We are grateful for his efforts, expertise, and commitment as he was always a step ahead throughout the legal process. We truly felt being in safe hands by having him by our side. Through strong representation, our contractor agreed to settle the case and accept our terms to cover the damages. Our nonprofit owes Saam and his firm a great deal of gratitude for their services. I was simply going to copy and paste the review I wrote for Eric on LinkedIn, but the representation Eric provided for me is deserving of more than that. I found myself bogged down in the mire of a legal battle over a lease agreement with a less than reputable property manager in the San Diego area. Due to Eric's perseverance and seemingly un-ending professionalism we emerged victorious against our legal foe, righting what had once been wrong, and further establishing what makes this country the best in the world, JUSTICE (and the bald eagle). On a slightly more serious note, Eric is a man you can trust. Eric can empathize in any scenario someone might find themselves in, and not only is he the kind of guy you want to take out for a beer, but you would feel completely comfortable entrusting your legal counsel to his intellect, motivation and desire to succeed. Thanks for everything man, you are the only counsel I will ever consider necessary. -Curtis

When GetQuik was looking for legal representation, I asked a few friends who they would recommend. My friend Elliot had engaged Venture Law Group, who helped guide his former company Netcentives through an IPO process. The partner they worked with was Elias Blawie. Fast forward a few years, Venture Law Group is now a part of Heller Ehrman. When I first met with Elias, I immediately liked him. Elias has worked with numerous startups throughout his career. He has knowledge and experience. As well, he is a very likeable dude. Calm and easy going. GetQuik's legal needs to date have been fairly straight forward. We recently cleaned up our corporate docs, and Elias and attorney Saxon Peters were instrumental in this process. Perhaps the thing I appreciate most about Elias' approach is that he looks for ways to minimize our legal bills, rather than proposing complex solutions that will run up our tab. His philosophy is to build good will and help a startup offload their legal burden in the hopes that the company will grow into a industry leader with expanded legal concerns which he and Heller can manage. The rare combination of a nice lawyer, and one that thinks in terms of long term relationships. That is what Elias brings to the table. Those in Silicon Valley may want to consider his services for their corporate legal matters.

Larry helped me with a lot of issues I was having on my website both technical and legal and resolved many problems I was having on it. I run a small cosmetic surgery theme website. He's conversant in matters of intellectual property, legal threats (from doctors who members of my board relay poor outcomes) and even things having to do with technical issues of the website. I was having some problems with people pilfering my intellectual property and not giving me attribution. He solved the problem.

Steve is working with us to create and manage a large patent portfolio. As a patent specialist myself, I've hired and worked with dozens of patent attorneys over more than two decades, and Steve is one of the best. His drafting is superb, and he has a wide range of technical expertise across electrical, mechanical, networking, and software. (I wouldn't be surprised to find that the list is much longer than that one). I am particularly impressed with the thoughtful organization of definitions in his patent applications, which in turn leads to development of claiming strategies that would likely be missed by other drafters. At the level of portfolio management, he is highly organized and provides concise, simple, helpful summaries. I have also been in numerous meetings where he has displayed current and comprehensive knowledge of patent law, including on some of the more obscure and technical topics that would require a typical practitioner to pull out the books. Finally, he has been efficient, providing exceptional value for the amount billed.

I am a contractual-based computer programmer and performed work for a Macon, Georgia Internet development company from 2006-2010. I was working under essentially a verbal agreement with no written contract. That's all well and good when things are fine but when push comes to shove, verbal agreements are worth the paper they aren't written on. As it turned out, the company encountered financial difficulties during 2010 and eventually told me they no longer needed my services, refusing payment to me for two months worth of work plus a flat-fee service agreement. Mr. Finkelstein contacted the company on my behalf and negotiated a settlement with very quick results. I was extremely impressed with the way he presented my position, which was pretty weak to be honest, and he came through when another attorney may not have been able to reach an agreement. I highly recommend Mr. Finkelstein to anyone needing the services of an attorney.

As a startup medical device company on a budget but ambitious plans, we turned to David to advance our intellectual property from several early and disjointed applications filed by well established and reputable large firms, into a valuable portfolio suitable used to raise multi-million dollars in capital. David explained the best manner to structure our activities, claims, clarified the purpose of each application, and established milestones and timelines. He provided us valuable ongoing counsel on the most efficient way to allocate our resources, the manner in which to protect equity with new concepts and advances, and the applicability of prior art. David also structured our applications in a staged manner in order to best protect our ideas while fitting our schedule and budget. In addition to impressive personal knowledge in the medical device space, David is meticulous and methodical, creating clearly written and well structured patent applications and portfolios. He routinely questions the need for unnecessary (but billable) patent activities, and systematically follows up during the prosecution process. Because of the quality and consistency of his work, we, including our CEO and President, have come to trust David to handle all of our IP matters.

My vocabulary does not contain enough superlatives to describe Joe Kovarik, the patent attorney that I was lucky enough to hire in 2008. During this time, Mr. Kovarik has provided invaluable legal counsel, has been my most loyal advocate, has diplomatically steered me away from potential problems and has allowed me to be successful at the USPTO. During a conflict which I had with a large corporation, Joe took them on and soundly beat them. This was not just due to his brilliance at the time, but had a lot to do with the preparations he made years in advance where he was essentially prescient in recognizing a dishonest company. Mr. Kovarik is the finest patent attorney I've had the pleasure to work with over the past 24 years. It is worth inventing something just to have him as your attorney.

I was really happy with Georgiy, he is extremely knowledgeable in software patents, he is also extremely reliable and trustworthy.. He always delivered the work in a timely fashion, but the most impressive thing with working with Georgiy is that I am located in Australia and I had made a mistake in regards to payment, I had accidentally sent in the entire amount right from the start, which was suppose to be broken down into small payment milestones depending on the completed work, therefore I became afraid that this mistake would affect the motivation that Georgiy would hold with this job since he had already gotten the entire full amount upfront.. However it became quickly evident that he was committed every step of the way to quality and excellence in his work.. I can definitely say he went to extra mile, whereas I kept making last minute changes on claims I also wanted to include in the patent and he was always patient and helpful to make the added changes free of charge.. He also surprisingly went so far as to draft all the drawings for the patent without any extra charges. I would recommend anyone to work with Georgiy if you want to work with someone that is knowledgeable and committed to helping you succeed.

I have worked with Margaret Polson for over 15 years. During that time, Margaret drafted and filed over 200 patents and various IP instruments for me and my company. And Margaret has helped manage over 60 challenges or infringements on many of these patents with a 100% success rate. She moved from her original firm to create her own IP Specialty firm. I was happy to follow her and maintain the solid working relationship that I have enjoyed and benefitted from these many years. Her professional demeanor and acute understanding of complex issues has been refreshing and never urbane nor pedantic. Her communication skills make it a pleasure to work with her and her staff. I highly recommend her for all issues regarding IP law. I have directed many other colleagues in my business circles to her to their great benefit. I expect to continue with Margaret as my principal IP attorney as long as I am in need of IP protection and representation.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
