Great firm to deal with. I am in Canada and expanding my business to the state of Florida. They incorporated my business as well as helped me with guidance on navigating other topics as things are much different in USA vs Canada. The immigration lawyer I am using also told me they gave me the correct advice for a non-resident as it is common for Canadian's to set things up correctly and be given the wrong legal advice.

I had a very time sensitive issue I had to deal with. In my quick research, Rick had Jenna call me back within a 1/2 hour. She instantly had an excellent plan to propose, which separated her from the rest of those I contacted. Not only this, but her compassion regarding this unique situation and commitment to help sort everything out as a result was very much appreciated during a difficult and scary time. Jenna was very relatable, professional and gave regular updates. She went above and beyond, ensuring we received the answers we needed in a timely manner. She had everything sorted within weeks despite some obstacles out of our control. I am thrilled I was put in touch with her as I don't think this could have been handled any better. Definitely hire this power couple!

Brandon and his team are literally THE BEST. I worked with two cheap attorneys before I found Brandon and I got exactly what I paid for which was representation that didn’t care, didn’t put the time in and didn’t fight for me. Brandon‘s previous experience as a police officer and private detective were very helpful in uncovering all of the hidden assets in my case. Brandon always worked to try to get my ex and I to settle outside of court rather than rack up more fees and unnecessary cost. That really stood out to me. Every hearing that I had with Brandon on my side, I felt safe, I felt like he was fighting for me, and I felt like he actually cared. His team was absolutely a pleasure to work with even through the gruesome things such as gathering financial affidavit, and a ridiculous amount of documents requested by opposing counsel. I could not have been happier with the service I was given in my extremely difficult case. I worked with Brandon for almost an entire year and he never got lazy. He never slacked off. He always gave 100%. Thanks Brandon and team!!!

I went in here for notarization two times on the 9th of July. Super friendly staff and Mr Moreno too! I asked him if he could assist me in a real estate issue and he said yes and to send him my file. I received an acknowledgement of receipt and that someone would get back to me. This was the second week of July. I called 3 weeks later and I was told someone would get back to me and then radio silence. This case is very sensitive to my livelihood and urgency is necessary in light of a party that is involved and her expected life span. Mr Moreno's and the staff friendliness made me comfortable in asking for legal assistance. I did a ton of investigation before sending this file as to the location of parties involved and was always willing to investigate more. Not sure what to do now...

It's good to know there are still GOOD GUYS out there! Let me first say I didn't hire Blair Clarke because he gave me the information I needed over the phone. In researching attorneys on the phone, I felt rushed to spit out my question before I felt like the meter was running. Blair patiently listened, asked questions, was quickly able to assess my situation and took the time to listen and provide his expert advice. Within the space of a ten minute relationship Blair managed to show professionalism, empathy and expert advice to a non-client. He really showed that he’s the right person for me!

Out on my boat last Memorial Day weekend, I was stopped for what was called a “routine safety inspection”. During the inspection, the officer asked if I had anything alcoholic to drink today. I replied yes. Having only had one drink, I was comfortable that he would finish his inspection and we would continue on with our day on the water. Instead, he tied my boat up to his and requested that I come over to his boat for a field sobriety test. After I was in the boat, he untied my boat stating that the water was too rough to leave the boats tied together. He proceeded with the test, which he said that I failed. I was handcuffed and taken to a nearby boat ramp where they had a mobile trailer set up for administering breathalyzer tests - which I refused. I was charged with BUI, taken to jail and released about ten hours later. Fast forward to Hebert and Associates: Blair Clarke took my case and fought it with confidence. His knowledge of the law was apparent and reassuring. The fact that the water was too rough to leave the boats tied together, but okay enough for me to take the field sobriety test was contradictory. A second sobriety test was never given once on land. In the end, Blair had my BUI case dropped - I paid a ticket for my expired flares and am enjoying the sunshine once again!

