If you have any kind of personal injury claim in California, individually or as part of a class, you need to hire Chris and Kevin Moon. It's that simple. As a business and employment litigation attorney for both plaintiffs and defendants with more than 70 jury trials under my belt, I know the difference between "litigators" and real trial attorneys. The former are all too common in our profession, adept only at pushing paper, filing motions, and acting like keyboard warriors. But when cases fail to settle and trial looms, those kinds of lawyers find themselves staring into an abyss. They then either fold by unfairly compromising their client's case to avoid exposing their lack of trial experience, or stumble through trial with disastrous consequences. Real trial lawyers, on the other hand, can take any case to the mat and win. They don't bluff, because they don't need to. Not only does this achieve better settlements for their clients, but if the case cannot settle these trial lawyers actually win. Chris and Kevin Moon are both real trial lawyers, and excellent ones at that. They are both tenacious, brilliant and powerfully effective. I know this because I have worked with them both, and have seen their skill and dedication first-hand. Whenever someone calls me with a personal injury matter, I immediately refer them to Chris and Kevin. Even more, they are the lawyers I would want to represent me if I was ever injured. If you are potential client, call them! If you are a defendant on the other side of a case from them, be afraid. Be VERY afraid.

I have worked with Chris Moon for many years and he always given me amazing legal advice. Most recently, Chris helped me with a thorny legal issue. After a short consultation, the matter was resolved relatively quickly, which I really appreciated. The Moon brothers are extremely smart and easy to talk to, which is why I have referred many family and friends to them.

I have witnessed her grow as an attorney in a large law firm environment, and now as a solo attorney, where she is sure to thrive and excel. Rachel is extremely conscientious and detail-oriented. She knows how to ask the right questions to dig deeper into issues. Rachel is not only a legal professional, but she has an innate business acumen that can be a bit challenging to find with most lawyers. I feel so fortunate to have Rachel on my side as not only my friend, but also a colleague. I certainly hope we're never on opposite sides of the "v"!

Working with Mark is a true experience in many different ways and it's a challenge to encompass the scope of his skills in one review. It is my opinion that Mark cares enough to see his clients and their projects as "seeds" and as such; has the visionary skills and leadership to tend a worldly garden.

Mark is very easy to work with and is not afraid to pull in outside expertise when required. On my project, he brought in another lawyer who regularly creates agreements like mine. The result was a meticulously coherent and thorough, extremely well thought through agreement. Mark also did a good job with my trademark application. I gave him all the information and next thing I knew I had my trademark approved and registered. If you are in the market for an IP lawyer choosing Mark would be a smart move.

Ana and the Wagoner Firm stepped in to help me with a breach of contract matter. She met with us and reviewed the contract and helped us gather all the evidence we needed to show that this commercial installer was in breach. She spoke with the company's attorney for several months and kept pushing for a fair result, when at first the company denied everything. Ultimately, we get the result we needed and then some. The full purchase price of our contract and and additional sum to get the required permits for the work we were having done.

I am a Veteran who was referred to The Wagoner Firm via the SBA/VBOC because of the firm's support of Veteran Small Business owners. I had the opportunity to work with Ana Galeano in a recent commercial real estate transaction in excess of $1 million. I was purchasing a major property in Schenectady, NY and needed an attorney with experience in real estate. Ana provided me with an opportunity to speak with her extensively at no charge to discuss questions and issues prior to my decision to retain The Wagoner Firm to represent me. One of my biggest concerns was the timeliness that was required due to tax incentive deadlines. Ana and her associates worked feverishly to meet the closing deadline. Many individuals at the closing table commented to me about how it was the quickest commercial transaction they had been a part of. This was even more impressive when you consider the uniqueness of the closing and several unpredictable complications that arose during the closing process. The transaction involved tax issues and a transfer of agreements with the local metroplex authority. Throughout the deal, Ana was very responsive and always made herself available through the critical period of negotiating contracts and closing the deal. In fact, she was available on weekends (without charging extra) and went above and beyond on many occasions to ensure the deal closed by the tax deadline. It involved a large number of parties (buyer, seller, tenant, bank, lender's counsel, brokers, agents), and Ana was very effective in communicating with all parties, including the attorney for the local authority. In addition, Ana has been responsive and available for post-closing matters, such as obtaining appropriate insurance, providing property management contracts, and guiding me through general issues with the property. I would not hesitate to recommend Ana Galeano and The Wagoner Firm to anyone who needs competent, trustworthy, and responsive legal counsel or representation.

