If I could leave less than 1 star I would..... I DO NOT recommend using brian........ He took my money, wasn't really interested in helping me or trying to fight for me I found out more things from google and people around me than I did from my lawyer..... he wanted me to take the first plea deal just told me I was guilty in every conversation. When I got new representation he didn't give me a single penny back. Save your money get a different lawyer

Ryan Henson and Millie Ibarra with Bevis, Thiry, Henson & Katz helped our family with a sensitive family law matter. They were patient, kind and available to answer our many questions. They guided us through the unknown and complexities of the legal system. They helped us understand the criminal proceedings and how best to engage with the Prosecuting Attorney's Office. They were strong advocates for our daughter and grandson. Ryan was open with his communication and helped us be prepared for each step through the lengthy legal proceedings. Millie was there to help us understand with dedicated ongoing, open communication. Phil and Krista also provided their views and assisted when needed. They are an excellent, dedicates team. We highly recommend them when you need a strong advocate with experience. Todd and Pamela Christensen

I had an absolutely wonderful experience having a consult with this law firm. The gentleman I spoke with was highly knowledgeable, with a keen legal mind and great emotional intelligence. He helped me to better generally understand how Idaho law governs the process I am interested in, gave great practical advice about the ins and out of what retaining Taylor law would be like, and was a genuinely compassionate and kindhearted person. I can tell from this call that Taylor law is one of the best forms in the Treasure Valley. Retaining them will place great resources and knowledge at one’s fingertips. I believe anyone would receive an organized service from sharp legal minds at this firm.

Nate has been a HUGE help throughout my custody agreement with my son’s father. As a single mother I had not the nearest clue what was going to happen and I was referred to Nate by a family friend, from the consultation I knew that he was someone I could rely on and loved how upfront and honest he was with how things were going to go. Both he and Katelynn made me feel at ease whenever I didn’t understand a certain issue and always answered any questions or concerns I had. Despite some unpleasant encounters with the other party they still remained very professional and assertive. I know who I will go to if I ever need help again. They have helped remove a huge weight off my shoulders by being supportive of my decisions and standing by me. They completely understood why I wanted a graduated schedule for a parent with little involvement. You are amazing at what you do and I am forever grateful for you!

After a 7-month long high-conflict divorce process with another attorney I knew my case was not handled the way it should be. I reached out to a friend who referred me to Nate. Nate had to jump into a very high-conflict divorce litigation process and had to undo a lot of damage done by how my first attorney handled my case. Nate took on the job, buckled down, and put much effort into my case. He did not make promises that he could not keep and always gave his solid and professional opinion when I had questions. I had to learn to trust Nate because I had been burned by my previous counsel, but I listened to Nate, followed through with his legal counsel, and the outcome was better than I could have imagined. Justice was truly served and I would not have been able to get through this nightmare without Nate and his team. He is knowledgeable, competent, and I could tell he was well-respected by the judge and court staff. I would highly recommend Nate to anyone I know who is in need of professional legal services.

Was referred to Trout to handle a very simple order to show cause. Fee churning in my opinion with two attorneys doing the work of one. Should have been a bill for no more than $10,000 in my opinion and I received a bill for $21,000 for a very basic order to show cause. When I questioned them about the large bill, they agreed to discount 10% but $19,000 is still about double what this should have cost in my opinion.

