Without question the best professional experience I’ve ever had with any type of firm. Mr Jacoby was as thorough as one could be and exceptionally knowledgeable in his field. He took a surprising amount of time both listening to our circumstances and explaining how best to proceed. Most importantly, it’s very clear his excellence stems from a true care of people. In addition, his staff is no less attentive and caring. I worked with Lisa Waltrip, who was wonderful. We navigated through a tedious Medicaid process with relative ease, with Lisa carefully explaining each step and simplifying everything. On top of it all, one day Lisa sent an email-she’d stopped and met my mother. In a world where personal attention and care seems to be greatly diminishing, this floored me. What a truly exceptional group of people. I cannot, nor doubt I ever could, recommend anyone any more than I can this firm. Thank you very much, John

Where do I begin? Compassion, Grit, Tenacity, Work- ethic, professional, are only a few of the words I would begin to describe Attorney Jacoby and his team, more specifically in my case Ms. Marcano. Any questions, concerns, were always responded to quickly and with full detail by Mr. Jacoby or his team. I have an extremely difficult and challenging situation, but Attorney Jacoby has always been patient and will do whatever is needed to help. They really do care and do their best to assist as if it was their own personal case. I cannot say enough how highly I recommend them; I would tell you if you are considering using them or not- do not waiver- you won't regret it! I am extremely grateful for their grace and the blessing they are for my child and myself. Five stars all the way if I could give them more I would!!

I retained David in order to marshal my aunt's and my mother's estates, and qualify them for Medicaid so I could placed them in a nursing home. I am a retired attorney but was not aware of the legal requirements and unusual legal avenues to accomplish the above. During my first meeting with David he explained to me the Florida Medicaid regulations in their minute details and his explanations and professionalism infused in me a total trust for him. He went as far as going with me to the nursing home where my aunt was recovering from an injury in order to explain to her what he was trying to accomplish and then his capable staff went to see my aunt in order to execute the proper documentation. This brought out David's caring for the less fortunate and his unbelievable human decency. In the end all that we set out to accomplish was successfully brought to be and I have no words to thank David, Kathy, and other members of his staff that so diligently and patiently took me through this and the follow up work that ensued. Now I not only have an attorney but I also made some new friends. I would have no hesitation to recommend David and his capable staff to anyone needing help in his areas of expertise. Don

We consulted with David H. Jacoby regarding our 93 year old father's trusts and Medicaid application. He brings several pertinent disciplines to the equation in addition to his specialty in elder law providing the well-rounded counsel we need to care for Dad effectively. We also found Mr. Jacoby to possess an unusual compassion and understanding for Dad's situation and he made himself available to help us on short notice. I highly recommend Mr. Jacoby for elder law; he is my first choice and I would not hesitate to contact him again should the need arise.

We were victims of hurricane Ian. Our property insurance was with Slide Insurance. Their initial field adjuster was terrific and agreed that the roof needed replacement and the lanai screens repaired. Slide then sent 2 other field adjusters out to refute original adjuster claims and said damage was caused by poor maintenance by us. Well, enter Mike who guided us to a successful claim allowing us to replace the roof and other needed repairs. He was professional, personable and knowledgeable about how insurance companies operate. A perfect lawyer to have on your side when dealing with insurance companies. Thank you Mike! John & Annie Speaker Punta Gorda, Florida

I hired this attorney to represent me in a slip and fall case. It turned out to be a huge mistake. We were offered $100K to settle but my attorneys recommended we go to trial. We were seeking over $4M. We lost the case and now I’m going to get $0. On top of that I have over $500K in medical expenses that I am now liable for and I’m concerned that I might have to pay additional legal fees. These attorneys give bad advice and are not competent in the courtroom.

Can a Lawyer Represent Me in Courts Outside of Melbourne, Florida?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
