10 years, $200,000 of legal fees and Meghan was literally the best lawyer we have ever had. She fought for our daughter not merely as a skilled lawyer but really as a mother. She knew our budget. She literally rescued our daughter from abuse. Our entire family cannot express words of gratitude. Hire her! She is like a Trojan horse in the spirit where she will fight for your family like her own!

On the evening of September 24, 2023, at 6:15 p.m. I was driving to my work as a night shift nurse at UMC as I have done 100’s of times before. I was traveling from my home in Henderson north on the 95 freeway to exit at MLK Blvd. At the 95/MLK off ramp I waited for the light to turn green then turned left onto MLK. I was then T-Boned by another vehicle traveling south on MLK that ran the red light. The full front of his car had severe damage. The right side of my car had moderate damage but was undriveable due to damage to the right front wheel. I got out of my vehicle and approached the vehicle that struck me. He appeared to be intoxicated. He was attempting to leave and was speaking to me in Spanish. Then in English he told me “We go, no police.” I called 911 and a brief time later an NHP officer arrived. He took my statement and called for a Spanish speaking officer to come and speak to the other driver. A Spanish speaking officer arrived and spoke to the other driver. The NHP officer gave me a report number. At this time, a friend or family member of the second driver arrived. They did a little work to his car then drove away. I could not drive my car due to the damage. My husband arrived and called AAA to have our car towed. Once my Adrenaline, calmed down my back and shoulder were hurting, and I went to the St. Rose De Lima Emergency Room from the accident scene where they performed a CT scan, X-Rays, and prescribed pain killers. I went home and rested and lost five days of work. I went to St. Rose Physical Therapy for 23 visits over a three month period and had three follow up doctors’ visits. Our car had $3745.40 worth of damage and was repaired by Frank’s Auto Body. We paid a deductible of $500.00. I was hit by a driver who was a Mexican citizen with a Mexican driver’s license. He was driving a car rented in Mexico. He had an insurance policy for the rental car with an office located in California. We contacted the Ed Bernstein Law Office the day after the accident because they have an office near our home. We provided them with the police report, photos, road maps, etc. They contacted the insurance company of the other driver and told us at first they were not responding then later told us they refused liability as their driver claimed I had run the light and his was green, which was not true. He hit me, he had severe front-end damage, his speed was fast enough that his air bags were deployed, my damage was on the passenger side. There were no witnesses, and the police report did not indicate who was at fault since neither officer witnessed the accident. Our insurance company, USAA, after their investigation declared we were not at fault. After six months the Ed Bernstein law firm informed us they were dropping the case as there were no witnesses and declared it to be a He said/She said case that they could not win. We disagree as the relative damage to each vehicle clearly shows the other driver hit me. I feel the Ed Bernstein Law Office gave up too easily without fighting for me. It took a month from the time of the telephone call informing us that they were dropping the case to when we received the certified letter dropping the case so I could proceed with another law firm.

Extremely unprofessional, Should be able to give Zero Stars. I was happy with the initial response to my inquiry regarding a potential case and the cost but as I was retaining them I got the we think this case is going to cost double. Really three weeks later as I'm retaining them. If that was the real cost why not tell me the upfront? Shady bait and switch! If you want your money to be taken then hire these people.

I (luckily) haven't had to deal with many lawyers in my life, but this location is a complete joke. Norma Jean is the first person you'll, unfortunately, run into and she makes it known from the beginning that you are inconveniencing her and she can't wait for you to be out of her face. I went to speak with an attorney, and for whatever reason they weren't in the office, I asked Norma Jean when they should be expected back and she immediately snapped back, "How would I know? I'm not a secretary!" I was surprised at the reaction so it took me a minute to gather my thoughts, but she managed to throw, "Is there anything else?" With the same horrible and unnecessary attitude. I just wanted to get out of there at this point, so I just asked for a card, I got a sigh out of her (of course), and I left. Afterwards, I tried calling the number on the card multiple times over at least 2 weeks to schedule another meeting and I just kept getting sent to voicemail. Finally, after weeks of hearing nothing from these attorneys, the issue was resolved and about 3 days after that, the attorney's assistant finally decided to return my call. I was shocked by how unprofessional, rude, and uncaring this 'professional' attorney's office was. I will never waste my time and money on them again and I recommend no one else does either. There are much better lawyers in Las Vegas.