There are three types of attorneys out there: those who do nothing, those who do something, and those who fight tooth and nail for their client. Emily Bass is definitely the latter. She takes on giants in defense of her client and does so with no fear whatsoever. She goes into battle with only one sidearm–knowledge of the law. This might sound like an effort to build an attorney of mythical proportions but it is not. I am simply describing as best I can the attorney who’s fought for me for six long years. She took my case when others wouldn’t consider it. She took my case knowing that it would be exhausting both financially and physically. I would describe Attorney Bass as conscientious, intelligent, knowledgeable and professional. Her work ethic is without flaw as is her character as an individual as well as a professional. The Patent process can be scary, expensive and frustrating. It is well published that patent approval could take three to six years and there is no guarantee of success. However, our experience has been the complete opposite of that trend ….. largely due to Brian’s hard work with my little technology company over the past five years. To date we have received five patents from the USPTO and have the like amount pending with the USPTO. Putting aside Brian’s vast experience and knowledge on the patent process, Brian’s greatest contribution to our process has been his ability to first, listen to what I am trying to accomplish and then have the courage to disagree with me if he feels that we are going down the wrong path. This is a quality that provides my company a sense of comfort and allows for more discussion and collaboration. In summary, Brian’s “hands on approach” has greatly benefited my company and I recommend his services to anyone that is looking for this quality when choosing the proper patent attorney.

After a death, the last thing you want to do is worry about someone liquidating your fathers assets. This is what my sisters and I had to face a week after burying our dad. Due to him not having a will things where really complicated and his wife tried to take advantage of the situation. A family friend referred us to Bill and he has been a breath of fresh air throughout this entire process. Her attorney has been procrastinating the entire time and Bill has been on him like white on rice! Bill is very much to the point- no BS so if you want to be coddled then this one isn't for you. But, if you want the facts and someone that is going to give it to you straight while fighting for what's right then Bill is your guy. I highly recommend his team to anyone going through probate or a family settlement agreement. He's expensive but well worth the money I promise!

There are few things as personal as a family dispute. There are even fewer people with integrity that will ethically represent you during an extremely difficult time. I interviewed many firms, as it was not only important to me that a positive outcome occurred, I also wished for someone that understood my plight and had character throughout the process. Bill was professional, thorough and honest from the start. He pointed out facts that no one else did as he had a grasp of the intricacies of our family trust and the law. He advised me openly along the way and I am grateful that he got an extremely positive outcome in a relatively short timeframe and at a fair fee. Highly recommend Houser Law Firm.

I was at my "wit's end" after 16 months with the legal system having charged me with 4 criminal counts. I contacted Counts Law Group on Friday for HELP and Cynthia Counts agreed to meet with me on Saturday at 10:30 (Father's Day Weekend w/Family visiting) to evaluate my case. Come early Monday morning Cynthia and Family were siting on a Court room bench with me. She had taken a Good part of her Father's Day Weekend to prepare my case before the court and traveled two hours "early thirty" Monday to have the court to acknowledge her as my co-counsel and at noon to present a motion to dismiss all 4 charges. Because of her arguments before the court, ALL 4 charges were later dismissed! If the legal system had more Cynthia Counts, those condensing "lawyer" jokes would most likely disappear! Bottom Line - 16 Months of sleepless nights vs. a weekend

I was served in April '14 in GA; this was the only time I have been sued. It was a terribly stressful time because I was struggling to make ends meet and with two small babies in diapers, my wife and I did not know where to turn for help. I asked the lawyer of a colleague if he knew a good attorney to help me in a defamation lawsuit. Without any hesitation, he emphatically told me, “Cynthia Counts is the best there is for that type of case”. The fact that my colleague’s lawyer knew of Cynthia and was so adamant in stating her abilities immediately gave me confidence because the referring lawyer is a criminal defense attorney whose clientele and case load are in a different realm of law than what my case was, yet he knew of Cynthia Counts and her abilities. I immediately called Ms. Counts and let her know who referred me to her. We agreed to have an initial consultation to discuss the case. Not having any previous experience in legal matters, I was concerned about being kept in the loop and having a comprehensive understanding of what was taking place, as I tend to be somewhat of a micro-manager, which is a difficult thing to be in a subject for which I had no formal training. It became apparent to me immediately that there was an added benefit when I learned that Ms. Counts is an adjunct professor, as she was able to frame things for me in an easy-to-understand context. Her teaching experience was also an added benefit because when I expressed my desire to be able to assist in my own defense, she gladly provided me the opportunity and gave me specific research assignments and tasks to be performed in order to help myself. She would then take the time to explain the results, meaning and impact of my research while all the time continuously teaching me and citing other precedents and GA case law concerning defamation and Free Speech. She also provided an in-depth and invaluable education in Georgia’s Anti-SLAPP legislation, background and intent. Furthermore, once we entered the courtroom for the first time and found out that the Plaintiff’s attorney steered the intended purpose of the initial hearing from evidentiary to something else, I got to see what Ms. Counts was really made of. She basically walked into an ambush on that first day in court and we were not prepared at all for where the first day lead us because it was supposed to be an evidentiary hearing that ended up being bifurcated, for which the first part was never disclosed in advance by the Counsel for Plaintiff but for which he was fully prepared. So we started our first day in court with the deck stacked against us, but in the end it did not matter because Ms. Counts knew the law. Because of her vast knowledge and depth of understanding of Georgia law, Federal law, Constitutional Law and her intimate familiarity with the Georgia Anti-SLAPP statute and precedents, she was able to successfully ward off the attack by Counsel for Plaintiff not only that day but two days later when we continued. Her courtroom delivery over those two days resulted in turning an ambush, and potential disaster, into the Judge issuing an order that protected my speech and resulted in Plaintiff’s immediate dismissal of the case. Throughout all phases of the case, Ms. Counts was always available either in person or via proxy through one of her diligent and well-written associates. Even when time constraints and schedule conflicts would have prevented other people from making time to talk, she was available and responsive through holidays, weekends, as well as nights. She is passionate about her work, knowledgeable about the law and is one of few that still believes in the truth above all else. If you are being sued for defamation or other alleged First Amendment violations and you were right and you were just in your actions, Cynthia Counts is the lawyer for you. She is highly recommended by me; simply 'Google' Cynthia Counts and the results speak for themselves.