You kept our piddly $7062.60 the judge gave us for the 50 plus trees that were stolen from us! (We should have won a lot more) 7. We sued you for malpractice and your insurance company agreed to settle with us to which you were given the remaining amount of your fraudulent fees! 8. We did NOT want to settle our Fraud Claim and Malpractice claim against you, but our attorney demanded it as our expert witness we were utilizing to sue you for malpractice had worked in the same law firm as you and a conflict of interest arose! After reading attorney Steven Wieland’s bio, where he proclaims; “Winning at trial in a real-estate easement dispute involving a large lakefront commercial-development property in Northern Idaho” Well, I (the Trust manager) just had to respond! The Trust originally filed a lawsuit against two entities in Kootenai County Idaho, regarding an easement issue, illegal timber trespass, trespass, and other issues in October 2018, after sustaining millions of dollars in damages to their 120-year-old farmland, which included defendants building an illegal road on their property, and cutting down approximately seventy (70) one hundred (100) plus foot tall trees that can never be replaced. I reached out to Steve Wieland in January 2020, after our first attorney quit prior to Trial (Scheduled for early March 2020), wherein Steve proclaimed that he was an “Expert on land issues, especially easements, and was an experienced trial attorney.” In Steve’s first three weeks, Steve charged the Trust approximately $18,000.00 primarily for reading through the case notes I had provided. Steve also charged the Trust ridiculous fees to research how he would represent the Trust, even though he had stated that he was an “Expert” on the issues being litigated. Steve later jokingly stated that he didn’t think the Trust would pay him that much…REALLY…what choice did the Trust have! They were desperate and it was too late to find anyone else and Steve took advantage of this fact. The next couple of weeks, Steve charged even more outrageous charges for “…reviewing the case and strategy on how to win” instead of getting discovery completed, finding experts, preparing for a continuance, etc… At the first hearing Steve was unprepared and failed to procure a continuance for trial. The Trust desperately needed to disclose expert witnesses in order to win their damages. Steve failed to obtain any experts and failed to disclose the ones I had procured on behalf of the Trust, even though the judge allowed him time to submit them. The attorney who drafted the Trust original easement even met with Steve prior to trial to provide ideas on trial strategy regarding the illegitimate amended easement document (presented by defendants) in question as it was obvious that said amended easement had been manipulated and changed from its original format. Steve missed the opportunity to utilize “Failure of the Meeting of Minds” as one example to rid said bogus amended easement. The Trust was unable to secure a large damage amount at Trial as NO EXPERTS were retained to prove the loss in damages to their property. Steve had attempted to utilize his wife, Jaren, and even brought her with him for a vacation (at the Trust expense) in beautiful North Idaho where the two of them spent a great deal of time in the local pubs instead of adequately preparing for trial! Steve later charged the Trust approximately $30,000.00 plus in attorney fees on behalf of his wife who did absolutely NOTHING! During trial, Steve did not properly cross defendants witness, Sandy Young aka VERDIS, who the Trust believed had forged the amended easement document that was being disputed. The Trust was not awarded the million plus in damages to their property and only received the minimal amount of $50 dollars from the judge because Steve had never procured any expert witnesses to testify at Trial as to the extent of damages! Steve eventually sought almost $200,000.00 in attorney fees and costs for doing very little paperwork, and absolutely nothing to help the case! We hired another attorney to appeal. A monkey in a suit could have won the case with the overwhelming evidence I had provided to Steve to ensure a win! It was a no-brainer! The Trust eventually pursued legal malpractice against Steve Wieland So, before you consider hiring Steve Wieland (I would run for my life), make sure you have him put everything in writing and that he actually knows the subject matter you need legal assistance with! SEE RESPONSE!

I was referred to Pat Kershisnik through lawpoint for a free consultation offered through my job's employee assistance program. I recieved an email from a representative asking for a date/time to talk with Mr. Kershisnik. I replied back that I was available Friday, July 26th at 11:30 am for a phone consultation. After confirming the date and time they said that Pat would be calling me at that time. I did not recieve a call from Pat until 12:35pm, over an hour later. He left me a VM stating that he was scheduled to talk to me. I called him back about 10 minutes later and told him he was an hour late calling me, and instead of apologizing or explaining that maybe there was a scheduling error, he proceeded to get mad at me and told me I could find someone else to work with and hung up on me. I called him right back and started to tell him that I did not appreciate him hanging up on me and that he should not be treating potential clients that way. He then proceeded to start over talking me and telling me that if I didnt want his help then to find someone else and hung up on me a second time. At this point I had given up on calling him back but wanted to share my experience incase someone was looking to hire him. I am going through the worse time of my life with a divorce and custody looming over me and this is how Mr. Kershisnik treated me. I went with Erika as a recommendation from someone else who hired her for their divorce. My divorce went to court because my ex refused to let me have my children for 50% of the time and refused to work out any type of percentage on the equity of our home and expected the court to give her the home and all of it's equity without giving me any whatsoever. I hired Erika to try and get equal custody of my kids and an equal share of the marital home. Throughout the trial, it felt as though Erika was on my ex's side every time she complained about anything through her lawyer. Every time any accusation was leveled against me by my ex, Erika would approach me already believing I had done whatever my ex said and tell me why I shouldn't be doing it instead of even asking me what the situation is first or asking if I had in fact done what I was accused of. Example: Several times my ex complained I was withholding all my money from her when, in fact, I had removed her access to the online bank account but still kept her debit card active for her to spend (with no limits). I sent emails to her saying I was removing her access to the online accounts but she still had her debit card and could spend whatever she needed. My ex only told her lawyer that I wasn't giving her any money. Erika emailed me saying I absolutely was not allowed to withhold money from her and how it would look bad and how my ex still needed to be able to feed the kids and everything. This was the first communication I had received from Erika about this matter and her first instinct was that I was doing it and she needed to stop me from doing that so she didn't lose the case. During talks with her, many times I felt as though I had to defend the way I just wanted to parent my children to her. Or what I was asking from the divorce. Ultimately, it felt like Erika is used to defending women against men who are trying to abuse the system in their favor just to get one over on their ex-wives and treated me accordingly even though I was her client. To be fully transparent. During the case, I won the custody I was seeking. I received a smaller portion of the equity of the home's value when the trial first started (40%/60% split that I offered to the judge because I make more money than she does) . However, the marital home's value increased substantially during the divorce (by approximately $140k). I asked Erika about trying to submit a new appraisal or what I could do to get 40% of the remaining equity of the house when it was sold and was told there was nothing I could do about it and lost out on 40% of the additional equity money my ex pocketed from the sale of the house. I would not recommend if you are a man, she seems to already have an idea how all men operate and that is how you will be treated. You will be driving your entire case and be on the defensive with her from the beginning.

