I couldn’t have asked for a better attorney to represent myself and my daughter’s dad on our deceased daughter’s case. I am forever thankful and grateful for Jerry Garau for his compassion, knowledge, and professionalism while working with us for the past 5 years. There aren’t enough words to let him know how much we truly appreciate him for his patience on putting a close to what felt like an open wound. He brought our family the closure we so desperately needed and for that, I feel truly blessed and honored to have him as our attorney.

I feel very blessed to have had the opportunity to work with Garau Germano. Given the unfortunate circumstances that I had went through, this team of attorneys had believed in fighting for me and what was right. Shan B. Haase was with me every step of the way, and through my anxiety, took the time to make sure that I understood every step of the process. Shan and Reese made sure that my voice was heard and fought for me. They stayed truthful and trustworthy and went above and beyond the call of duty. I would highly recommend this law firm to anyone who needs assistance with a medical malpractice case.

Do not believe that if your case mirrors anything on their website that they will take yours. My spine surgery was done wrong and after nine years I learned that I’m not completely fused. Update* after listening to the message that was left for me it turns out that the information that was relayed back to the attorney about my case seemed completely wrong, so since the attorney heard my situation incorrectly, I was denied. 👍🏽-I just learned of a failed back surgery, when a mass showed up on my back from fluid buildup a month ago, around the hardware from my back surgery lower lumbar fusion L4 L5 and S1. When looking at the mass the doctor noticed that after 9 years my back hadn’t fused together because a different doctor did my surgery incorrectly. He was fired later on for a reason unknown to me. I’m just now learning how bad my back really is. I’ve had years of pain and hardship and didn’t know it was partly because with my lower lumbar fusion, the doctor had put screws in my hips. Now 80 pounds lighter it’s becoming more and more painful to walk. The hardware in my back is now protruding slightly, degenerated disc, a cyst on my nerve and arthritis. The doctor perform my back surgery incorrectly mainly by putting screws into my hips and I have had years of problems. The intake worker knew I was having another MRI Today for a possible future surgery because of this, however I received a denial letter instead. They don’t waste their time by calling people and telling them their denied they will send a letter. #Care

I was lied to constantly. I never once was able to speak with Mr. Lewis. I paid half which I was told I needed to paid in October 25, 2023 and the other half was to be paid when the expungement was completed. I made several calls to Mr.Lewis office always speaking to a Mark?? I was lied to constantly. First lie was the prosecutor was being replaced in Hamilton County so that was causing a hold up. I waited another month I called and lied to saying that my paperwork had been lost in the process. End of April I requested copies of court documents sent on my behalf. I received the PDF. Forms of documents to both counties I needed expungement from. Neither had been submitted to the court. And not signed by David Lewis. I have times and dates of every call and the PDF forms sent to me on May 1st. Never once during this time was I asked for balance to complete process. Not until July when I called Mark out as being a liar and this he admitted to everything. I asked for a refund he said it would be a couple days for the check to process. I called back to see if he could just refund my boyfriend’s CC. That’s when Mark informed me that he couldn’t give a refund I would have to pay the balance to get Mr. Lewis to move forward with this process. Of course I have been dealing with this for almost a year now. When I was first told it would take 3-4 months to complete. I didn’t want to give more money considering how much I had been lied to and never once had a chance to speak with Mr. Lewis. No matter how many times I ask. The office completely stopped answering my phone calls. Until one day Julie Brown answered I explained my dilemma. She is another attorney in this office. She said she would take notes and leave on Mr. Lewis desk but she doubts if I will get a return call. Mind you my cases were both minor both misdemeanors. I should have never been put through this stress. I would never have a kind word to say about what I was put through and never about Mr Lewis. He is a fraud to me. Robin McCaslin

In 2019, my son died of a very preventable illness that the doctor failed to correctly diagnose. I reached out to Hovde Dassow + Deets for help in holding the doctor and hospital accountable for their failure to provide adequate care for my son. I would like to thank Hovde Dassow + Deets for all of their hard work. They did an outstanding job, and I highly recommend them to anyone who has suffered from any type of medical malpractice. I got exactly what I asked for thanks to their competence and diligence. While no amount of money will ever bring my son back, it brings me great comfort to know that I not only got justice, but I got closure as well.

