Seemed to have knowledge based off of the small amount of information given during our consultation and she was able to point me in the right direction in the end. This was a couple years ago, but in the end everything she said was correct and true in terms of legalities.

Having made a very big mistake, I started the painful process of trying to find someone who would help without taking my money (happily) and leaving me to my (richly deserved) rewards. As the saying goes, "play stupid games, win stupid prizes". Nick took my case, never left me feeling judged by him, and did his best to help me through the process with my dignity and my finances intact. Nobody could have punished me as passionately as I did and continue to punish myself, and I know I won't be repeating my act of stupidity again. Nick took my case and obtained for me exactly what I was hoping for...a healthy slap from the justice system that didn't leave me destitute and/or in a cage. If you find yourself in my shoes, please consider this as a help in sorting through a long list of nameless and faceless counselors. You'll get his best because that's what his own personal ethics demand of him. Lawyers get a bad wrap. I thankfully don't have a lot of experience with them, but if more of them were like Nick, they wouldn't have this kind of reputation. Please give him a try. Like me, you'll be glad you did. Thanks, Nick! And see...I remembered to write this review! I'll be dropping by to see you one of these days when I'm not desperate for help. You're a good fellow. You may not get rich doing good work for dopes like me, but I trust you'll sleep every night knowing you're leaving the world better for your having been a part of it.

Adam and Greg helped me get through what felt like an never ending situation. Both were straight forward and strategic in the processes. Helping me map out what I wanted the outcome to look like and what all of my options were. It was a very complicated situation that they handled it at ease. While anything involving lawyers is extremely stressful they helped me find peace of mind. What mattered most to me is that they are honest and trustworthy. Without their help I would be in a very different place. Plus their duo dynamic is unmatchable.

I needed to get advice on doing an affidavit for an informal probate. I was charged $500 which I thought was a decent price. When I took the paper with me to show a different state that I had the authority of personal representation for this will I was told that court wouldn’t accept it unless signed by a court in Montana. When I got he from the court ordeal in the conflicting state I called the office to verify if I was supposed to take the paper they had drawn up for me to the courthouse. I really received no help or substantial advice. I then went to the court house and paid them a little over $100 to accomplish the same thing. I didn’t need what this law office did for me at all. To top things off I received a bill from them for a bit under $70 to call and poss the question about getting the paper they had drawn up taken to the court. Very disgusted with this office. The whole reason was to show the conflicting state I was authorized by a will to take care of the estate. I have to travel back across the country again. The whole thing has cost me into the thousands. And I still owe them for posing a question..../

Yes 3 weeks ago I found out my ex wife was screwing me over financially. I was frantic and needed to consult with an attorney right away. I've had bad attorneys before and I wanted a supposedly good one this time. Boy was it a mistake calling ms Chisholm. She has not bothered to return 1 phone call or Email in 3 weeks time. I wound up having to study the laws myself just to see exactly what i needed to do. It sure would have been nice to have some professional help. Guess i called the wrong attorney for that.

After a very good experience working with Dean Chisholm in an employment matter, there was absolutely no hesitation to meet with Penni Chisholm when my wife sought an amicable separation & Divorce. Penni initially supported my intentional fight to keep the love of my life as my wife but, when therapy and time didn’t provide answers Penni recommended a quality mediator to begin the process of separation. She is an amazing soul and gifted, caring Attourney that provides all scenarios and allows her client time and room to process while working diligently behind the scenes to ensure all options remain available. I couldn’t ask for a more human, compassionate & intelligent person to walk me through this process!

I just called and the receptionist said they don't deal in tenant/landlord issues. Mine is extreme. One tenant has assaulted me twice, the landlord drills into my locked bedroom and steals things. He takes photos of other tenants driver license' and screenshots them, then emails them in a group chat, he's broken the no contact order for the physically violent tenant and let's her back in the home and I'm in fear. I told this receptionist to remove the tenant/landlord issues from the website. It's false advertising.

Adrian miller represented us in a probate case. There was no question as to who the property was to go to, the defense should have had no leg to stand on . Adrian charged us over ten thousand dollars to prepare for trial and sue for damages which was what was agreed upon when she was hired. She did not follow through, withdrew right before it was time for trial . We gained absolutely nothing from her representation and she actually caused us to loose a hearing, loose evidence and loose irreplaceable property. She witnessed numerous illegal actions and blatant disregard for court orders by the opposing party and did nothing to defend us, did nothing to address it period. Adrian does not listen to her clients, is dishonest, belittling, is a know it all, who does not care what the client wants,. She does what is best for her ,not what is best for the client. Her withdraw cost us valuable time and money and other attorneys do not want to take your case after one has withdrew.. Adrian millers representation only hurt our case and we now have to pay someone else to do all of the work she was paid to do but failed to produce results for. When her representation ended, We only felt Wronged by the person we hired to prevent us from being wronged..

Consulted on a divorce case. She was abrupt, rude, and not happy that I had my toddler with me. My case involved domestic violence and she seemed extremely uncomfortable with the details of that. She also made me wait several days to call and tell me she wouldn't take my case. By then I'd already ruled her out and found someone else.

After seeing this man's performance in the court room I was apoloed by his sloppy manerisums and his eger temper. He was so sloppy even then judge was telling him to make his point and hurry up with what he was trying to say because he was rambling on with no conclusive point. All in all I was vary dissapointed with his court room conduct. I was not please to see a man of his status to be acting in the manner he did, it was childish, bull headed, bad tempered, along with being sloppy in his dispositions as well as a vary bad temper venting out all over the court room.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
