We drug our heals for a long time in getting our estate planning done. It felt like it was going to be overwhelming. Lance and his team walked us through the process step by step, answering all questions along the way and making the process so clear and simple. We now have everything - and I mean EVERYTHING (way more than I would have even thought of covering) - planned and in order for our family. We both feel relieved, secure and grateful that we took the time to complete this process. I would highly recommend Lance and his office to anyone I love and I would even go further to say I would encourage them to contact him soon. Simple. Clear. Professional.

As a real estate agent I frequently deal with multiple property owners who are involved with real property. Lance is the attorney I go to for advice on how best to help my clients and has helped several of them avoid potential pitfalls and challenges in their estates.

Lance Like is a great attorney! I am a financial advisor and have a lot of experience reviewing estate plans for my clients. Because I have so much experience with this, I feel very comfortable saying that Lance Like is the gold standard when it comes to estate planning services. Along with that, Lance also works in the area of elder law. Lance is always the first attorney that I recommend to my clients for any and all elder law and/or estate planning needs. He is a partner that I trust with my clients and their needs. There is no higher compliment or endorsement that I can give.

I have worked with Paige now for several months regarding Guardianship. Things I can say is that she has a gentle soul. She is very trustworthy and did a really good job on the Guardianship. I gave 4 stars in Responsiveness and Knowledge only because there is always room for improvement in those areas with anyone. The only negative I could say (if you want to call it a negative because of the "gentle soul" part) is that if you have a case where you need someone to "fight" then this is not the person for you. But my case has not been typical in the least and has been hard to deal with. I think with the typical case, you would not be disappointed with her work. She is thorough and dependable and I would trust Paige not to overcharge, etc. when I usually do not trust attorney's. She seems to adhere to the standards that should come with this practice.

My wife and I did our estate planning with them and they were outstanding. If you think you can do estate planning online with minimal knowledge of the little details of the law (like I have) you need expert help. Michelle was the attorney we worked with and she was excellent; her and the team asked us very detailed questions regarding wishes, scenarios that we would have never thought of but that could present in the future but that we realized are extremely important. I highly recommend them and am very pleased with the estate planning portfolio they prepared for my wife and I. This team is worth every penny.

I looked at several local Bloomington attorneys before deciding on Freitag and Martoglio. The thing that put them over the top for me is that they seemed genuinely compassionate and interested in helping my mom and I settle an estate. They communicated clearly, offered solutions that were helpful and in my mom's best interest, and unlike other local attorneys their fees were fair and equitable. Honestly they went way above and beyond for us. If you want top notch legal representation from attorneys who care about you, then this is your law firm. If you want to fund the fancy buildings and vehicles of the attorneys who represent you and get lesser representation, then pick a random phone number from the list of other estate lawyers in Bloomington and start writing checks. I definitely recommend this firm to my family and friends and to anyone reading this review.

Aaron has became more than a lawyer for me. He and his staff have treated me like I was part of there family. Always responsive to any issue that came up in a timely manner. Would reach out to me on weekends when I needed him the most. I wanted to settle for a lot less, but not Aaron. Aaron truly cared about me and my future. I will always be grateful to him. You're more than lawyer to me you're my friend. Didn't know Aaron prior to hiring him. Aaron you're the #1 attorney in Bloomington because you care. Thanks for everything my man!

I have Guardianship over my mother and this is my mother's attorney. She has Alzheimer's disease. She also has a boyfriend that came into the picture after my mother's husband died. After knowing my mother for 3 weeks he contacted Tom Bunger for my mom and he had also taken her to her banks 3 times to get her accounts closed. He succeeded once on getting her to close her accounts and thankfully I got there in time to mop up after the damage was done. Tom Bunger told the boyfriend that he couldn't represent him because it would be a conflict of interest. Yet, we just received a bill that clearly shows a meeting and phone calls with the boyfriend and he is asking to be paid out of my mother's account! Also my mother can't speak for herself nor does she even remember the whole court fiasco that the boyfriend caused. Somehow Tom can't figure out that the boyfriend is a fraud and has no money. The boyfriend told Tom that he has a large pension and a large savings account, yet the boyfriend breaks down in court crying (yes crying) he only makes SS and very little of that. This has been a nightmare for the family and Tom has only encouraged the problem. Don't use this attorney if you care for an elderly family member.