We were incredibly fortunate to work with Nick Deets on my wife’s legal case. She was in a horrible car accident two summers ago. One of the best qualities that Nick had was his timely communication with us. He was really only a simple phone call away any time that we needed him. Since my wife’s accident in July of 2022 Nick and his team stayed in touch with us, offered us updates on our case, as well as treasured advice throughout the tumultuous aftermath we found ourselves in after her accident. The other quality we valued was Nick’s competency in knowing what needed to be done, as well as his drive to make sure that it got done. He was over prepared for every meeting we had, and any communication and negotiation he had regarding our case was handled efficiently. We never had a concern about the quality of work Nick did because he showed us that he cared about us. Knowing that he cared about us made it easy to trust him. Nick’s preparedness was evident in his network of people, from his team to trusted individuals outside of his firm, and his readiness to connect us with them to help us out. Neither my wife or I had needed to be involved with an attorney before we met Nick. We were thoroughly spoiled, as he and his team set an exceptionally high bar for our expectations in the future. I hope that we do not find ourselves with a sizable enough injury again to warrant legal representation, but I would not be concerned with where to find it, because we were in good hands with Nick.

I believe Josh Tatum and Peter Racher are unethical attorneys. I strongly warn all prospective clients to stay away from these attorneys; find someone else to help you! As I have ran the case details by several prominent attorneys, we feel that this can be proved in both a legal case and complaint with the State Board against Josh Tatum, Peter Racher and their Firm (PSRB). Briefly, I hired a partner attorney (Shelley Jackson) at the Law Firm, Plews Shadley Racher & Braun (PSRB) regarding an employment discrimination case. Shelley extensively reviewed the case and contacted the opposing attorney to negotiate a settlement agreement. Shelley then suddenly resigned from the Firm in the middle of the negotiations to take a position at a different company and handed the case over to an associate attorney (Josh Tatum) at the Firm. Josh did not know the details of the case well at all and it disturbed me greatly especially given that I had paid a very large amount of legal fees (18k) to the original partner attorney to know the case well. I was nervous at this point given my discussions and correspondence with Josh and his lack of understanding of the case and so I spent some extra time with him before he made contact with the opposing attorney to ensure he was up to speed as much as possible at least on the important details of the case. I asked Josh if he would listen to the audio of various meetings and review emails that I had already paid the original partner to listen to and review; Josh responded that he would have to re-charge me to do those things. Then he contacted the opposing attorney and made a huge mistake during negotiations in suggesting that we were ok with no non-disparagement clause. He also tells me the opposing counsel did not agree to the main items of the agreement as the partner attorney stated they did before she left the Firm. I immediately halted all activity with the PSRB Law Firm and contacted the managing partner (Peter Racher) and expressed my numerous concerns. I told Peter and the Firm that I would hold off on paying any outstanding invoices until everything was satisfactorily resolved. Peter stated he would get back to me. Weeks and weeks went by, still no response. Eventually, Josh forwarded me correspondence from the opposing counsel and during that time I found out from Josh that PSRB had terminated our attorney-client relationship and would not be representing me any longer. They advised me to seek successor counsel. The managing partner eventually wrote me a 1.5-page letter not stating much but that he investigated my concerns, reiterating that our attorney-client relationship had ended, and that they would not be refunding me any fees paid and basically good luck.

I have been to this facility on three occasions to deliver catering orders. All three times well over $200 in food. They are always extremely nice. However, it's always a hour of my time wasted for nothing they never tip and never have .. I do this full time and have for 8 years . It's completely disrespectful and discouraging. We don't make a delivery fee we strictly live off a gratuity and it clearly states that on the receipt and website. You can't buy time plain and simple and for these people to disrespect my time and money on multiple occasions has just left a sour taste in my mouth .

