I had to have an updated will since it had been years and my situation had changed. Not only did Atty Miller do this to my specifications, she made sure I was covered for end of life health concerns and emergency life situations. On top of all that, I needed the update in a very short time. She delivered.

After a acute change in health status, we were referred to Lillian for estate planning. During a very difficult time, she and her office provided outstanding services in the area of estate planning, advanced directives, and wills. We can not thank her enough. As well, folks we have referred had a similar superb experience, and we will continue to recommend her and her staff to others.

Lillian Miller was recommended by a friend to do estate planning for me. She did a great job. She met with me and my two children, where we discussed our situation and our needs. She listened very well, and took the time to understand us. She asked many questions, so she could get a clearer picture of what I would like to accomplish and avoid in the event of my death or incapacitation. She spent a great deal of time explaining to us what our options were, and what advantages or disadvantages there would be depending on the choices that were made. She was prompt in returning phone calls or emails. Her fees were reasonable. I would highly recommend her as an estate planning attorney.

This is my story, In 2016 I started my journey at nursing school at Stone Academy in the evening program. I encountered many delays during this time, I finally graduated in the year 2020 instead of 2019. I have been trying to pass my NCLEX from November 2020 until January 2024, I passed. I felt accomplished and all congrats were in order. I applied for a job went through the process but my license keep saying pending on DPH website. I called the Board of Nursing and the person who answered the phone informed me that my license will not granted until they receive an updated transcript that I graduated from this institution as the one they have on file said withdrawn. The emotions were high when I heard these words my response was how could you have sent me ATT to write my boards for the past 3 years? The backlash was awful, detached and no empathy. She did refer me to call OHE ( Office of Higher Education) to find out if they have the transcript but they did not! Long story short….OHE put me on a list to request an official transcript from Stone Academy, this school stop existing in 2022 and currently have lawsuits. I decided to higher a Lawyer, I called Keily Mira Law Firm and was connected to Jon. I went in the office, I explained my case but he never had a case like mine. He got the understanding and decided to take my case, he was also hitting close doors! I gave him all the information for him to work with, when I thought getting a Lawyer would perform a miracle, I felt frustrated and overwhelmed. Jon reminded me that he is working on my behalf and he is my ADVOCATE, I would have to be patient because it wasn’t an easy task. OHE placed my name on a list to receive my official transcript, even though a copy was sent wouldn’t be enough, on 2/20/2024. I emailed OHE 2 weeks ago to find out if there were any updates the person responded to me yesterday 4/18/2024 “as of right now there hasn’t been any updates and I have escalated your case”. I forgot to forward this email to Jon yesterday, I was rushing to work. While I was at work yesterday my phone rang and I saw that the call was coming from Jon’s Office. He was excited too, He said your license is in your inbox, I was thinking this is too good to be true but he kept saying it. I started crying on the phone, He insist I check and so I did. I couldn’t see from my eyes being filled with tears. I said where is it coming from and he told me and I saw it! Awwwwh what a relief Jon has been working behind the scenes while I was being patient, Jon was definitely my advocate! I am forever grateful, I am now moving forward with my life to make a better living for myself and my family. I cannot thank you enough! You didn’t turn me away. Thank you! Thank you!

Four separate associates of this guy flailing around in my case for over 2 years...one disappeared with only an auto reply voicemail... He was no longer there for my motion to correct an illegal sentence by omar Williams and fired state attorney Gail hardy...the last associate fed donuts to cops on her way to the bar...ultimately they quit despite the merits of my claims that were acknowledged in lieu...run from these bunch of nutmeggers...holy moly

I guess I am finding myself on the Kirschbaum bandwagon looking at the reviews and if I could put all of them together that would explain how I feel. Please put your Yellow Pages away and stop googling and look no further, this is the best legal team in the state not only witnessed by the reviews I have read but from my own personal experience! I had a very difficult case that included the bureaucracy with the state’s Department of Developmental Services (DDS). The intricate layers that I was facing were mind boggling to say the least. I didn’t even know if they would take on such a case as mine. I knew going in that it was going to be difficult. My head was not hiding in the sand and would have understood if they had wished to decline. With my first initial appointment I met with the Managing Partner, Damon Kirschbaum and then later I met with Supervising attorney, Andrew O”Shea. When I left the initial appointment I was left with peace of mind and finally some tranquility that I had the best team working for me. The only thing that they told me was to tell them the truth of the circumstances and they would have my back….and indeed they did. I know this as when I saw emails going back and forth I remember seeing several that included 11:00 p.m. e-mail correspondence as well if I had a question during the weekends they were always there for me. What I think impressed me the most and made things easier was that both Atty. Kirschbaum and Atty. O’Shea listened intently on the issues at hand. They put a plan of action into place, explained in detail the pricing structure and put everything out on the table. I was never hit from behind on anything. If they didn’t have an answer to a question I posed to them they found out the information and presented it to me. They became immersed in my case all the while handling other cases as well. I always felt that I was the only client they had but I knew they had many others. You will never find more competent and caring attorneys such as Atty. Kirschbaum and Andrew O’Shea. If you want to have peace of mind as well as the feeling that the weight of the world is no longer on your shoulders, I know that they would exceed your expectations. jk

I love Attorney Owen Eagen, I had a great experience. Unfortunately not so much with the staff. I had mistakenly lost a check that the office had given me during a closing. The check was part of the closing. On May 25th I went directly to the office and the front desk lady came to the screen and made me feel line a second class citizen. Than told me to walk to the side of the door while she open the door to talk with me. I understand covid and I work in a public place but again felt like a second class citizen. I understand everyone is careful. All I wanted was prompt service. If I had a closing I might have been treated better, I sent several emails and only one was returned. Not very nice. I work in banking and as a Branch Manager my customer whether right or wrong we always do our best to treat them with world class service. I am very disappointed, As much as I felt Attorney Eagen is professional and did a nice job on my closing. I feel his staff could have treated me a bit nicer.

We hired this elder law attorney in 2005-06 to prepare our wills, etc. When it became necessary to conduct further business in 2015, I was treated with extreme disrespect and condescension, consequently, I do not recommend this attorney and urge people to seek legal aid elsewhere.

Eliot Nerenberg never even filed a motion after I hired him to represent me in a custody and Child support matter. I kept waiting for a court date and after almost two months I asked him why it was taking so long and at that time he said he hadn’t expected my ex to be as difficult and uncooperative. Apparently Eliot thought an agreement could be reached without going in front of a judge but he was wrong. I used up what I had in savings to retain Eliot and he never filed the motion. I was devastated that someone I trusted and once thought so highly of was so cavalier as he said he would need another $10,000 to proceed with filing the motion.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
