Malcolm represented me in a consumer protection case in mid 2015. He was very understandable and listened to my concerns carefully and gave the most honest recommendations including- the best or worse possible outcomes from the case. He did not pressure me to make any decisions, rather would advice and give me enough time to make my own decisions in accordance to what I was comfortable with. His communication skills were excellent. He literally informed me about every new finding and details about the case as soon as he can- through email, text or phone call. If Malcolm were running late for a meeting, he would call and inform me about it and even give the reason as to why he is late. Malcolm is kind. For services that I could not afford, he referred me to the Memphis Area Legal Organization to aid me with some form of assistance. He also provided me with invoice documentation of every cost of his excellent services. Prior to my case, his good heart was also shown when he donated his car to benefit an organization I was working for as an intern- the Church Health Center, a clinic providing coverage for the working uninsured poor in Memphis. He is a fast thinker, calculates his opponents’ thoughts wisely and makes a smart moves based on that. Due to his demands, the company I was suing was willing to drop the case even before heading to court and reimbursed me with enough money to recover my property. And with wonderful twists to the story, it was also featured on the commercial appeal newspaper. Malcolm is an excellent lawyer. I would highly recommend him for all your legal services matters.

I am honored to offer a few words about the services of Ernesto Borges. I first met Attorney Ernesto Borges about fifteen years ago in Chicago when he presented one of his clients to be featured on my music television show. It was just after cable television was avilable in Chicago. We exchange contact information and I was left with a very good impression of him as an entertainment attorney. He soon proved to be a very knowlegeable and well established Chicago based lawyer who worked with corporate giants, a variety of music talent, movie stars and sports celebrities. Some years later, as I was heavily involved in some multi-million dollar real-estate, success education and telecommunication deals in Chicago, I called on his services. He provides excellent legal services and operates a top level law firm. I have been recommending his firm to other people for years and his firm is now recognized as one of the top minority owned law firms in the United States, servicing many thousands of clients and continually giving back to the community. I resently moved to Beverly Hills, California and have retained a law firm here. Being from Chicago, I still stay in touch family and friends and Attorney Ernesto Borges. When ever I, a friend, family member or business associate is in need of legal services, Attorney Borges is at the top of my call list. He and his team are very responsive and trustworthy and I recommend them to anyone looking for professional legal services and advice. As his client, you can count on him to protect you and be honest about your situation under the law, open about the options you have, what service he can provide and his fees. It all started back in December 2013 when I filed a Provisional Patent. I worked on the project and planned to file a Utility Patent before the Provisional Patent expired in December 2014. Due to the complexity and amount of work needed to file a Utility Patent and no prior experience, I started to look for someone who could help me complete the filing process. The cost of filing patent is generally very high for an individual inventor. I read an article in San Jose Mercury news describing Lincoln Law School of San Jose that helps out people like me. I immediately contacted them and they accepted helping me out. I was in touch with an outstanding individual, Mr. Britten Sessions who undertook the responsibility of filing a Utility Patent on my behalf. The deadline for filing was almost on us and I had serious doubts if things could be done in a couple of weeks time. I was expecting that my Provisional Patent will expire and I shall have a new filing date with the Utility Patent. To my surprise, Britten Session and his team pulled off the filing ON TIME, including digitally redrawing all my diagrams! Since then I have been in constant contact with Britten Sessions as the patent process has been progressing. The application got allowance in mid 2015, and a continuation of claims. The paperwork for both allowance and continuation of claims was done shortly afterwards. Now I am waiting for the final outcome!

To say that my case was unique might be an understatement. When I hired Logan, I had been to court several times already without representation in a civil claims trial. What made it different was the claims of the case brought against me by an ex boyfriend. With no knowledge of law and being pitted against someone who was more well-versed, I felt like I'd already lost. I reached out to Logan first for legal advice, and he went so much farther than I ever expected him to. He calmed my fears all the time, and helped me build a case. Logan was extremely professional during our conversations and remained even more so in the court room. Because he represented me, I was able to put the situation I was in in the past. I no longer feel anxious or nervous all the time about having to go to court or having to see that person. Logan helped me in my court case, but he also helped my personal life and state of mind more than he will ever know. I would recommend him as a lawyer to literally everyone I know who needed representation. He is knowledgeable in not only his field, but almost every one. His specialty is not 'civil cases', but he treated it like it was. As a client, Logan made me feel like my case was his only one. He was available to me all the time, and he made sure I knew he was.

I cannot begin to thank Sholly for his work on a couple business cases, my company unfortunately needed him for. In the 14 years in business, we have not had clients try to take funds that were due to us. He helped us go to mediation, win and collect on the one case and on the other avoid all of that while still getting paid for our services rendered. He is straight forward and tells it like it is, and being in business I can afford not to be told what the facts are. I would highly recommend Sholly to anyone needed legal services related to your business. It is very refreshing to find someone like this.

