Not being one who writes reviews, I am writing because I am uniquely positioned to provide insight as I have observed Ms. Fleishman’s performance over the last 10 years in my own case, extended family’s case, and the cases of family friends. Ms. Fleishman delivered wins in each of these cases and demonstrated brilliant intellect, detailed knowledge of law, uncanny intuition, and a keen sense on where a case is heading and what may arise. Lori and her team completely turned my case around into a complete success. In the past, I interviewed many attorneys and can empathize that it is incredibly difficult finding someone trustworthy, who is not primarily concerned with filling their retainer. Ms. Fleishman is on the opposite end of this spectrum as she genuinely gives counsel for the benefit of her clients. She cares more about winning your case, protecting you from any damage, and obtaining the healthiest outcome for your family. There have been moments when her advice to me went against any additional profit to her. This is the caliber of representation that I strongly believe deserves such a great review. Ms. Lori Fleishman is a renowned top tier attorney who is highly regarded in the South, having represented both private individuals and major companies. She is regularly hired by the South’s finest, from company heads to industry executives. People even look for her from areas outside Tennessee. Many have heard of her wins, as she wins more than loses. If you are hiring her for your case, you’d be happy to know that you are hiring the Ivy League of attorneys. If average attorneys are Kias, Ms. Fleishman is definitely a Ferrari. Quite literally, she has a strong presence in the room and is extremely fast on her feet. A rarity in the law world, she has both an empathetic, objective eye, but is also well known in the courtroom for being an aggressive fighter. Her fierceness in defense of her clients has long been famed and discussed among attorneys and previous, happy clients. I have seen her in Gladiator mode and she will NOT back down in your defense. I cannot emphasize this enough. She is extremely thorough and will catch the little details others will overlook, which can turn cases around. This combined with her intelligence, strong poised presence in the courtroom, and 30+ year experience makes her someone you definitely want on your side in tough cases. I’d much rather have her on my side than against. From personal experience, Ms. Fleishman takes the time to listen to her clients, ask detailed questions, and can immediately consider a number of possible strategies and resulting scenarios. With 30 years of experience, her expertise clearly shows in the first meeting, in mediation and under pressure in trial cases. She has a natural ability to think beyond what is being portrayed, and figure out what is truly happening on the other side. I read other reviews on this site and have to shake my head. Some of the negative reviews are not authentic as there are cases where disgruntled opponents or ex spouses have lost against her in court and log onto these sites to smear her name. They create fictitious, fake stories to retaliate against a fair trial that they did not win. Please be careful when considering. As with any review, please question the credibility and stability of these authors. Questioning is healthy. If you are not sure about an attorney, try scheduling an appointment and see for yourself. If the attorney clearly shows knowledge, addresses your concerns, and completely evaluates your situation, that is a good sign. Under her representation, I rested easy knowing that I have the best possible attorney in the South. I have confidently recommended her to my own family and friends, and I’ve only gotten words of gratitude. So I can definitely recommend her to others on here without hesitation. Feel free to send the letters of appreciation to my email. It would be extremely difficult to find better.

