Mr. Chapman represented us in a very long, drawn out and difficult case. He was extremely understanding and patient with us and worked so hard on our behalf. It is our opinion he was born to be a trial attorney. We would recommend him highly to anyone who asked...and in fact have already told a friend to give him a call.

As we entered our twelfth year as a co-defendent in a lawsuit between four well-known Texas cities, I called Mr. Walker, based upon my previous experience with him, for assistance. In less than ONE year, Mr. Walker was able to professionally, calmly and quickly resolve the litigation to all parties satisfaction to where all four cities have reconstituted their business relationship and have remained friends. Mr. Walker is the consummate professional and has the ability to explain complex legal issues to the layman. I have directly observed him in his communications with Boards of Directors, judges, Board of Trustees and a City Council. Mr. Walker has a "commanding presence" when he is speaking and providing guidance to his client, judge and jury.

We hired Jose portela to file lawsuit of massive fraud againt a fradulent enterprise in Dallas area engaged in looting millions of dollars from unsuspecting investors. We were looking for good hearted lawyers with iron fists. Jose got titaniums. The opponents had close to six to ten attorneys, some with so much experience their dentures would shake, but here is this young guy Jose with the zeal and lawyerly skills so effective that each and every motion we filed was accepted including contempt and sanctions against the defendant and their high octane zero power lawyer who basically kneeled to settle on our terms. This is a truly gentmany lawyer with tiger claws.

I received a DWI while being represented by another attorney, who I was unable to contact for the many questions I had afterward. Mr. Franklin stepped in to answer those questions, help me through the process and restore my license. His efforts were not only incredibly helpful but he was always available as well. I will rely on his speedy response and professional advice in any future legal matter I might have.

Mr. Whitehouse guided my web firm through a rather intricate start up process with total aplomb. He has excellent communication skills, and was able to keep me in the loop despite my relative ignorance to all things business. He was overly attentive, regardless of the relatively small-scale of our operation, He was far and away the most adroit business attorney that I have ever dealt with, and we will continue to use him for all our contract matters.

Tony is not only a rare breed among lawyers, but among individuals providing a service as well. He is responsive, knowledgeable and interested in his clients. I started working with him about eight or nine months ago on several business projects. He helped me work a number of situations that I thought would not work out in my favor. He told me what he would do and then he did what he said he would do. If he had an associate working with him, he ensured that that individual did what had to be done. I could not have asked for more. I have been extremely happy with his services and wish every "vendor" that I work with was as conscientious and diligent as Tony.

I was terminated from my position abruptly and my company owed me over $30,000 in commissions that had not been paid out. I have never worked with a lawyer and I have to admit I was weary of everyone I spoke to. I reached out to multiple employment lawyers around the state and Mary was the clear choice. Mary took the time to talk to me about my case specifically and answered my questions on the initial phone call. It was clear that Mary was very knowledgeable about Texas labor and employment law. Her rates seemed very fair and aligned with the market. I was happy to sign an agreement to work with Mary. Upon reviewing my employee agreement she noticed that all litigation was to be held in the state of IL. Mary could have moved forward and I would have never thought anything about it, but that is not what she did. Although she had already had multiple conversations with me and reviewed my documents she advised me to get a lawyer in IL to avoid higher cost overall. I was not charged anything for her time. Her honesty was greatly appreciated as money was a high priority being unemployed. I would turn to Mary for any employment or labor issues in the state of TX. Highly recommend everyone to give her a call!

I was in the process of buying a business and needed Andrea's services on really short notice. Not only did she respond very quickly, but was happy to help me. I was so impressed with how thorough she was and how much she actually knew about that area of law. She made suggestions about things that I would have never even thought of, and I believe that I was in very good hands. I felt like I could definitely trust her and proceed with the transaction with confidence. Her knowledge and professionalism was top-notch, and I will definitely contact her for legal services in the future.