"I'm exhausted from being mistreated and bullied because of my lack of education. It feels like those in positions of power are trained to take advantage of and silence marginalized individuals like me. I'm fed up with being disrespected and undervalued. All I've ever wanted is for someone to be held accountable for their actions and to be treated with dignity and respect. Unfortunately, I was denied fair compensation for my work and wasn't given a chance to thrive. I'm at a breaking point, feeling like I'm not good enough in this society. I've even considered harming myself in a desperate cry for help. But I want to make it clear that I hold those who have wronged me accountable. I will speak out against the injustices I've faced and make sure that the names and companies responsible are known. I hope that someday, I'll receive the fair chance I deserve. Until then, I'll keep seeking justice and support. May peace be with those who truly care about the well-being of others."

My attorney was Maschmeyer. Maybe some of the other attorneys in this Law Firm or decent but he was completely incompetent. He was late getting to court didn't even make it into the courtroom until after the judge was seated. The only preparation for the case that he had were some hastily scrawled notes on a yellow legal pad that even he couldn't read. He submitted no evidence to back up my claims, he did not petition the court to ask for anything that I had asked for, and ultimately the only thing that got accomplished was the one thing that I was vehemently against. Cost me a few thousand dollars to get absolutely nothing. And believe me the judge made it absolutely clear in his ruling that he ruled the way he did because there was no evidence submitted, no petition submitted, and that my attorney kept bringing up things that the judge had no jurisdiction on.

Tim helped me on my mothers wrongful death after a hernia surgery. I worked with him from April of 2015 just weeks after my moms passing until June of 2019 when the other side settled. I didn't have a dime out of my pocket and was amazed at what he was able to do for our family. His staff are great and as you can imagine I came to know very well in 4 years and I'm thankful for them as well.

I have had two different issues in which the Firm had helped me with. My fist case was a Work Comp claim. I submitted my claim and talked with Mr. Harts. After my meeting, Mr. Harts said e could not help me. I than sent my issue to Mrs. Golitko, I’m not sure if I explained better this time around but was told that Mr. Harts will be taking my case, in which was settled out of court. My second case was an Auto Accident in which, Mr. Reichert took on and got me my Settlement. During my Second case, I was having issues with my Employer, such as being denied the right to file for Worker’s Compensation, I asked Mr. Reichet about this and he stated that he would not be able to take this on. I emailed both Mr. Golitko and Mrs. Golitko about my Employment issue and have not heard a response back for neither of them. It has been Months since I have reached out and asked for assistance. This is why I am giving them a 3 star Rating.

What a Medical Malpractice Lawyer Can Do for You

A medical malpractice lawyer specializes in helping individuals who have been harmed due to the negligence or misconduct of healthcare professionals, such as doctors, nurses, or hospitals. These lawyers assist in cases where a healthcare provider deviates from the accepted standard of care, resulting in injury or death. Medical malpractice cases can involve misdiagnosis, surgical errors, medication mistakes, birth injuries, and other forms of medical negligence.

If you or a loved one has suffered harm due to improper medical treatment, a medical malpractice lawyer can help you understand your legal options, file a lawsuit, and pursue compensation for medical expenses, pain and suffering, lost wages, and other damages.

When Should I Hire a Medical Malpractice Lawyer?

Hiring a medical malpractice lawyer is essential if you’ve been seriously injured due to the negligence of a healthcare provider or institution. Situations where you should seek legal representation include:

  • Misdiagnosis or delayed diagnosis: If a doctor fails to diagnose or delays diagnosing a medical condition, leading to harm or progression of the illness.
  • Surgical errors: Harm resulting from surgical mistakes such as operating on the wrong site, leaving instruments inside the body, or performing unnecessary procedures.
  • Medication errors: Injuries caused by prescribing the wrong medication or dosage, or mistakes made by pharmacists in dispensing drugs.
  • Birth injuries: Injuries to a newborn due to medical negligence during labor and delivery, such as failing to perform a timely C-section or improper use of delivery instruments.
  • Anesthesia errors: Complications arising from improperly administered anesthesia, which can lead to serious injury or death.
  • Inadequate follow-up or aftercare: Suffering due to lack of proper monitoring or care after a medical procedure, leading to complications.
  • Hospital or nursing home negligence: Harm caused by the negligence of hospital staff, nurses, or administrators who failed to provide adequate care.

