We have worked with Lindsay on trademarks and trade dress for different products and have been extremely happy with the work she has performed for us. She is very personable, a great adviser, keeps us up to date on progress, and does a good job explaining the legal process in layman's terms. We realize we could not have done this without her knowledge and expertise and are very fortunate to have Lindsay on our team.

I've worked as a client with Lindsay Molnar on a variety of areas between contracts, litigation, trademark, etc and find her refreshing, as she is bright, responsive and has provided "common sense, legally strategic" legal advice and actions, for our various company groups. She is highly professional, bright and communicates extremely well (important when you need the "bottom" line to make sound decisions. I recommend Lindsay and continue to do business with her for our legal needs.

David has represented me for over twenty years on matters of substance that range from Real Estate Investments as well as General business matters with an emphasis on contract oversight. The attention to detail and legal insight ,born out of many years of practice at the highest levels, is apparent in all of his work. There is a reason as to why I intend to continue to use him, he's is simply the smartest most conscientious lawyer I know.

Mr Rudich has worked with our group on various matters for over 20 years. He is ever there, quick to respond and aggressively address any matter/issue that comes up. His is a cherished relationship, one that has saved us from ourselves on several occasions, and in the process saved us now in the low millions of dollars in operating expenses due to his unflinching grasp of existing and developing law as it applies to our field, which happens to be medical. I'm proud to count him as more than just a friendly acquaintance. He is a friend -- and a powerful one at that.

My experience with John Vukmanovic was positive and rewarding. His expert guidance, counsel and knowledge led me through a very difficult ordeal. He was cunning and tenacious... a true advocate that was always working for my best interests. I trusted him to handle my case and was rewarded with the best possible outcome. His people and negotiating skills are outstanding. I can't say enough good things about John.... I know people who have had bad experiences with attorneys, but I am an enthusiastic cheerleader for John's talents, skills, and expertise. Not only is he an outstanding attorney, but a genuinely considerate and thoughtful person. If you want a true advocate and need someone genuine in your corner, John's the guy!

John is an excellent lawyer. We hired him for a commercial litigation case. He was extremely responsive, and accessible, but also thoughtful, ethical and competent. He acted as a great counselor, was highly supportive and very easy to work with during a very stressful time. In addition, he was quite fair in cost applications. This was quite unexpected from a seasoned civil litigator and trial lawyer. We would highly recommend him.

We have been represented by Reid Dammann for several years in various matters and have found him to be very knowledgeable with patents, trademarks and other intellectual property matters. Reid has always been able to give us direct and effective advice and presented us with all options and alternative courses of action. This included advice on IP matters as well as prosecuting patents and trademark litigation. Reid has always gone that extra mile for us and has helped us out of some tight spots. We are glad to be working with Reid and would recommend him to others without hesitation.

Our firm had just spent over $25,000 on creating a new services website. We were using a new trademark based on an e-commerce name we had been using for well over 20 years. To our great surprise, we were slapped with a notice of litigation from a much, much larger online company that we were infringing on their web territory - that the names were "confusingly similar". We were referred to Reid through one of our firm's members. Reid and I teleconferenced. As a start-up we had limited funds for expensive legal fees. Reid's wise counsel, hard-won through numerous follow-up calls and appropriate filing response timing, not only saved us tens of thousands of dollars in protracted litigation costs, which Reid and I both knew would quite legally and obviously, win us an eventual victory, but also resulted in a compromised settlement with the plaintiff that allowed us to be compensated more than adequately by the plaintiff to simply change our domain name and surrender our new trademark to them. Although in theory, this settlement was less than palatable to us, his counsel was well timed and eminently practical. Thank you Reid!

As the Founder & CEO of a mobile software company, intellectual property is of tantamount importance. It's the core foundation on which our entire business is built. Over the years we've filed numerous patents and trademarks, and our attorney of record has always been Reid Dammann. We respect and value Reid's contributions to our overall business strategy so much that we followed him when he recently moved to a different firm. In fact, the only reason we signed a retainer with his previous firm was because Reid was the partner managing our account. I would not hesitate a single second to recommend Reid. He is incredibly smart, a master of his craft and is a joy to work with. Reid always takes the extra effort to make sure we're happy as clients. If you're considering Reid as your attorney, don't even think twice. He's the man for you.

Armen got involved in my case--which seemed very complicated, in the summer of 2015, when our judge started getting a little peculiar and guided the litigation--as well as the senior partner in his firm, through to the default judgment phase. And although there are some interesting technical points over the next six months that must be traveled, the outcome could NOT have been better. It goes without saying that I am NOT the easiest of clients to work with, and the manner in which Armen was able to diffuse my 'all-over-the-place' personality, while still dealing with an absolutely crazy judge to get the outcome we got was absolutely AMAZING and deeply appreciated. I will say that I will rest extremely easier once we are truly done with the judgment being satisfied, BUT to have gotten to this point, with the judgment that Armen obtained is truly one of the greatest things that has ever been done for me, as well as my family.

Upon settlement of my case, I felt that it was a fair settlement amount and that Mr. Manasserian did everything in his power to ensure this process had truly been as smooth and comfortable as possible. The landlords of the home I had rented for 4 years put the house on the market while I was still living there. I endured 2 invasive open houses where I was asked to vacate the premised as well as required to make the home presentable. When the home entered escrow, construction to shore up the foundation ensued. The foundation work required a crew of 4 to crawl under the one story cabin to dig out dirt. They started at 7:00 in the morning. I caught one of the laborer looking up from a hole in the floor in my bathroom, feces were left in my backyard as well as a pervasive urine smell. This went on for 3 weeks. The landlord did not reduce my rent or compensate me for this disturbance or my time. Nor did they intend to pay relocation costs when the house was sold and I was evicted. Mr. Fraser was able to secure $5,000 relocation fees and free rent for my last harrowing month in the home as well as full refund of my rent deposit and a little extra for my pain and suffering. This allowed me the means to relocate without further stress.