I sued Amazon in small claims court because I got hacked and the software was launched from Amazon cloud with the defendant having knowledge of it being hosted there. Mr. Eaton was representing the defendant. He tried to win the case by insulting and verbally attacking me to avoid paying damages. He actually told the judge that the registered agent for Amazon didn't matter to toss the case even though jurisdiction was agreed upon during the first hearing. He then proceeded to call me an "amateur that delivered the papers myself" I have to admit I'm not a lawyer but what a fine professional Mr. Eaton is.

He was retained but never worked my case for 8 months. Then found out he never submitted any documents to the District Attorneys office on my defense. The only discovery the DA had was a statement the plaintiff wrote. Then he made a plea deal an hour before the deadline with the District Attorneys office the day before the bench trial without my consent. I just can't recommend an attorney that requested so much documentation for 8 months then never submitted it. I will never pay another attorney in full when retaining them again.

I contacted James Kohl in late January for a 144 legal opinion, as he was the new attorney for the public company. After supplying all of the supporting documents, I continued to follow up on progress and received roughly 1 email per week that he was busy, out of the office or working on it. On March 5th, I had to cancel the request due to no replies. I have had roughly 30 144 legal opinions done in the last 5 years through the previous corporate counsel and never waited over 48 hours to receive them. I feel this behavior is completely incompetent and has caused over $25,000 in losses due to his untimely conduct. Great news is I found out anyone can write a legal opinion and does not have to be from corporate counsel, so I contacted a reputable attorney and received the legal opinion within 24 hours after providing all of the documentation that I had sent James Kohl.

What a Lawsuit / Dispute Lawyer Can Do for You

A lawsuit or dispute lawyer, often referred to as a litigation lawyer, specializes in handling legal conflicts between individuals, businesses, or organizations. These lawyers represent clients in civil lawsuits, helping to resolve disputes through negotiation, mediation, arbitration, or litigation in court. They can assist with a wide range of disputes, including contract disagreements, property disputes, business conflicts, personal injury claims, and more.

If you are involved in a legal conflict and need representation, a dispute lawyer can guide you through the litigation process - from filing or defending against a lawsuit to negotiating settlements or representing you at trial.

When Should I Hire a Lawsuit / Dispute Lawyer?

You should consider hiring a lawsuit or dispute lawyer when you're involved in a legal disagreement that cannot be resolved informally and may require legal action. Common reasons to hire a lawyer include:

  • Breach of contract: If someone has failed to fulfill the terms of a contract, a lawyer can help you file a lawsuit to seek damages or enforce the agreement.
  • Business disputes: Whether it's a partnership disagreement, shareholder conflict, or a dispute with a supplier or customer, a lawyer can help resolve business-related issues.
  • Property disputes: If you're involved in a dispute over property ownership, boundary issues, or landlord-tenant conflicts, a lawyer can assist in resolving the matter.
  • Personal injury claims: If you were injured due to someone else's negligence and are seeking compensation, a lawyer can represent you in a personal injury lawsuit.
  • Debt collection or defense: If you're being sued for unpaid debts or need to collect a debt owed to you, a lawyer can represent you in court or negotiate settlements.
  • Employment disputes: If you're involved in an employment-related dispute, such as wrongful termination or discrimination, a lawyer can help you file a claim and represent you in court.
  • Defending against a lawsuit: If you've been sued, a lawyer can defend you against the claims, challenge the evidence, and negotiate a settlement or represent you at trial.

Hiring a lawyer early in the process can help ensure that your case is properly managed and that your rights are protected throughout the dispute resolution process.

What Does a Lawsuit / Dispute Lawyer Do?

A lawsuit or dispute lawyer provides a wide range of services to help clients navigate legal conflicts and seek resolution. Their tasks typically include:

  • Evaluating your case: Reviewing the facts and evidence to determine the strength of your case or defense and advising you on the best course of action.
  • Filing lawsuits or responding to lawsuits: If you're the plaintiff, the lawyer will file a lawsuit on your behalf. If you're the defendant, they will respond to the lawsuit and build a defense strategy.
  • Gathering evidence: Collecting and reviewing evidence such as contracts, emails, financial records, and witness statements to support your case.
  • Handling negotiations: Negotiating with the opposing party to reach a settlement before the case goes to trial, which can save time and money.
  • Representing you in court: Presenting your case in court if a settlement cannot be reached, including presenting evidence, questioning witnesses, and making legal arguments on your behalf.
  • Exploring alternative dispute resolution (ADR): Suggesting mediation or arbitration as alternatives to a trial, which can be faster and less expensive.
  • Drafting legal documents: Preparing and filing necessary legal documents such as complaints, motions, and responses, as well as drafting settlement agreements if a resolution is reached.