Lori Fleishman is a great lawyer and I highly recommend her for handling your divorce and/or child custody case. However, before I get into all the reasons why I think Lori is the best lawyer for these law specialties, I want to set the record straight about an exceptionally negative review about Lori that I just read on this forum. It is titled, ‘Jacqui, child custody case.’ Jacqui rated Lori as "poor" in all categories. I thought, how is it possible that one of Lori’s clients would rate her so low? A lawyer that deserves such low ratings surely could not survive in such a competitive market as Knoxville. I knew that Lori’s law firm was thriving, so I went back to re-read this review to try to better understand the person’s perspective. While I was reading it, I realized that I knew the person that had written this review, based on terminology and writing style, and she wasn’t a client of Lori Fleishman. Let's call her Alicia (not her real name), who is my child's ex-mother-in-law. Alicia hired several lawyers during the past few years in an attempt to gain the upper hand in both the divorce and child custody case in which my child was involved. She used various dirty tactics to try to manufacture evidence that she could use in court. Lori was able to negate the fabricated evidence and use it to our advantage. Because Alicia has not been able to prevail, she has resorted to character assassination of the opposing lawyer (Lori). A lawyer's reputation is their livelihood. This is an effective, but very dishonest and low class way to "get even." It is interesting to note that Alicia chose the name Jacqui to be the author of her bogus "review." Jacqui is the name of one of Alicia’s real life daughters. Jacqui is really a very nice person and I doubt if she is linked in any way to her Mother's deceitful actions. This is a good example of how easy it is for someone to ruin a professional's reputation by using lies on feedback forums, like this one, or on social media. It makes me wonder how many other bad reviews of Lori on this website and others like it could also be Alicia’s work. It is becoming more and more difficult to distinguish between the good guys and the frauds, liars, and disreputable people online. They distort the truth for their own selfish motives. The good guys are legitimately trying to help the readers of this forum by sharing their REAL experiences, both positive and negative, as one of Lori’s clients. If people are being truthful, I have no doubt that the good reviews will overwhelmingly outnumber the bad ones. MY REVIEW My wife and I first met Lori Fleishman four years ago when we were looking for legal representation for our child’s divorce, which included a child custody battle. We were very pleased with the outcome that Lori fought for in both the divorce and the custody battle. Lori has a great legal team to assure that her clients have the most competent and effective legal representation possible. We highly recommend Lori Fleishman to anyone who is looking for a knowledgeable, experienced, and effective lawyer to represent them in a divorce or a child custody dispute. Lori guided us through the turmoil and kept us in the loop of what was happening at each step in the process. She imparted to us her confidence that we would eventually prevail. In summary, I can’t stress enough that you don’t realize how important it is to have really good legal representation, especially if you face off with someone like Alicia. You need a lawyer that can respond to the twists and turns in a case and not back down from any hostilities or difficult situations faced, especially when “special personalities" are involved. - George

Before I hired Ms. Fleishman, I looked at AVVO to see if she had any negative input. I was somewhat concerned by some of these comments. However, I know, first-hand, the kind of lawyer Ms. Fleishman is, and I also know that she gets results. It is true that any legal process takes a lot of time, and sometimes it takes much longer to get through all of the legal hogwash than we would like, but the end result is what is a determining factor for me. Ms. Fleishman has a history of having good results especially in child-custody matters. I know of no highly utilized attorney that has not received a negative comment from a client, or the other side, at one time or another. I suspect many of the negative comments made here, were made by someone other that the client. I have nothing but good to say about this attorney. Ms. Fleishman is professional, Ms. Fleishman is experienced in the law, and Ms. Fleishman gets results . . enough said!

If you can't get Jo Ann, Blair is your next pick. Even though she couldn't figure it out she was also in the wrong jurisdiction. Blair was the opposing counsel. She also had the same tendencies where they don't care to take dads away who haven't done nearly as bad as other dads. This firm is NOT for dads. Though they are bulldogs. You may be able to get them to fight for you. Now if you're a woman, you'll get what you want in court with this firm. Blair gets 2 stars because Jo Ann got 3. It's half personal and professional.

We hired Ken recently. We found him to be dishonest. He charged us significantly more than he told us he would, waited until the last minute to give us his bill (after we repeatedly asked him for it with no response), and refused to compete a task that all other lawyers perform. I’m sure Ken is a good guy but on this occasion it felt that he was taking advantage of us so it’s only fair that you know. I’d like to think that he has learnt his lesson that people are more important than money.

Absolute crap. They don’t care about the people. What a scam what a joke. I wonder if they even take any cases. Horrible. Just horrible. I’m saying this from experience with them. I spoke to one of their so-called representatives or want to be lawyers. They agreed to take my case and then 20 days before my hearing they said oh no, we can’t take it. This is for a simple divorce. No assets not contested divorce. Why tell someone you’ll take the case? Don’t let them ruin you too. If my tax dollars go to help fund them, I’m gonna be really upset!!!

Not sure how anyone qualifies for legal aid when their income eligibility for a family of 4 is 25,000 a year. Then when I asked about debt to income, bills, and child support etc was met with incredible hostility and rudeness. That is well below the poverty line. You would have to be homeless to qualify for their services according to the rude woman I spoke with.

If I could give a lower rating than this I definitely would. He drug out the divorce as long as possible, Would bill me every month additional $100-$300 or more for “mailing” me with ridiculous trumped up fee charges such as, he would bill me for “reading”an email from defendants attorney who made a minor statement concerning a date or comment and also for cost of secretary “ mailing “me a notification stating that he read it, a separate fee for postage, and “ labor” for actually mailing it! He also called me one Saturday morning asking me to come to his office to “discuss the case” which I thought was odd and said so but he insisted that, “he had other pressing cases coming up and may not have another time before the next 3 weeks before going to court”… so I drove a good distance to get to his office, within a minute of being seated he excused himself and spent a good 30-35 minutes rummaging in a file closet across the hall, kept excusing himself to do more of the same, would comeback… ask me something that we had already discussed then get on his laptop… he didn’t want me there to discuss MY case… he was preparing for ANOTHER upcoming case and wanted to BILL ME for his time at the office on a Saturday!

