He's also a very personal man they shows a genuine interest me, not only as client but also as a person. Likewise, the office staff are very professional and courteous. I have known Rachna for years, working with her on multiple occasions when she was with the Jane Doe Advocacy Center. Therefore, when I decided to get a divorce, it was a no-brainer to go to this acquaintance I had known for years. At first, my experience with The Lien Law Firm was excellent. You can make payments in installments, but they will start the proceedings once everything is collected. When I was able to get an in-person visit, everything went well. Since 10/23/2022, I have been diligently pursuing my divorce proceedings. Unfortunately, she was unavailable to take my call almost every time I called the office. I would leave a message for a callback, which I rarely received on multiple occasions. There were a couple of phone appointments that she missed, and I never received a callback. The client portal is a joke because I have sent messages to Mrs. Lien, the office staff, or both and never received a response. It has taken a little longer because initially, I had a paternity test involved in my divorce proceedings, and they would need to try and serve her. This was difficult because she was not living in the same state as I, and I did not have an exact address for her. Eventually, divorce paperwork was completed in June 2023—multiple attempts to contact afterward without responses. On October 24, 2023, I had a phone appointment, and she said she could not find my wife to serve her. I provided updated info that I was able to find, and she said I could hire a PI in Florida, which could cost me a couple thousand dollars more. She also provided me with the information of three aggressive lawyers if I still wanted to try to track her down. On January 25, 2024, I went to the courthouse on other business. While there, I checked out the status of my case, and I was informed that it was on the dismissal pile. I made a follow-up appointment in February, which she missed. I eventually was able to get an in-person appointment on June 14, 2024, and decided to forgo the paternity test and finish the divorce. I had to refile the paperwork because it was dismissed in January. She said it was left on the dismissal pile on purpose to see if my wife would come out of the woodwork and be caught and served. It is now September 12, 2024, and multiple attempts to contact her since the June meeting have failed. I am still in limbo on whether she has resubmitted my divorce paperwork or not. This has been an extremely frustrating and draining experience. Another reason not to get married.

I recently had the pleasure of working with Roy Williams at Henry, Williams and Kinder, P.C. in West Plains, Missouri for legal assistance following a vehicle accident. I cannot speak highly enough of his outstanding exceptional service. His approach and attention to detail were instrumental in resolving the situation effectively. Mr. Williams' knowledge, competence, and skill made a world of difference during what could have been an overwhelmingly stressful time. Thanks to Mr. Williams' efforts, we were able to achieve a positive outcome that exceeded my expectations. The efficiency and the caring nature of his staff also contributed significantly to my satisfaction. I wholeheartedly recommend Roy Williams and his team for anyone in need of legal assistance. His professionalism, expertise, and genuine care for his clients make him an invaluable asset to the legal profession. I would gladly give him more than five stars if I could!

⚠️CAUTION‼️ After reading the positive reviews on Todd my wife and I thought he might be a safe bet. WE SHOULD’VE PAID ATTENTION TO ALL HIS NEGATIVE REVIEWS and saved ourselves a nightmare experience! We met with him for 2 hours, explained our desperate - time constraining situation, and begged for his help and protect legally. He said he would, and he gave us his word as we shook hands, and paid him $5000.00 that he required, THEN WE NEVER HEARD FROM HIM AGAIN for 36 days!!! So my wife called and left a voice message but STILL DID NOT HEAR BACK FROM HIM!!! On the 41st day of STILL NOT HEARING from Todd, she called again and his secretary talked to him while putting her on hold - BUT HE STILL WOULDN’T TALK TO HER! She said - “he said he will call you RIGHT BACK”. He NEVER CALLED MY WIFE! The next day, (day 42) my wife drove half an hour to his office to get there at 8am and asked for our $5000.00 dollars back. My wife said the secretary called Todd and all he said was “ok”. After that, on 7/12/24, my wife received a phone call from Todd and we discussed each other's position and Todd said that he would be willing to help us again. My wife and I told him only if he would agree to bill us hourly instead of $5000 dollars and communicate to the opposing party, and to us, in a reasonable timely matter. Todd agreed to that. It wasn’t until Monday morning (7/22) of not getting anywhere with Todd that my wife sent him a lengthy email stating our concerns and displeasure over our entire experience, and he only replied “We will address your topics pursuant to the attached service agreement. Please sign and return it at your earliest convenience.” and finally sent us the contract to sign. However, his contract did not state the terms and conditions that we agreed upon and stated that we would pay him another $5000 dollars instead of being billed hourly! So, my wife had to again email him inquiring why his new contract did not state our agreement. Our anxiety, frustration level, trust, and faith at this point through all the nonsense was through the roof. On Tuesday (7/23) Todd sent a contract correctly stating our terms of agreement and my wife and I signed and returned it stating – “My husband and I were hoping that we could come down and meet with you at your next soonest time because a few things have changed and I need to show you some things and it would be rather difficult to try and explain it in a email if that is ok with you? We will try and accommodate your schedule to come at your next available opportunity.” By the following Monday 29th, after not ever hearing back from Todd to get his next available appointment time, we decided that it was not going to be in our best interest to proceed forward with Todd due to his inability to maintain reasonable lines of communication, inability to perform one single task for us since May 29th, inability to perform any task for us in a timely manner, inability to uphold terms agreed upon and changing them for his benefit after the fact, and causing us almost 3 months of complete wasted time causing escalated anxiety, worry, and stress. SO HE STICKS US WITH A $480. BILL! It was completely irresponsible, inconsiderate, unprofessional, and incompetent in our opinion. Not only did he not keep his word that we shook on, but he cost us wasted time on the case and added problems that my wife filed a complaint with the Office of Chief Disciplinary Counsel, as there is an issue with Supreme Court Rule #’s - 4-1.3 Diligence, 4-1.4 Communication, and 4-1.5 Fees. And contacted the Better Business Bureau to hopefully protect others from going through what he put us through. We feel that there’s an endless sea of lawyers out there, so take caution when considering this one. We had very high hopes just to be duped!