How Are Lawsuit / Dispute Lawyers Paid?

The fee structure for lawsuit or dispute lawyers varies depending on the complexity of the case, the type of dispute, and the lawyer's experience. Common payment methods include:

  • Hourly rate: Many lawsuit lawyers charge by the hour, especially for cases that require extensive preparation, research, and trial work. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Contingency fee: In certain cases, such as personal injury or breach of contract claims, a lawyer may work on a contingency fee basis. This means they only get paid if they win the case, usually taking a percentage (typically 25% to 40%) of the settlement or damages awarded.
  • Flat fee: For specific services, such as filing a simple lawsuit or representing you in mediation, some lawyers may charge a flat fee.
  • Retainer: In complex cases or long-term litigation, a lawyer may ask for a retainer, which is an upfront payment to secure their services. The lawyer will then bill against the retainer as they work on the case.

Discuss the fee structure with your lawyer during the initial consultation to understand how fees will be handled throughout the case.

How Much Does a Lawsuit / Dispute Lawyer Cost?

The cost of hiring a lawsuit or dispute lawyer depends on the complexity of the case, the lawyer's experience, and the fee structure they use. General cost estimates include:

  • Hourly rates: Lawyers may charge between $150 and $500 per hour, with higher rates for more experienced attorneys or cases requiring extensive trial preparation.
  • Contingency fees: If your lawyer works on a contingency basis, expect them to take 25% to 40% of any settlement or court award. For example, if you win $100,000 and the contingency fee is 33%, the lawyer would receive $33,000.
  • Flat fees: For less complex disputes or tasks, such as drafting a settlement agreement or representing you in mediation, flat fees may range from $1,000 to $5,000, depending on the scope of work.
  • Retainers: Some lawyers require an upfront retainer fee, which can range from $5,000 to $20,000 or more, depending on the case complexity and expected litigation length.

Make sure to ask for a detailed breakdown of fees during your consultation so you know what to expect.

Top Questions to Ask a Lawsuit / Dispute Lawyer

Before hiring a lawsuit or dispute lawyer, consider asking the following questions:

  1. What experience do you have with cases like mine?
Ensure the lawyer has handled similar disputes and is familiar with the relevant area of law.
  2. How do you charge for your services?
Clarify whether they charge hourly, on a contingency fee basis, or offer flat fees, and ask for a detailed cost estimate.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case and potential challenges.
  4. Have you handled cases that went to trial?
If a trial is possible, confirm the lawyer has courtroom experience.
  5. How long will the process take?
Get an estimate of the timeline for resolving your dispute.
  6. Will you handle my case personally?
Understand who will manage your case and their level of involvement.

How to Check the Credibility of a Lawsuit / Dispute Lawyer

To ensure you're hiring a reputable lawyer, take the following steps:

  • Check their bar status: Confirm with your state bar association that the lawyer is licensed and has no disciplinary actions.
  • Look for relevant experience: Review their website or professional profile to ensure they specialize in litigation or dispute resolution.
  • Read client reviews and testimonials: Look for feedback on platforms like Avvo, Martindale-Hubbell, or Google.
  • Ask for references: A credible lawyer should provide references from past clients.
  • Check for professional affiliations: Membership in organizations like the American Bar Association’s Section of Litigation can indicate expertise.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting, bring the following:

  • Contracts or agreements: Copies of any signed contracts or relevant agreements.
  • Emails and communications: Any written communication between you and the other party.
  • Evidence of the dispute: Receipts, financial records, photos, or witness statements related to the conflict.
  • Timeline of events: A clear chronology of the dispute, including key dates and interactions.
  • List of questions: Prepared questions about your case, the legal process, costs, and strategy.

Being well-prepared will help the lawyer assess your case effectively and provide you with the best legal advice on how to proceed.