Needs to retire. His letters to the court are always with spelling mistakes, he overcharged me (bills to read a one sentence email). When you call him he is in a bar or tavern as you can hear the backnoise. A few emails to him he charged over 1000. He is a joke and has people believing he is this really good lawyer. He is good at taking your money, thats all. My ex was trying to work with Mr. Valone through his lawyer to wrap up our divorce and Mr. Valone would write all these awful lies in letters to my ex. When I asked him why he was doing this he said he has been doing it all his life. He even had me feeling sorry for my ex. I think he has had a bad life or bad drinking problem. His letters are all filled with lies and he does not care. He sounds drunk all the time. His face is always red. Stay away.

We hired Mr. Herrera after a pleasant phone call to help my elderly mother with a landlord (slumlord). After paying his fee for a letter we had to seriously edit because it did not contain troubling elements regarding her landlord's negligence, he was difficult to reach and made excuses contrary to legal remedies we know existed. A month after the first letter, as we waited for the landlord to take action on his dilapidated house, I hired him to write a letter to a business competitor regarding his defamation and slander. I had to write the entire thing, including state and federal laws he was ignoring, as I'd already emailed him the laws and their corresponding precedents. Months later, after landlord had failed to live up to his own written promises, much less repair the house in a livable fashion -- which includes a failing heating and ductwork system -- Mr. Herrera told my mom to wait until winter before we could address the issue. Seriously? Seriously. We'd informed him, with photos, of this problem the PREVIOUS WINTER. To get that "answer," we had to call numerous times over the course of two weeks, finally stating "we'll have to hire a new attorney if we don't hear from you today." He took our money, wrote crappy letters, refused to any follow-up, and never stated fees for more action. Maybe he didn't want to take any action. Maybe he made his easy money and that was all he wanted. We paid for letters I could've written myself just to have his Esq. attached to them. Wasted six months and $800 which would've been better spent on a competent lawyer. Nothing has changed since we sadly chose Mr. Herrera to "represent" us.

What a Real Estate Lawyer Can Do for You

A real estate lawyer provides legal assistance in transactions and disputes involving property, including residential and commercial real estate. Whether you're buying, selling, leasing, or developing property, a real estate attorney can help ensure that your transactions are legally sound and your rights are protected. They review contracts, perform due diligence, resolve disputes, and provide legal representation in negotiations and litigation involving property matters.

Real estate lawyers are crucial in safeguarding your investment by ensuring compliance with local, state, and federal real estate laws, as well as protecting you from potential legal pitfalls related to property ownership and transactions.

When Should I Hire a Real Estate Lawyer?

Hiring a real estate lawyer is beneficial in various scenarios, including:

  • Buying or selling property: When navigating complex real estate contracts, it’s advisable to have a lawyer review and ensure that the terms are favorable and legal.
  • Commercial property transactions: For leasing, purchasing, or selling commercial properties, a lawyer can help manage the intricate legal aspects of such transactions.
  • Zoning or land use issues: If you're planning to develop property or change its use, a real estate lawyer can guide you through zoning laws and land use regulations.
  • Resolving property disputes: For boundary disputes, title issues, or disagreements over property rights, a lawyer can help mediate or litigate the matter.
  • Foreclosures or evictions: If you're dealing with foreclosure or managing a tenant eviction, legal representation ensures that the process adheres to local laws and protects your interests.
  • Title and deed issues: Lawyers can help clear title disputes, ensure the legitimacy of property deeds, and handle transfers of ownership.

What Does a Real Estate Lawyer Do?

A real estate lawyer provides a range of services to help with property transactions and disputes, including:

  • Contract drafting and review: Ensuring that purchase agreements, leases, and other contracts are legally binding, fair, and protect your interests.
  • Title search and clearance: Conducting a thorough title search to ensure that the property has no legal claims or liens that could affect ownership.
  • Facilitate closing: Managing the closing process in real estate transactions, including reviewing final documents and ensuring that everything is in order before the transfer of ownership.
  • Resolve disputes: Handling legal disputes related to property ownership, boundaries, zoning, or tenants.
  • Assist in financing: Reviewing loan agreements and mortgage documents to ensure the terms are fair and legally sound.
  • Zoning and land use advice: Guiding clients through the complexities of zoning laws and building regulations for property development or renovation projects.

