookie-cutter claims when they receive a new matter. Thankfully, that is not how Todd works. Todd examines a client's issues in a practical, efficient and often creative manner, and then works closely with the client to ensure that the services he renders are those that are most likely to achieve the client's ultimate goals. I would encourage any in-house attorney reading this review to give Todd a call the next time you have a matter you are not comfortable handling in-house. Before you know it, he will be on speed dial.

“Erin Jacobson is hands down the best music and entertainment attorney that I’ve ever dealt with! I’ve hired many lawyers to assist in music licensing and publishing deals over my career and have have not had any that I would rave about. They all essentially did their job to some extent, but none of them actually worked hard for me or even pretended to be interested. Erin is not only very intelligent and professional, she also really cares about my business and takes pride in her work. Often, when you give a lawyer a retainer you have to hunt them down for updates…not Erin. She’s easy to get in touch with, quick to respond and always on top of it. If you want an attorney that will work hard for you, I’d obviously recommend her!”

"I think the best way to rate is to detail my experience. I hope this review helps. I'm an independent producer who, due to differences of opinions, had been inexcusably ousted from a project. I went above and beyond (the EP's words, not mine) in all areas; was on set where and when I could be, offered industry insight, assisted them with another production (for which I was made promises and they never followed through), introduced them to connections (for which they wouldn't have had otherwise), distribution (to which they snubbed their noses at), obtained pertinent info on an historic criminal case, info they never could have obtained on their own. That old adage "no good deed goes unpunished" well, does that ever ring true in my case. Bottom lining it, I was in for a percentage of the proceeds. The EP's decided they were not going to honor our initial verbal agreement. I knew that if I wanted to see a dime, I needed an attorney. I had spoken with various entertainment lawyers in L.A. and Michael came to me highly recommended by a manager who knows the business of "show" inside and out. He knows who's good, who's bad. Michael and his team were, in a word, exceptional. Knowledgeable, skilled, always responsive (it's rare for an attorney to always be responsive!), always took the time to make sure I understood the intricate details, and why the case had to take the turn it did. My case was simplistic yet complicated; both defendants were, well, beyond words. I'll stop there. So during discovery it came out that proceeds were so much lower than I had anticipated. Because the project turned out as it did technically (my opinions didn't matter despite being hired because of my expertise), and due to the inexperienced jacks of all trades/masters of nothing, there was hardly any return to speak of. Or so the EP's have said. Ask me if I really buy that, I'll tell you no. Problem is proving it. But in the off-chance what they have claimed they made is true, then they were an utter failure. I digressed; Michael and Paul were patient. They cared about the outcome. They guided me through the first trial; there was mediation at first and the proposed settlement was beyond a slap in the face. I'd have rather lost every penny at the judges hands than to settle with those two ignoramus'. Michael left me a voicemail while I was in court, he cared about what was happening. When I called him back, I told him what transpired. Additionally there was some paperwork that needed immediate attention. Although that trial was over, and we were then awaiting a verdict, Michael cared enough to take care of what needed taking care of. And we won! So I guess one time in court wasn't humiliating enough to these two inept wanna-bees; yep, you guessed it! They filed an appeal. I then had the Kernan firm by my side in court; they were allowed to accompany me this time. And, we won again! The satisfaction of having stellar representation, who is not only knowledgeable but professional, and can kill in court, that's sublime. For all I went through with an inexperienced, inadequate, irrational and highly unprofessional first-time "producers"- and I've worked with many over my 22 years in the industry- these two were the worst... and just to know that I had a competent, trustworthy, reliable and responsive team in the Kernan Law Firm- there are not enough great adjectives in our vocabulary to describe Michael, Paul and the whole team. If this thing went up to thousands of stars, the Kernan Law Firm would have that rating from me. I would use Mike and his team again in a heart beat.... and only Mike and his team. They're the best, (literally) bar none."

Usman was stupendous, professional, courteous, honest, and cognizant from the start! Given the many variables and complexity involved in forming a business entity, registering a trademark, registering a copyright, registering an EIN, determining whether a terms of usage and privacy policy agreement is required, and reviewing health disclaimers for an eBook, Usman was highly cooperative and responsive making me feel at ease. He answered my comprehensive emails succinctly and thoroughly. He recommended a service called Markify for conducting additional trademark searches outside of USPTO's database. He even went so far in responding very efficiently over the weekend, outside of business hours. That innate gesture is definitely praiseworthy and exceptional given time was not on my side nor was it for Usman. I needed answers quickly, even though I didn't explicitly mention these sentiments to him because that would be too impractical and idiotic. He understood my situation with all the nuances and did everything in my best interests to secure all the legal knots in a timely fashion without any hiccups. When it came to billing, he was cognizant of keeping me abreast of the total hours he spent on specific tasks. Using LawTrades, he took the time out of his hectic schedule to list the estimated project fees including all fixed upfront costs for registering the business and his hourly review rate. His financial transparency gave me a pretty good cost picture of his services with no surprises! Additionally, Usman telephonically walked me through the step-by-step instructions for obtaining an EIN for an LLC. That made the entire process seamless, saving me much valuable time. All and all, I would highly recommend Usman if you're looking for an intellectual property lawyer, creating a legal entity for your business, reasonable legal fees, and state-of-the-art service. Thank you Usman, for all your hard work, patience, and timely responses for consciously completing all my outstanding requests from start to finish!

I hired mr. Maddalosso for my startup to help put together a Corporate Guarantee to secure a significant bank loan. Mr. Maddalosso knowledge of this subject was in-depth, his research was thorough and he was obviously very experienced and reliable. What I also appreciated was his insights and advise surrounding the Legal Opinion he gave: he explained a lot about the underlaying contracts the juridical aspects and he pointed out several possible legal challenges and how to cope and overcome them (free of charge). Mr. Maddalosso is bilingual (English, Italian and Japanese) and the communications with him were very responsive, fast, direct and easy to follow. I actually was a lawyer myself before turning to business, albeit in a different field (criminal defence), but I can guarantee that mr. This is A notice , that if this firm continues to be dishonest , representatives im my case, I will be addressing my concerns with the State Bar. Intimidation has been used to try to discourage me to tolerate lack of representation towards my case. I’ve been questioned regarding statements that the opposing party has made after this firm contacted the opposing party. I’ve been told at least five times that this case was being filed with the court in the jurisdiction of my claim. I have yet to see any proof or case number in relation to this matter. My intelligence has been continuously insulted which has prompted this email. The doctors that work with this firm are also questionable. I’ve seen the Social Media accounts for this firm quoting that clients should be honest with the firm . While the firm follows a”do as I say and not as I do “ behavior. And in my opinion has poor work ethic. I have been respectful in this matter and patient. I don’t feel that I am being properly represented. I was told that A private investigator was hired and that I would be contacted , that it took 2 weeks to obtain insurance information from the Landlord who refused to provide her insurance. It’s been well over that time frame. I was told that the firm was providing payments upfront for filing and obtaining information. Although that maybe true this service is not free of charge. This is where intimidation and manipulation came into place regarding the percentage of my settlement. At this time I do not view this firm as trustworthy. I have kept my public opinion to myself, out of decency and respect. I don’t feel that anyone should be taken advantage of , because of lack of knowledge or different profession. Being rude , because a client is unwilling to accept anything said without proof is unprofessional is wrong ethically and morally. In my opinion it’s a manipulation tactic. I don’t appreciate the treatment I’ve been receiving, or the dishonesty. After I emailed this to the firm , I was accused of being disrespectful, which I now way was disrespectful . I expressed my true feelings regarding my experience and of course they terminated representation after this, to cover up their lies. I stand by what I said !

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