If you need a QDRO or DRO (for divorce) this is the lawyer you need to use!!! She is the nicest, fairest most decent lawyer I have dealt with and unfortunately I have had experience with three divorce lawyers for one divorce from HELL. She is very competent and knows her stuff. I wish I could have hired her as my first divorce lawyer. Anyway, I was able to have her fix the DRO even though she's in Ithaca and I'm in the Hudson Valley! We did everything over the phone/ email. So don't let distance sway you. If you have a New York State Retirement or 401k and are getting divorced you need to call her. Don't let your divorce lawyer handle the QDRO because they could screw it up like mine did. Use an expert like Carla.

After incorporating my second start-up in Kansas City, I knew LegalZoom could only insulate basic liabilities and afford minimal protections for intellectual property. Realizing my options were limited outside of the Valley, I needed an attorney with versatility- one who could do more than an online legal service or a niche practitioner; I needed a JD/MBA like Matthew Kincaid. I've known Mr. Kincaid since high school; he is the same fanatical academic he was at Rockhurst, obviously remaining steadfast after graduating from KU and now as an attorney at Dysart-Taylor. Suffice it to say, my contract-forms are now iron-clad, galvanized by his meticulous review and consequential revisions. He is also a master of Cease & Desist. I'm fortunate to call Matthew a friend in my corner and our General Counsel at Bucephalus Dev. Please don't hesitate to contact me for additional references-thank you!

I'm a small MSP (6 employees, 2 locations, one in Orlando, one in Cleveland), offering infrastructure as a service and some BDR services to my customers. I needed an attorney to review my current contracts, and write up some new ones. I heard him speak at a Microsoft Partner Summit meeting years ago, and then again at ConnectWise's IT Summit in Orlando in 2010. This guy understands managed service providers like no one else outside of the industry. A lawyer who can talk about HaaS or IaaS? Are you kidding? I could not believe it...until I retained him. He knows what he's doing, in a field where so many others don't. He's the guru of MSP contracts, and i don't make a move without calling him first. Maybe the best recommendation I could offer you is this: last year I brought him in to speak at a networking group of MSPs in the mid-west, and i'm already getting requests to bring him back. His leadership in our prior cases, resourcefulness, hard work and continued perseverance are quite evident when you meet Kevin and once he begins to work on a case for you. These qualities and strong work ethic has certainly helped him with our franchise litigation. Among his very positive personal qualities, Kevin displays patience and understanding which was very important to us as we approached litigation. As we worked through prior litigation, we always knew what was ahead of us. In addition, Kevin has excellent communication skills. This will continue to help us as we continue to use Kevin’s legal expertise. Kevin has a very warm and friendly personality and gets along very well with other people. However, make no mistake about it; once he get’s into the courtroom there is do doubt about his decisiveness and his quest to protect our interests. From the very first conversation I had with Bryce he was very clear about what might or might not happen with my trademark issue. I have dealt with many lawyers in my life for various reasons, but have never felt like my case was the most important case they had. This was only for a trademark issue, I can only imagine the amount of work and passion he would put into something more serious. Bryce seems to really love what he does and he made me feel like he was in the fight with us. I had a very strange trademark issue (which other lawyers, I reached out to had never heard of) where my mark was in between a common problem of being too descriptive or being deceptive because my mark didn't have the ingredient in my product that was the name. If that sounds confusing, that's because it was VERY confusing. Other lawyers told me that I should just change my name and they recommended to make up a word to avoid these kind of issues. That was simply not something I wanted to do. I had a name, I loved it, I wanted to fight for it and that's what Bryce did. After reading the argument Bryce put together I was blown away. The amount of time and research that went into the argument was the difference between us winning and losing. I couldn't be happier with the service Bryce provided and would highly recommend him for any issue you are facing. Thanks Bryce!! You are the BEST!!

As a future franchisee, I hired Brad to review the Franchise Agreement package. In general, Brad was very responsive and thorough with his review, and was easy to communicate with regarding the explanations of all the various segments of the agreement. On Tuesday, I informed him I needed the review quickly as I had been out of town for three weeks and delayed the process already. He informed me that we could review by the end of the week. He returned the initial documents on Wednesday and we reviewed the comments on Thursday and Friday. His response was very quick. Additionally, his comments were well organized and very explanatory, and we reviewed the intent and options on each clause...at the end of the discussion, I had adequate knowledge to prioritize the areas into action items and information items. It was a pleasure to work with Brad and would recommend him.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
