I originally engaged Mr. Westerfield to handle a debt that went to court. This was approximately 2 yrs ago. I was put on a payment plan with the understanding that a lien would not be put against my property. I was very clear explaining I wanted to make payments to avoid a lien. I think I would have remembered if I was told a lien would be placed anyway as I was trying at all costs to avoid that. Perhaps I misunderstood. Certainly possible. However fast forward present the attorney handling the payments stopped cashing checks. Yes, I had missed a payment, but they always took a late payment. I tried calling the company who would not talk to me w/o Mr. Westerfield’s approval. I called two week straight begging for a call back because at that time I found out I had a lien on my property which I did not know about. Being distressed went to office in person and found Mr. Westerfield in his office. I was told a letter would be sent out that afternoon. Again, I am calling 2 weeks later and driving over to find office closed. I can’t get a response. I paid this second time, and for services not rendered. I am out my money and still have no response. I went to a lawyer for help and feel taken advantage of.

I would like to begin by saying thank you to Mr. Westerfield and his wonderful staff for guiding us through the financial process that we just finished. You were so knowledgable and kind to us. Melissa worked on our case and went above and beyond anything I could ever have hoped for! We are so very thankful. I would highly recommend Steve Westerfield for any legal advice. He certainly knows the laws and works diligently to help his clients. I would also like to thank Rhonda as well. You also helped us so much along the way. Again, thank you to Mr. Westerfield and his staff. Your wisdom and kindness will never be forgotten. Sincerely, The Stricklands

This man is incompetent. Appointed by judge to do moms probate. Doesn't know the first thing about law. Two years later, hasn't even started probate. Left house to rot, didn't secure her belongingdps or take an inventory, didn't secure her bank account, left her car rotting in a field. Caused city violations due to neglect of her property. Finally resigned after repeated urgings to get the job done. Total deadbeat attorney, hasn't much experience, but huge ego.

Hired for lien work. $2000 by the time the lien was filed. By that time, not even worth the money to file suit. Poor adviser. I always had to reach out to him for any information. He never called on phone. Always sent an email then charged for 1/2 hour of time. Also charged just to read my emails. Never informed me on any dealings with other parties lawyer. Do not waste your time with this firm!’

I would recommend doing your research before retaining. I've spoken to 2 different individuals who used this individual for a custody battle and both have been very displeased. He just doesn't appear to care and put in the effort. I definitely recommend interviewing other attorneys before you commit to this one.

I hired this lawyer to do my divorce/custody. Worse mistake ever made. When I first met her she seemed very nice and knew what she was doing. It all started to go down hill once I had paid her. She was very rude to me over the phone, she would basically talk down on me. When she found out who my ex husbands lawyer was, she started to tell me that she respected that lawyer and was friends with her so right then and there I automatically knew I wasn’t going to get anything I had asked for. It was almost like she was scared to fight for me against the other lawyer. Well that’s when she started to ignore my texts and phone calls. She didn’t speak to me for about a month and a half. That’s when my soon to be ex husband started texting me saying his lawyer couldn’t get ahold of mine either. We all tried and no response. Well we basically did our divorce and custody papers through his lawyer only! He would contact me and let me know what was going on and what his lawyer was going to put in the papers. I had no support what so ever from my lawyer because she still wouldn’t contact me. Well I finally got fed up with it and told her that I paid her to be my lawyer and she needed to contact me!!!!! When she finally contacted me she said “I had a class Monday and I wasn’t able to speak.” Which does not explain where she was the rest of the Month and a half. She called me and I told her what me and my husband had agreed upon and she started gripping at me some more and talking down on me. She then told me a day and time to come into her office to sign my divorce papers. When I showed up at her office she took me to the room to sign the papers. While she was being very unprofessional and telling me that I shouldn’t sign them because I was going against the advice of my lawyer and saying I needed to take it all to court. She was not ever there for me to give me advice or to help me. She wanted to push it as long as she could so we would have to go to court. But I signed my papers and left. I would not recommend this lawyer to anyone! I wasted my money on her. I basically paid her for nothing because she didn’t do anything I asked of her and all she did was bring me to her office and let me sign my divorce papers.

We hired Pat as a divorce and custody lawyer after having wonderful experience with her in my criminal case. She was rude, talked down to us and was not on our side the entire time. She was on the other party's side because she knew their attorney. She ignored us for nearly 3 months, I had to do the majority of the investigating, and then let things go.Then gave us bad advice to give my husbands kids up for adoption to people who are alcoholics and child abusers. It was unfair treatment and we let her go as our attorney. We were aware that she had an excuse of family issues at the time our case was in full swing but that does not excuse her behavior. Now we will never know if those kids will survive the holidays.

Have been paying rent for 9 mos on apt in Hillcrest owned by Foster. Two words describe this "man": Dirtbag and Slumlord. The place is a "dump". Broken Windows, water seeping up from foundation, black mold, ceiling about to fall in. Mr Foster cares only about collecting rent. He owns 26 dwellings and each is worse than the last one. I don't know how the "man" can sleep at night .. Probably on a mattress stuffed with $$$. Whatever you do don't rent from this man. Repairs won't be made and he refuse to cooperate.

My son needed representation at a bench trial for a traffic citation. I had to pay the secretary $100 before we were even seen. Ms. Walker didn't seem especially interested in any of our facts, she only pontificated on random subjects. She looked at her calendar near the end of the appointment and grinned. The trial was going to be during her vacation, she couldn't have helped us anyway. She wasted our time and hers. I am a widow and $100 is a lot of money to me.

Mrs. Allen should not be allowed to practice law. I hired her for two separate needs and after multiple attempts to get her to do the actual work to no avail she was let go. Both cases were resolved easily by the other attorneys who I hired to replace her. She was unresponsive , unreliable, and incompetent, but very capable of billing for work not done. She actually billed me $65 just to read a two sentence e-mail that I sent to her when she would not respond to my phone calls. Please do not use this person unless you have plenty of time and money to waste. By the way, she didn't respond to the e-mail either. One case was for a divorce and the other for probate. Hopefully this will save someone else's family from having to go through the same difficulties mine has had with Susan Walker Allen. Billed around $4,000 and we received nothing at all from this lady. All the work was redone by other local attorney' s in a professional and timely manner for around $3,500. When you are going through a difficult divorce or death of a loved one you do not need an attorney who compounds your misery and your out of pocket expenses.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