Absolutely DO NOT! have these people represent you. They ALL play the game, run the rat race pretending to busy working in your best interest, all the while they just eat up your retainer fee, AND then bill you more even when you tell them "I don't have any more money for attorney fees" even still, that is NOT clear enough for them. CLEARLY they are too educated to understand common English. Do not hire these people. They don't care about you, your hardships, or the outcomes of their advice. Ex. they advised me to let me ex fiance "have possession of our jointly owned property", and argue it in court at a later date. Well HE set it all on fire (83K truck, 60k worth of tool) and committed suicide that same night. They seemed shocked when I told them again he is mentally unstable yet they cautioned me about securing a protective order. People make sure no family, no friends, no acquaintances, or even your enemies hires this firm. They are as evil and conniving as those who you are hiring them to protect you from.

I have no idea why I'm going through these attorneys. I'm just a volunteer. In July of 2023 I asked for a simple meeting to go over reasonable accommodations with my volunteer agency and I did everything that was asked of me, including going through their local board, who never addressed the evidence or medical documents I provided. Shockingly, this volunteer agency (CASA) is now using their donor funds to hire private attorneys in Bloomington to handle their employment and discrimination cases. I'm still on leave against medical input and the director of the agency and Ms Cimera from this office are unable to efficiently respond to my basic questions while there are children on waiting lists who need advocacy. Am I on a medical leave or a personal leave? Can I set up a meeting with my volunteer agency to go over my concerns?

When it comes to being a "neat" and "tidy" attorney in any legal issues, Mr. Steve Douglas performed to our expectations and beyond. Our experience as business owners over the last few years is that he has a "no-nonsense attitude" about how he presents himself and his conduct when dealing with our legal hurdles. His ability to persuade and prepare case files is perfect and considered "proper etiquette," and it shows. No, loose ends with his service at all, and his work is impeccable and in good standing with the judiciary. I have executed his services on two deed transactions, litigation with others who do not know how to read a contract, also corporate formations for an s-corp type of filings for corporation guidelines and compliance's. He shines across the board. We have found his services to be excellent/professional. 10+ Professional. 10+ for prompt communication. 10+ legal understandings and pitfalls. If I ever need his services again, I will not hesitate. Highly recommended John Arnold - Bloomington Indiana.

I never saw a guy so eager to turn his coat -- to completely sympathize and give credence to the opponents. When I hired him to investigate slanderous statements and other misbehavior by several people, he said "I believe you." Maybe he was just lying at that time, I don't know. But he believed everybody he questioned on the other side IMPLICITLY. Every time he questioned some miscreant who had behaved maliciously toward me, he found them absolutely believable. They would say, "We didn't do nuttin', we're as pure as the driven snow," and he would report, going on and on about how believable they were, how truthful, etc. And when he questioned a DOCTOR! His awe and reverence for the upstanding, dignified and respectable "DOCTOR" X was absolutely nauseating. In short, he immediately gave far more credence to all the denials that anything happened, than to me -- even in the presence of hard, physical evidence. In addition, he was insulting and mocking, and he LOVES to give his clients orders. I don't know if he's a good lawyer or not. Just be sure he's really on your side, and will STAY on your side, when you hire him.

I called Jerry Siefers 4 times between January and March of 2015. We were really in a bind as we all live out of state and my mother in Indiana has alcoholic dementia and many other health issues related to alcoholism. We have been trying to get guardianship, or at least to get some legal questions answered. I was perfectly willing to pay Mr. Siefers for a consultation. I got no phone call back. Really disappointed.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
