I am young designer who recently entered the IP world. Sheri has been instrumental in guiding me through the process of protecting my ideas and designs. Her rates are straight forward with no question marks or small print. This provided me with piece of mind and allowed us to move quickly as a team from initial conversation to completion of a set of provisional patents. Thank you and I am looking forward to continuing the partnership in the future.

I have had the pleasure of working with Sheri for a number of years now. I am a 20 year corporate counsel who hands out millions in work each year, and I am exceedingly picky and demanding in what I want. Timeliness. Communication. KNOW THE LAW. She is one who sets the standard on all of these. A tireless worker, gracious and unflappable, who would take whatever technology I gave her, learn it quickly and generate a great application, at a fair price. Exactly what every lawyer should strive to be.

I started out trying the patent process by my own by filing a provisional application. It was very detailed. I had a different firm convert it to a non-provisional. They took my money but did a horrible job. Always felt like they nickel and dimed me. I went to Jeff and he straitened everything out and got the application allowed which the others could not. He was always available and prompt to reply to my calls/emails. Wish I used him from the start. Don't go anywhere else. Start here with him.

Morgan, Fran and Team saved my life/career from being destroyed! I came to Morgan two years ago and he went to work on my cases (yes cases). The one thing I can say throughout the last couple years is don’t get frustrated. Listen to Morgan, even though the legal systems time line will sux and will go slow, stay the course. Morgan/Fran are supportive and will help you throughout the process. All my cases were dismissed last week. Best money and decision I could have made choosing Morgan and team. Regards, Kenny Tranum.

Sanjeev is a consummate professional. His exceptional legal and business knowledge were great to find. I, as a smaller contractor, had worked with a "deadbeat" general contractor that was not paying all of the other contractors on a specific project. I was not the only contractor on the project that wasn't being paid but I was able to get my money with the help of the Kumar Law Firm. It was truly an awesome experience. I learned so much by just being able to interact with Sanjeev throughout the process. I cannot say enough great things about Sanjeev and his law firm. If you find that you require the services of a very well versed and professional lawyer, I highly, highly recommend The Kumar Law Firm, PLLC in Austin, TX.

Ben Setnick represented us for over two years during a very complicated and contentious business partnership and we were thankful to have him. He is a brilliantly knowledgable attorney and conducts himself with the utmost professionalism. In dealing with both a prime/sub government contractor relationship and also dealing with labor union disputes, Ben made himself intimately familiar with the details of the contract. He was always so well prepared that we had absolute faith in his guidance. Our confidence in him was justified. In the course of time Ben was able to negotiate a very positive settlement between all parties. We are grateful to him for all his hard work and his expertise.

I am writing to recommend Tim Lee for legal work. Tim has been my company’s go-to person for legal matters for over seven years. We have used him to draft, review and negotiate contracts on multiple occasions and have always been pleased with the results. He has handled our trademark and copyright filings and advised us on how to protect the intellectual property we have. Tim has also been very helpful with employment matters. He drafted our human resources policies and procedures manual and we regularly consult with him on employment agreements and other matters as they arise. We have had several matters come up over the years that could have easily ended up in a courtroom, but Tim helped us avoid it. Some lawyers seem eager to file a lawsuit when a contract dispute arises, but Tim works with us, our clients and vendors in an effort to resolve our problems in a manner that minimizes cost and is most effective for us. In addition, unlike other lawyers, Tim has taken the extra step of learning how our business operates and what our priorities are. We are very pleased with the legal service Tim provides us and hope to keep him as our attorney for many years to come. Sincerely, Scott President/Founder Screamer Co.