Told this person my story. Gave her all my info. Wasted a week, hoping she was going to help. All she had to do was file paperwork In Boise for me since i am in Nevada. I was going to send her my paycheck just to do this. It was to save my kids. I apparently had an open and close case. She dropped me because there wasnt enough money in it and a waste of her time. If you're looking for an attorney who cares about your case, dont trust this woman unless you have thousands of dollars. Worthless.

Everytime I have walked into court with Penelope Gaffney at my side I have won. In my divorce I acquired 50/50 custody of my daughter, my house, and my savings. My ex, after the divorce filed 7 contempt charges against me. All charges were dropped with prejudice. If you need an attorney, hire Penelope Gaffney as she could save you thousands in the long run, and possibly your sanity and life. I say that with all due sincerity as that is what she has done for me. I cannot say it enough, Penelope is amazing and where it counts most to you, a court of law she is the best.

Attorney Chad Bernards recently assisted me in a high conflict, extremely complicated case. He is a very knowledgeable attorney who knows his stuff. He was always available to respond to my queries promptly. Above all he is a great human being who genuinely cares for his clients. I not only found an excellent attorney whose legal skills are exceptional, but a great friend as well. His clients and fellow lawyers are lucky to know him and be part of his professional life.

Chad represented me in a civil suit. He advised me to file motions, which he drafted and billed me, and then advised me not to file! Chad consulted Sr. partners and double billed me. He conducted legal research and billed many hours. I asked to see the documents or notes from that research but was refused. He would not answer direct questions when posed, and conducted the case without my knowledge or informed consent. Chad refused to lay out a strategy or a path for resolution of the case. When I asked why he would not provide me with any guidance during discovery, he sent notifications to opposing counsel and the judge that he was withdrawing, and then notified me. I was left materially harmed, and billed more than $8,000.00 with absolutely no cogent advice or results. Do not let this happen to you.

Worst Attorney experience ever! Don't waste your money! I was given a low quote up front and assured that we would win the case. After spending triple the original estimate, I was told that I have a "Weak Case." I asked for a refund based on grossly misleading legal advice. The only response I got was an additional billing. Please shop around for a more honest & knowledgeable attorney, or represent yourself, lose anyways & save lots of money. Following Matt's advice has caused permanent damage to my established business. They walk away with a stack of my hard earned money.

Matthew is a very excellent young lawyer in downtown Boise. He is professional and always comes well prepared for any case that he is working. Matthew presents his cases eloquently in court and leaves nothing in question. I cannot express how well Matthew does his job. I would recommend him for any legal needs. His clients will not be disappointed in his preparation of cases. He is very thorough and leaves no details out. He is also very punctual and always early for any cases. Another point in Matthew's favor is that he doesn't sugar coat the case and what he feels will be the outcome of your case. He is candid and always tells the truth. His integrity in impeccable.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