Medical malpractice cases are complex, and hiring a lawyer early can help ensure your rights are protected and your case is handled effectively.

What Does a Medical Malpractice Lawyer Do?

A medical malpractice lawyer provides various legal services to help injured patients hold negligent healthcare providers accountable. Their responsibilities include:

  • Evaluating your case: Reviewing medical records and consulting with experts to determine if you have a viable claim based on the standard of care and harm suffered.
  • Filing a lawsuit: Initiating legal action by filing a complaint against the responsible parties in the appropriate court.
  • Gathering evidence: Collecting medical records, expert testimonies, and other relevant evidence to build a strong case.
  • Negotiating with insurance companies: Working to secure a fair settlement that compensates you for your injuries without the need for a trial.
  • Litigating in court: Representing you during trial proceedings if a settlement cannot be reached, presenting evidence and arguing your case.
  • Calculating damages: Assessing the full extent of your losses, including medical expenses, lost income, pain and suffering, and future care needs.
  • Handling expert testimony: Coordinating with medical experts who can testify on how the standard of care was breached and how it led to your injuries.

How Are Medical Malpractice Lawyers Paid?

Most medical malpractice lawyers work on a contingency fee basis, which means they only get paid if they recover compensation for you. Key aspects of this payment structure include:

  • Contingency fee percentage: The lawyer's fee is typically between 25% and 40% of the settlement or award.
  • No upfront costs: You do not pay any legal fees unless the lawyer successfully recovers compensation on your behalf.
  • Case expenses: Costs for expert witnesses, medical record retrieval, and court fees may be deducted from your settlement or award in addition to the lawyer's fee.

Always discuss the fee arrangement during your initial consultation to understand your financial obligations.

How Much Does a Medical Malpractice Lawyer Cost?

The cost of hiring a medical malpractice lawyer is usually based on a contingency fee model. General estimates include:

  • Contingency fee: Lawyers typically charge between 25% and 40% of the total recovery amount.
  • Case expenses: Additional costs such as expert witness fees and court expenses can range from $5,000 to $50,000 or more, depending on the case complexity.

Ensure you receive a clear explanation of all potential fees and expenses before proceeding with your case.

Top Questions to Ask a Medical Malpractice Lawyer

Before hiring a medical malpractice lawyer, consider asking the following questions:

  1. What experience do you have with medical malpractice cases like mine?
Confirm the lawyer has a successful track record with similar cases.
  2. How do you charge for your services?
Understand the contingency fee percentage and any additional costs you may incur.
  3. What is the likelihood of success in my case?
Seek an honest assessment of your case's strengths and potential challenges.
  4. How long will the process take?
Get an estimate of the timeline for settling or taking the case to trial.
  5. Will you handle my case personally?
Ensure you know who will be managing your case and their level of involvement.
  6. Have you worked with expert witnesses?
Verify the lawyer's experience in collaborating with medical experts essential for your case.

How to Check the Credibility of a Medical Malpractice Lawyer

To ensure you're hiring a reputable lawyer, take the following steps:

  • Verify their bar status: Check with your state bar association for their license and any disciplinary actions.
  • Review their experience: Look for specialization in medical malpractice and a history of successful cases.
  • Read client reviews: Consult platforms like Avvo or Martindale-Hubbell for testimonials and ratings.
  • Ask for references: Request contact information of previous clients willing to discuss their experience.
  • Check professional affiliations: Membership in organizations like the American Association for Justice (AAJ) indicates a commitment to the field.

What Should I Prepare for My First Consultation?

To maximize the effectiveness of your initial meeting, bring the following:

  • Medical records: All documents related to your treatment and injury.
  • Evidence of harm: Photos, medical bills, and records of lost wages.
  • Communication records: Any correspondence with healthcare providers or institutions.
  • List of healthcare providers: Names and contact information of all involved medical personnel.
  • Questions for the lawyer: A prepared list to address all your concerns.
  • Timeline of events: A detailed chronology of your medical care and the issues encountered.

Being well-prepared helps the lawyer assess your case accurately and advise you on the best course of action.