I highly recommend Makarem & Associates and specifically attorney Britland Kenworthy. I was fired from a brand new employer after I informed them that I had some lab results that were positive for cancer and urgently needed to get followup testing. Eight days later they terminated me. Turns out that I was cancer free but the stress of the whole situation was unbelievable and I was a mess. Makarem took my case and Britland fought for me even when it looked like a losing proposition. The settlement they reached was a lifesaver for my wife and I and I cannot recommend them highly enough.

Before I started the process of filing my patent, I had two questions: 1. Who will be the most professional lawyer who can take me all the way to where I want to be with my idea? 2. Will the lawyer be able to really understand me, my passion, and every aspect of my idea so we can bring my dream to life? The answer is Vincent Look, and the answer to the second question is an unequivocal and resounding yes. Vincent was beyond everything I could ask for in an attorney. He explained all of the legal steps involved in such a patient way. Then, on our FIRST call he made me feel like he understood everything I said and on the FIRST document he composed afterwards, I saw my dream described into words right in front of me in such a SHARP and PROFESSIONAL way that I could not stop thinking how lucky I am that Vincent is on my team. He is the BEST attorney a dreamer can have. He is RELIABLE, CONFIDENTIAL, PROFESSIONAL, KIND, WARM, AND A LEADER you can always trust. He is quick to respond, he is on top of his work, and I know any law firm would benefit from everything he can offer. All my appreciation goes out to Vincent Look, to whom I’ll always be grateful.

After speaking with several firms, I chose to hire Vincent Look as my patent attorney. He won me over from the first phone conversation. I could tell that he was very pationate and extremely serious. He actually made me feel as though my product was just as important to him as it is to me. The patent process can be very brutal. But if you have an attorney who’s doors are always open and keeps you totally in the loop, it makes the process a much more pleasant experience. Although, he has other clients, he made me feel as though the whole team was working solely for me. That’s COMFORTING. If you are in search for a patent attorney to represent you. Vincent is the one. I’m looking forward to working with him again on my next invention.

Four years ago, we went through an exhaustive search for an attorney to act as General Counsel to our young but growing business. We needed someone that was knowledgeable, tough, but also someone who shared our values. We had worked with a junior attorney that had made several mistakes and cost us big money. After the first meeting with Jorge, my partners and I knew immediately that he was the perfect fit for our company. Initially, we were concerned about whether we could afford someone of Jorge's caliber as it was an increase in hourly rate from our previous attorney; however, after four years of work he has saved us much more money than he has billed us. He speaks in plain English and quickly gets to the crux of any issue. We lean on his experience often, and consider him a friend. He has taken a personal interest in the success of our business and has played a crucial role in the development of our company. I would highly recommend him to anyone.

Not true. The webmaster decided on well over $30,000 for the site and with little recourse I had our attorneys battle it out. I wrote a check for $5,000 a month later and learned 2 valuable lessons. 1 - Always consult with the lawyer before you sign a deal with anyone for a business opportunity. 2 - Call Josh if you are being bullied and do not know what to do. Thanks man Davidkimmerle.com

I recently worked with MSD Law on an employment misclassification case, and I couldn't be more satisfied with their service. From the moment I reached out to them, I felt confident that I was in good hands. I first spoke with Brie and after I told her of the circumstances and she agreed to take on my case. She introduced me to Camron who would take the lead and he was great to work with. From the beginning to end, the team at MSD Law, Camron and Brie, is not only professional but also incredibly knowledgeable when it comes to employment law. They took the time to thoroughly understand the details of my case and provided clear, actionable advice every step of the way. Throughout the process, they kept me well-informed of where we were in the process. They even have an app that keeps you updated. What impressed me most was their dedication to getting the best outcome for me. They were tenacious in advocating for my rights, and thanks to their hard work, I was able to resolve the misclassification issue successfully. If you're facing an employment misclassification issue or any other workplace legal concerns, I highly recommend MSD Law. Their expertise, professionalism, and personal commitment to clients make them an outstanding choice!

I hired Jane to represent me when I received an NTA for an issue I had with my Green Card. I was notified that I had utilized a fraudulent I-94 to obtain my Green Card and was asked to appear in court to testify my case. My family and I were nervous going into this, we weren't sure what to expect, how to prepare, and what the outcome would be. Jane and her team walked us through the entire process and shared their expertise on cases like this. They assured me they would be with me through the entirety of the case and made sure I was given all the necessary information to be able to come out of the case successfully. Jane has a lot of knowledge and expertise in immigration law and proposed utilizing a lesser known waiver (247A1H) for my case. This strategy proved to be successful and the IJ approved of my waiver and granted me legal status back to the States. Fast forward a few months after the court case, and I have successfully obtained my US citizenship. After all these years of confusion and frustration with my status, Jane and her team were able to clear up my case in one swing and now I write this today as a citizen and a success story. I want to thank Jane and her team again for their patience during this turbulent time of my life and walking me through every step of the way. I'd highly recommend their services for anyone needing immigration law assistance.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
