The process of a "Workers' Compensation" case is extremely detailed and complex for an uninformed and naive person. The professionals at The Brian E. Quinn Law Firm, especially Darlene Marquette and her staff, never lost sight of the ultimate goal, that is, to protect my rights and interests. Darlene and her staff were knowledgeable, courteous and prompt in dealing with an extremely complex case. Thanks again for bringing my case to a successful conclusion.

Attorney Dixon was the consummate professional. I had two cases with Attorney Dixon, a workers compensation case and an injury case. I have been a blue collar worker for over 30 years. I was treated unfairly after some on the job injury issues and Attorney Dixon helped me get my medical bills and workers compensation benefits set straight. He was up front with me and kept his promises from the beginning unlike another lawyer I had in the past. Attorney Dixon understands working people. He has years of experience and he knows the kind of issues that confront me and my fellow workers. From my first meeting to my last meeting with him, he explained the law in clear and simple terms and was very patient. He communicated with me throughout the whole case and always sent me relevant documents and letters. I always knew where my case stood. I was being treated unfairly at work after my injuries and I needed an Attorney I could trust. I trusted Attorney Dixon and it was the best decision I could have made for me and my family. I highly recommend Attorney Dixon to anyone.

A friend recommended attorney Himes after I received a custody modification in the mail. I was sick to my stomach about going to court and didn't know what to do. I went in to see attorney Himes for a consult so I could be more informed about the process and my rights. Attoney Himes let me know that first I would have a mediation. Attoney Himes told me that if I didn't not agree with what what must child'support father was asking for to not agree and request a hearing. He told me to not feel pressed to agree even if it's one day. He looked through all the documents I provided him and was confident that I had enough document to keep the current agreement in place. He offered to come with me to the mediation but let me know that it was not necessary. He suggested that I save my money and use it toward retaining him if my case were to go to trail. He was very knowledgeable about custody court. He told me that if I were to agree to any modification during mediation then I would not be able to use any of my documentation in the future. I ended up requesting for my case to go to trail (the mediator was very pushy for me to just agree to 50/50). Attorney Himes represented me. He answered all my questions. He got back to me in a timely manner. He spent his time with me so that I felt comfortable (he wasn't just milking the clock). He didnt make me any promises. He actually told me "the judge could decide to agree to give him 50/50 or a few more overnight but he's not a bad guy he just has some growing up to do". He made sure the judge knew all my concerns. I ended up winning my case but even if I hadn't I would still recommend Attoney Himes. He always had my child's best interest at heart which is exactly what I wanted!

Did everything he said he would from the day he came to my house while I was incapable of walking, to personally getting back to me whenever I wanted to talk with him and not the legal aid(which she can damn near answer everything for you but not give you legal advice “legally” & she won’t bend rules which is very nice to see this firm is all about confidentiality and ethics). Thank you Mr. Barone, & Miss. Tonya for everything & fortunately I’m all healed up & blessed to be back in action without you two this wouldn’t be possible!

I couldn't have asked for better representation than I received from Ms. Harkins. She was always very responsive. She was well versed with my case which only could have resulted from studying the material at hand and knowing the law. The two opposing attorneys (one from a local dealership and one from Mercedes Benz USA) certainly led some great arguments as to why this case shouldn't qualify for the LL however Shannon was quick to respond with clarification and solidified why it should qualify for the LL. The three Attorneys hearing our case ruled in favor of us. I feel as though we only won the case because of Shannon's confident presentation!

I am so pleased with the service that Kathleen has provided us since my injury. We call Dallas Hartman after seeing a television commercial about workers' compensation. I was getting my benefits but I thought it would not hurt to get an expert opinion. Everyone I dealt with was so nice and Kathleen took my information and told me to let her know if anything changes. When my employer tried to stop paying my benefits before I could return to work, Kathleen jumped into action. I am so thankful for her help. It never cost me anything and with her help she was able to get my benefits continued for almost a year. I highly recommend Kathleen Robertson if you have been hurt at work.

If you've been hurt at work, I highly recommend Gary Monaghan. I called his office, made an appointment, & within days, I no longer had to worried about where to find help. Gary took care of all my needs. He listened while I explained what caused my injury. From that point on, he took care of everything. I did not have to do anything else. He took care of filing all the paper work, talking to opposing lawyer, judge, & made sure that all my medical bills were paid. I can't say enough about how confident Gary made me feel during this experience. If you need someone that will care about your pain, & walk with you through the process, Gary Monaghan is the lawyer to call.

The entire case took longer then I expected, but then I didn't realize all the red tape involved. Overall Dan was patient with me and explained everything in a way that I could understand. In the end all went great and I would recommend him to anyone.

He handled my Unemployment compensation appeal. I was so nervous I was shaking like a wet dog and showed up barely in time for the hearing. On the other side were representatives of my former employer, the school District of Philadelphia. He was able to argue the law despite the lying of the other side (I am sure they will claim the same about me). And I left believing i had my say and my dignity back.

