I had an excellent experience with Ted. He received a favorable decision for me and kept me informed throughout the whole process. Dealing with legal issues can often times be very stressful, but working with Ted alleviated much, if not all, of the stress associated with my particular situation. I would whole heartedly recommend Ted to anyone who is looking for a smart, honest, personable and affordable attorney. Hopefully, I won't need to, but I would use him again in a heartbeat.

Managing the IP portfolio at a large institution, Ms. Malloy is one of many outside counsel that I work with relating to patent matters. Her knowledge within the intellectual property sector is extensive, and unlike other firms I have engaged, she is timely responsive to my inquires and proactive in bringing new matters to my attention. Further, in terms of quality, the patent applications she drafts and prosecutes are in the top tier among the various counsel I work with. As an added bonus, the firm has a flat fee structure for patent prosecution - which is very important in order to control current and predict future patent costs of the large portfolio I manage.

When our first child was born, our life insurance agent referred us to three highly qualified estate planning attorney.  We interviewed all and decided to work with Lourdes Hilliard, because we liked her attention to details, willingness to explain and educate us on various options that suits us, and finally her very personable style.  Lourdes set up a trust and will for us, and she continues to provide us with great service, whether it is about converting real estate property into trust or some very minor tasks, Lourdes took care of all our requests with great professionalism.  I would highly recommend her to my family and friends.

If you're anything like me and all you have is a great business idea and limited to know knowledge of how to get going and legally get your business on the right track you have got to speak to Ms. Hilliard! Not your typical lawyer, you know the long winded jargon that regular people don't understand. I'm a baker, not an attorney or legal anything by any means! She took my small kitchen start up and gave me all the facts, and guidance I could have ask for without the intimidation and over the top unnecessary long hours of billing. Her process is simple, she starts you off with a questionair and fully dives into your goals and direction. I feel fully confident in our decisions to not just protect my business but create my brand. This is a one stop shop!

I hired Josh to help me with a website was hijacked by a web designer, I had a functioning site and with one disagreement it was shut down and a message put up saying that I do not pay my bills. Not true. The webmaster decided on well over $30,000 for the site and with little recourse I had our attorneys battle it out. I wrote a check for $5,000 a month later and learned 2 valuable lessons. 1 - Always consult with the lawyer before you sign a deal with anyone for a business opportunity. 2 - Call Josh if you are being bullied and do not know what to do. I am a practicing trial lawyer of 30 years in Florida, who focuses on David and Goliath complex litigation. I thus understand what it takes to be one of the best lawyers in your chosen field. Though I have litigated complicated intellectual property cases, I had never previously sought to obtain a trademark. I hired LegalZoom thinking it could give me the basics of what I need and guide me. As a lawyer, I thought I could figure the rest of it out. What I discovered with LegalZoom is that 3/4 of the time it guided me in the wrong direction, identified the wrong categories where our trademark should fit, constantly asked me to provide the same information over and over again, and failed to deliver what I thought I was purchasing. I would argue with them and they would insist they were correct, which I ultimately found to be inaccurate. And, LegalZoom is not cheap. I then found Chris Day and his very skilled assistant, Amy Goodwin, and they did exactly what they said they would do exactly when they said they would do it and did a phenomenal job of getting us back on track and correcting the LegalZoom initiated errors. They also did so for very reasonable cost. I know when I'm dealing with one of the best lawyers and, without a doubt, Chris Day is. And Amy Goodwin is as sharp and as pleasant as you will find. You cannot go wrong with Chris, Amy, and their staff. Feel free to Google my name and call me in Florida if you have any other questions. Don't pay too much attention to these Avvo numerical ratings. This company starts out by rating a lawyer as competent as Chris at a 6.5 out of 10, or whatever, implying that he is not as good as the lawyers Avvo rates at, for example, 10 out of 10. Doing so in my opinion as a trial lawyer who has litigated well-known defamation cases is exactly that-defamation, as well as objectively unsupported disparagement. It is also very deceptive for the public. To categorize a lawyer, who has earned his reputation amongst those who really count, as being on the surface less competent is very dangerous for Avvo and similar companies that solicit lawyers to subscribe to their business model or pay a fee to become one of their premium members. Chris Day doesn't need that, but the public needs to understand just how misleading these numerical ratings can be. Trust me when I say as a lawyer who knows Chris Day is more competent than 99% of the lawyers on Avvo with a 10 out of 10 rating who claim a similar expertise. They better be careful before a lawyer like me decides to demonstrate to them formally the significant defect in the business model. We'll see whether they publish this because if they don't that just might incentivize me a little more.

I, as General Counsel, retained Mr. Lasater for the purpose of pursuing a claim against a faulty software product that didn't operate as offered. It was a complex case with a plethora of legal documents and issues of contract, choice of law, intellectual property, and generally litigation. His advice in the prepatory phase was honest, cost effective, no nonsense possibilities and issues. He became familiar with a large number of technical people on both sides, the technical issues of both hardware and software, some issues of securities and generally made my job simple. He also paid attention to detail in the process of depositions all while also noticing details at our location that divulged information about the defendant that had a serious impact on their position. It was settled at a price that was more than we expected and I will use him again. Thank you Kieran!

I am so happy to have been referred to Mia. I am a wedding planner and a new, big opportunity had recently fallen in my lap. It was a type of event partnership that I hadn't experienced before with a high profile family. I found myself in desperate need of a brand new contract that would specifically cater to my new opportunity. I was referred to Mia through another planner because Mia has lots of experience helping event professionals, as she used to be an event planner herself. The second I sat down with her I knew I was in great hands. Not only was she able to help me from a legal stand point, but she had tons of wisdom to help it also make sense from the events stand point. She worked quickly and efficiently and created a beautiful contract for me. She was an absolute pleasure to work with and I would recommend her to anyone!

Stephen was a fantastic help in dealing with construction issues at our house. He was extremely thorough and professional. I felt he gave really informed advice regarding our contract with our engineer. He was attentive and considerate. He understood our position and directed us appropriately. He didn't try to force us to actions that we weren't comfortable with. I felt like we were in good hands if the conflict had escalated; he carefully protected us and informed us of all the options if we wanted to seek damages. He was very understanding and patient with us, as we are not used to dealing with these types of legal issues. He gave us a voice when we didn't have one, and was able to get immediate action from our engineer. I went to Mr. Hudspeth hoping that he would represent me on a business contract. But after reviewing my entire contract and having two of his staff attorneys research my case, he came to the conclusion that I would be better served by an attorney with expertise in securities law. Mr. Hudspeth did not charge me for any of his or the other attorneys’ time. I was disillusioned that he was not going to be able to represent me because I wanted the most competent attorney I knew, and that was Mr. Hudspeth. The reason I know this is because I also worked for Mr. Hudspeth for five years. I learned to have tremendous respect for him as a lawyer and as a person. I have been around lawyers most of my life, but working for Mr. Hudspeth I saw a side I had not been exposed to very much. His compassion for others and understanding comes through in his communications, and that is something I have taken away with me and try to emulate. In his practice too, he expected that everyone adhere to ethical standards as the right and natural thing to do. What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