I can honestly say I was completely satisfied with the work Mr. Bretz did for me. He took an interest in the case, kept me up to date with what was going on, and was always a straight shooter. Most impressively, when one particular "requirement" came up for the dispensation of the case towards a certain outcome, that I was NOT particularly thrilled about, Mr. Bretz got that requirement tossed out. So that all I had to do was pay my required fine. And I was even able to do that in two payments, due to my challenging financial situation. So, the outcome was totally favorable, and I would absolutely recommend Bretz Legal if you find yourself in any kind of driving situation that may look bad at first. When I hurt my back on the job as an RN, I had no idea how everything would pan out. Through my treatment, it was determined that I would never be able to work as a bedside RN again. A friend referred me to Tim, and from the word “go”, he was the advocate I didn’t know I needed. My case was a bit unusual, but he stuck with us. He answered questions from my husband and me as straightforward as possible. Never once was he patronizing. If there was a process that we didn’t understand, he would patiently explain. He returned calls and emails- even if he didn’t have a concrete answer. He would at least let us know he was searching for answers if he didn’t have one. He is a kind soul and really wants the best for his clients. I couldn’t have asked for a better person to tackle this case than him. I would recommend Tim to anyone in Kansas or Missouri who needs an attorney in their corner for workers comp cases. He truly is the best.

I had Manson and they just weren’t knowledgeable, the secretary was very unorganized (they had to be reminded of things rather than keep good records) or strong enough to go against a large corporation like Amazon. I got screwed and I am left after the fact with a tendon injury that conveniently was never found before or during the settlement. I believe KU med gets donations or something from Amazon since they used to be used for their workman’s comp. So I am left with pain in my left wrist and I have to sleep in a sling just so I can hope I have a good day to get anything accomplished. I am left with a disability for life unless it can be operated on at some point. In other words, go with a large law office and read the reviews.

What a Workers’ Compensation Lawyer Can Do for You

A workers’ compensation lawyer specializes in helping employees who are injured or become ill as a result of their job to receive the benefits they are entitled to under workers' compensation laws. These lawyers represent injured workers in claims for medical benefits, wage replacement, and other compensation related to workplace injuries or illnesses. They also help when claims are denied, benefits are delayed, or disputes arise with the employer or the insurance company.

Whether you've been injured on the job, developed an occupational illness, or are dealing with a denied workers' compensation claim, a workers’ compensation lawyer can help you navigate the claims process and ensure you receive the full benefits you deserve.

When Should I Hire a Workers' Compensation Lawyer?

You should consider hiring a workers' compensation lawyer in several situations, especially when complications arise during the claims process or when your rights as an injured worker are being challenged. Some common reasons to hire a workers' compensation lawyer include:

  • Claim denial: If your workers' compensation claim has been denied, a lawyer can help you appeal the decision and represent you in hearings or litigation.
  • Inadequate benefits: If the insurance company offers you a settlement that doesn’t cover your medical expenses, lost wages, or other damages, a lawyer can negotiate on your behalf for a fair amount.
  • Delay in receiving benefits: If your benefits are being delayed, a lawyer can help expedite the process to ensure you receive timely compensation.
  • Permanent disability: If your injury leads to permanent disability (partial or total), a lawyer can help you navigate the more complex process of securing long-term benefits.
  • Retaliation by employer: If your employer retaliates against you for filing a workers' compensation claim (e.g., by firing or demoting you), a lawyer can protect your rights and pursue legal action.
  • Third-party liability: If a third party (e.g., a contractor or equipment manufacturer) was responsible for your injury, a lawyer can help you pursue additional compensation through a personal injury lawsuit.
  • Pre-existing conditions: If your employer or the insurance company claims that your injury is related to a pre-existing condition, a lawyer can help you present evidence showing that the injury was work-related.

Hiring a lawyer early in the process can prevent delays, avoid mistakes, and ensure you receive all the benefits you’re entitled to under workers' compensation law.