When hurt at work, who else is looking out for YOU? Your employer? The employer's insurance company? Are you serious? NO WAY! Even when outside of Greater Philadelphia in PA, I was referred to Galfand Berger LLP and Mike McGurrin for help for my injury at work as sustained 3 months before I called. At first my employer and insurance appeared cooperative as my injury was treated by excellent doctors and I had returned to work. Excellent medical care after getting hurt at work is anything but a guarantee I have learned from others though. The insurance company even tried to trick me into going out of state, and ask Mike and read his book on why that might not be a good option for you! I was able to keep my job all the same, but do not be fooled because your employer wants you out even though by law the employer cannot fire you simply in retaliation for having gotten hurt at work or having filed an insurance claim against their insurance policies. Keep written records of everything said and done as you get medical help and before you return to work, and do NOT sign anything your employer or insurance company gives you without contacting Mike FIRST! I did not of course sign anything of the sort even before contacting Mike. If your employer or the insurance company insists you sign or threatens you if you don't sign or otherwise, CALL MIKE ASAP! I wish I called Mike also before I returned to work anyway! The employer was even hoping I would leave before my first day of benefits, which they waited until 3PM on the last day to give me the information for review over a weekend! Get some help sooner, and if necessary after trying to work things out at work professionally with any common unprofessional manager, also have your attorney call their bluffs via HR should any given manager give you a harder time than others at work only because you were hurt. After I got Mike's advice on my case, I was able to make plans including having an antagonistic manager via HR back off from his all-to-common nonsense and harassment when not having any attendance or work performance issues. After you get hurt at work you'll still be out a bit of funds in medical supplies, medicine, and lost time to see the doctor even in the best case because your employer's insurance company is too cheap to even give a prescription for Rx-size dosage common pain killers like those in smaller dosages at any drug store. Though workers' compensation settlements sure can take awhile and every case will be different, Mike helped to settle my case favourably after only 6 months after I retained him! A good settlement like I received makes up at least for all those funds and time you were out after getting medical treatment and working to put yourself back together to go back to work. Your work injury happens and you can't rewind the clock or erase the pains past and present, and no doubt if I could go back in time and erase the accident I would even now, so get help sooner to make sure YOU get what should be coming to you under state and also possibly federal law with Mike McGurrin's help!

Mr. Moore represented me in a criminal case in which I was falsely accused by a vindictive former business partner. The facts and the timeline in this case for lack of a better word were very close and even though I was on video else where the accuser tried very to "move the goal posts" many times to convince the jury of my culpability.Mr. Moore through his great attention to detail of the facts, trial experience, and powerful cross examination of the the accuser and spouse enlightened the jury of this evil persons' intent . Thanks to his hard workand diligence I was found unanimously not guilty on 8 counts of the complaint. Through the 4 months of this nightmare Mr. Moore kept us well informed of what was happening, gave my wife and I the knowledge that we were being compentently and vigorously represented without making any empty promises, and a certain comfort level under the circumstances.I've been around long enough to know that nothing is certain and every situation is fluid, that being said I give William E. Moore my highest recommendation of competence and confidence. Thanks a million soldier

What a Workers’ Compensation Lawyer Can Do for You

A workers’ compensation lawyer specializes in helping employees who are injured or become ill as a result of their job to receive the benefits they are entitled to under workers' compensation laws. These lawyers represent injured workers in claims for medical benefits, wage replacement, and other compensation related to workplace injuries or illnesses. They also help when claims are denied, benefits are delayed, or disputes arise with the employer or the insurance company.

Whether you've been injured on the job, developed an occupational illness, or are dealing with a denied workers' compensation claim, a workers’ compensation lawyer can help you navigate the claims process and ensure you receive the full benefits you deserve.

When Should I Hire a Workers' Compensation Lawyer?

You should consider hiring a workers' compensation lawyer in several situations, especially when complications arise during the claims process or when your rights as an injured worker are being challenged. Some common reasons to hire a workers' compensation lawyer include:

  • Claim denial: If your workers' compensation claim has been denied, a lawyer can help you appeal the decision and represent you in hearings or litigation.
  • Inadequate benefits: If the insurance company offers you a settlement that doesn’t cover your medical expenses, lost wages, or other damages, a lawyer can negotiate on your behalf for a fair amount.
  • Delay in receiving benefits: If your benefits are being delayed, a lawyer can help expedite the process to ensure you receive timely compensation.
  • Permanent disability: If your injury leads to permanent disability (partial or total), a lawyer can help you navigate the more complex process of securing long-term benefits.
  • Retaliation by employer: If your employer retaliates against you for filing a workers' compensation claim (e.g., by firing or demoting you), a lawyer can protect your rights and pursue legal action.
  • Third-party liability: If a third party (e.g., a contractor or equipment manufacturer) was responsible for your injury, a lawyer can help you pursue additional compensation through a personal injury lawsuit.
  • Pre-existing conditions: If your employer or the insurance company claims that your injury is related to a pre-existing condition, a lawyer can help you present evidence showing that the injury was work-related.

