We went to Bridget Andruscavage as she was listed as one of the lawyers in our area, through our legal plan at my work, who did trusts and wills and she had good reviews. We thought we had a simple case to work on. We are not self employed. All of our assets, except hunting property, are separated and in either my or my wife's name. I have siblings who have put the hunting land into a revocable trust. Within the first 10 minutes of talking to her, she was telling us we should go somewhere else as she is not the best person to go to. This should tell everyone what they need to know. Trusts are used to avoid probate court and to protect assets from estate taxes. If she can't help those people who want to avoid probate and need to protect their assets, then why advertise as being able to do trusts? Our guess is that she couldn't make enough money for the amount of work involved. Find someone else as meeting with her about a trust and will is a waste of your time. That's what we found!

The tender years doctrine is a legal principle in family law since the late 19th century. In common law, it presumes that during a child's "tender" years (generally regarded as the age of four and under), the mother should have custody of the child. The doctrine often arises in divorce proceedings.

Absolutely this sam surface is no good at all.the 4 times I talk to him as the first time telling him yes on hiring him and that was it like a 5min talk.the 2 time he had to make it quick because he was at swimming lessons with his son and that was maybe 5min.the 3 time he had to make it quick again because he was out skiing with his son and again that was less then 5min.and the 4 time was the day befor court and him telling me he never filed any of the evidence or audio that he was given and had in his possession that was on my behalf to show different then what was sed about me.i allso asked him to file for the other person to show cause or prove with showen what thay wer saying was try or not.wich he dint do any thing at all.he told my aunt I would not call him back or I was avoiding his calls so I called him and ask him why would you lie to my aunt and say that to her and I have my phone records to show every time I talk or he called me or I called him.i asked him for a receipt on what he chared because my aunt is the that payed him and I wanted a recipe because I was fileing a complaint with the bar association and he told me I'm not give you any thing and I ask him if thairs any thing he wanted to say on his behalf why he dint file anything and he had a addatude again telling me I'm not given you anything.please note I have not seen my child in 17years and this time hired sam to represent me and he had made it so much worse now I cant even get a court date to have a judge here my side because thay sed I had my cance.after all this he still got payed 2500.00$ for talking to me on the phone for maybe 30minutes all together wich he claims that would be his free console realy and a court date asken for a continue because he had just been hired and needed time to file paperwork wich he never did.

I have never written an attorney review, but this one was necessary!! Danielle Difiore' at Anderson DiFiore, PLLC has gone above and beyond for our daughter. She made decisions I didn't always understand until the outcome, but she told me in our first meeting to trust her judgment and decisions throughout the case. I asked her to protect my daughter's voice and choice. And she did just that. And I am so glad I just listened to her, followed her and bit my tongue when I was worried it might not work. She has helped us protect our daughter. A lawyer is always expensive, and she is, but she is worth every dime and deserves every dime. Our case has been long and drawn out for years, but she was brave and took on the many filings in this case. She didn't care about winning or losing (she takes risks), she didn't care about background (a very broken situation), or even the money (allows payment plans), she cared about the child in the case and that has been so clear from day one. She has put in so much time, effort and care. My family calls her the chihuahua, she might be small, but don't let that fool you, she's feisty and fiery. Danielle is ready to put on a fight where it is needed. I don't think she knows just how much my family and I appreciate her and what she has done and continues to do to help us legally protect our daughter's voice. She's an amazingly kind human being, don't let that tough exterior fool you, she uses that for court and it's intimidating for sure, she can read anyone! And boy does she know how to use her abundance of knowledge where necessary, her filings are impeccable, her arguments flawless. I have had my fair share of legalities and meetings with attorneys. They were either for the average millionaire, unavailable, uninformed, too scared to rock the boat or take risks, or just didn't care at all, but there is no one better than Danielle. If you're honest (and you better be, she will read you) and if you can relinquish control, she will take your case where it needs to be. She will care about the child. Hire her now!

Danielle was an absolutely amazing attorney. She won handily both times we had to go to court over my custody agreement. She was more than available whenever I had questions, and was a perfect representation for me and my family. I wouldn't trust anybody with my children's future with me more than this firm. I owe them way more than I ever had to pay. Also, I couldn't be more proud that she got her name on the door while she was representing me. She absolutely deserves it, and I would recommend her to anybody who asked!

While our initial consultation made me feel heard and supported, it has been nearly four months since our last contact despite multiple attempts to call, text and email. I've been left hanging without the agreement I paid for and have been forced to seek for and hire another attorney. As much as I understand that life happens and he may truly be unable to help me at this time, I've paid for a service and believe I deserve an explanation, at minimum, as this significantly impacts a very sensitive situation.

He seems like he might be a nice guy, but after he agreed to take on our simple case, we've only progressed inches in the 6 months that we hired him. It takes him weeks to respond to emails (after I've sent multiple follow ups) and it's been a month since we cancelled his services, requested our invoice and a refund of the retainer we paid him, and we still haven't received it. Again, probably a nice guy, but I've been nothing but tirelessly disappointed since hiring him and would recommend people look elsewhere for their legal needs. All his 5 star reviews are from years ago. It's a shame he takes people's money and then just disappears. You get people's hopes up, John, on very personal and sensitive matters. Maybe you should start saying no to people if you're too busy to actually help them.