She has demonstrated a thorough and in-depth knowledge of First Amendment and other constitutional and civil rights case decisions and a willingness to think outside the box. I consider her to be a first-rate attorney, especially for media and free speech matters. When questioning one of the witnesses at my trial, Cynthia was matter-of-fact, calm, and professional in working inconsistencies out of the witness. When writing motions, she cited an extensive case law history that applied to my specific case - demonstrating to me that she works hard on her cases. Also, Cynthia is one of the most ethical and trustworthy attorneys I would recommend - her manner of speaking is very straightforward and her presentation skills are first-rate. She arrived early for my continuance sign-ins to avoid the huge waste of time that I've seen other defense attorneys put on their clients, and her court time was used efficiently and appropriately during trial. It was a truly healing experience being vindicated at trial. As a client, I have been treated with respect and dignity and was followed-up with promptly on questions. This is one lawyer I will always have on my short list to refer other people to, especially regarding civil rights matters.

A few years ago I realized I didn’t own all of my driveway. I contacted Jordan for help. I felt I had a good case to at least obtain an easement for the portion of my driveway I had been using since I bought my home in 1987. An easement is an easement but with Jordan’s expertise I was able to negotiate a deal with the vested owner and obtain fee title for my driveway I’m for ever grateful to Jordan and would highly recommend him!!!

Jordan Ciliberto is an exceptionally competent attorney that I highly recommend. Like most professionals that are great at what they do, he implements strong attention to detail and a risk-adjusted approach to unforeseen circumstances. I've worked with Jordan on many occasions. In fact, over the last 5 years I've have benefited from his expertise, guidance, and services for Commercial Leasing, Easements, Land Use, Clouds on Title, TIC Agreements, LLC Operating Agreements, Trust & Estate support, Equity Exchanges, and Partnership Buyout/Restructuring. As a client, I really appreciate his tenacious dedication to excellence, deep knowledge, proven track-record of success, as well as his generational vibrancy. He is an excellent attorney, and an outstanding participant in our community who also happens to sit on a few different Boards. -TH

If we could, we would give James Shanor a higher rating than allowed. James expertly resolved our contentious home co-ownership dispute and navigated a very honest, reasonable result that was 30% higher than the other party’s original offer. If you need to get out of a sticky situation for a very fair, less than excepted attorney cost, he’s the lawyer who can get the job done.

Jamal has been excellent to work with. He was recommended to me by another excellent attorney that was forced to withdraw from the case due to a conflict. He picked it up and we have had nothing but good results. The case is complicated by occurring in two different venues, chancery and municipal with a different attorney & different firm handling the municipal portion. The communication on Jamal's part with us and the other attorney was always clear and timely. His research has been thorough and helped us be successful.

I had an employee who thought he was an owner and tried slapping me with a bogus lawsuit spearheaded by an out of state wannabe lawyer. I immediately contacted Mr. Aiello to discuss my options. Good thing I did, He put the pieces together and formed a game plan to protect my assets and squashed the so called claim against my business. Mr Aiello got me moving forward again, I will definitely use his services again if I have to.

I was sued by a former employer and need a legal team that could effectively defend me and clear my name in a technology dispute. I couldn't have found a better team than Chris Banys and Richard Lin, and also I couldn't be more pleased with the resolution of my case. From day one, I was impressed with their professionalism, empathy, sense of ethics, and patience as they worked with me to get the information they needed to represent my interests. I really can't provide more detail about the case specifics, but trust me, when faced with an aggressive adversary hoping to steamroll over you, you definitely want Mr. Banys on your side in the courtroom.

Chris Banys was very knowledgeable in this area. He helped me throughout the whole dispute, advised me of my rights and did everything he could to keep the cost down. He started off by reviewing my leases, and sent my landlord various letters. When we filed suit he did everything that he could to move things along. Chris was very aggressive in his approaches because I knew that from prior experiences with my landlord that he had to be. When the case settled Chris got me everything that I deserved and I didn’t have to give my landlord anything. It was a great win and I would always hire him for any matter that comes up. He treated me like part of his family and kept me posted all the time. He is a great fighter and knows what he is doing.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