Hiring a lawyer early in the process can prevent delays, avoid mistakes, and ensure you receive all the benefits you’re entitled to under workers' compensation law.

What Does a Workers' Compensation Lawyer Do?

A workers' compensation lawyer provides a range of legal services to injured workers, ensuring that they receive the benefits they deserve. Their tasks often include:

  • Filing claims: Helping injured workers prepare and file their workers' compensation claims to ensure accuracy and timeliness.
  • Appealing denied claims: Representing workers whose claims have been denied and guiding them through the appeals process, including hearings and court appearances.
  • Negotiating settlements: Negotiating with insurance companies to secure fair compensation for medical expenses, lost wages, and other damages.
  • Handling disputes: Resolving disputes between the injured worker, the employer, and the insurance company regarding the amount of compensation or the nature of the injury.
  • Coordinating medical evidence: Gathering and presenting medical records, expert testimony, and other evidence to support the workers' compensation claim.
  • Advocating for benefits: Ensuring that injured workers receive all the benefits they’re entitled to, including temporary or permanent disability benefits, vocational rehabilitation, and medical treatment.
  • Filing third-party lawsuits: In cases where a third party is responsible for the injury, a workers' compensation lawyer may also pursue a personal injury lawsuit to recover additional damages.

How Are Workers’ Compensation Lawyers Paid?

Workers' compensation lawyers typically charge a contingency fee, meaning they only get paid if they successfully recover benefits for you. This fee is usually a percentage of the benefits awarded, and the specific percentage is often regulated by state law. Here's how it generally works:

  • Contingency fee: The lawyer's fee is typically between 15% and 25% of the total benefits awarded to you. You don’t have to pay any upfront legal fees, and the lawyer’s fee comes out of the settlement or benefit award.
  • No fee if no recovery: If the lawyer doesn’t recover any benefits for you, you generally don’t have to pay for their services.
  • State regulations on fees: Many states cap the percentage that workers' compensation lawyers can charge, and some states require the fee to be approved by the workers' compensation board or judge.

Be sure to discuss the fee structure with your lawyer during the initial consultation to understand how much you will owe if your case is successful.

How Much Does a Workers' Compensation Lawyer Cost?

The cost of hiring a workers' compensation lawyer typically depends on the contingency fee arrangement, meaning the lawyer’s fee will be a percentage of the benefits you receive. General cost estimates include:

  • Contingency fees: Most workers' compensation lawyers charge between 15% and 25% of the total settlement or benefits awarded. For example, if you receive $50,000 in benefits, the lawyer’s fee would range from $7,500 to $12,500.
  • State regulations: Some states limit the percentage that workers' compensation lawyers can charge. In these cases, the fee is usually capped, often at 20% to 25%, depending on state law.
  • Additional costs: Some lawyers may charge for out-of-pocket expenses, such as filing fees, medical records retrieval, and expert witness testimony, though these costs are typically deducted from the settlement after the case is won.

You should always ask for a clear explanation of fees and potential additional costs during your consultation so you understand the financial arrangement.

Top Questions to Ask a Workers' Compensation Lawyer

Before hiring a workers' compensation lawyer, it’s important to ask the right questions to ensure they are the best fit for your case. Key questions to ask include:

  1. What experience do you have with workers' compensation cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your injury is severe or the case involves disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges a contingency fee and whether there are any additional costs you need to be aware of.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including the potential challenges and outcomes.
  4. Have you handled cases like mine before?
Find out if the lawyer has experience dealing with cases involving similar injuries or disputes, such as denied claims or permanent disability.
  5. How long will the process take?
While it’s difficult to predict an exact timeline, the lawyer should be able to provide a general estimate based on their experience with similar cases.
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of your case. Make sure you know who will be working on your claim.

How to Check the Credibility of a Workers' Compensation Lawyer

To ensure you are hiring a reputable workers' compensation lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no disciplinary actions against them.
  • Look for workers' compensation experience: Review the lawyer’s website or professional profile to ensure they specialize in workers' compensation law and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s expertise and service.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their experience in workers' compensation cases.
  • Check for professional affiliations: Membership in organizations like the Workers' Injury Law & Advocacy Group (WILG) or local bar association committees on workers' compensation can indicate the lawyer’s commitment to this area of law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a workers' compensation lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Accident report or incident documentation: Bring any documentation related to your workplace injury or illness, including accident reports or notifications to your employer.
  • Medical records: Provide copies of medical records, including treatment notes, doctor’s reports, and any information related to your injury or condition.
  • Employer correspondence: Bring any letters, emails, or forms related to your claim from your employer or the workers' compensation insurance company.
  • Wage and benefits information: Provide information on your wages, benefits, and any lost income due to the injury.
  • List of questions: Prepare questions about your case, the process, costs, and what to expect moving forward.
  • Timeline of events: Prepare a timeline of the incident, your injury, and any medical treatment or communication with your employer and the insurance company.

Being well-prepared for your consultation will allow the lawyer to assess your case more effectively and provide you with the best possible legal advice.