How Are Real Estate Lawyers Paid?

Real estate lawyers typically charge for their services in the following ways:

  • Flat fee: Many real estate transactions, such as reviewing a sales contract or assisting with a closing, are charged on a flat-fee basis.
  • Hourly rates: If a lawyer is handling complex disputes or litigation, they may charge by the hour. Hourly rates can vary significantly based on the lawyer’s experience and location.
  • Contingency fees: In rare cases, such as property disputes or claims for damages, a lawyer may work on a contingency fee basis, meaning they only get paid if you win or settle the case.
  • Retainer: For ongoing legal support, some clients may pay a retainer, which is an upfront fee used as a deposit for future legal services.

It's important to clarify the fee structure with your attorney before hiring them to avoid any surprises.

How Much Does a Real Estate Lawyer Cost?

The cost of a real estate lawyer varies based on the complexity of the matter, the location of the property, and the lawyer’s experience. Key factors that affect pricing include:

  • Type of transaction or issue: Simple tasks, like contract reviews, typically cost less than handling a complex property dispute or litigation.
  • Experience and location: More experienced lawyers or those in high-demand areas, like urban centers, often charge higher rates.
  • Billing structure: Lawyers may charge a flat fee for basic services like document review or hourly for more time-intensive work such as disputes or litigation.

Flat fees for straightforward services like closing assistance may range from $500 to $1,500.

Hourly rates can range from $150 to $400 or more, depending on the attorney’s experience and location.

Always discuss fees upfront to understand the overall cost of the legal service you're receiving.

Top Questions to Ask a Real Estate Lawyer

Before hiring a real estate lawyer, ask the following questions to ensure they are the right fit for your legal needs:

  1. What experience do you have with real estate law?
Ensure the lawyer has experience in the type of real estate transaction or dispute you’re facing, whether residential, commercial, or development-related.
  2. What is your fee structure?
Ask how the lawyer charges for services - whether it's a flat fee, hourly rate, or retainer - so there are no surprises later on.
  3. How long will the process take?
Especially important for real estate transactions or disputes with deadlines, ask for a general estimate of how long the process will last.
  4. Have you handled cases similar to mine?
Experience with similar transactions or disputes can give you confidence that the lawyer knows how to handle your case.
  5. Will you handle my case personally, or will it be passed to another attorney?
Confirm who will be handling the bulk of your case work, especially in larger firms where junior lawyers may take on some responsibilities.
  6. Can you provide references?
Speaking with past clients can give you insight into the lawyer's experience and how they handle cases.

How to Check the Credibility of a Real Estate Lawyer

To ensure you’re hiring a reputable real estate lawyer, take these steps:

  • Check with the state bar association: Verify that the lawyer is licensed and in good standing with no disciplinary actions on their record.
  • Read online reviews and testimonials: Look for reviews on legal directories and platforms like Avvo or Martindale-Hubbell to see what past clients have said.
  • Ask for references: A credible lawyer should have past clients willing to share their experiences.
  • Review their track record and expertise: Look at the lawyer’s website or LinkedIn profile for information about their experience in real estate law and any relevant cases they’ve handled.
  • Membership in professional organizations: Lawyers who are members of respected legal or real estate organizations, like the American Bar Association’s Real Property Division, often signal credibility and expertise.

What Should I Prepare for My First Consultation?

To make your first meeting with a real estate lawyer productive, you should prepare the following materials:

  • Relevant property documents: Bring purchase agreements, lease contracts, mortgage documents, zoning permits, or any other paperwork related to your case.
  • A summary of the issue or transaction: Be ready to explain the situation, whether it's a property dispute, contract negotiation, or development issue.
  • Questions about the legal process: Prepare a list of questions about how the lawyer will handle your case and what steps are involved.
  • Financial documents or loan agreements: If the case involves financing or a mortgage, bring any related documents for the lawyer to review.
  • Your goals and timeline: Be clear about what outcome you're hoping for, and if there are any deadlines that need to be considered, such as closing dates or legal filings.

By coming prepared, you can ensure that your consultation is efficient and informative, allowing you to assess whether the lawyer is the right fit for your real estate needs.
