I am an attorney in Ohio. I reached out to this office on a whim for some assistance in a Probate matter that I was working on in Ohio that had ancillary issues in Indiana. Attorney Kyle Persinger immediately reached out to me and was able to assist me in bringing some finality and closure to my client during a difficult time in her life. I could not have asked for a better experience working with this firm, and I highly recommend them to anyone in need.

they strung me along for 3 weeks promising a return call. I finally stopped in personally and find out there is a conflict of interest. I feel this was intentional and very unprofessional on their part.

Hello. My name is David E. Jacobson. I had a very unfortunate event w/drastic circumstances last year in late July of 2018. I was arrested for some Very serious charges and was booked into the Marion County jail. When I realized what had happened I was in a confused and in very timid condition as I am not used to jail conditions. Mr. Josh Moudy actually came to visit me while incarcerated. Mr. Moudy stated that he was hired by my mother to represent me as my defense lawyer. He was stern but he uplifted my hopes of being released from the Marion Co. jail, which is an extremely uncomfortable and scary place to be in. Josh Moudy told me I would probably be released on my own recognizance. Somehow the jail records got an error on my case as I had 2 cases but only one arrest. Mr. Moudy got the second case dismissed due to his outstanding abilities to speak w/the right people. I saw a judge and was released but still incarcerated. However due to Mr. Moudy's professionalism I was released from the jail which a terrible place to be and I do not fit in well there. Upon release I had a court date a month or so later. Josh got the prosecutor to arrange a plea agreement that consisted of zero time to serve in jail but a conviction. However I am going to hire Josh Moudy again to have my record reduced and or dismissed. Mr. Moudy sent a young lady named Grace Atwater to represent me. She was Fantastic. I was a free man w/extremely limited conditions on probation. If Anyone ever gets arrested in Marion Co. and or surrounding cities I Highly recommend Kammen and Moudy. Josh Moudy is FAR worth the $$$ as he is the Best defense attorney in My opinion. I thank Josh and Grace again for what you do as you do it w/extreme professionalism. Thanks again Josh Moudy.-The Best attorney in the city of Indianapolis by far.- David E. Jacobson

They do things you express you don't want to do (that can harm your case), as lawyer's they should be thinking of the long term and not the short term win.. They don't listen to you and encourage an outcome that best suites them. They don't budget. They spend the highest amount of money on things that you may pay the price for in the end.

I would not recommend using Koehler. They were great to work with up front. I had to file a Chapter 13. One of the creditors listed in the bankruptcy filed a lawsuit against me. I called and was told they’d look into it and get back with me. I never heard from Koehler’s but did receive a default judgment from the other attorney and the courts. I called and emailed several times. Finally someone I emailed said she forwarded my email to a person who would take care of the lawsuit. I now have a Chapter 13 coming out of my check and a garnishment summons that I have to attend. Instead of relying on Koehler I have contacted the creditor’s attorney to try to get this stopped. If not, I will have to miss a day of work to go to court, all of this after paying Koehler’s a lot of money to ensure I didn’t have my wages garnished. I’m very disappointed with this firm.

I found Amy to be highly unprofessional, and highly ineffective with my case. I was rear-ended badly while I was stopped at a light and injured. I could never get in touch with Amy, nor her minions she assigned to help. There was little to no communication for weeks at a time. They never made me feel like I was important enough for their time. I missed a few PT appointments due to Covid and a snowstorm. She blamed that for my laughable settlement. She must have had friends and family write all these reviews, unless she just decided she hated me for reasons unknown, and decided to treat me unfairly. I can't imagine there would be a much worse option out there. Do yourself a favor and look elsewhere for an attorney. to Covid

2 years ago started a long and nasty divorce with child custody involved. I went and seen multiple lawyers and when I found Alex, I knew he knew what he was talking about. Alex and his Paralegal Maddie fought for my case for 2 full years and they were constantly involved and keeping me up to date on everything happening. I'm proud to say we won our case and I know it's because of Alex and Maddie. Thank you both and the rest of the team for everything you have done for my family and I.

Nick and his firm are stewards of both professionalism and personal attention to their clients. As a retired combat Veteran, I never thought I would need legal counsel. Nick and his entire team immediately became an extension of support and expertise. Nick and his team's attentiveness and responses did not just help me recoup from a general contractor financial hardship but walked me through each step in the process. I also cannot speak highly enough as to this firm and recognition of the cost of efficient legal counsel. They keep communication concise, do not take short cuts but are extremely fair with their fees. This firm takes time to listen, treats you like a person and a family member. Nick...you and your team are phenomenal and wish nothing but future success. Thank you so much! Chris

I was lied to constantly. I never once was able to speak with Mr. Lewis. I paid half which I was told I needed to paid in October 25, 2023 and the other half was to be paid when the expungement was completed. I made several calls to Mr.Lewis office always speaking to a Mark?? I was lied to constantly. First lie was the prosecutor was being replaced in Hamilton County so that was causing a hold up. I waited another month I called and lied to saying that my paperwork had been lost in the process. End of April I requested copies of court documents sent on my behalf. I received the PDF. Forms of documents to both counties I needed expungement from. Neither had been submitted to the court. And not signed by David Lewis. I have times and dates of every call and the PDF forms sent to me on May 1st. Never once during this time was I asked for balance to complete process. Not until July when I called Mark out as being a liar and this he admitted to everything. I asked for a refund he said it would be a couple days for the check to process. I called back to see if he could just refund my boyfriend’s CC. That’s when Mark informed me that he couldn’t give a refund I would have to pay the balance to get Mr. Lewis to move forward with this process. Of course I have been dealing with this for almost a year now. When I was first told it would take 3-4 months to complete. I didn’t want to give more money considering how much I had been lied to and never once had a chance to speak with Mr. Lewis. No matter how many times I ask. The office completely stopped answering my phone calls. Until one day Julie Brown answered I explained my dilemma. She is another attorney in this office. She said she would take notes and leave on Mr. Lewis desk but she doubts if I will get a return call. Mind you my cases were both minor both misdemeanors. I should have never been put through this stress. I would never have a kind word to say about what I was put through and never about Mr Lewis. He is a fraud to me. Robin McCaslin

Best Attorney you'll EVER FIND,FOR A MALPRACTICE CASE!! He couldn't have worked any harder for me than he did! I ended up with him, on a whim of a recommendation from a different attorney after I'd been passed down to some new Atty that just wanted to get it settled, done and over, wanting me to settle for $11k total with him getting 40% of that & so on! Mike took me on,took his time to do it right 👍🏻 & I will tell you this much, the case ended up settling for a ton MORE! I can't disclose that, but he's well worth it 🤩

Amy and Alex were GREAT!!! I have been fighting the same battle with my sons mother for probably 9 years now. The first attorney didn't accomplish much other than getting a divorce decree signed. The second attorney got paid alot of money to sit next to me in the court room - that's about all he did. Amy and Alex were EXCELLENT in court - Amy argued my case extremely well and brought to light contradictions in oppositions testimony and arguement that I had never even noticed over the past 9 years. They put in the time and effort necessary to prepare for court instead of looking over a file for a few minutes before they walked in the court room as my previous attorneys have done, they were accessible when I needed them in an emergency, and they were patient with me and even comforting when the process became overwhelming. No attorneys have ever performed to provide a better result than Amy and Alex and I couldn't be more grateful for their representation.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
