I hired Mr. Weiss to handle my grandfather's estate and it was a nightmare. The lawyers took forever to respond to phone calls and emails. It was a very frustrating experience. If they had been more professional about contracting me in a timely manner, I would overlook the ridiculous length of time it took to get matters settled.

Scott Weiss is one of the most honorable, knowledgeable, and informative lawyers I have had the pleasure of working with in estate litigation. Scott Weiss's representation was exemplary, his grasp of the law is impressive and his appeal work outstanding. I would highly recommend Scott to anyone seeking an estate lawyer, especially if you are facing probate litigation.

I called around to various attorney's unsure if I had a case or not against my doctor. It was of a sensitive issue and most attorney's I spoke with I felt didn't even listen to my concern before already having a strategy. Though Mr. Chiarello can hardly understand what it feels like to be a woman and go through something so sensitive, he still showed sympathy and listened before just saying he would take me on as a client. So far I have been impressed with his professionalism, communication, and his dedication to my case. He didn't promise me any guarantees but he is doing this on consignment so really he takes all the risk of his time to get potentially nothing. So the fact he is working so hard for me without a guarantee he will get paid, well that is amazing to me. I am confident in his ability to get us the best outcome on my case.

At signing he gave us the impression that we will have a certain amount at the end of the case. Just before we settled he told us he will consider taking less percentage because of the low amount of the settlement - but then when we signed he took the original amount and we were left with barely enough to pay hospital bills. Shame! This is how you misguide people and make them sign things they don’t want to sign. He was also only cooperative only in the beginning - the last few months we could barely reach him, he would never respond. warning- we don’t recommend his service! far away from being honest.

Do not hire this man and if he happens to be your court appointed lawyer, try to get a new one! We had Samuel Walker handle my husband’s appeal and not only did he lose, he was arrogant and rude throughout the entire process. He refused to communicate with my husband nor myself about anything. We wouldn’t find out about hearings and filings until much later and the appeal he filed was completely botched!

Attorney Walker has the ability to diffuse contention between the parties in a courtroom. His speech is calm and articulate. He is thorough in his approach to counsel. I have been satisfied with the level of representation in both my appellate and family court cases.

I was represented years ago by this attorney and I would have been better off going at it alone. She didn't fight at all. Because of her, my children were placed with an addict/alcoholic who now has about 15 serious open criminal cases against him. My kids are safe with me but no thanks to her. I would recommend you find someone who takes their job seriously. This woman encouraged me to just marry this man who did terrible things to us for years. She was a joke and she doesn't really care about the safety of her clients or the children.

I hired Brian as an attorney and not only did he have my best interest in mind at all times, he is very clear on his ways of working and if he will take your case or not. He will absolutely stand up for his clients and fight for what you deserve while making sure you understand everything every step of the way. Highly recommended!

I hired this guy as he was recommended to me by a business associate that is also a lawyer. I looked him up and there are a bunch of glorified summaries of his work online, not many reviews though. I made the mistake to hire him. He showed minimal interest in my case, he did charge me though and once we filed an EEOC complaint, he dumped me as a client and never provided me with a coherent explanation. I guess he thought he could not make enough money off me? Who knows. While he definitely has expert understanding of his field, his ethics are questionable. Why would you take on a case, file and them dump a client? He did provide me with a list of alternative lawyers I could contact. I did contact those lawyers and they were useless, some dealt with insurance claims, accidents etc, the kind of people you see on tv and cringe, they had no employment law experience.

Hired this attorney recently and regretted it from the start. He screamed at me, threatened me, and generally just belittled me. I called the FL Bar to file a formal complaint but decided it was not worth the time. I would never, under any circumstances, hire this attorney. He is an egomaniac. He is unprofessional.

I had a case that after speaking to a paralegal at Mr. Pollards firm assured me that he would be interested in and would contact me the following day. A few days went by and I was told again that he would contact me the following day. Another week later I made another call just to be told again that he would call the following day. Months have gone by now and still no word from Mr. Pollard. Don’t waste your time!

I was terminated in 4/2020 due to a one year non complete contract from a previous employer. Mr. Pollard was highly recommended to me and I was so excited to do what I could to fight back. I quickly retained Mr. Pollard and paid $500 for him to review my paperwork. As an unemployed single mother, this was hard but felt worth it for his help. I finally got a call from Mr.Pollard, after following up for a response, he had me repeat my situation, as if he never read my paperwork, and suggested that he would request a waiver for my release from the contract. I was so excited to hear that and after writing another summary for Mr. Pollard and hearing nothing for weeks, I wrote him again. It turns out he did nothing. He finally just said to allow my waiver time to run out. And what did I expect him to do when he was working pro Bono. I never asked him to work for free, and in my opinion I paid him plenty for hardly any work. I was and am still confused with the outcome. I paid $500 for a quick phone call with him where he promised efforts that he never made. This was over a year ago, and I have moved forward but I don’t want anyone else to have the false hope I did.

Jonathan represented me during the first stages of my divorce. He was quick in charging, not very willing to comunicate and quickly decided to let me go as soon as things went a bit difficult. He missed to have me fill a Financial Affidavit! to start the proceeding (divorce 101). I paid him because of my respect for his father, not because I was satisfied with the service.

As a defense Attorney the objective is to defend your client. This man failed to provide a defense at all for me. He seemed fearful of the prosecuter and reluctant to argue facts. He did not provide me with the evidence against me. It was impossible to reach him and when I would receive a response, it was through email. He is ultimately a coward in the court room. He should have stuck to what he knows best, collecting money!

We hired this lawyer to represent our homeowner association in a simple case. We took the time to explain all details of the case in the initial meeting only to realize that he was unable to deliver any results. He buckled quickly at the opposing council's threats and suggested that we did not have a case several months later. Did not appear to have his clients' best interest in mind. Would not use him or his firm again.

I hired Mr Dilley and was sorely disappointed. The defendant filed motions that I was unaware of, I was left mostly in the dark with no real strategy, and I felt as if he was working for the other side. I also felt I was getting ready to lose my case with prejudice - which would have ended all my work to hold the defendant accountable. I do not recommend!

This man robbed us of our money and took advantage of a family in need!!! A brief synopsis, I hired this lawyer to represent my husband who was picked up upon return to the Fort Lauderdale cruise port (our family vacation) on a VOP from Orange county, FL. us!! His retainer fee was $2500 and he took this money knowing that he could not help us and after I realize his scheme I fired him and agreed to give us back half the fee ($1250) in which I received and gave to his new lawyer in the county where the case is and where he need to be transferred to! DON'T LET THIS HAPPEN TO YOU, BUYER BEWARE!!

I had an extremely disappointing experience with this law firm regarding my home insurance claim. From the start, they didn’t seem to take much action, and the process dragged on for quite some time. Ultimately, my claim was denied, and they claimed there was nothing further they could do. I decided to take matters into my own hands, did some research, and filed a complaint with the state. As a result, my claim was reopened without their involvement. Finally, the insurance company finally sent the check, the law firm requested a 20% fee from the payout of around $130. They informed me that if I wanted the funds, I would need to send them 20%, even though they played no role in reopening the claim. I will definitely not be recommending or using their services again in the future.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