Dave took over my case from another lawyer who wasn't doing such a great job. This put him at a disadvantage with missed legal deadlines and having to play 'catch up'. Despite this, he managed to help me have a much better outcome than I might have. He kept me in full and timely communication throughout, and he had previous experience and expertise in the area I needed. He helped me see that mediation was the best way to go for my case cost/verdict wise and was very supportive of my situation. Highly recommend him.

I applied for the Human Resources Assistant position with Stinson, LLP in Minneapolis, Minnesota, in August 2024. I was called the next day after applying via their online job application on their website. My initial telephone interview was with Chelsea L. Clennan, Director of Human Resources for Stinson, LLP, who's located in their Wichita, Kansas office. Chelsea was immediately complimenting me, telling me that any employer would be lucky to have me, that my skillsets are perfect for the role, that they would move quick for me in the recruitment process, they would make same-day job offers if needed-- immediately raising red flags for me that she was not a genuine person. She immediately moved me on to the second and final stage of the hiring process: the final interview with the hiring manager, the HR manager of the Minneapolis office-- both of whom reported to Chelsea. My suspicions of Chelsea would prove correct when, all the sudden, after letting her know after my final interview on Friday afternoon that I did have another offer, which I'd received the day prior, Chelsea responded to my email quickly, letting me know her and her hiring team would meet on Monday. In her email to me, which I've attached, she even told me her team considered me a top candidate. Monday came and went-- nothing, crickets. Tuesday, I received the attached screen shot email, letting me know they'd meet later that day. I replied, thanked her for keeping me in the loop, even further expressing my gratitude for keeping in touch with me and making me feel respected and valued. Tuesday, Wednesday, Thursday, Friday -- absolute radio silence from Chelsea L. Clennan. I sent a polite follow up email Friday afternoon-- again, I had been ghosted. Not a single reply or word from Chelsea or her team ever since -- despite her shtick of "you're a top candidate" and "we move quickly." I shudder to think how Stinson, LLP employees -- whether in Minneapolis or Kansas -- are treated if Chelsea treated a job applicant -- me -- with what I felt like was pure garbage and disrespect. Personally, I do not recommend Stinson as a place to work based on my experience as a job candidate and how I feel I was treated. When people like the human resources director show you their true colors-- believe them.

I walked in alone to a hearing riddled with anxiety and uncertainty, with no legal representation. Not knowing what was going to be my outcome, especially over a situation that should not have even been brought to a level where court would have been involved, I requested a court appointed attorney. I have never lucked out so much in my entire life than I did that day. Stinson Law firm just so happened to be providing pro bono work that morning and took my case. The two attorneys I worked with not only helped me feel validated in my disbelief that I was even there, but also were the most knowledgeable powerhouse of representation I could have ever asked for. If I were to sum it all up in 3 reasons why I would recommend them to anyone, it would be: Top notch negotiation skills, an unmatched knowledge of the law surrounding my scenario, and for being the most personable, down to earth people, to have the pleasure of working with.

Terrible experience with this law firm. Like many others, I had a great conversation with Dick Morris saying we absolutely had a case and they would be thrilled to represent us. They asked for a retainer of $5,000 and then threw us to a junior lawyer who had no idea what she was doing. Over $24,0000 in bills later we lost the case and I still have the same home issues I did when I retained Morris Law Group. Buyer beware.

Worst law firm every. We hired they on November 3 2023 and we're told it was a easy straight forward case and should be resolved by Christmas. When it is still on resolved and obsoletely now progress on the case in 8 months. They are very poor at returning phone calls and emails to both their clients and the other parties lawyer. They wasted 8 months of our time on a very time sensitive case. Stay very clear from them. Especially Richard Hechter. This law firm should be investigated by the BBB and the State Attorney General.

I would highly recommend not retaining attorneys from the Morris Law Group. Last fall, my siblings and I were directed to retain an attorney due to a relative openly admitting not upholding their fiduciary duties in our family partnership. This impacted my sisters and I. We retained Amy Mattson and she included her former coworker Patrick Kennedy for some reason. We spent several months responding to emails (sometimes being double-billed for having to respond to the same question that we already answered), they were unable to assist us with our document request per our partnership agreement, we were billed to refresh their memory despite already providing them with the information via an email that we were already billed for, and we did not receive any legal advocacy with our matter - they both seemed very disinterested in our case and more concerned about racking up legal fees. Our last meeting with Amy and opposing counsel, she said very little and deferred to my sister and I to represent ourselves during the meeting. When it was all said and done, they didn’t assist us in anyway. I would highly recommend avoiding this law firm and do your research when retaining attorneys, you deserve better.

Eric Brever is terrible at returning correspondence. I would never use this law firm again, due to this attorneys disregard for their clients timeliness. I don’t think I’d be asking for anything to grand by assuming I should be able to get an email response within a few days……. It’s much worse. These emails go unanswered, or are no longer pertinent after finally getting a response as much as 30 days later. I would have much preferred that he be a professional and tell me that he either doesn’t want to represent me, or that he’s too busy. If you need a simple LLC set up (very easy for an average person) he’s capable of pulling that off correctly, but I’d really be leery of trusting him with a timely matter, or if you are looking for a response even.

He was flexible and made our requested changes. His wording in the letter was direct and well supported by stating multiple statutes and common business practices.

Mike Kircher has done a fantastic job of representing my kids and I over the last few years. He's extremely intelligent, and really knows the law inside and out. I can't recommend him highly enough! I've also worked with Steve Sunde in the past. I have so many good things to say about him as well. I would never trust issues of family or business law to any other law firm.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