Blair has been such an asset to my family; mainly my son. He has dedicated himself to protecting and defending others. I felt the need to commend him on his sincerity, devotion and belief in our young people. Hebert and Associates, in my opinion, is the most outstanding law firm in Pinellas County. When I needed someone the most, I reached out to this law firm, and found two incredible attorneys that were calming, reassuring and understanding of my families needs. Parents, it is a struggle raising our children today and it is difficult to help them through the challenges they face, but with the help of Hebert and Associates (especially you Blair), our family is back on track, and I pray it will remain that way. Parents, write this name down, if God forbid you are ever in need of an outstanding law firm who truly cares, whether it be for your children or for yourself. I thank you so very much for your outstanding representation and your dedication.

Incredibly unprofessional conduct from this firm, unresponsive, dismissive, and dare I say equally incompetent. There are far better firms that act with more integrity and care for their clients. I would keep looking if you want true legal representation where you are made to feel like they are working for you and not being treated like an inconvenience. I think they forget who is paying them. I had the same negative experience with the Attorney that the women listed in the previous review, she is not at all exaggerating this mans level of unprofessionalism.

Hired for my divorce. If I wasn’t actively calling or emailing them, they’d let weeks go by without reaching out even when action was needed on either end. I think the divorce took twice as long just due to slow responses and the inability to be proactive. I paid for legal advice to avoid losing more than I had to in mediation and ended up not getting much in the way of advice at all. I could have gone to a friend for free if I wanted to hear that it was all up to me in the end. It’s pretty upsetting to hire what amounts to a glorified $350/hr paper pusher.

She had me sign off in the middle of mediation from my divorce which is unheard of. You can't do half and send it to the court. She destroyed my life and it has taken two lawyers to fix what she did. She can't do her paperwork or ever be prepared for anything. She is completely unprofessional. She has been in trouble before because she shared that with me. She should be disbarred. She thinks she can swing her hair and body and scare people, but she doesn't know law. I beg you to not make my mistake and use her at all. Thank god, I stopped in the middle and went elsewhere. Cut me off while trying to convey what and why I felt my suit was valid. I truly mean with in 10 words of speaking he began talking over my talking, and I MEAN talked OVER me. Normally when someone does that I let them speak...after a few times I decided to keep talking. Yup, he kept talking over me. I had to refresh his interest with each phone call. Felt no genuine respect for me as a client, felt his admin was patronizing towards us. He IS a gentlemanly attorney, but if you NEED a tough litigator, not sure he is the one. IF someone needs an attorney to obtain what they are entitled to by law by a simple request, then the suit is valid...the opposition refused and so I needed an attorney. Yet I had to keep reminding Mr. Miller WHY I felt Opposing was not at all trustworthy...At the end of the suit, Mr. Miller dared to defend the opposing counsel to me....I spent over $6k to obtain what should have been provided freely and with out any problems, and yet the opposing counsel isn't a bad egg? Seriously? He really just did not respect this client or suit.

If you want a states of your case you will need to send email after email of which she charges for you for each of them. He was my divorce lawyer, and he treated me like a little woman who didn't know anything. He'd inform me of "my" strategy just before hearings in the courtroom hallway. He refused to fight for timesharing with my children, saying that I just needed closure. He told me I didn't have enough money to prove parental alienation. When the judge made a temporary order giving me more time with my daughter than Attorney Kennedy requested (but still less than what I wanted), Attorney Kennedy tried to block it. He zealously advocated against my position, and he wanted me to pay $300 per hour for him to advocate against me! I had to order a transcript to prove what the judge said (and I was right), and then Attorney Kennedy wrote a timesharing order that was so vague that the police told me it would be difficult to enforce. I finally fired him, one of the best things I ever did in my life. And I represented myself and got the timesharing with my daughter that I wanted, at a level that Attorney Kennedy told me I'd never get and was staunchly unwilling to even request. He even wrote a letter to me saying that it was inappropriate for the judge to give more than what "we" asked for! This man is NOT an advocate. Dealing with him during an already difficult situation was one of the worst experiences of my life. If you want an advocate, someone who respects you, or someone who even cares slightly about your predicament, please run as far away from James Kennedy as you can get.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
