I have consulted with Tim from time to time about various estate planning and elder law matters, and have also referred clients to his office. Tim consistently provides excellent advice in a thorough, prompt, courteous manner, even when it comes to extremely difficult and complex legal questions. His office provides an exceptional level of service at a great value, comparable to that of a large downtown law firm, but without the expense and inconvenience.

Injured at work and found out insurance isn't there just to help. I was being cut off on my much needed services. I learned insurance is all about cutting you off as soon as they can do it and not providing you the careand services that you are entitled to. Mr Cullinan overcame the obstacles of my case and reached a just settlement with any physical care necessary related to injury for the rest of my life. I am eternally greatfull to Mr.Cullinan and his skills in handling the situations thrown at him. I thought at one point it was over for me and he very skillfully battled back and won the case. I could also say William Cullinan is a patient, caring,, skillful and hardworking attorney.

I have used Molly 3 times over the past 5 years for different matters for my business. She represented me for a deposition. She defended me in a separate litigation as well as filed counter claims. She skillfully out boxed opposing council in court and got the case dismissed. The third representation was her fighting a subpoena for emails and other documents and files against my company from a large publicly traded company. She was able to protect our rights and our sensitive documents and emails. We never had to give them a single thing! Priceless. Molly is business minded attorney which I appreciate and derive value from in that I can just layout the situation once and she gets it. She also has a great team of attorneys in her firm to support her. Her pricing is fair and reasonable and a true value when you look at the level of experience and execution you get for your money. I feel the world needs to know what a stand up guy Jesse truly is. Not long ago I ran into some issues that required help of a Lawyer. Not knowing who to turn to I saw Jesse's advertisement and decided to give him a call. I have to say this was the best decision that I've ever made. Not only did he put my mind at ease but he was there for me whenever I needed him. He kept me up to date every step of the way and was able to resolve my case quickly. He made a very stressful situation seamless and for that I am eternally grateful!

Carmel represented us in the sale of our condo and purchase of another condo. Her knowledge and attention to detail helped us to avoid and cure a serious title issue. She was always available for us and took calls on weekends and evenings. She even stayed late (8pm) to allow us to sign documents for the closing. Carmel and her staff were very professional and took the time to answer all of our questions and respond to our concerns. We highly recommend the Gilberti Law firm!

Daniel Crossman Perry is a superb lawyer who avoids litigation when possible; when he must go to trial, he wins cases with the merest flick of his intellect and experience. I have seen him turn in stellar performances not only in his usual field--land use cases--but also in a broad range of general litigation--including the winning of a very complex case involving a pension fund that left opposing counsel bewildered and scratching her head. I have personally witnessed naughty government officials *tremble* while being cross-examined by Dan. His one weakness is that he can, at times, be closed-mouthed and hard to reach. I spent seventeen thousand dollars in legal fees involving a residential condominium in Boston, where a large, famous Boston firm had been hired. This was only because Dan was unavailable; he would have resolved the case with equal skill and one-third the fee. Do not hesitate to bring to Dan your estate planning needs--trusts, wills, and health care proxies--as well. Dan has *literally* written the book on one of the most obscure and difficult areas of legal practice in Massachusetts--property lawyers across the state reach for his treatise on the Subdivision Control Law, which he wrote for the august MCLE (Massachusetts Commission for Legal Education). Dan's partner Marc Deshaies is an excellent lawyer as well. Judges--especially prickly, hard-to-please Superior Court Judges--know Dan, trust him, and like him. This guy is power you definitely want in your corner. In the areas of complex litigation, property, and land use, this gentleman is as good a lawyer as anyone in Boston for 50% the fee.

My husband and I have worked with Phil for many years - he has executed a very complex family trust for us (my husband is the sole proprietor of his business, and that was part of the trust), acted as our real estate attorney, as well as having guided us through our will, medical directives, powers of attorney, etc. He is calm, patient, detailed, and as knowledgeable as they come. He is always quick to return calls, and his office staff are wonderful to work with, too. He was perfect for creating our will - a very emotional and challenging process, especially as you try to determine guardiancy of children. He guided us gently and carefully pointed out various considerations that we would have missed or avoided. He was sensitive to the delicacy of the process. And he took care of every detail. When we sold our house without a realtor, Phil was invaluable as a source of guidance as we worked out P&S with him and discussed negiotiations and closing details. We recommend Phil with the very highest rating. If all attorneys were like him, they'd be revered by the public!

We were absolutely thrilled with our experience with Kenneth Collinson, who guided us through the fairly complex process of creating a will and establishing a trust for our estate. Ken was incredibly knowledgeable, gifted at explaining complicated concepts and was attentive to each and every detail of the task. We left much better informed about our own estate and financial situation and were incredibly relieved to have finally completed the process, knowing our affairs were in order. Thank you Ken!

As a lawyer, with over 30 years of experience, I've come to know what a good lawyer looks like and I can tell you it includes the likes of Mary Schmidt and her team. Every once and awhile, a lawyer needs his or her own lawyer to represent them. When I needed a lawyer for a tricky probate litigation matter, there was no question but to seek advice and counsel from Mary Schmidt and her team. She is smart; capable and available, not to mention, extraordinarily hard working and good judgment and common sense. It was a bonus that both the Judge and clerks of the court knew and respected her. I recommend her without reservation.

I have taught my children that the single most important decision they will make in their lifetime will be their choice of spouse. Unfortunately, I did not get it right. Thankfully, there are attorney's like Patrice Morse to put your life back together when it falls apart during and after divorce. She will put your needs and the needs of your children first. This woman is a spectacular litigator, is well respected among the Boston area courts, and well known by the judges of Norfolk and Suffolk county as a respectable, highly trained and fair attorney. She takes the time to speak with you, learn your history, and learn the intense, important details of your marriage and why it fell apart. Most importantly, she cares. She cares about your needs and your children's needs. She is so easy to talk to and she knows the law. She does her research then goes to court and will nail your ex-spouse to the wall. She is a fierce attorney who held my hand tight as I sat in the courtroom waiting for a judge to decide the fate of my children and myself. I will never trust another human being like I trust Atty. Patrice Morse. If you are looking for a divorce attorney or for an attorney to deal with absolutely any post divorce issues, she is the one to hire. Do not waste your time looking elsewhere. She is the absolute best and worth triple what she charges. Diana V. Perry, MD

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
