I met this attorney many years ago when he was representing another party in a mutual negotiation and thought at the time the other party was receiving outstanding representation. Many years later when the time came that I was in need of legal counsel for a very serious business matter I immediately thought of him. I retained him and he has done an outstanding job representing my interests. If you need an aggressive litigator after all attempts at negotiation fail, I highly recommend this attorney. He comes well prepared, thinks outside the box and will keep you fully informed. The most impressive thing though, he is an extremely honest man that possesses the highest degree of integrity. How's that for an attorney?

I called in to his office to ask questions about a legal matter I was having. The secretary put me on hold and Frank answered, looking for another client. He politely asked me my why I was calling and ended up talking to me for 15 minutes. He told me some things I didn't want to hear, but needed to, and also some things that made me feel alot better about my next step. I ended up hiring him and I'm glad I did. He's a hard worker, and a straight shooter. You don't see a whole lot of that anymore.

Consulted with this attorney on a real estate matter. Was well informed, and best of all, was practical. Answered all my questions, was prompt and available when he said he would be. I would recommend him again, and probably seek out his counsel if additional legal advice was needed, but thanks to him the consultation was all we needed to resolve the matter with the opposing party.

Finally, I encounter an honorable attorney! As non-attorneys, we are obligated to only receive legal advice from a licensed attorney. I wish I would have sought her advice first - it would have saved me both time and expense.

Lars was by far the best lawyer I ever work with. I secretly mourn the day he left the practice of law for the glamour of big business. I'm certain he's a great asset to whatever project he is lending his skills. As a small business owner, I found Lars to be extremely knowledgable about a wide array of legal issues, and he was certainly the most proficient and trustworthy attorney I ever knew. I remember his gifted technical writing skills always captured both the important facts and the urgency and emotion behind one's dispute or legal issue, and he innately knew what information to detail and which part to reduce too. He probably prevailed on every single motion he ever presented on my behalf. I've retained half a dozen lawyers since, but I never did find anyone who could replace Lars. Someday I hope he returns to private practice.

Martin worked on my social security case with Social Security Lawyers of Nevada. He is a smart and compassionate person, who worked very hard on my case that had previously been denied with a different firm. He researched my complex illness and explained how it affected me to the judge in his hearing brief. He also spent a lot of time preparing me for the hearing. Questions were always answered quickly by phone or email. I would not hestitation to recommend a Martin, Peter and Social Security Lawyers of Nevada to handle a social security disability or medical malpractice case.

Kevin Diamond is the most honest and professional attorney I have had the pleasure to work with. A friend of mine was injured at my house resulting in his becoming a parapalegic. My insurance company refused to pay the policy limits (1 million) and I was facing a probable verdict of at least 5 times that amount at trial. I retained Kevin to protect my interest against my insurance company. I am a JD and MBA who has worked extensively in litigation support. He did an amazingly thorough and extremely professional job. The insurance company eventually settled the claim but I felt comfortable that we had established a great bad faith claim if they went to trial and there was a verdict over the policy limits. Kevin is always responsive and kept me informed every step of the way. His bill ran somewhat higher than the original estimate and he has been kind enough to let me make monthly payments. I have recommended him to others.

We have had Mike Kealy for our attorney, both professionally and personally, for nearly 30 years. Mike's many strenghts include his ability to grasp situations that he may not have previously encountered, his preparedness, patience and willingness to take the time to explain all facets of a given proceeding. We have engaged Mike's services in real estate matters, both on the buying end and selling end, landlord/tenant issues, corporate and civil matters, insurance, litigation, and even a bit in estate planning. Not only do we find Mike's wealth of knowledge and expertise immense, we find that his motto of "prepare, prepare, prepare" certainly pays off on behalf of his clients. There is nothing worse than not knowing where you stand in a given situation and Mike never puts you in that position - he always keeps you informed, makes sure of your understanding, and keeps you apprised of any new developments.

Ryan McElhinney Esq. of the Barber Law Group helped me reclaim my 'voice' after not being heard in the workplace for four years. Ryan gets results. He is sharp, compassionate, available, Ryan does not disappoint. He takes your case seriously and is very attentive. His staff is top notch as well. I was very fortunate to have been referred to Ryan McElhinney at the Barber Law Group. My emails and phone calls were always answered promptly. I was never left guessing as to the status of my case. I felt he cared. I highly recommend the Barber Law Group/Ryan McElhinney for any legal needs.

HRD Law is vital to the success of my company! We first started working with the attorney’s at the firm to review our software license agreements. During the process we were thrilled to see the extreme level of detail and care taken with crafting the exact contracts we needed to protect both ourselves and our clients. Time and time again we were blown away with their professionalism and willingness to understand our business needs. They have now become an integral part of our business processes and have allowed us to focus on what we love to do. We sleep better at night knowing that they are part of our team and would highly recommend them to anybody looking for a firm to take you to the next level.

In December 2016, a collection agency started garnishing my wages illegally and continued to do so for several months. I was never served papers of any kind plus the debt was not mine. It belonged to my wife. Back in 2008, my wife incurred the debt. In 2012, I filed bankruptcy. I didn't include the original debtor in my petition for bankruptcy, because I was unaware that I owed them money. Had I known I would have simply included them in the bankruptcy, and that would have been the end of the matter. Since the original debtor nor the collection agency never informed me that I was responsible for my wife's debt. They essentially forfeited their right to come after me after my bankruptcy was closed and discharged. But they did anyway. This was a violation of the bankruptcy code. The federal bankruptcy court agreed and awarded over 65,000 in my case. Thanks to Sean and his team, I am feeling Damn good. If you want to feel good too then Hire Sean Payne!!

I retained Cindy Stock, Esq., on two separate occasions regarding divorce and custody issues. She was imminently qualified as she had previously represented clients in domestic cases, and had been practicing law for a number of years. Her representation was par excellence. Her high degree of knowledge of the law and command of the English language was nothing short of impressive. She was very thorough in her representation, covering items one doesn’t think of during such times. I could not have asked for, nor received, a more acceptable outcome. Her compassion was equally impressive. I would not hesitate to recommend Attorney Stock to anyone, from the simplest case to the most challenging or unorthodox. Whatever the situation, I am thoroughly convinced she can handle it with the utmost efficiency, ease, and with superb composition and performance.

I didn't want to hire a lawyer. I thought I could do all relevant research myself. After extensive research of all applicable statutes, I concluded I needed a lawyer and consulted several. Elizabeth Bitter impressed me as the most knowledgeable. In fact she quickly provided the statute I needed and had merely glanced over. Ms Bittner accompanied me to court and was the key into the successful outcome of a complicated case.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