What Does a Workers' Compensation Lawyer Do?

A workers' compensation lawyer provides a range of legal services to injured workers, ensuring that they receive the benefits they deserve. Their tasks often include:

  • Filing claims: Helping injured workers prepare and file their workers' compensation claims to ensure accuracy and timeliness.
  • Appealing denied claims: Representing workers whose claims have been denied and guiding them through the appeals process, including hearings and court appearances.
  • Negotiating settlements: Negotiating with insurance companies to secure fair compensation for medical expenses, lost wages, and other damages.
  • Handling disputes: Resolving disputes between the injured worker, the employer, and the insurance company regarding the amount of compensation or the nature of the injury.
  • Coordinating medical evidence: Gathering and presenting medical records, expert testimony, and other evidence to support the workers' compensation claim.
  • Advocating for benefits: Ensuring that injured workers receive all the benefits they’re entitled to, including temporary or permanent disability benefits, vocational rehabilitation, and medical treatment.
  • Filing third-party lawsuits: In cases where a third party is responsible for the injury, a workers' compensation lawyer may also pursue a personal injury lawsuit to recover additional damages.

How Are Workers’ Compensation Lawyers Paid?

Workers' compensation lawyers typically charge a contingency fee, meaning they only get paid if they successfully recover benefits for you. This fee is usually a percentage of the benefits awarded, and the specific percentage is often regulated by state law. Here's how it generally works:

  • Contingency fee: The lawyer's fee is typically between 15% and 25% of the total benefits awarded to you. You don’t have to pay any upfront legal fees, and the lawyer’s fee comes out of the settlement or benefit award.
  • No fee if no recovery: If the lawyer doesn’t recover any benefits for you, you generally don’t have to pay for their services.
  • State regulations on fees: Many states cap the percentage that workers' compensation lawyers can charge, and some states require the fee to be approved by the workers' compensation board or judge.

Be sure to discuss the fee structure with your lawyer during the initial consultation to understand how much you will owe if your case is successful.

How Much Does a Workers' Compensation Lawyer Cost?

The cost of hiring a workers' compensation lawyer typically depends on the contingency fee arrangement, meaning the lawyer’s fee will be a percentage of the benefits you receive. General cost estimates include:

  • Contingency fees: Most workers' compensation lawyers charge between 15% and 25% of the total settlement or benefits awarded. For example, if you receive $50,000 in benefits, the lawyer’s fee would range from $7,500 to $12,500.
  • State regulations: Some states limit the percentage that workers' compensation lawyers can charge. In these cases, the fee is usually capped, often at 20% to 25%, depending on state law.
  • Additional costs: Some lawyers may charge for out-of-pocket expenses, such as filing fees, medical records retrieval, and expert witness testimony, though these costs are typically deducted from the settlement after the case is won.

You should always ask for a clear explanation of fees and potential additional costs during your consultation so you understand the financial arrangement.

Top Questions to Ask a Workers' Compensation Lawyer

Before hiring a workers' compensation lawyer, it’s important to ask the right questions to ensure they are the best fit for your case. Key questions to ask include:

  1. What experience do you have with workers' compensation cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your injury is severe or the case involves disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges a contingency fee and whether there are any additional costs you need to be aware of.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including the potential challenges and outcomes.
  4. Have you handled cases like mine before?
Find out if the lawyer has experience dealing with cases involving similar injuries or disputes, such as denied claims or permanent disability.
  5. How long will the process take?
While it’s difficult to predict an exact timeline, the lawyer should be able to provide a general estimate based on their experience with similar cases.
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of your case. Make sure you know who will be working on your claim.

How to Check the Credibility of a Workers' Compensation Lawyer

To ensure you are hiring a reputable workers' compensation lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no disciplinary actions against them.
  • Look for workers' compensation experience: Review the lawyer’s website or professional profile to ensure they specialize in workers' compensation law and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s expertise and service.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their experience in workers' compensation cases.
  • Check for professional affiliations: Membership in organizations like the Workers' Injury Law & Advocacy Group (WILG) or local bar association committees on workers' compensation can indicate the lawyer’s commitment to this area of law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a workers' compensation lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Accident report or incident documentation: Bring any documentation related to your workplace injury or illness, including accident reports or notifications to your employer.
  • Medical records: Provide copies of medical records, including treatment notes, doctor’s reports, and any information related to your injury or condition.
  • Employer correspondence: Bring any letters, emails, or forms related to your claim from your employer or the workers' compensation insurance company.
  • Wage and benefits information: Provide information on your wages, benefits, and any lost income due to the injury.
  • List of questions: Prepare questions about your case, the process, costs, and what to expect moving forward.
  • Timeline of events: Prepare a timeline of the incident, your injury, and any medical treatment or communication with your employer and the insurance company.

Being well-prepared for your consultation will allow the lawyer to assess your case more effectively and provide you with the best possible legal advice.
