Excellent intellectual property law firm. I worked with Don Lewis on three patents and was always impressed by his thoroughness, professionalism, and intellectual prowess. Although Don is retired now, if the other partners are anything like him, you'll be in good hands.

So Jewell Briggs worked her way up from poverty to become a very successful attorney at Harness & Dickey, PC where she is an Associate Attorney with secretaries and paralegals. During law school, she won the Moot Court's best patent brief. Few of us are born with the potential or talent to be able to write competently matters for federal court, let alone, be able to write the way a federal judge can. Jewell Briggs writes at the top of her class and her game. I refer any and all patent cases to her as I know she can do it. The sheer volume of reading and writing that she can do in a day and at the level that she performs is at the very top of the field.

Robyn has helped me through the trademark process on multiple occasions. She helped me successfully resolve a matter involving copyright infringement that was valued at low seven figures. She makes herself available whenever I have questions. I wouldn't even consider engaging any other IP attorney.

I’ve worked with Aileen to have a trademark registered with the USPTO. The laws around this trademark and emerging industry are new and controversial. However, Aileen was able to navigate even the toughest interpretations to ultimately land me a trademark that secures and protects my business’s novelty. She is knowledgeable, reliable, and a great communicator with fast responses. I always felt taken care of -she always had things under control. Made the process easy and stress-free. It was seamless from start to finish. She’s trustworthy and experienced. She ensured deadlines were on track, even when I was not. She provided exactly what I needed as a busy entrepreneur. I am so happy that my startup’s logo is finally recognized and protected on a federal level. I cannot thank her enough for making this happen, when others have told me it might not be possible. Thank you Aileen!

As Vice Present of my company I had many conversations with Fiona specific to Contracts with Customers. Fiona does a great job in keeping me and my people grounded to the details in the contracts we worked through. She made herself available day or night when needed to hit a deadline, and was a great asset on the phone with customers and customer legal counsel. Fiona is very knowledgeable in the EMS world. She is able to take on multiple actions at one time and deliver results on time which enabled us to close agreements with customers sooner than later. She stays calm on customer calls, even when some conversations got a little tense. Has a great ability to stick to the topics and stays on track, so the focus stays specific to what needed to be agreed to by both parties. Very Solid and highly recommend.

Mr Tinker helped me out a few years ago with a patent and a couple trademarks. easy, no sweat, right? I'm certain many others would have helped me with my "easy, no sweat" filing, but Mr Tinker did more than that. He called me up and explained a concern he had with some language in my filing that he felt didn't protect my interests as well as he felt it should. I was confident that my wording was superior and protected me from any infringements. He very politely explained how my branding had an application in an area that I had not thought of and won me over. As he stated (paraphrasing, of course), "the chances you will end up needing this additional protective language is remote, but it won't even take me ten minutes. So why don't I just do it anyway?" Well now three years later, I’ve expanded my branding and launched into the area he identified and others. Had he not cared enough to critically think about all possibilities, I would be filing expensive updates every year or so. But he took care of me and his original work stands unchanged and undefeated (I had an infringement and I won, no sweat). I came to this site to find him now to help me with another trademark, but have learned that he went in-house for a major international company. Makes sence, he is of that caliber

Reza has worked with me on a couple of medical device patents and has also worked with one of my family members on a medical device patent. I know Reza well by now and can't say enough about him and how much of a pleasure it has been to work with him. As a person, he is truly unique - one of the kindest and easiest people to work with. It is rare to find someone who is so good at what he does, who cares so much about doing an exceptional job, who is so knowledgeable in not just law but in science and math, and who is so patient in dealing with everyone from the secretary to the president of the company! His PhD from Harvard is clearly evident in his deep knowledge of physics, math and science in general. He not only helped me with my patents, he actually had excellent and very creative ideas on how to further improve the products and broaden the scope of the patents far beyond where I would have imagined. My project was his project. He was a true partner in the development process. Reza works with quite a few very large companies and I am definitely not one of those very large companies. Reza still treated me with the same care and priority that you would expect for a large corporation. One of the things that I was very concerned about when starting this process was the potential cost and my experience with other lawyers who would nickel and dime me to death. Again, Reza's approach was a breath of fresh air. While he was by no means cheap (you get what you pay for especially in the world of IP), his financial conditions were clear up front and his estimates were right on target. He was even able to offer some creative options on how to reduce the cost which I hadn't even thought about. I never felt that he was just after my money. We determined the costs very early on and I was relieved that there were no surprises throughout the whole process! This was very important so that I could budget properly right from the beginning. I highly recommend Reza without any reservation to anyone who is looking for an exceptional lawyer and an exceptional person to truly partner with them in protecting their intellectual property. You will not be disappointed!

Lisa is an exceptional attorney who possesses a breadth and depth of IP law knowledge that isfar beyond that of the other IP attorneys I have utilized in the past. She is an out-of-the-boxcreative thinker and is proactive in her practice of IP law. I would happily serve as a trade reference on her behalf. In no uncertain terms would I hesitate to recommend her for anyone needing any intellectual property legal work. Lisa has successful assisted me with obtaining over 50 awarded Claims before the USPTO, WIPO and CPO over the last few years.

Ashlie is an extremely flexible attorney, who adjusted her routine and plans to meet my and my wife's schedule to discuss our Will and Estate Planning needs. Ashlie took the time to get to know us, understand our needs, and the needs of our family. Ashlie educated us on aspects of the law that would benefit us, and how our Will and Estate must be worded in order for our family to be taken care of upon our departure from this Earth. Her patience and calm demeanor allowed my wife to relax when discussing the difficult subject of our eventual passing and how we can plan our estate to care for our loved ones. Ashlie is an engaging, well-spoken, energetic, and assertive attorney. Her costs for services were in-line with many attorneys, however, we chose her because she wanted to know us and our family as people, not clients.

Michelle and Kathleen helped us update our living will and worked attentively, and patiently, with us to ensure that all of our questions and concerns were addressed within our legal document. We had a lot of back and forth conversation in which they were incredibly helpful in allowing us to fully understand the legal ramifications of each choice we were making with the structuring of our will. At the same time, they are incredibly professional and I would highly recommend them to anyone.

Donna Chesteen is extremely analytical and deliberate in her approach. I was very impressed with her knowledge of the law. She is honest, compassionate, genuine and worked very hard for us. She made us feel comfortable throughout what was an extremely stressful process. She kept us informed as to what was happening at all times, and she made her self available by responding quickly to our emails. In running a business you have to have an attorney who understands and specializes in contracts. We trust her implicitly and will never sign another contract without her guidance. She saved us from over-paying twelve thousand dollars to just one vendor alone. I would highly recommend her. She is a very rare find.

When I found Ms. Koefod, I was really frustrated as I had consulted with a few other attorneys who did not seem to take me seriously. I started out with an e-commerce business and launched a Marketing firm but am pretty young and it is all online. I felt like Ms. Koefod was not only really well versed on what I needed, but also took me seriously and gave me great advice about suggestions to protect my business. She took care of my business formation and got my trademarks filed. It was nice to know the fee up front since everything was a flat rate and I got office hours and personalized attention that was focused on my specific business needs. She was very responsive and helpful and I now use her as fractional General Counsel so that I have an excellent attorney if and when things come up as my business grows! I felt really comfortable working with her. She wasn't stuffy and spoke to me in a clear way. The office is also really up to date on technology so I could do all my communications with them through my phone since I am on the go so much. I am suggesting Ms. Koefod to friends who are starting businesses and even side hustles and was excited to hear that the firm services can grow along with my company. It felt like a very tailored bespoke solution.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