I hired Bryan Garner and his team of five lawyers to work on an appellate brief for my client. His reputation as a top-notch writer is unquestionable, and I was interested to see it in practice. Blown away is all I can really say. His description of editorial consulting doesn't do it justice. It wasn't an "editing job" so much as a complete rewrite of the brief. Despite my initial skepticism during the process, the final production was impeccable--no-spin but persuasive, and above all winning. You've never experienced anything as intense as a round of serial editing in Garner's office. It is humbling but indisputably enlightening. It was a learning experience that I've put into practice in my group. We've made it a practice of reviewing some of Garner's edits on the brief we hired him on to use in our later work, hoping the genius will rub off on us. And squeezing out every last drop of goodness from that appellate masterpiece. This is one satisfied client, and I am eager to work with him again if I get a case that would interest him. The legal gods willing.

I recently hired Mr. John W. Ford, Jr., to represent me in a longstanding dispute. After a brief conversation with Mr. Ford on the phone, along with an initial consultation at his office, I knew Mr. Ford was the perfect attorney for this case! While there were a few complex issues to this case, Mr. Ford easily dissected each issue, provided me with options, and I always found him to be genuinely concerned about me, and my family member’s health and well-being! Throughout this case, with Mr. Ford’s guidance, we were able to achieve a satisfactory result for all parties involved. It is a rare combination to find an attorney that is highly knowledgeable, very well-prepared, always punctual for meetings and phone calls, while at the same time, having heartfelt compassion for his clients! I would highly recommend Mr. John W. Ford, Jr.

As a cofounder and CEO of Xtreme Lashes, I'd highly recommend Charles Sturm. Charles has been our Labor Law attorney for Xtreme Lashes since 2006. He has handled several cases and has achieved great results for Xtreme. Charles also created various contracts for our firm and has given us regular legal advice to guide our company as we grow internationally. Charles has become more than just my attorney, he's now a good friend as well. He truly cares about the best interest for the company and often gives good advice to position the company in a way to avoid expensive litigation in the future. You can't help but like Charles once you meet him, he's always courteous, respectful with a smile on his face and has a way of charming the other side into a positive result for his clients. He knows how to be firm, yet pleasant at the same time. A great to have trait in high stakes negotiations.

My house was struck by lightning, my insurance company had me jumping through hoops just not to pay me what was owed to me after paying into my insurance company for years. I hired Delphine James to represent me, Mrs. James contacted the company spoke with the manager who right away started telling her that he would cut a check for the items that were damaged to my home. I was going back and forth with them for weeks and they only started talking about paying me when Mrs. James got involved. They still wanted me to take all the burnt out items to have them tested on whether or not they could be fixed or need to be replaced, they also wanted to give me items that cost less than what i had in my home which Mrs. James sent them a letter stating that the items needed to be replaced with exactly what I had. Mrs. James did a wonderful job and took a lot of stress that I was going through from the insurance company away. She was very professional and very helpful. I appreciate everything she did for me and my family, I would hire her again and would recommend her to all my family & friends.

I am a season ticket holder for a sporting event in the West End. Last year the parking was converted from the honor system pay box to the Verrus system. I use this parking lot 2-3 times per week and have been ticketed so many times I feel it borders harassment! In the past it has actually cost me MORE money to fight the ticket, which is in error every single time. Catherine took over my case and was able to have my tickets, and any future ones I receive (in error) dismissed immediately (with no additional filing costs or certified mail fees!). The peace of mind I now have with Catherine in my corner is priceless. Next I want her to take on correcting this faulty system the city has put their trust in!

I am an attorney and cpa. I have a real estate dispute with another attorney about the meaning of various contractual provisions related to a disputed transaction. I found a case which I believed indicated my client had treated the transaction properly. Opposing counsel believed the case said just the opposite. I engaged Jeff to give his expert opinion on the case. Not only did Jeff agree with my position and explain why, but he also found other grounds and cases which supported my argument that the client had treated the transaction properly. All in all an exceptional piece of work. I highly recommend Jeff.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
