A very belated review that I just realized I never left - We had a great experience with Kathleen and her office in the matter of a step-parent adoption. She was thorough in explaining the different types of step-parent adoption that could apply to our case (contested vs uncontested) and with her guidance, we were able to land on an uncontested case. She handled all the communication and paperwork with the additional parent. As this was during COVID, our hearing was held virtually, but it was a quick and easy process the whole way through. No surprises or hidden charges, and both Kathleen and her office staff were incredibly kind. Highly recommend.

I wholeheartedly recommend Kathleen McCann for anyone navigating the complexities of Family Law. We came to her with a complex question that other attorneys had not been able to handle--correcting the age of a child adopted from a foreign country--and she knew exactly what to do. Her deep knowledge and swift handling of our case significantly eased the process. Kathleen was exceptional in answering all our questions, providing clear, accessible explanations that kept us informed and confident. We swiftly resolved this worrisome matter, and we feel very grateful that we found Kathleen. We highly recommend her for any family law matter.

Teresa Foster and her team have been incredible throughout my court proceedings. From the moment I hired Teresa’s team I knew it was the best decision I could have made to get me through this hard time in my life. From our first meeting, she explained everything to me in terms I could easily understand and was always very responsive when I had questions. If you want an attorney that truly makes you feel as though she is in it with you, I highly recommend Teresa Foster and her team!

I’m so disappointed in Caitlin and the team at McKinley Irvin due to their lack of integrity and honesty. Caitlin is self serving and not in this business for her clients she is only interested in making money. I wish I would have avoided her. Lesson learned. Don’t let it be a costly bad decision for yourself and seek counsel elsewhere.

I had a great experience with these guys, who represented me in a ridiculous lawsuit brought against me by my greedy, land grabbing neighbors (ahem- allegedly). They helped me save a TON of money so that I could take the fight over the finish line, despite the opposing counsel's constant threats and grandstanding. I was successful in holding onto the property my neighbors were attempting to take from me.

*** DON'T HIRE THIS FIRM!!!*** I made a huge mistake in hiring this firm. They placed my case with an LLLT within the firm. It was explained to me that she would be doing paperwork and I would be represented in court by one of the lawyers in the firm. The LLLT didn't file the proper paperwork and the lawyer that was supposed to represent me said I never hired him. They made so many mistakes. Their mistakes cost me my family and over $10k with a good lawyer undoing everything they messed up. I currently have an open review with the Washington State Bar Association against this firm for its failure in my case. Run as fast as you can away from this firm.

I hired autumn for a restraining order case for myself and teenage daughter against my exhusband. Paid a tremendous flat fee, she said the case was going to be easy cut and dry and would be done and in our favor. She had my daughter write a declaration and advised she be there for the trial online incase judge had any questions for her. As soon as the judge saw her I was told I was in question of my parenting judgment for having her there and for her writing the declaration, The judge would not let me speak to let her Know that it was my lawyer that had her write those and all under her advisement that it was done and autumn did not speak up or say a word about anything or even in my defense that it was her doing not my own and the case was dismissed With me being in poor judgment. When I asked her why she didn’t defend myself she refused to answer my question and so I wrote to the head of her firm Erin to get. A refund for the unprofessionalism. He advised me That it wasn’t his business what his lawyers dead and would forward my email to her and of course I never did hear back from her whatsoever.

Absentee, judgemental; not very personable. Book smart , but lacks empathy. I have worked with three lawyers in the community and Lisa is the least responsive. Frankly, I wouldn't trust going to trial with her at all. Never even called when the judge asked her to..... twice. I always have to call her. She makes me feel not worth her time; unless I reel her in. She maty not like me but we're not in a college sorority!

Update April 2nd 2020- I have been receiving emails from AVVO that James now disputes information in my review. I want to make it clear that they are the ones pestering me by phone and email to write a review. Now that I wrote my honest feelings about the emotional roller coaster and screw-ups working together he wants to try and remove my review. Further reasons to stay away from James Pak Lawyer. They are trying to remove anything potentially negative about them even though they asked for the review. This speaks volumes about how they do business. STAY AWAY. March 20th 2020- I was being pestered by these people non-stop to write a review about their services working on my case. I tried ignoring them since my experience was pretty bad but alas... they kept asking for it. So here it goes. I retained James and his crack team of professionals because they showed up first in Google for personal injury attorney. I see thats not the case anymore and should have chosen one of the others that appeared on there now. I didn't call anyone else because I assumed they were the best. Boy was that a big mistake. Shortly after hiring them they sent me to a local chiropractor for a few months. This was okay, they did a great job although it was constant 3 times a week. Once the chiropractor said everything was better James' receptionist said that they would begin negotiating my case with the insured driver. The weirdest thing happened, after hearing weekly or monthly from someone during the first month or two of my case they went radio silent for over a year. I had ideas of the thousands of dollars they were making off of my case and no one could bother picking up the phone and giving me a call. And then it came... a phone call. From the receptionist. She told me that they've been negotiating hard on my behalf and they have reached a settlement. The offer? 50% lower than the national average for someone with my injuries. How do I know this? After 15 months of radio silence I started calling other attorneys and looking for second opinions. They were all too willing to share their opinions of my case and one looked up my injuries and told me the national average settlement amount. Armed with my new knowledge of the injuries and how personal injury law was negotiated, I declined the offer. I refused to take that low ball offer against my own attorneys advice. And I'm glad that I did! They went back to the insurance company and came back with a little better offer. Which I did take. I needed to put this behind me. It had been a long road. Would I hire this same law office again? Highly unlikely. After speaking to the other law offices in the area for 10 minutes, I was armed with much more information and now know they were all smoke and mirrors. Just because someone shows up on google first, doesn't mean they will negotiate your case properly.

I hired Johnnie Holtmann to represent me in a divorce action. I needed a quick infusion of cash in order to pay some bills, including his attorney bill. He recommended that I use the qualified domestic relations order (QDRO) process to transfer funds from my wife’s account. The court ordered that these funds be transferred as a “fixed” amount. Unfortunately, the result was that the transfer took four months instead of a few weeks. The bottom line was that I relied on his legal recommendations and that damaged me. My credit score suffered because I could not pay my bills in a timely way. I also lost money in the transaction because the monies were not put into a “fixed” account such as a savings account, but were put into a “variable” account that lost roughly 9 percent of its value over that time period.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