I met Jenny informally at a meeting and immediately liked her as a person. Our introduction was a lucky coincidence as I had just started a business and happened to be seeking legal advice. I was confident that I could easily find a well qualified and talented lawyer, but I wanted more than that. My business is my passion and my life and I wanted somebody that would treat it as such. Jenny stood out in a crowd of professionals as she was friendly, down to earth, and had a warm, welcoming demeanor. I honestly could not believe she was a lawyer. She is sharp, witty, and extremely intelligent, as many lawyers are, while also being a compassionate, kind human being with a wealth of knowledge and experience, which many lawyers are not. She is an exceptional lawyer and an exceptional person. Lawyers become lawyers for many reasons, it seems like Jenny is a lawyer because she thoroughly enjoys it. It is her career, her service to the world, and her passion; it shows in her level of dedication to, and consideration for, her clients. She is an excellent educator and I applaud her for being so incredibly adaptable, yet solid in her values and limitations. She knows exactly what she is and is not willing to do in her practice, and is very straight forward with her intentions and statements. Bottom line, she is an honest, trustworthy person and she is great at her job. She is exceedingly fast at writing documents, and is very efficient with her time. If you write her an email, you are guaranteed to hear back from her as soon as is humanly possible. In addition to providing superior legal protection for myself and my business, she also has a great personality, and manages to be incredibly fun while maintaing a high degree of professionalism. She has earned my business and my loyalty, and I plan to use her services for years to come.

I met Jenny when she was giving a presentation on ip, contracts and business formation at a tech entrepreneurs meetup. The presentation was quite good, and since I'm looking to start my own business, I took note, because I'd been on the lookout for a lawyer I could trust to understand these issues in the context of software development. As it happens, I ended up landing some contract work, but felt really uncomfortable with the language in it, particularly regarding the ip. As a programmer, this is a really important area for me. Since it was my first time using a lawyer for this kind of thing and it was also a very small contract, I decided to try out oDesk but was pretty dissatisfied with the results. After wasting a lot time and money, I decided to contact Jenny and to be honest, I'm really glad I did. At this point, the employer was getting frustrated at how long it was taking to get the contract back to them and I was a bit desperate. I reached out to her, and she got back to me right away. We talked about my situation and concerns about the contract, and she got started immediately, even meeting me on the weekend to handle some paperwork. After a quick turnaround, she walked me through all her changes on the phone, explaining her rationale and patiently explaining points that I didn't understand. Personally I appreciated this, since I always look to increase my understanding on top of getting what I need done. Since it's in my nature, even though I was having a lawyer look at the document, I did a lot of research on my own regarding software contracts, and what should be in them. Having never done this before, I wanted to be more informed, and I'm glad I did, since it allowed me to gauge that the work done for me off of oDesk was not high quality. That being said, I was feeling pretty skeptical when I hired Jenny, but I couldn't have been more happy with the end result. She was able to tell me what wasn't standard, what was missing, alter language to make the contract more fair for me and even pointed out certain language that I thought I understood, but I guess in a court of law, does not mean what I think. At the end of it I was quite happy. As unfair as the contract started out, I felt very confident in the end result. Throughout the whole thing, I felt she understood where I was coming from as a programmer, which was the most important thing to me. I tried to go the cheap route with oDesk and got what I paid for. After going with Jenny, I feel like I got more than I paid for. I'll definitely be going back to her when I need a lawyer in the future.

While Greg's profile says specialization in personal injury, car accidents and trucking accidents, he is highly skilled, motivated, and resourceful in numerous other types of complex matters. Greg, secured a multimillion dollar settlement through the course of a very complex business and insurance case for me. When every other attorney said their was no liability or damages, Greg saw both and built a very strong case that increasingly put the opposing big-city "powerhouse" firms in their seats through the course of many high-stakes issues and hearings. Having repeatedly been on the raw end of attorneys over-charging and under-performing, hiring Greg has been a breath of fresh air and renewed my faith in knowing there are some quality attorneys out there in an ocean of those who give the overall practice a very bad name.

Fortunately, Attorney Johnson is very timely and has uncanny ability to deal with all types of personalities. Additionally her legal research and writing skills have proved to be a tremendous asset to us as we move forward with my husband's career in the music industry. With technological advances, changes to legislation and ongoing debates regarding intellectual property, royalties, etc it's key to have someone representing who is well versed. Attorney Johnson has proved that she is more than capable for this challenging area of the law and she comes highly recommeneded.

Being that this was my first time to file a patent, I had several questions about the process and a great need for it to be done correctly the first time. Thanks to Serena, my overall experience exceeded all expectations. She truly cares about the client in making sure all questions are answered thoroughly and in a timely manner. Her professionalism and knowledge left me feeling confident that everything would be done correctly. She pays close attention to detail and was patient in educating me along the way. I was kept in the loop throughout the entire process and now have an understanding as to what to expect going forward. I highly recommend Serena, Beth in the Denver office, and the Eldridge Law Firm overall if you are wanting your idea patented correctly.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
